115 Offence—disclosure of compelled material subject to a direction7
Offence—general8
(1) A person commits an offence if:9
(a) the person discloses compelled material (whether or not the10
person is the first to do so); and11
(b) a direction has been made under subsection 110(1) that12
covers the compelled material; and13
(c) the direction has not been revoked; and14
(d) the disclosure contravenes the direction; and15
(e) the disclosure is not authorised by or under section 117 or16
subsection 121(1).17
Penalty: Imprisonment for 5 years or 300 penalty units, or both.18
Offence—aggravated19
(2) A person commits an offence if:20
(a) the person discloses compelled material (whether or not the21
person is the first to do so); and22
(b) a direction has been made under subsection 110(1) that23
covers the compelled material; and24
(c) the direction has not been revoked; and25
(d) the disclosure contravenes the direction; and26
(e) the disclosure is not authorised by or under section 117 or27
subsection 121(1); and28
(f) either or both of the following subparagraphs apply:29
(i) the person intends to endanger the health or safety of30
any person or prejudice the ACIC’s ability to obtain31
intelligence relevant to serious and organised crime;32
