What it does
This Direction, made by the Minister for Communications, Michelle Rowland, instructs the Australian Communications and Media Authority (ACMA) to amend the Telecommunications (Emergency Call Service) Determination 2019 (the Determination). The instrument is the Australian Communications and Media Authority (Emergency Call Service Determination) Direction 2024, dated 21 August 2024 (sections 1 and the heading). It is made under subsection 14(1) of the Australian Communications and Media Authority Act 2005 (section 3). The Direction commences the day after registration (section 2).
Mechanically, the Direction divides the required amendments into two groups with different timing mandates. Amendments described in subsection 6(1) are to be determined by the ACMA by 30 April 2025, and to commence in full at the earliest practical opportunity and in any event no later than 1 November 2025 (section 5(2)). Amendments described in subsection 6(2) are to be determined and to commence in full by 1 November 2024 (section 5(3)). Section 6 of the Direction sets out content that must be inserted into the Determination. The Direction authorises ACMA, in making those amendments, to define any terms it considers appropriate, including terms used in the Direction but not defined in section 4 (section 6(6)).
Substantively, the Direction requires the Determination to impose operational and customer-facing obligations on carriers and carriage service providers (the Direction uses the defined term provider which is “a carrier or carriage service provider”, section 4). The amendments in subsection 6(1) are concerned with ensuring emergency calls reach the emergency call person for 000 and 112 during outages and with post‑outage reporting and disruption protocols. They require providers to, among other things, act in relation to controlled facilities when core network connectivity is lost, take reasonable steps to avoid impeding “emergency call camp on functionality” during outages, test delivery of emergency calls to the emergency call person (including when using emergency call camp on), and configure networks to carry emergency calls regardless of the mobile phone used to make the call (section 6(1)(1)). Providers must also share real time network outage information with emergency services, report detailed post‑outage information to ACMA and the Department, maintain a disruption protocol, and submit management plans ahead of operational or network changes that will affect emergency call delivery (sections 6(1)(2)-(5)).
