Australian Communications Authority (HPON Transmitter Licences) Direction No. 1 of 2001

The Direction relies on and interlocks three statutory frameworks: the Australian Communications Authority Act 1997 (the enabling power), the Radiocommunications Act 1992 (licence issue and renewal provisions cited), and the Broadcasting Services Act 1992 (the ABA’s section 34 open narrowcasting determinations and the concept of open narrowcasting). The Direction uses several defined, technical concepts from those statutes.

HPON radio licence: the Direction defines this term tightly (s 3). An HPON radio licence is a transmitter licence issued under s 100 Radcom Act that authorises an open narrowcasting radio service in broadcasting services bands that are designated as available for allocation under an ABA section 34 open narrowcasting determination at the time the licence is issued, and where the authorised transmitter power exceeds thresholds: more than 1 watt in residential areas, more than 10 watts in non-residential areas. The definition therefore combines purpose (open narrowcasting radio service), spectrum location (broadcasting services bands subject to a section 34 determination), and technical limits (power thresholds, with a residential/non-residential distinction).

Section 34 open narrowcasting determination: this is a BSA construct. The Direction uses it as the trigger and temporal anchor for licence-period synchronisation (s 5). The Direction treats the ABA’s section 34 determinations as the relevant instrument by which parts of the radiofrequency spectrum are made available for allocation to open narrowcasting service providers.

Price-based allocation policy: the Direction explicitly prevents the ACA from refusing renewal solely on the basis of a general policy that HPON licences should be issued by a price-based allocation system under subsection 106(1) Radcom Act (s 4). The Direction does not define price-based allocation, but cites the Radcom Act provision as the rationale for the prohibition.

Licence-term synchronisation: the core operational concept is aligning the ACA’s licence periods with the ABA’s section 34 determination periods. On renewal the ACA must set the licence period to end at the same time as the ABA’s specified period in the relevant section 34 determination (s 5). The Direction makes an exceptionary transitional rule that compresses licence terms for issuances and renewals occurring before 1 July 2002, requiring them to end no later than 30 June 2002 (s 5A).

Delegation application: the Direction is expressed to apply also to the ABA when acting as the ACA’s delegate under s 238 Radcom Act (s 6). This recognises that the ABA may perform ACA functions and signals that the same constraints and obligations apply when the ABA acts in that delegated capacity.

Commencement and amendment: the Direction commenced 1 March 2001 and was amended in 2002 to add s 5A and modify s 5 (Notes, Tables). The compilation notes registration requirements under the Legislative Instruments Act 2003 for non-exempt legislative instruments (Notes).

Collectively these concepts make the instrument a narrowly targeted administrative direction, linking renewal discretion to ABA determinations and excluding a specific ground for refusal.

The Direction affects three principal institutional actors and a class of licence-holders or prospective applicants.

1. The ACA. The Direction is addressed primarily to the ACA and constrains its decision-making on renewals of HPON radio licences. The ACA is prohibited from refusing renewal on the basis of a general policy favouring a price-based allocation system under s 106(1) Radcom Act (s 4). The ACA is also required, when renewing, to set licence periods to coincide with the ABA’s section 34 determination periods, subject to the Radcom Act cross-reference (s 5). Decisions taken by the ACA before 1 July 2002 to issue or renew must use the shorter transitional period (s 5A).

2. The ABA when acting as delegate of the ACA. The Direction expressly applies to the ABA in its capacity as delegate under s 238 Radcom Act (s 6). When the ABA performs functions delegated by the ACA (for example issuing or renewing transmitter licences under delegation), it must comply with the same prohibitions and timing obligations.

3. HPON licence-holders and applicants. The Direction defines an HPON radio licence tightly (s 3). Holders of such licences and applicants for them are directly affected by (a) the restriction on ACA’s ability to refuse renewal on one specified policy ground (s 4), and (b) the requirement that licence terms align with ABA section 34 determination periods (s 5). For issuances or renewals decided before 1 July 2002, applicants and holders must expect a licence period that ends no later than 30 June 2002 (s 5A).

