10 Australian Criminal Intelligence Commission Bill 2026 No. , 2026
Commonwealth place has the same meaning as in the1
Commonwealth Places (Application of Laws) Act 1970.2
compelled material: see subsections 108(1) and (2).3
computer means all or part of:4
(a) one or more computers; or5
(b) one or more computer systems; or6
(c) one or more computer networks; or7
(d) any combination of the above.8
confiscation proceeding: see section 18.9
constable means:10
(a) a member or special member of the Australian Federal11
Police; or12
(b) a member of the police force or police service of a State or13
Territory.14
constitutional corporation means a corporation to which15
paragraph 51(xx) of the Constitution applies.16
contributor, of national policing information: see subsection17
183(2).18
controlled conduct means conduct engaged in by a person for or in19
relation to which the person would, but for section 143, be subject20
to civil or criminal liability under a law of the Commonwealth, a21
State or a Territory (including the general law).22
controlled intelligence operation means an operation that:23
(a) involves the participation of one or more ACIC staff24
members; and25
(b) is carried out for a purpose relevant to the performance of the26
function set out in paragraph 24(a); and27
(c) may involve an ACIC staff member or other person engaging28
in controlled conduct.29
conveyance includes an aircraft, vehicle or vessel.30

corrupt conduct has the same meaning as in the National1
Anti-Corruption Commission Act 2022.2
criminal intelligence assessment: see section 208.3
data storage device means a thing containing (whether temporarily4
or permanently), or designed to contain (whether temporarily or5
permanently), data for use by a computer.6
Examples: A disc or file server.7
deal with, in relation to an ACIC record, means:8
(a) copy the record; or9
(b) transcribe the record; or10
(c) retain the record; or11
(d) remove the record; or12
(e) otherwise use the record.13
derivative material: see section 109.14
DIO means that part of the Defence Department known as the15
Defence Intelligence Organisation.16
Director-General means the Director-General of the Australian17
Criminal Intelligence Commission.18
disclose, for compelled material or derivative material, includes:19
(a) to make available; and20
(b) to disclose copies, contents or descriptions of that material.21
document has the same meaning as in the Evidence Act 1995.22
electronic communication means a communication of information23
by means of guided and/or unguided electromagnetic energy:24
(a) whether between persons and persons, things and things or25
persons and things; and26
(b) whether in the form of:27
(i) speech, music or other sounds; or28
(ii) data; or29
(iii) text; or30
(iv) visual images, whether or not animated; or31
