112 Australian Criminal Intelligence Commission Bill 2026 No. , 2026 (3) To avoid doubt, information, a document or a thing is not1 compelled material to the extent that it is obtained otherwise than:2 (a) as required by a notice to produce; or3 (b) during an examination.4 (4) The witness, in relation to compelled material covered by5 paragraph (1)(a), (b), (c), (d), (e), (f), (g) or (h) is the person6 mentioned in that paragraph.7 (5) The witness, in relation to derivative material, means the person8 who is the witness in relation to the compelled material from which9 the derivative material was obtained.10