Secondary effects reach other stakeholders.

• Open narrowcasting service providers operating in the broadcasting services bands designated by ABA determinations will be affected because their authorising transmitter licences (where HPON thresholds are exceeded) will have renewal protections and synchronised terms that follow ABA determination periods (s 3, s 5). This influences operational planning for those providers.

• Spectrum planning and allocation policy actors: the Direction constrains the ACA’s use of a price-based allocation policy as a basis for refusing renewals of existing HPON licences (s 4). That interacts with the ACA’s broader allocation and auction policy deliberations under the Radcom Act.

• Third parties interested in contested spectrum allocations may find that the ACA cannot use a general price-based allocation policy as a ground to refuse renewal of an existing HPON licence (s 4), at least insofar as that refusal would be based on a general policy rather than other statutory grounds.

Who pays: the Direction itself does not specify fees or charges. However, by affecting licence-term certainty and renewal bases, it affects the economic expectations of licence-holders and prospective market entrants, who bear the costs of compliance, technical adjustments to power thresholds, and planning uncertainty aligned with ABA determinations.

Who decides: the ACA and, where delegated, the ABA make issue and renewal decisions, but the Direction prescribes a constraint on the ACA’s decision-making and on delegated decision-making by the ABA (s 4-6).

Timing and transitional considerations: the Direction’s commencement date (1 March 2001) and the transitional cut-off in s 5A (1 July 2002; with 30 June 2002 as the latest licence end date for interim issuances) create a limited window where different term-setting rules apply. The amendment history confirms s 5A was added by Amendment No. 1 of 2002 (Notes).

The Direction imposes specific duties on the ACA and the ABA when acting as delegate, and it protects rights of HPON licence-holders by limiting one ground of refusal.

Duties imposed on the ACA (and on the ABA when delegated):

• Duty not to refuse renewal on a particular basis: The ACA must not refuse to renew an HPON radio licence under s 130 Radcom Act on the basis of a general policy that such licences should be issued under a price-based allocation system determined under subsection 106(1) Radcom Act (s 4). This is an absolute prohibition in the Direction’s terms; the ACA remains able to refuse renewals on other statutory grounds or factual bases not proscribed by the Direction.

• Duty to specify licence period to align with ABA s 34 determination: When the ACA decides to renew an HPON radio licence under s 130 Radcom Act, the ACA must, subject to subsection 103(3) of the Radcom Act, specify a period under subsection 103(2) Radcom Act that ends at the same time as the period specified by the ABA under the relevant section 34 open narrowcasting determination, or the relevant part of that determination (s 5). The duty concretely links the renewal term to the ABA’s determination period.

• Interim duty for pre-1 July 2002 issuances and renewals: If the ACA decides before 1 July 2002 to issue under s 100 Radcom Act or renew under s 130 Radcom Act an HPON radio licence, the ACA must specify, under s 103(2) Radcom Act, a licence period ending no later than 30 June 2002 (s 5A). This is a temporal constraint on licence duration for that transitional period.

• Duty of application to ABA delegate: The Direction applies equally to ABA acting as delegate under s 238 Radcom Act (s 6). That means the same non-refusal and term-specifying duties apply to the ABA when acting in delegated capacity.

Rights protected or created:

• Right to avoid a particular policy-based refusal: HPON licence-holders acquire a safeguard because the ACA cannot refuse renewal simply because it prefers a price-based allocation policy for such licences (s 4). This protects existing licence-holders from a particular mode of administrative policy change applied as a general ground for refusal.

• Right to synchronised licence end date: On renewal, licence-holders have a right, via the Direction, to have their licence period end contemporaneously with the ABA’s section 34 determination period (s 5). This yields a predictable upper boundary for term length determined by the ABA’s period specification.

