Australian Capital Territory National Land (Road Transport) Rules 2025

Applied law and scope: The instrument uses the Ordinance’s mechanism for applying ACT road transport laws to National Land. Section 6 implements that mechanism by listing specific provisions (s 6(4)) and stating they apply as in force at commencement (s 6(2)). The areas to which they apply are those the Minister designates in writing under the Australian Capital Territory (Planning and Land Management) Act 1988 as land required for Canberra’s special purposes, and areas covered by agreements between the NCA and another Commonwealth entity for parking management (s 7(1)-(2)). The Schedule 1 map is explicitly illustrative, not determinative (s 7(3), Schedule 1(1)-(2)).

Infringement notice framework: The instrument groups the relevant provisions into an "infringement notice framework" (s 10(1A) and (2)-(3)). That framework includes infringement notices, reminder notices, extension of time, time for prosecution, management plans for instalments, waiver provisions (with certain exclusions), withdrawal, disputing liability, and evidentiary certificate rules (s 10(1A)(a)-(o)). The modifications specifically add that payment or inclusion in a management plan will not be taken to be an admission of guilt or liability (s 15, modifications to s 39; and similar insertions in ss 18-19 modifying the Offences Regulation).

Administrative architecture: Several administrative terms are redefined for the applied laws. Under s 8(2), the administering authority and decision‑maker are the Minister. Internally reviewable decisions are those prescribed by Schedule 1 to the Road Transport (General) Regulation 2000 as applied, except decisions made personally by the Minister. That places central administrative and review functions with the Minister and narrows the class of decisions that are internally reviewable (s 8(2)).

Extension to non‑road areas: The Road Rules are modified to make some stopping and parking prohibitions extend to "open area[s] that are accessible to the public" on National Land, defined to include grassed, mulched, gravelled, tiled, paved, landscaped or partially landscaped areas accessible to the public (s 20, inserting a new s 197(3)). The road transport safety regulation also authorises parking permits for such open areas (s 24(1) amending s 64(1)(c)), and authorises a fee to be determined under s 96 of the Road Transport (General) Act for some permits (s 24(1A)).

Instrument status and oversight: The instrument defines that particular declarations and guidelines relevant to parking are legislative instruments (ss 22-23 modifying ss 33-34 of the Safety and Traffic Management Regulation) and that approvals are notifiable instruments (s 24 modifying s 36). For fee determinations, s 17 (as modified) makes a determination a legislative instrument (substituting s 96(3) to read "A determination is a legislative instrument").

Penalties and penalty units: Penalty units for offences, civil penalties and pecuniary penalties in the applied laws are set to the amount specified in s 133 of the Legislation Act 2001 (ACT) at commencement (s 27), with the instrument noting the amounts current at commencement ($160 individual, $810 corporate).

Selective application and carve‑outs: The instrument applies a limited set of provisions only and in many cases expressly excludes particular subsections, paragraphs or sections from application. Examples: section 24 (Infringement notices) applied other than subsection (3); Division 3.2A applied other than paragraph 31A(4)(c), subsection 31B(4) and sections 31C and 31D; Division 3.2B applied other than particular subparagraphs and sections (s 6(4) item 1). Similar partial applications and exclusions appear throughout the table (s 6(4) items 2-5). Those carve‑outs change the procedural architecture available on National Land relative to the ACT framework.

Evidence, identity powers and enforcement: Key enforcement powers and evidentiary tools are applied, such as identity card rules (s 6(4) item 1(a)-(b)), powers to require names, dates of birth and addresses and to direct removal of face coverings (s 6(4) item 1(r)-(s)), and the application of evidentiary certificates (s 6(4) item 1(q) and s 10(1A)(n)). Obstruction and false‑statement offences are applied (s 6(4) item 1(y)-(za)).

Practical permit types: The safety and traffic management regulation is modified to authorise three specific permit types relevant to National Land: special event parking permit (existing), construction zone permit (newly named, s 25(2) inserting fa), and national institution volunteer permit (s 25(2) inserting fb). Those categories are linked to fee-making powers (s 24(1A)) where relevant.

Criminal law overlay: Chapter 2 of the ACT Criminal Code 2002 applies to all offences against an applied ACT road transport law as that Chapter was at commencement (s 26). That sets the substantive fault elements and defences for criminal offences as they were at the time of commencement.

Collectively, the main concepts are: selective importation of ACT road and parking law into Commonwealth-administered National Land; centralisation of administration and decision-power in the Minister as administering authority; extension of parking/stopping control into public open areas on National Land; modified infringement‑notice processes emphasising payment without admission and instalment/management-plan regimes (with carve‑outs); and declarative choices about instrument status affecting parliamentary and public oversight.

Directly regulated persons: Drivers, riders and vehicle owners who enter, stop, park or otherwise use the National Land areas specified by ministerial designation or NCA agreements are immediately affected because a defined set of offences and parking/stopping rules apply there as Commonwealth law (s 6(1)-(2); s 7(1)-(2)). The applied provisions include stopping and parking rules (see s 6(4) item 4 listing many sections of the Road Rules Regulation, and s 20 expanding s 197), accessible open areas on National Land will be subject to those rules (s 20(3)). That places duties on anyone parking or stopping in those areas to observe the signs, permits and ticketing schemes that the road transport authority (and Minister) may prescribe.

