The ACIC may make a criminal intelligence assessment in respect4
of a person for the purposes of a background check required or5
permitted under other legislation.6
The ACIC may give the criminal intelligence assessment to7
another Commonwealth agency for the purposes of the background8
check.9
Adverse criminal intelligence assessments do not need to be made10
or given if doing so would prejudice law enforcement or11
intelligence interests.12
A person who is the subject of an adverse criminal intelligence13
assessment may seek a review of the assessment.14
The Director-General may arrange for the use of computer15
programs to make certain decisions under this Part.16
208 Meaning of criminal intelligence assessment17
(1) A criminal intelligence assessment is a written statement made by18
the ACIC expressing any recommendation, opinion or advice on,19
or otherwise referring to, the question of whether it would be20
consistent with preventing the advancement of serious and21
organised crime for prescribed administrative action to be taken, or22
not taken, in respect of a person.23
(2) To avoid doubt, a criminal intelligence assessment includes any24
qualification or comment expressed in connection with any25
recommendation, opinion or advice mentioned in subsection (1), if26
