Australian Civilian Corps Amendment Act 2013

To understand the operation of the amended framework, several key statutory definitions and structural concepts must be analysed.

The Secretary and the Department

The Act repeals the definitions of "AusAID" and "Director-General" from Section 5 of the parent Act. It inserts a singular definition for "Secretary", meaning the Secretary of the Department. The Department refers to the public service department now tasked with administering the ACC. This shift centralises all employer powers, policy-setting capabilities, and administrative discretions in a single public sector chief executive.

Employer Powers of the Secretary

Defined in the amended Regulation 20(5), these encompass the rights, duties, and powers mentioned in Part 3 of the Act. This includes the direct employment of ACC personnel, determination of terms and conditions, and unilateral management of staff deployments.

Senior Officer of the Department

Under the newly substituted Subclause 3.6(2) of the Directions, a "senior officer" authorised to issue directions to an ACC employee is defined strictly by reference to hierarchical public service bands. The officer must hold or perform the duties of either a Senior Executive Service (SES) position (or equivalent) or an Executive Level 2 (EL2) position (or equivalent) within the Department. This replaces the looser concept of a "senior AusAID Officer".

HR AS (Assistant Secretary) and Ethics Director

The administrative apparatus is flattened by substituting the "HR ADG" (Assistant Director-General) with the "HR AS". This represents the person holding or performing the duties of the Senior Executive Band 1 position in the branch of the Department responsible for personnel and employment matters.

Similarly, the "Ethics Director" is defined as the person holding or performing the duties of the Director position in the section of the Department that has responsibility for the ACC Values and the ACC Code of Conduct.

Transitional Instruments

Under Part 5, the Act distinguishes between "old legislative instruments" and "amended legislative instruments". It establishes a legal fiction where actions taken by the defunct AusAID or its Director-General are deemed to have been executed by the Department or the Secretary.

Furthermore, Item 127 introduces "transitional determinations". This is a mechanism allowing the Secretary to declare in writing that non-legislative instruments made under the old Act continue to have legal effect. These determinations are explicitly excluded from being legislative instruments, thereby avoiding parliamentary disallowance and scrutiny.

The primary group affected by this Act consists of Australian Civilian Corps employees. These are civilian specialists deployed or registrable for deployment in international disaster relief, recovery, and stabilisation operations.

Under the amended regime, these employees no longer interface with a specialised, relatively flat international development agency (AusAID). Instead, they are subject to the broader, more hierarchical management of a major Commonwealth department. Their employment terms, deployment protocols, and code of conduct enforcement are governed directly by the Secretary of the Department.

The Act also directly impacts the senior leadership and HR professionals of the Department. The Secretary inherits extensive statutory burdens. These include the duty to uphold and promote the ACC Values under Section 14, and the power to issue binding directions on those Values and the Code of Conduct under Sections 13 and 16.

Departmental managers at the SES and EL2 levels are affected. They are now legally recognised as the "senior officers" who possess the statutory authority to issue operational directions to deployed ACC employees.

From an economic perspective, the Act shifts the transaction costs of managing a highly specialised, contingent civilian reserve from a dedicated agency to a consolidated departmental structure. While this integration may yield economies of scale by centralising HR and finance, it risks diluting specialized expertise.

For private contractors and specialists on the ACC Register, this change means their files, personal information, and professional deployments are managed by different personnel under a different administrative chain of command.

The Act and its schedules establish a revised matrix of statutory duties and rights that govern the relationship between the Department and ACC employees.

Secretary’s Duties and Powers

• Promotion of Values: Under the amended Section 14, the Secretary is under a strict statutory duty to actively uphold and promote the Australian Civilian Corps Values.
• Direction-Making Powers: The Secretary has the power to issue written directions concerning the ACC Values (s 13) and the Code of Conduct (s 16). These directions are binding on all ACC employees.
• Employer Discretion: Under Section 18, the Secretary possesses the sole employer powers of the Commonwealth in relation to ACC employees. This includes the unilateral right to determine terms, conditions, and deployment tasks.
• Workplace Commitments: Under amended Directions 2.4 and 2.5, the Secretary is tasked with providing, "to the extent possible", a workplace free from discrimination that recognises the diversity of the Australian community, alongside a fair, flexible, safe, and rewarding work environment.

Ministerial Limits

Under the amended Section 25, there is a clear statutory limitation on Ministerial directions. The Minister must not give directions to the Secretary in relation to the selection or employment of a specific individual as an ACC employee. This maintains a formal separation between political direction and merit-based public sector staffing.

Employee Duties and Privacy Rights

• Code of Conduct: ACC employees must comply with the Secretary's directions regarding the Code of Conduct.
• Information Sharing: Under Regulation 20, the use or disclosure of personal information relating to ACC employees is restricted. It is permitted only if it is necessary for the performance or exercise of the employer powers of the Secretary or the employer powers of an Agency Head.
• Gifts and Prizes Policy: The Schedule to the Directions imposes strict duties on employees regarding the receipt of gifts and prizes. Employees must hand over gifts above a certain threshold. Under Item 107, the Secretary has the power to direct an officer to dispose of such gifts. Under Item 112, prizes won at sponsor charity events are only acceptable if the opportunity to win was also open to individuals who are not members of the sponsoring entity (such as the Department or the ACC).