Permit holders and applicants: Entities and individuals who currently seek or hold parking permits on National Land will be affected by the new explicit authorisation of permits for ticket parking spaces and open areas accessible to the public, and by the addition of permit types such as construction zone permits and national institution volunteer permits (s 24(1)-(2), s 25). Those applicants may face application fees if a fee is determined (s 24(1A)).

National Capital Authority and Commonwealth entities: The NCA is named in the instrument (definition in s 5), and is a party to the agreements contemplated in s 7(2) for management of parking. Where the NCA has agreements with other Commonwealth entities, those agreements determine where the applied law is to operate. The instrument therefore affects the NCA’s contractual and operational relationship with other Commonwealth entities concerning parking management (s 7(2)).

Minister and road transport authority: The instrument reassigns significant administrative powers to the Minister by defining administering authority and decision‑maker to mean the Minister for the purposes of the applied laws (s 8(2)). The road transport authority and parking authority functions as referenced in the ACT instruments will be exercised under the applied framework with the Minister occupying a central role; some functions may be delegated but the instrument’s definitions make the Minister the formal decision point.

Enforcement officers and authorised persons: The applied law brings into force ACT provisions giving police officers and other authorised persons powers to require identity and driver details, to ask for removal of face coverings and to rely on evidentiary certificates (s 6(4) item 1(r)-(s); item 1(q); item 1(v)). Individuals who act as authorised officers will be empowered to issue infringement notices and exercise stopping or parking enforcement on National Land under the applied provisions. The instrument also applies provisions about identity cards and the power not to be exercised until identity cards are shown (s 6(4) item 1(a)-(b)).

Organisers, businesses and contractors using National Land: Entities that organise events, run concessions, conduct construction or use National Land for commercial activity will be affected by the extension of parking controls into open accessible areas (s 20(3), s 24(1)-(2)) and the addition of a construction zone permit (s 25(2)). Those organisers may need to secure permits, comply with ticketed schemes, and face enforcement if they, their contractors or patrons breach stopping or parking rules.

Individuals and corporations facing penalties: Enforcement under the applied laws uses ACT penalty units as specified in s 27, but the instrument expressly notes that the monetary amount of a penalty unit is the ACT figure in force at commencement (s 27(2)) and provides the amounts current at commencement ($160 individual, $810 corporation). Corporations therefore face substantially larger nominal penalties per unit than individuals (note to s 27(2)).

People relying on internal review rights: The instrument preserves internal review mechanisms only as they are prescribed in the applied regulation schedules, but it excludes decisions made personally by the Minister from being “internally reviewable” (s 8(2)). That means persons wishing to challenge certain administrative decisions will need to check whether the decision is among those prescribed as internally reviewable and whether it was a decision made personally by the Minister.

Public and visitors to National Land: Because the instrument extends stopping and parking rules to open areas that are accessible to the public (s 20(3) and s 24(1)(c)), the general public and visitors using paths, grassed or landscaped areas on National Land must consider that parking offences and permit requirements may apply outside traditional carriageways. That alters the regulatory environment for everyday users of National Land.

Indirectly affected parties: Businesses in nearby ACT areas may experience behavioural spillovers. For example, drivers deterred by parking controls on National Land may park on adjacent ACT roads instead; that is a likely substitution effect though the instrument does not model it. The instrument’s provisions therefore affect a range of actors from individual drivers to institutional parking managers, and place administrative power at ministerial level.

Primary duties , compliance with stopping and parking rules: Persons on National Land where the applied road rules operate must observe stopping and parking prohibitions and directions specified in the applied parts of the Road Transport (Road Rules) Regulation 2017 and the Road Transport (Safety and Traffic Management) Regulation 2017, as modified (see s 6(4) item 4 and item 5). That includes no stopping/no parking signs, restrictions around pedestrian crossings, loading zones, taxi zones, bus zones, permit zones, shared zones, disability parking, electric vehicle parking and ticket parking schemes, together with prohibitions against obstructing access to footpaths etc (s 6(4) item 4(a)-(zb)). The instrument explicitly extends a number of these rules to "open area[s] that are accessible to the public" on National Land (s 20(1)-(3); s 24(1)(c)).

Permit and fee duties: Where the road transport authority issues a permit under s 64 as modified, permit holders may be authorised to park in permit zones, ticket parking spaces or open public areas on National Land (s 24(1)). Section 24(1A) permits the road transport authority to determine a fee for the issue of a parking permit under paragraph (1)(b) or (c) using the Act’s fee‑making process (see the modification of s 96 in s 17). Section 25 expands the types of permits that may be issued to include construction zone permits and national institution volunteer permits (s 25(2)). Those seeking to park under a permit must comply with permit terms and may be required to return permits when cancelled under s 25(1)(c) (amending s 66 and s 67 as they relate to parking permits).