Cross-reference obligations and caveats:

• Subject to Radcom Act provisions: The duties to specify licence periods are expressed as subject to subsection 103(3) of the Radcom Act (s 5). The Direction therefore acknowledges that the Radcom Act contains provisions that may limit or qualify the ACA’s specification of licence terms. The Direction does not reproduce those Radcom Act subsections; practitioners must read the Radcom Act to determine the full scope of constraints.

• Temporal limitation: The interim duty in s 5A operates only for decisions made before 1 July 2002. The Direction creates a time-limited rule that affects the ACA’s power to set licence durations for that window.

Mechanics of exercise:

• Decisions (issue or renewal) to which the duties attach are decisions under s 100 and s 130 Radcom Act. The Direction does not change the statutory powers to issue or refuse; it prescribes limitations on the grounds for refusal and the manner of specifying licence periods.

• The Direction is made under subsection 12(1) of the Australian Communications Authority Act 1997, which provides the legislative basis for the Direction (front matter). The Direction therefore functions as a statutory instruction to the ACA derived from that enabling Act.

The Direction itself does not create express penalties, fines, or criminal offences in its text. The instrument is a direction made under subsection 12(1) of the Australian Communications Authority Act 1997; it prescribes the conduct required of the ACA (and the ABA as delegate) in the exercise of particular statutory functions. The Direction uses mandatory language , "must not refuse" (s 4), "must specify" (s 5, s 5A) , thereby creating obligatory administrative duties. The source document does not set out sanctions for non-compliance within the Direction itself.

Enforcement mechanisms and practical remedies must be inferred from the statutory context and from how directions of this kind operate within administrative law, but the Direction does not itself recite those mechanisms. Within the text, the Direction:

• Identifies the statutory bases for the relevant ACA functions (issuing licences under s 100 Radcom Act, renewing under s 130 Radcom Act, specifying licence periods under s 103(2) Radcom Act), which suggests that enforcement or review would be through the statutory decision-making framework of the Radcom Act and ordinary avenues of administrative review or judicial review available against decisions made under those Acts. The Direction does not specify review forums, time limits, or procedural steps.

• Applies when the ABA acts as delegate of the ACA under s 238 Radcom Act (s 6), implying that the Direction binds a delegate performing delegated functions. Again, the Direction does not specify internal disciplinary or sanctioning measures for a delegate’s non-compliance.

Notes and instrument status that affect enforceability:

• The compilation indicates the Direction was prepared and amended, and that registration requirements under the Legislative Instruments Act 2003 apply to non-exempt legislative instruments (Notes). The registration and publication regime under that Act affects the legal visibility and procedural status of the instrument, but the Direction itself does not set out enforcement detail.

• Because the Direction references and operates in the context of other statutes (Radcom Act, BSA, ACA Act), practical enforcement of the Direction’s mandatory obligations would commonly be tested by reviewing whether the ACA (or its delegate) acted in accordance with the Direction when exercising powers under the Radcom Act. The Direction’s wording creates a clear statement of required practice (for example the prohibition in s 4), which would be relevant in any administrative or judicial review of a renewal refusal or of licence-period specification.

In short, the Direction imposes binding administrative obligations on the ACA and delegated ABA decision-making but contains no express penalties; enforcement would proceed under the broader administrative law framework and the statutes referenced, none of which are reproduced in the Direction. Practitioners should consult the Radcom Act, the ACA Act and administrative law remedies to identify precise enforcement routes.

The Direction is an instrument made under subsection 12(1) of the Australian Communications Authority Act 1997 and operates by directing how the ACA (and the ABA as delegate) must exercise specified functions under the Radiocommunications Act 1992 and in relation to determinations under the Broadcasting Services Act 1992.

