18 Australian Criminal Intelligence Commission Bill 2026 No. , 2026
search warrant means:1
(a) a premises search warrant; or2
(b) a person search warrant.3
search warrant item means a document or thing seized under a4
search warrant.5
secrecy provision: see subsection 48(2).6
security has the same meaning as in the Australian Security7
Intelligence Organisation Act 1979.8
senior position holder means a person referred to in paragraph (a),9
(b) or (c) of the definition of ACIC staff member who holds the10
position of, or performs the duties of, an SES employee, or an11
equivalent position, in the ACIC.12
serious and organised crime: see section 10.13
serious misconduct, by an ACIC employee, means:14
(a) corrupt conduct engaged in, a serious abuse of power, or a15
serious dereliction of duty, by the employee; or16
(b) any other seriously reprehensible act or behaviour by the17
employee, whether or not acting, or purporting to act, in the18
course of the employee’s duties as an ACIC employee.19
serious offence has the meaning given by subsection 3C(1) of the20
Crimes Act 1914.21
specified criminal intelligence assessment action: see subsection22
215(4).23
State agency means:24
(a) a Department of a State; or25
(b) an instrumentality of a State, including a body corporate26
established, or continued in existence, for a public purpose27
by or under a law of a State; or28
(c) a company in which the controlling interest is held by any29
one of the following persons, or by 2 or more of the30
following persons together:31
(i) the Crown in right of a State;32

(ii) a person or body covered by paragraph (b);1
(iii) a person or body covered by subparagraph (i) or (ii).2
State offence means an offence against a law of a State.3
State or Territory law enforcement agency has the meaning given4
by subsection 3ZQU(7) of the Crimes Act 1914.5
strip search means a search of a person or of articles in the6
possession of a person that may include:7
(a) requiring the person to remove all of their garments; and8
(b) an examination of the person’s body (but not of the person’s9
cavities) and of those garments.10
summons means a summons issued by an examiner under11
subsection 59(1).12
superior court judge: see subsection 94(3).13
Territory agency means:14
(a) a Department of a Territory; or15
(b) an instrumentality of a Territory, including a body corporate16
established, or continued in existence, for a public purpose17
by or under a law of a Territory; or18
(c) a company in which the controlling interest is held by any19
one of the following persons, or by 2 or more of the20
following persons together:21
(i) the Crown in right of the Australian Capital Territory or22
the Northern Territory;23
(ii) a person or body covered by paragraph (b);24
(iii) a person or body covered by subparagraph (i) or (ii).25
terrorism offence has the same meaning as in subsection 3(1) of26
the Crimes Act 1914.27
terrorist act has the same meaning as in subsection 100.1(1) of the28
Criminal Code.29
Tribunal means the Administrative Review Tribunal.30