Infringement notices and payment rights: The applied infringement notice framework provides that persons alleged to have committed an infringement notice offence may be served an infringement notice and have the option to pay the penalty as an alternative to prosecution (s 10(2)-(3) modifying s 22). The Offences Regulation provisions applied include rules about service of infringement notices, contents, reminder notices, extensions of time, management plans for payment by instalments, and payment by instalment provisions (s 6(4) items 1 and 3, and s 18-19). The instrument explicitly confirms that payment or inclusion in a management plan will not be taken as an admission of guilt or liability (s 15 amending s 39; s 18(1)-(2) and s 19 inserting similar text into the Offences Regulation). The required time to pay is 28 days after service, subject to extension rules (s 18(2) as to the required time).

Management plans and instalments: The applied framework allows individuals and corporations to enter into an infringement notice management plan with the administering authority for payment by instalments (s 11, s 13 modifying s 31A). Where a person has a management plan, the instrument provides that an infringement penalty for a new offence may be added to that plan (s 11-13 modifications). However, particular paragraphs and sections of the ACT Divisions dealing with management plans and waiver are excluded (s 6(4) item 1 and ss 10-13), so the complete ACT regime does not apply without those carve‑outs.

Police and authorised person powers: The instrument applies powers that allow a police officer or authorised person to require a driver or rider to disclose name, date of birth and address, to direct removal of face coverings, and to require people to disclose the identity of a driver, to the extent those provisions relate to applied offences (s 6(4) item 1(r)-(t)). It also applies identity card rules and the Power Not to be Exercised Before Identity Card Shown (s 6(4) item 1(a)-(b)). Those exercising enforcement powers must show identity cards where required by the applied provisions.

Evidentiary rights and certificates: The applied law permits use of prescribed evidentiary certificates in proceedings (s 6(4) item 1(q) and s 10(1A)(n) noting s 56). Certificates and the evidentiary provisions in Division 4.4 and s 72 are included as part of the infringement notice framework (s 10(1A)(o) and s 6(4) item 1(u)). That creates an evidentiary streamlining device for enforcement action on National Land.

Administrative decision-making and review: The instrument centralises decision‑making authority with the Minister by defining administering authority and decision‑maker as the Minister (s 8(2)). It also narrows the set of internally reviewable decisions by excluding decisions made personally by the Minister from being internally reviewable (s 8(2)). Schedule and regulation provisions from the Road Transport (General) Regulation that prescribe internally reviewable decisions apply as modified (s 6(4) item 2 and s 8(2)).

Instrument and oversight rights: Several declarations, guidelines and determinations under the applied regulations are made legislative instruments subject to the Legislation Act 2003 (Cth) architecture (ss 22-23 and s 17 modification to s 96(3)). Approvals are to be notifiable instruments (s 24). That affects parliamentary/scrutiny and legal procedural architecture for the instruments used to manage parking and traffic on National Land.

Criminal law protections: The instrument applies Chapter 2 of the Criminal Code 2002 (ACT) to offences under the applied laws as they stood at commencement (s 26). That imports fault elements and defences in that Chapter into Commonwealth law as applied to National Land, giving accused persons those statutory protections and elements.

Other duties: It is an offence not to comply with directions, obstruction or making false statements under the applied provisions (s 6(4) item 1(y)-(za)), and persons must not hinder or obstruct (s 6(4) item 1(y)). Approved forms and certificate evidence provisions are applied (s 6(4) item 1(y)-(v)), which creates duties to use particular forms where required.

Rights to contest and timing: The instrument preserves avenues to dispute liability and to seek extensions of time, the time for payment and service rules for infringement notices, and the beginning of prosecution timelines as those provisions are applied, subject to the carve‑outs and modifications (see s 10 and items in s 6(4) and the modifications in ss 11-13 and 18-19). Persons served with infringement notices have the statutory timelines and procedural options provided by the applied provisions, for example the 28‑day payment window and rules for extension (s 18(2)).

In sum, the instrument imposes duties to obey stopping and parking rules (extended to public open areas in some cases), obliges permit and fee compliance where fees are determined, subjects drivers and vehicle owners to infringement penalties enforceable as Commonwealth law on National Land, endows enforcement officers with identification and evidentiary powers, and places administrative control with the Minister while preserving some dispute and payment options for recipients of enforcement action.

Penalty unit framing and amounts: Section 27 fixes the monetary amount of a penalty unit for offences, civil penalties and pecuniary penalties in the applied ACT road transport law to the amount specified in s 133 of the Legislation Act 2001 (ACT) as it was at commencement (s 27(1)-(2)). The instrument’s notes state the amounts current at commencement: $160 for an individual and $810 for a corporation (Note 2 to s 27). Those amounts apply to offences and civil pecuniary penalties in the applied provisions. The practical effect is that corporate penalties, when expressed in penalty units converted at the corporate unit value, will be numerically larger than individual fines because the corporate penalty unit is higher.