The Australian Civilian Corps Amendment Act 2013 does not introduce new civil penalties or criminal offences. Instead, it relies on a framework of administrative sanctions, disciplinary procedures, and institutional compliance mechanisms managed under the Australian Civilian Corps Regulations 2011 and the Secretary's Directions.

Code of Conduct Breaches

The primary enforcement mechanism relates to breaches of the ACC Code of Conduct. Under the amended Regulations (specifically Regulations 11, 12, 14, 15, and 16), the Secretary possesses the ultimate authority to determine whether an employee has breached the Code.

If a breach is established, the Secretary has the administrative power to impose disciplinary sanctions. These sanctions can range from formal reprimands to termination of employment, or removal from the ACC Register.

The process is managed internally. Investigations are led by the Ethics Director and recommendations are routed through the HR AS. The Act shifts this entire disciplinary machinery from the old AusAID framework to the Secretary of the Department.

Recovery of Public Monies

Financial compliance is maintained through administrative procedures for the recovery of public debts or overpayments. Under Item 104 of the Schedule to the Directions, any public money or financial discrepancies must be reported and "given to an officer of the Department who has responsibility for the collection of public money". Failure to comply with these directions constitutes a breach of the Code of Conduct, triggering the administrative sanctions outlined above.

Enforcement of Gift Procedures

The strict protocol for handling gifts and benefits is enforced by internal audits and registries. If an ACC employee retains a gift in violation of the Directions, it is treated as an ethical breach. The Secretary can enforce compliance by issuing a direct order to surrender the property or by directing a departmental officer to dispose of the item.

The Australian Civilian Corps Amendment Act 2013 is a highly unusual drafting instrument because it operates across multiple vertical layers of the legislative hierarchy simultaneously.

Typically, an Act of Parliament only amends primary legislation, leaving the executive to amend its own regulations and directions. However, under Section 3(1) of this Act, Parliament took the step of directly amending the Australian Civilian Corps Regulations 2011, the Prime Minister’s Australian Civilian Corps Directions 2012, and the Director-General’s Australian Civilian Corps Directions 2011 within a single legislative vehicle.

To preserve the separation of powers and the future flexibility of the executive, the Act contains explicit saving provisions in Section 3:

• Section 3(2) clarifies that the parliamentary amendment of any regulation under this Act does not prevent that regulation from being subsequently amended or repealed by the Governor-General in the ordinary manner.
• Section 3(3) establishes that the parliamentary amendment of any direction does not prevent the direction from being subsequently amended or repealed by the Prime Minister or the Secretary of the Department, as the case requires.

The Act also interacts directly with the broader framework of Australian public administration. By replacing "AusAID" with "the Department", it integrates the ACC into the financial management and governance frameworks of the Public Governance, Performance and Accountability Act 2013 (which succeeded the Financial Management and Accountability Act 1997).

The references to "an officer of the Department who has responsibility for the collection of public money" align the ACC's financial operations directly with the general public governance rules governing the collection, custody, and administration of public money by Commonwealth entities.

The Australian Civilian Corps Amendment Act 2013 (No. 140, 2013) was introduced into the House of Representatives on 20 November 2013 and passed through the Senate on 4 December 2013. It received the Royal Assent on 13 December 2013, and commenced operation immediately on that day under Section 2.

The Act contains a single Schedule divided into five distinct parts:

• Part 1: Amends the Australian Civilian Corps Act 2011 (Items 1 to 28). These amendments systematically substitute "Secretary of the Department" for "Director-General of AusAID" and "the Department" for "AusAID" across the primary statute.
• Part 2: Amends the Australian Civilian Corps Regulations 2011 (Items 29 to 60). This part aligns the definitions within the subordinate regulations, replacing references to AusAID officers with senior officers of the Department and updating information-sharing provisions.
• Part 3: Amends the Prime Minister’s Australian Civilian Corps Directions 2012 (Items 61 to 64). It officially names the directions and updates the register and departmental titles.
• Part 4: Amends the Director-General’s Australian Civilian Corps Directions 2011 (Items 65 to 122). This part renames the instrument to the Secretary’s Australian Civilian Corps Directions 2011, updates internal titles (e.g., HR ADG to HR AS), and completely rewrites the administrative processes for handling gifts, prizes, and payroll processing.
• Part 5: Establishes the transitional provisions (Items 123 to 127). These provisions are critical for maintaining continuity of operations, ensuring that all prior actions, directions, and non-legislative instruments survive the transition from AusAID to the Department.

Since its enactment, this amending Act has spent its force mechanically. Its changes have been fully integrated into the compilations of the parent Act, regulations, and directions.

There is no recorded litigation or judicial history directly interpreting the provisions of the Australian Civilian Corps Amendment Act 2013.

This absence of litigation is a common feature of administrative machinery-of-government legislation. The Act primarily performs internal corporate restructuring and title substitutions within the Commonwealth public sector, which rarely generates justiciable disputes.

