215 Automation of specified criminal intelligence assessment action3
(1) The Director-General may, in writing, arrange for the use, under4
the Director-General’s oversight, of computer programs to take5
specified criminal intelligence assessment action that must be taken6
by the ACIC under this Act.7
(2) Before making an arrangement under subsection (1), the8
Director-General must consult the Inspector-General of9
Intelligence and Security.10
(3) As soon as practicable after making an arrangement under11
subsection (1), the Director-General must give a copy of the12
arrangement to the Inspector-General of Intelligence and Security.13
(4) Specified criminal intelligence assessment action is:14
(a) performing, or refusing or failing to perform, a function or15
duty under subsection 211(6); or16
(b) performing, or refusing or failing to perform, a function or17
duty under subsection 212(2); or18
(c) doing, or refusing or failing to do, anything related to19
performing a function or duty under the subsection20
mentioned in paragraph (a) or (b).21
ACIC treated as having taken specified criminal intelligence22
assessment action23
(5) Specified criminal intelligence assessment action taken by the24
operation of a computer program under an arrangement under25
subsection (1) is treated, for all purposes, as specified criminal26
intelligence assessment action taken by the ACIC.27
Substituting specified criminal intelligence assessment action28
(6) The ACIC may take specified criminal intelligence assessment29
action, or make a criminal intelligence assessment under30
Division 3 Automation of specified criminal intelligence assessment action