Enforcement actors and powers: Enforcement will be exercised by police officers and authorised persons under the applied provisions. The instrument applies identity card rules and powers to require the name, date of birth and address of drivers and riders and to direct removal of things covering a person’s face where relevant to applied offences (s 6(4) item 1(a)-(b) and item 1(r)-(s)). It also applies s 60 (police or authorised person may require people to disclose identity of driver) to the extent it relates to an offence applied to National Land (s 6(4) item 1(t)). These powers enable roadside or on-site identification checks and the capacity to gather information to support enforcement.

Infringement notices and their management: The instrument imports the ACT infringement notice model for the outlined offences so that enforcement can be effected by issuing infringement notices as an alternative to prosecution (s 10 and s 6(4) item 1(d)-(h)). The Offences Regulation provisions applied include those dealing with service of notices (including electronic service), contents of notices and reminder notices, extension of time rules, payment by instalments and management plans, and cost of serving reminder notices (s 6(4) item 3(a)-(n), items o-r; ss 18-19 modifying contents and timing specifics). The applied framework includes Division 3.3AB (Effect of penalty payment etc) and Division 3.5 (Disputing liability), which structure how payment and disputes interact with prosecutions and criminal records, with specific modifications to make it explicit that payment will not be taken as an admission of guilt or liability (s 15; ss 18-19 amendments to Offences Regulation).

Collection tools and evidentiary measures: The applied law gives enforceable evidentiary functions to certificate evidence and other evidentiary provisions (s 6(4) item 1(q) and item 1(v); s 10(1A)(o) noting s 56 and s 72). Those devices enable the administering authority to use declaratory certificates as evidence of matters like ownership, registration or service of notices in enforcement proceedings.

Instrument status altering oversight and challenge routes: The instrument designates declarations and parking authority guidelines as legislative instruments and approvals as notifiable instruments (ss 22-24). That affects the parliamentary and administrative oversight mechanisms and could alter avenues for legal challenges or procedural scrutiny depending on how the legislative instruments are made, registered and disallowance procedures under the Legislation Act interact with the Commonwealth scheme.

Payment without admission and prosecution interaction: The instrument modifies the Act and Offences Regulation to insert express statements that payment or being subject to a management plan is not an admission of guilt or liability (s 15 and ss 18-19). It also modifies the "time for beginning prosecution for infringement notice offence" provision to align with the infringement notice framework being the operative concept on National Land (s 10(3) and s 6(4) item 1(j)). Reminder notice timing and service are adjusted (s 18 includes revised definition of the "required time" for payment in the Offences Regulation, set to 28 days with further detail).

Practical enforcement on open areas: By extending prohibitions and permit regimes to open areas accessible to the public on National Land (s 20(3) and s 24(1)(c)), enforcement can target vehicles stopped or parked on non-road surfaces such as grassed or paved landscapes. That expands the enforcement domain beyond carriageway pavement into landscaped or pedestrian areas on National Land.

Sanctions for obstruction and false statements: The applied provisions include offences for hindering or obstructing and for making false or misleading statements (s 6(4) item 1(y)-(za)), which supply enforcement recourse when persons interfere with authorised persons or provide false information during enforcement interactions.

Who decides enforcement and remedy: The Minister is defined as administering authority and decision-maker (s 8(2)). In practice that places initiation and some administrative decisions about infringement notice management plans, waiver processes and enforcement settings under ministerial control. Internal review is preserved only for prescribed decisions other than those made personally by the Minister (s 8(2)). That affects how and where enforcement decisions may be administratively challenged.

Limitations and carve‑outs affecting enforcement: The instrument applies enforcement provisions selectively and removes or excludes particular subsections and sections from the ACT law as applied (s 6(4) item 1 and others). For example, section 24 is applied other than subsection (3); various parts of Divisions 3.2A and 3.2B and Division 3.3AA have carve-outs. Those exclusions may limit, alter or change remedies available to respondents in infringement notice proceedings on National Land compared with the full ACT regime.

In summary, enforcement will be carried out under the applied ACT rules adapted to National Land, with infringement notices and reminder notices as operative collection mechanisms, use of evidentiary certificates and identity powers to support enforcement, administrative control and decision-making vested in the Minister, and penalty amounts anchored to ACT penalty units as at commencement.

Relationship to the Ordinance: This instrument is made under the Australian Capital Territory National Land (Road Transport) Ordinance 2025 and explicitly implements the Ordinance’s mechanism for applying ACT road transport laws as Commonwealth law on National Land (ss 2-4 and the simplified outline in s 4). Sections 6-9 are drafted expressly "for the purposes of subsection 8(1) of the Ordinance" or similar cross-references, indicating that the Ordinance is the primary enabling statute. The instrument's operation is therefore derivative and contingent on the Ordinance’s authorisation.

ACT law as source material: The instrument imports ACT statutes and regulations by reference (s 6(4) table), applying them "as in force at the time this instrument commences" (s 6(2)). That creates a static import at commencement for the provisions listed. Subsequent changes to the parent ACT instruments after commencement are not automatically imported unless the instrument or Ordinance provides for that; s 6(2) fixes the applied versions as at commencement.

