106J Notification of unavailability of fuel (1) If a fuel offered for retail sale by a confirmed fuel retailer is temporarily unavailable, the retailer must notify the Director as soon as reasonably practicable. (2) A confirmed fuel retailer must not, without reasonable excuse, fail to notify the Director in accordance with subsection (1). (3) For the purposes of subsection (2), it is a reasonable excuse for a confirmed fuel retailer to fail to notify the Director in accordance with subsection (1) if the retailer is unable to notify the Director due to— (b) in the case of a notification that must be provided by way of a software application, the unavailability of that application as a result of circumstances beyond the retailer's control; or S. 106K inserted by No. 46/2025 s. 23.