Interplay with the Radiocommunications Act 1992 (Radcom Act)

• The Direction expressly references and modifies how the ACA must exercise powers under the Radcom Act: the Direction affects renewals under section 130 (s 4), issues under s 100 and renewals under s 130 in the transitional rule (s 5A), and requires the ACA to specify licence periods under subsection 103(2) and subject to subsection 103(3) Radcom Act (s 5, s 5A). It also references subsection 106(1) Radcom Act , the Radcom provision for price-based allocation systems , but the Direction precludes reliance on a general policy favouring such allocation as a ground for refusing renewal (s 4). The Direction thereby modifies the administrative exercise of Radcom powers without amending statutory text.

• The Direction also notes the ABA’s potential role under s 238 Radcom Act as delegate of the ACA; it applies to the ABA when acting in that capacity (s 6). This creates operational alignment where the ABA exercises ACA powers under delegation.

Interplay with the Broadcasting Services Act 1992 (BSA)

• The Direction’s definition of HPON radio licence and its synchronisation requirement hinge on section 34 open narrowcasting determinations made under the BSA. The Direction requires that the ACA, when renewing, set licence periods to end at the same time as the relevant ABA section 34 determination period (s 5). That makes the ABA’s determinations a temporal anchor for Radcom licences and aligns spectrum-use authorisation terms with the BSA instrument that designates availability for open narrowcasting.

• The Direction imports BSA concepts such as "broadcasting services bands", "open narrowcasting radio service", and "open narrowcasting service" by definition (s 3). The practical effect is coupling transmitter licence timing and renewal treatment under the Radcom Act to the ABA’s regulatory delineation under the BSA.

Interplay with the Australian Communications Authority Act 1997

• The Direction is authorised by subsection 12(1) of the Australian Communications Authority Act 1997 (front matter). The ACA Act provides the power for the Minister to direct the ACA. The Direction therefore operates as an executive direction made pursuant to that statutory authority.

Interplay with the Legislative Instruments Act 2003 and publication requirements

• The compilation notes that under the Legislative Instruments Act 2003, which commenced 1 January 2005, registration on the Federal Register of Legislative Instruments is required for non-exempt instruments (Notes). The Direction’s compilation indicates registration and amendment dates in the Table of Instruments. That procedural regime affects the instrument’s publication and visibility but does not alter its substantive content.

Cross-references and limits

• The Direction repeatedly defers to specific subsections of the Radcom Act (s 103(2) and s 103(3)). Because the Direction does not reproduce those Radcom provisions, their content determines how the ACA may specify a period and what limits apply. The Direction’s obligations are therefore framed as subject to those Radcom provisions, creating interdependence and potential qualification by the Radcom Act text.

• The Direction prohibits refusal on the basis of a general policy favouring price-based allocation under s 106(1) Radcom Act. It does not, however, prohibit the ACA from implementing price-based allocation mechanisms where they are statutorily required, nor does it preclude refusal on other specific or fact-driven grounds authorised by the Radcom Act or other statutes.

Operational consequences

• By synchronising licence terms with ABA s 34 determination periods, the Direction forces coordination between two legislative regimes. Changes to ABA determinations under the BSA will therefore have a direct effect on the maximum remaining term of an HPON radio licence on renewal under the Radcom Act. Practitioners must therefore read the BSA determinations alongside Radcom Act provisions when assessing licence-term exposure.

• Delegation interplay: because the Direction applies to the ABA when acting as delegate, administrative functions may be exercised by the ABA on the ACA’s behalf, but subject to the Direction’s constraints. This affects the architecture of decision-making and accountability for licence issuance and renewal.

In sum, the Direction sits as an administrative instruction that modifies the ACA’s exercise of Radcom powers by reference to ABA determinations under the BSA, while being made pursuant to the ACA Act and subject to procedural publication obligations under the Legislative Instruments Act 2003.

The compilation records the Direction’s original making and at least one formal amendment. The relevant dates and textual changes are set out in the Notes tables of the compilation.