Commonwealth legislative instrument architecture: The instrument changes the legal form of certain ACT regulatory instruments by declaring them to be legislative instruments or notifiable instruments for the purposes of the Legislation Act 2003 (Cth) (ss 17, 22-24, which amend the status of determinations, declarations, parking authority guidelines and approvals). That shifts the instrument oversight and tabling obligations into Commonwealth legislative instrument processes and connects these regulatory actions to Commonwealth procedural review and parliamentary oversight mechanisms.

Criminal law overlay: By applying Chapter 2 of the Criminal Code 2002 (ACT) to offences against applied road transport laws (s 26), the instrument links ACT criminal fault elements and defences to Commonwealth law as it applies on National Land. That choice integrates the ACT criminal law approach into the Commonwealth enforcement context for the applied offences.

Interaction with the Legislation Act 2001 (ACT) and penalty units: The penalty unit value for applied offences is fixed to the ACT penalty unit amount under the Legislation Act 2001 (ACT) at commencement (s 27). That imports an ACT monetary scale into the Commonwealth enforcement framework on National Land. The instrument notes the amounts current at commencement (s 27 Note 2) but also ties future penalty unit calculations to the ACT regime as it stood at commencement, which can influence cross‑jurisdictional comparisons.

Relationship with NCA agreements and ACT planning law: The areas of National Land to which the applied laws attach are those designated in writing by the Minister under the Australian Capital Territory (Planning and Land Management) Act 1988 and areas subject to agreements between the NCA and other Commonwealth entities for parking management (s 7(1)-(2)). That establishes an operational interface between planning/land designation law, the NCA’s administrative arrangements, and the applied road transport law. The map in Schedule 1 is illustrative only (s 7(3)), so the practical boundaries will be determined by ministerial designation and interagency agreements, not the map alone.

Delegation and review under administrative law: The instrument defines the Minister as administering authority and decision‑maker for the applied laws (s 8(2)). Administrative decisions by the Minister or under delegated authority will fall within Commonwealth administrative law frameworks (omitted from the instrument’s text but operating generally), but the instrument removes internal review where decisions are made personally by the Minister (s 8(2) excludes such decisions from being "internally reviewable decisions"). That alters the interplay between internal administrative review and external merits or judicial review channels; affected persons will need to check which decisions remain internally reviewable (as prescribed in the applied regulation schedules) and which do not.

Territorial overlap and substitution effects with ACT law: While the instrument applies ACT law as Commonwealth law on specified National Land, the ACT remains the source of the rules. There will be a demarcation between Commonwealth‑applied ACT law on specified National Land and ACT enforcement on other ACT roads. This may create substitution effects (drivers parking on adjacent ACT roads to avoid Commonwealth enforcement on National Land, regulatory arbitrage between regimes) though the instrument itself does not model those effects; the structural interaction is that identical or similar rules may operate under two different legal regimes depending on location.

Statutory instruments and parliamentary oversight: Because some determinations and guidelines are declared legislative instruments and approvals are notifiable instruments under the Legislation Act 2003 (Cth) (ss 22-24), Parliament’s disallowance and tabling procedures for legislative instruments will be available for those elements, linking Commonwealth scrutiny mechanisms with ACT regulatory content being applied on National Land.

Overall, the instrument is an inter‑jurisdictional application of ACT road and parking law into Commonwealth jurisdiction over National Land, aligning administrative status and oversight to Commonwealth instrument frameworks, importing ACT criminal law elements and penalty unit valuation at commencement, and situating ministerial designations and NCA agreements as the spatial triggers for application.

Instrument origin and dates: The instrument is dated 24 February 2025 and states it commenced immediately after the commencement of the Australian Capital Territory National Land (Road Transport) Ordinance 2025. The Ordinance’s commencement date is noted as 1 April 2025 (s 2 and the commencement note). The instrument contains commencement notes repeated at various points, confirming the operative date (for example, notes at s 6(2), s 26 and s 27).

Initial instrument content: The instrument’s body sets out the initial schedule of applied ACT road transport laws and the precise list of provisions applied (s 6(4) and the full table). It also sets out a suite of detailed modifications to those applied laws across Divisions B-E of Division 2 in Part 2. The Schedule 1 map is included and described as illustrative, current as of 18 February 2025 (Schedule 1 note).

No amendments recorded in the text: The instrument as supplied contains no later amending items or schedules. There is no recorded history of amendments within the instrument. The text itself constitutes the original making instrument and does not include a section further amending prior instruments; rather, it applies and modifies ACT instruments for the particular Commonwealth purpose.

Subsidiary instrument status and future amendment pathways: The instrument modifies the applied ACT laws by altering how particular provisions operate on National Land and by changing the legislative instrument status of certain decisions (ss 17, 22-24). Future amendments to the applied arrangements could occur by either (a) amendment to this instrument (a Commonwealth instrument under the Ordinance), (b) changes to the parent ACT statutes and regulations which would not automatically update the applied versions because s 6(2) applies the laws "as in force at the time this instrument commences", or (c) amendments to the Ordinance itself that change the architecture for applied laws. Because s 6(2) fixes the applied versions at commencement, subsequent ACT amendments will not automatically alter the Commonwealth‑applied texts unless the Commonwealth issues a fresh instrument or the Ordinance provides otherwise.

