30Territory liable as manager

#### 30 Territory liable as manager (1) Where, apart from this section, the Commonwealth would be liable in respect of an act done or omitted to be done by the Territory in the performance of its functions under section 29, the liability is vested in the Territory and ceases to be a liability of the Commonwealth. (2) Where: (a) a liability arises in respect of: (i) land at a time when it is Territory Land; or (ii) the management of the taking of water on National Land; or (iii) the regulation of the taking of water on National Land; and (b) the liability arises from a covenant given by the Commonwealth at any time in its capacity as owner of the land; the liability is vested in the Territory and ceases to be a liability of the Commonwealth.