Key dates

• Original Direction: Australian Communications Authority (HPON Transmitter Licences) Direction No. 1 of 2001. Gazette notification 31 January 2001; commencement date 1 March 2001 (Notes, Table of Instruments).

• Amendment No. 1 of 2002: Australian Communications Authority (HPON Transmitter Licences) Direction No. 1 of 2001 (Amendment No. 1 of 2002). Gazette notification/FRLI registration 6 March 2002; commencement 6 March 2002 (Notes, Table of Instruments).

Nature of amendment

• The Table of Amendments records that s 5 was amended by 2002 No. 1 and that s 5A was added by 2002 No. 1 (Notes, Table of Amendments). The present compilation therefore reflects the Direction as amended to insert the transitional provision s 5A and to amend the existing s 5. The compilation does not reproduce earlier versions, but the insertion of s 5A makes clear the amendment was intended to govern interim issuances and renewals prior to 1 July 2002.

Contextual procedural notes

• The compilation includes a note stating that under the Legislative Instruments Act 2003, which came into force on 1 January 2005, registration on the Federal Register of Legislative Instruments is required for all non-exempt legislative instruments. The Direction’s compilation acknowledges this procedural regime, though the Direction itself predates that Act and the amendment timeline is chiefly 2001-2002.

What the amendment does functionally

• The addition of s 5A establishes an interim licence-duration rule for decisions taken before a defined cut-off (1 July 2002), limiting licence periods to end no later than 30 June 2002. The amendment therefore created a shorter, fixed outer limit for licence terms in the transitional window and adjusted s 5 as necessary to accommodate that transitional arrangement.

Limitations of the compilation record

• The compilation provides the dates and identifies which provisions were amended or added, but it does not reproduce the pre-amendment text of s 5. It also does not provide the amendment instrument’s Explanatory Memorandum or second-reading speech material. Accordingly, the compilation establishes what changed and when, but not the legislative policy materials beyond the amendment record.

Practical consequence for practitioners

• Where historical decisions or licences were issued around the 2001-2002 period, the amendment history is relevant to determining applicable licence terms for particular issuances or renewals. Practitioners reviewing licences issued or renewed before 1 July 2002 should confirm whether the transitional rule in s 5A operated and, if so, whether licence terms were set to expire no later than 30 June 2002 as required.

The compilation provides no record of litigation or court decisions concerning the Direction. The instrument’s Notes and Tables list instrument dates and amendments but contain no cases, judicial commentary, or references to administrative review decisions.

Consequences for research and advice

• Because the compilation contains no litigation history, practitioners must not assume judicial interpretation exists for the Direction. Any analysis of how courts have treated the Direction, or how administrative review bodies have applied it, is beyond the information contained in the source. To identify any litigation or review decisions that interpret or apply this Direction, independent searches of case law and tribunal decisions would be required; the Direction’s compilation does not supply such material.

• In transactional or compliance work, absence of recorded litigation in the compilation does not remove the need to consider judicial and tribunal avenues available under the Radcom Act, the Administrative Decisions (Judicial Review) Act, or other relevant statutory review regimes, but the Direction itself does not supply those references.

What the Direction does supply relevant to litigation

• The Direction uses mandatory language that would be material to any judicial or administrative review where a licence renewal was refused on the basis of a general price-based allocation policy, or where the ACA (or the ABA as delegate) set a licence period inconsistent with the ABA’s section 34 determination period. If such a decision were challenged, the Direction’s text would be a central primary instrument for judicial review arguments about the proper exercise of ACA powers. The compilation does not record whether any such challenges have occurred.

The Direction is compact and specific, but several points can catch practitioners who do not read the cross-referenced statutes and dates carefully.

Narrowness of the HPON definition

• The Direction applies to a narrowly defined class of licences (s 3). An HPON radio licence combines service-type (open narrowcasting radio service), location (broadcasting services bands available under an ABA s 34 determination at the time of issue), and transmitter power thresholds (>1 watt in residential areas, >10 watts in non-residential areas). Licences that fail any element of that definition fall outside the Direction. Practically, a licence that serves open narrowcasting but is issued in a band not currently “available for allocation” under an ABA s 34 determination is not an HPON radio licence under this Direction. Likewise, licences at or below the power thresholds are excluded.