Map updates and designation processes: The instrument makes clear that the map in Schedule 1 is illustrative only and not determinative of the areas to which the applied laws attach (s 7(3) and Schedule 1(1)-(2)). The statutory trigger for spatial application is ministerial designation under the relevant planning Act and agreements with the NCA (s 7(1)-(2)). Therefore, the practical boundaries can be amended by updates to ministerial designations in writing or by changed agreements between the NCA and other Commonwealth entities rather than by amending the map within this instrument.

Penalty unit anchoring at commencement: Section 27 anchors penalty unit dollar values to the ACT Legislation Act’s figures as at commencement. That feature means any later change in ACT penalty unit amounts will not affect the applied laws unless a future Commonwealth instrument changes the anchor. The instrument records the values current at commencement ($160 individual, $810 corporation) in the notes to s 27, producing a fixed monetary baseline for enforcement until the Commonwealth legislates otherwise.

Likely amendment vectors: The plausible amendment routes are: (1) Ministerial administrative adjustments (for example, new ministerial designations of National Land under s 7(1)), (2) new agreements between the NCA and Commonwealth entities under s 7(2), and (3) formal amendments to this instrument to expand or contract the listed applied provisions, alter exclusions, or change the legislative instrument status of particular decisions. Because the instrument is a Commonwealth instrument under the Ordinance, those future changes will follow Commonwealth legislative and administrative procedures, including tabling and disallowance where declaratory elements are legislative instruments.

In sum, the instrument is newly made and in force from 1 April 2025 with its applied‑law content fixed to the versions at that date; there are no later amendments recorded in the text supplied. Spatial changes will occur through ministerial designations and inter‑agency agreements rather than merely through the Schedule 1 map.

No judicial decisions or litigation are recorded in the instrument itself. The text does not reference any court or tribunal determinations, and it names no cases. The instrument is an enabling and operative administrative rule; any litigation that might arise would do so after its operation and would concern issues such as the legal validity of decision‑making under the instrument, the designation of National Land areas, administrative reviews of enforcement or permit decisions, or substantive criminal and regulatory prosecutions under the applied provisions.

Potential litigation nodes implied by the instrument (based on its terms): The document itself does not provide case law, but the structure of the instrument indicates potential areas where disputes might arise once it is operational, including the following themes grounded in the instrument’s text:

• Spatial boundaries and designation: Because s 7(3) makes the Schedule 1 map illustrative only and s 7(1) says areas are those designated in writing by the Minister under the ACT planning Act and s 7(2) includes areas subject to NCA agreements, litigants could contest whether a particular parcel of land is within the area that the Minister intended to designate or within the scope of an NCA agreement. Challenges could focus on whether the Minister’s written designation properly followed any statutory requirements in the planning Act or whether the agreements referenced meet the legal test for delegating parking management to another entity. The instrument does not itself set out the designation instruments, so questions about the content and form of such ministerial designations could be litigated.

• Administrative decision and internal review limits: The instrument defines the Minister as the administering authority and decision‑maker (s 8(2)) and excludes ministerial personal decisions from being internally reviewable (s 8(2)). That raises potential litigation about whether a particular decision is a "decision made personally by the Minister" and thus excluded from internal review, or whether it is a delegated decision subject to prescribed internal review processes. Disputes could arise over the availability of internal review and whether procedural fairness obligations have been met.

• Application and meaning of the applied provisions: Litigants may seek judicial clarification of how the modified ACT provisions operate when applied as Commonwealth law on National Land, especially where the instrument carves out subsections and paragraphs from Divisions (e.g. exclusion of particular paragraphs in Division 3.2A and Div 3.2B). Disputes may therefore concern interpretation of which parts of the ACT regime apply and how the modifications should be read together.

• Enforcement practices on open areas: Given the extension of stopping and parking offences to "open area[s] that are accessible to the public" (s 20(3)) and the authorisation of parking permits in those open areas (s 24(1)(c)), factual disputes over what constitutes an "open area that is accessible to the public" could be litigated. The instrument provides a definition at s 197(3) (inserted by s 20(2)) but factual application could lead to legal argument in enforcement or judicial review proceedings.

• Penalty unit conversion and corporate penalties: Since s 27 anchors penalty unit values to ACT figures at commencement and the instrument notes the dollar amounts current at commencement, defendants may challenge the appropriateness or legality of penalty conversions in particular cases. That is speculative but follows from the instrument’s decision to adopt ACT monetary units for Commonwealth enforcement.

Because the instrument is newly in force and no cases are mentioned in the text, these are potential future litigation themes rather than a litigation history. Any actual litigation will need to be located in subsequent court or tribunal records; the instrument itself provides the legal architecture likely to generate disputes in the areas described.