Furthermore, the potential for litigation arising from the transition from AusAID to the Department was pre-emptively minimised by the transitional provisions in Part 5 of the Schedule.

Specifically, Item 124 (which deems things done by the Director-General or AusAID to have been done by the Secretary or the Department) and Item 126 (which does the same for regulations and directions) create a seamless statutory continuity. This continuity prevents plaintiffs from arguing that an administrative action, employment contract, or disciplinary proceeding was invalidated or rendered ultra vires by the sudden abolition of AusAID or the office of the Director-General.

Any employment-related disputes that may have occurred within the ACC would have been handled through internal public service grievance channels or standard Fair Work Commission arbitration, rather than through constitutional or administrative law litigation in the Federal Court.

Practitioners and compliance officers should be aware of several administrative and legal traps within this legislation.

The Dissolution of Dedicated Teams

Under Item 108 of the Schedule, the mandate that the "Pay and Conditions Team will maintain the Register" was completely omitted. Under Item 114, references to the specialized "HR Services Section (HRS) in Human Resources Branch (HRB)" were replaced with a generic reference to "the relevant section in the Department".

This means that the highly specialised, dedicated administrative support structure that previously managed ACC personnel was dissolved. HR queries and registry updates are now absorbed into general departmental operations. This absorption can lead to delays, lost records, and a lack of specialised knowledge when deploying civilian experts into high-risk overseas environments.

Vague Financial Channels

Item 104 replaces the requirement to present public monies to the "Collector of Public Monies (CPM) in Finance Branch" with a general instruction to give the money to "an officer of the Department who has responsibility for the collection of public money".

This change introduces administrative ambiguity. It removes a concrete, named destination for financial compliance and replaces it with a functional description, increasing the compliance risk of accounting errors during rapid field deployments.

Physical Address and Contact Purges

Items 120, 121, and 122 omit clear contact details from the official forms, such as "The Pay and Conditions Team, Internal Mail: 11th Floor, Allara Street, Canberra" and the email paycon@ausaid.gov.au.

Without these statutory anchors, finding the correct desk within a massive consolidated department to lodge compliance forms or return financial records becomes an operational challenge.

The Non-Legislative Instrument Trap

Under Item 127, any non-legislative instrument made by the Director-General under the old Act (such as operational policies, standard operating procedures, or individual deployment terms) does not automatically survive the transition.

Survival depends entirely on the Secretary making a written determination under Item 127(1). Because these determinations are explicitly declared to not be legislative instruments under Item 127(3), they are not published on the federal register of legislation.

This lack of publication makes it difficult for external legal researchers, journalists, or employees to verify whether a specific administrative policy or deployment term was legally preserved or allowed to lapse during the transition.

For legal advisers, HR professionals, and departmental managers, compliance with the post-2013 regime requires structured adherence to the following protocols.

                   [IDENTIFY ACTIVE COMPLIANCE TASK]

an active s 127 determination. open to non-sponsoring parties.

1. Document Auditing and Title Compliance

Any template, employment agreement, deployment contract, or correspondence must be checked to ensure that:

• All references to "AusAID" have been replaced with "the Department".
• All references to "Director-General" have been replaced with "the Secretary".
• Forms do not direct physical correspondence to the old Allara Street address or the defunct paycon@ausaid.gov.au email.

2. Verification of Delegated Authority

Before any directive is issued to a deployed ACC employee, the managing officer must verify that they possess the legal authority to do so. Under Direction 3.6, the officer must:

• Hold an active Senior Executive Service (SES) Band 1, 2, or 3 position (or equivalent) in the Department; or
• Hold an active Executive Level 2 (EL2) position (or equivalent) in the Department.
• Ensure that any HR approval is routed specifically to the "HR AS" (Senior Executive Band 1) or the "Ethics Director", rather than the defunct "HR ADG" or "HR Services Section".

3. Executing Transitional Determinations

To ensure the ongoing legality of any operational guidelines or deployment contracts drafted before 13 December 2013, compliance officers must:

• Identify all non-legislative instruments executed by the Director-General of AusAID.
• Draft a formal written determination for the Secretary’s signature under Item 127 of the Australian Civilian Corps Amendment Act 2013.
• Explicitly include any necessary title substitutions in the text of the determination (e.g., declaring that references to AusAID are to be read as references to the Department) as permitted under Item 127(2)(a).
• File the executed determination in the Department's internal record system. Because it is not a legislative instrument, there is no requirement to register it on the Federal Register of Legislation, but it must be kept on file to prove the ongoing chain of authority.

4. Financial and Gift Reporting Protocols

If an ACC employee receives a gift, benefit, or prize during their deployment:

• The gift must be reported immediately to the HR AS (formerly the HR ADG).
• Any physical gifts that must be surrendered under the Directions must be handed over in accordance with a direct order from the Secretary. This order will instruct a departmental officer to dispose of the item, replacing the old protocol of sending it to the "Manager, Property and Facilities Management".
• Any recovered public funds or overpayments must not be sent to the old CPM in Finance. They must be handed over to the specific departmental officer who has been formally designated as "responsible for the collection of public money" under the Department's current financial delegations.