Reliance on other statutes for operative detail

• The Direction repeatedly defers to the Radcom Act (for example s 103(2), s 103(3), s 100, s 130, s 106(1), s 238) and to the BSA (for section 34 determinations). The Direction does not reproduce those statutory provisions. To assess the precise legal consequences, limits, or exceptions, practitioners must consult the Radcom Act and the BSA. For example, s 5 duties are "subject to subsection 103(3) of the Radcom Act"; if s 103(3) imposes a qualification or bar, it could limit the Direction’s operation. Failure to read the referenced provisions is a common pitfall.

Temporal and transitional traps

• The Direction’s transitional provision (s 5A) applies only where the ACA decides to issue or renew an HPON licence before 1 July 2002, and requires the licence period to end no later than 30 June 2002. Practitioners dealing with licences issued or renewed in that window must confirm the decision date, not merely the application date or the operational start date. Administrative record-keeping and precise dating are consequential.

Delegation application

• The Direction applies to the ABA acting as the ACA’s delegate under s 238 Radcom Act (s 6). Parties may assume the ABA and ACA operate independently, but the Direction imposes the same constraints on the ABA when acting as delegate. Auditors and counsel should check whether a particular licence decision was made by the ACA or by the ABA under delegation, because different internal review processes and administrative records may apply.

Misreading the non-refusal prohibition

• Section 4 does not prevent the ACA from pursuing price-based allocation mechanisms generally, nor does it bar refusal for other statutory or fact-specific reasons. The Direction forbids only refusal based on a general policy favouring price-based allocation under subsection 106(1) Radcom Act. If the ACA grounds a refusal on other statutory criteria or on concreto evidence justifying refusal, those bases are not proscribed by the Direction. Equally, the Direction does not compel renewal where other legal grounds for refusal exist.

Dependence on ABA determinations

• The licence-term synchronisation in s 5 ties the ACA’s renewal-period specification to the ABA’s section 34 determination period. If the ABA’s determination period is short, staggered, or unexpectedly altered, licence-holders will face corresponding truncation of renewal terms. Practitioners should not assume long standard terms; the ABA’s determination periods control the end date. The Direction does not address what happens if an ABA determination is amended mid-term; consult BSA procedures for amendments and transitional arrangements.

No internal penalties specified

• The Direction contains no internal sanctioning or enforcement mechanism. It is mandatory language aimed at administrative actors. If a decision appears inconsistent with the Direction, the appropriate recourse is to examine statutory review mechanisms under the Radcom Act and general administrative law. Parties should not expect the Direction to supply an expedited enforcement pathway without reference to those regimes.

Publication and registration timing

• The compilation notes registration requirements under the Legislative Instruments Act 2003. Given the Direction predated that Act, care should be taken to confirm whether and when the instrument was registered and whether publication and availability requirements affect procedural rights based on notice. The compilation’s Table of Instruments records Gazette/registration dates, but practitioners should verify current instrument status in official registers.

For administrators, applicants, licence-holders and advisers, compliance requires attention to definition triggers, timing, decision grounds, and cross-referenced statutory text. Below is a practical checklist framed around the Direction’s operative requirements (s 3-6) and the compilation notes.

1. Confirm whether the licence is an HPON radio licence (s 3)

   • Verify the licence is a transmitter licence issued under s 100 Radcom Act.
   • Confirm the authorised service is an open narrowcasting radio service (as defined in the BSA).
   • Confirm the transmitter operates in broadcasting services bands that, at the time of issue, are available for allocation under an ABA section 34 open narrowcasting determination.
   • Confirm the authorised maximum transmitter power exceeds the thresholds: greater than 1 watt in residential areas, greater than 10 watts in non-residential areas.
   • If any element is missing, the Direction does not apply.