Map is illustrative not determinative: Schedule 1 provides a map illustrating areas of National Land, but s 7(3) explicitly states the map is illustrative and not determinative. Consequently, practitioners cannot rely on the Schedule’s map alone to conclude that a particular spot on the ground is subject to the applied laws; instead they must obtain the ministerial designation in writing or the relevant NCA agreement referenced in s 7(1)-(2). Practically this means that until the ministerial designation or NCA agreement is published or made available to stakeholders, there will be uncertainty about whether a location is within the applied regime.

Minister as administering authority and decision‑maker: Section 8(2) defines administering authority and decision‑maker to mean the Minister. That centralises formal responsibility and has two practical consequences. First, many administrative choices and determinations will be traceable to ministerial officeholders rather than an agency delegated official. Second, s 8(2) excludes decisions made personally by the Minister from being "internally reviewable decisions". The practical effect is that if a matter is determined personally by the Minister, the internal review path preserved by the applied regulation schedule will not be available; an affected person will need to check other remedies such as external merits review (if available) or judicial review. Practitioners must therefore ask whether relevant decisions were made personally by the Minister or by delegate to determine reviewability.

Selective application and carve‑outs: The instrument applies many ACT provisions but excludes particular subsections, paragraphs and sections. For example, the instrument applies s 24 (Infringement notices) other than subsection (3); applies Division 3.2A other than paragraph 31A(4)(c), subsection 31B(4) and ss 31C-31D; applies Division 3.2B other than certain paragraphs and sections (s 6(4) item 1). These carve‑outs mean that the ACT infringement regime will not operate identically on National Land. Practitioners must review the instrument’s table line by line and not assume the entire ACT regime applies.

Payment not admission of guilt: The instrument expressly inserts language that payment under an infringement notice will not be taken as admission of guilt or liability (s 15 and ss 18-19). That protects persons paying penalties from certain consequences of implied admissions, but will not necessarily prevent enforcement authorities or others from treating the payment in other administrative contexts. The protection is statutory and limited to the effect stated in the modified provisions; counsel should check precisely which downstream consequences are excluded.

Open areas now regulated: The insertion of "open area that is accessible to the public" into s 197 and the authorisation of parking permits and fees for those areas (ss 20 and 24) mean that stopping and parking prohibitions will apply to non‑carriageway landscape areas on National Land where they are accessible to the public. This can catch event organisers, contractors and volunteers who may have previously regarded these areas as outside traffic regulation. Questions about whether a particular space is an "open area that is accessible to the public" will have practical enforcement significance (s 197(3) provides a non‑exhaustive definition).

Fee‑making and s 96 carve‑outs: Section 24(1A) allows a fee to be determined under s 96 of the Road Transport (General) Act 1999 for certain parking permits. However, in the applied provisions for the Road Transport (General) Act in the table at s 6(4) the instrument applies section 96 other than subsections (4) and (5) (s 6(4) item 1(x) and s 17 modifying s 96(3)). The text of the instrument does not reproduce ss 96(4)-(5) (they are excluded), so practitioners must check what those excluded subsections would have done in the ACT context and account for their absence on National Land. The exclusion may alter procedural or consultation requirements for fee‑making; the instrument does not itself state why those subsections are excluded.

Corporate penalty unit disparity: Because s 27 anchors penalty units to ACT values and the instrument notes $810 per corporate penalty unit at commencement (s 27 note 2), corporate fines calculated in penalty units will yield larger dollar fines than for individuals. Entities should be aware of the conversion and the higher monetary exposure per unit.

Instrument status and parliamentary oversight: The instrument declares certain declarations and guidelines to be legislative instruments and approvals to be notifiable instruments (ss 22-24). That creates obligations for tabling and possible disallowance under Commonwealth legislative instrument architecture. Users should track the making of those instruments and any attendant regulatory impact statements or tabling processes.

Evidence certificates and service methods: The applied provisions include mechanisms for certificate evidence and for service of infringement notices by various means (s 6(4) items 1(q), 1(v) and 3(c)-(f)). Certificate evidence and electronic service methods can expedite enforcement, but raise procedural challenges for respondents who may be less likely to see electronic notices. Practitioners should monitor service methods used in practice and the issuing authority’s adherence to the applied service rules (for example s 12B on electronic service is applied).

Parking scheme fragmentation and substitution effects: The instrument allows ticket parking schemes, but excludes some parking‑machine misuse and interference offences (see s 6(4) item 4(x) excluding s 213Q-S). The applied scheme thus creates a specific configuration of ticket schemes, but with carved-out offences that might affect enforcement strategy. Also, enforcement on National Land may shift parking demand to adjacent ACT streets; the instrument itself does not manage that spillover.

Limited litigation history: As noted earlier, the instrument contains no litigation history. That means there is no existing body of case law on how courts will interpret the modified provisions on National Land, increasing legal uncertainty initially.

In short, the main practical pitfalls are: not assuming the Schedule map is definitive; overlooking ministerial control and the narrow internal review availability; missing subtle carve‑outs in the applied provisions; under‑estimating the extension of regulation to open public areas; and failing to account for the penalty unit conversion and the changed legislative instrument status of determinations and guidelines.