2. For the ACA or ABA delegate: do not refuse renewal on the proscribed basis (s 4)

   • When assessing a renewal application under s 130 Radcom Act for an HPON radio licence, do not base a refusal on a general policy that such licences should be allocated by a price-based allocation system under s 106(1) Radcom Act.
   • Document substantive, licence-specific reasons for any refusal, referencing statutory grounds in the Radcom Act or factual/technical non-compliance, not a general allocation policy.

3. For the ACA or ABA delegate: set licence periods to coincide with ABA s 34 determinations (s 5)

   • When renewing an HPON radio licence, specify the licence period under s 103(2) Radcom Act so that it ends at the same time as the period specified by the ABA under the relevant section 34 open narrowcasting determination, or the relevant part of that determination.
   • Check subsection 103(3) Radcom Act for any qualification that affects the length of licence periods and ensure the period set complies with that subsection as well.

4. Transitional compliance for pre-1 July 2002 decisions (s 5A)

   • If issuing under s 100 Radcom Act or renewing under s 130 Radcom Act and the decision date is before 1 July 2002, specify a licence period ending no later than 30 June 2002.
   • Ensure administrative records show the date the decision was made (not merely application date) to confirm whether s 5A applies.

5. Delegation compliance (s 6)

   • If the ABA is exercising ACA powers under s 238 Radcom Act as delegate, ensure actions comply with the Direction in the same manner as the ACA would. Delegates must apply the prohibition on refusal under s 4 and the period-specification duties in s 5 and s 5A where applicable.
   • Record delegation instruments and the legal basis for any decision under delegation.

6. Cross-check related statutory provisions

   • Read and apply the relevant Radcom Act subsections cited in the Direction (s 100, s 103(2), s 103(3), s 106(1), s 130, s 238) to ensure that licence-issue and renewal decisions are procedurally and substantively compliant across both the Direction and the Radcom Act.
   • Review applicable BSA section 34 open narrowcasting determinations to determine the period specified by the ABA and whether the relevant part of the determination is the appropriate anchor for the licence period.
   • Confirm whether any changes to the ABA’s s 34 determinations during a licence term affect the licence end date under the Direction and BSA procedures.

7. Administrative record-keeping and documentation

   • When refusing a renewal (for reasons other than the proscribed general policy), document the precise statutory basis and facts supporting the decision to demonstrate the refusal did not rely on a general policy of price-based allocation.
   • When specifying licence periods, record the ABA s 34 determination referenced and the decision date, so that the synchronisation requirement is demonstrably satisfied.
   • For delegates, retain the instrument of delegation and clear internal provenance showing the decision was made under authority delegated by the ACA.

8. For licence-holders and applicants

   • Anticipate that renewal refusals will not be based on a general price-based allocation preference; however, be prepared to comply with technical, interference, or other statutory conditions that remain valid grounds for non-renewal.
   • Expect licence terms on renewal to be aligned with ABA s 34 determination periods; factor that timing into business and capital planning.
   • For decisions around the transitional period, verify whether the s 5A requirement applied to your licence and plan for the 30 June 2002 end date where relevant.

9. Consider administrative review pathways in case of apparent non-compliance

   • The Direction contains mandatory duties but no express penalties. If a decision appears inconsistent with the Direction, explore statutory review avenues under the Radcom Act and general administrative law remedies. The Direction’s text will be material in any such review; preserve decision records and the rationale for the contested decision.

10. Keep instrument status and amendments under review

• The compilation shows the Direction was amended (Amendment No. 1 of 2002). Confirm whether any further amendments or revocations have occurred since the compilation date. Also verify registration and current status on official registers in accordance with Legislative Instruments Act 2003 processes.

Following these steps will align administrative practice with the Direction’s mandatory wording and preserve evidence required for both internal and external review.