Identify the spatial scope first: The applied law only operates on the areas of National Land designated in writing by the Minister under the relevant planning Act, and on areas covered by NCA‑Commonwealth agreements for parking (s 7(1)-(2)). Compliance starts by obtaining the authoritative designation and any relevant NCA agreements. Do not rely solely on the Schedule 1 map, which is illustrative only (s 7(3)). Organisations or individuals using National Land (event organisers, contractors, institutions) should request or obtain from the Minister’s office or the NCA a current list or copy of the designations and agreements that determine where the applied law operates.

Audit activities against the applied provisions: Review the table at s 6(4) line‑by‑line to identify which ACT provisions apply to the land in question and, critically, which subsections and paragraphs are excluded. The instrument applies selected sections from several ACT statutes and regulations, but with specific carve‑outs. Prepare a checklist of applicable stopping, parking and enforcement provisions applicable to your location and activities (e.g., s 167-203B stopping/parking rules under the Road Rules Regulation as applied in s 6(4) item 4).

Permits and planning for open areas: If your activities involve parking, loading or vehicle presence in open areas that are accessible to the public (as defined in the inserted s 197(3)), plan to apply for the relevant parking permits. The road transport authority may now issue permits for ticket parking spaces and open public areas (s 24(1)(b)-(c)), including construction zone permits and national institution volunteer permits (s 25(2)). Check whether a fee has been determined for the permit type you need; s 24(1A) authorises a fee determined under s 96 for certain permit types. Ensure permit applications are complete, comply with any notifiable or legislative instrument requirements and retain proof of any permits issued.

Engage proactively with the Minister/NCA: Because the administering authority and decision‑maker are defined to be the Minister (s 8(2)), early engagement with the Minister’s office and the NCA about intended activities, resources, permit regimes and enforcement expectations is sensible. Where practical, negotiate inclusion of designated areas or management details in NCA agreements to provide certainty about the applicable regime.

Comply with enforcement and identity requirements: Ensure that drivers, riders and staff understand that authorised persons and police have powers to require names, dates of birth and addresses, and may direct removal of face coverings where relevant (s 6(4) item 1(r)-(s)). Train staff to comply with such directions and retain identity information where lawful and appropriate. If you employ or contract authorised parking or enforcement officers, ensure they carry and show appropriate identity cards where required (s 6(4) item 1(a)-(b)).

Develop a process for infringement notices and disputes: The applied framework provides specific timelines and management options. Note the required time to pay an infringement penalty is 28 days after service of the infringement notice unless extended under the Act’s extension provisions (s 18(2)). If receiving multiple infringement notices, consider whether entering an infringement notice management plan with the administering authority is appropriate; the instrument modifies the management plan provisions to allow instalment payment and to add new penalties to existing plans where applicable (ss 11-13). Prepare to use the available dispute mechanisms and ensure any representations or applications for extension comply with the content requirements in the Offences Regulation (s 6(4) item 3 and ss 18-19).

Record‑keeping and evidentiary readiness: Because the applied law uses certificate evidence and prescribed forms (s 6(4) item 1(q) and item 1(y)), keep meticulous records that can be used to rebut or respond to certificates or infringement notices. Maintain logs of vehicle movements, parking authorisations, permit holders, ticketing transactions, photographic evidence, and communications with enforcement officers. When contesting notices, ensure evidence addresses the matters that the certificate purports to establish.

Check fee and penalty exposure: Because penalty units are fixed to ACT values at commencement (s 27) and the instrument records the dollar equivalents current at commencement ($160 individual, $810 corporate), conduct a compliance cost assessment. Corporations face large monetary exposure per penalty unit. Budget for possible permit fees if a fee has been determined under s 96 for certain permit types (s 24(1A)), and confirm whether the fee has been actually made as a legislative instrument by the road transport authority under the modified s 96.

Monitor legislative instruments, guidelines and approvals: The instrument makes certain declarations and parking authority guidelines legislative instruments and approvals notifiable instruments (ss 22-24). Track the promulgation and tabling of such instruments because they may set the operational detail (e.g., parking schemes, fee schedules, permit terms). Subscribing to the Commonwealth register of legislative instruments and the NCA’s publications is advisable.

Train staff and signage: Update operational policies to reflect the extended reach of stopping/parking prohibitions into open public areas on National Land. Ensure signage is compliant with the applied rules and clearly indicates permit zones, fee zones and ticketing requirements. Train staff, security and contractors on enforcement interaction protocols, noting powers to require identity, removal of coverings and the consequences of obstruction or false statements under applied provisions (s 6(4) item 1(y)-(za)).

Plan for contestation and review pathways: For disputes about administrative decisions, identify whether the decision in question is a prescribed internally reviewable decision under the applied regulation schedules (s 8(2)) and whether it was made personally by the Minister (in which case internal review is excluded). If internal review is not available, consider external merits or judicial review options. Early legal advice is advisable where contested decisions involve permit refusals, cancellations or enforcement policy.

Engage in stakeholder consultation where appropriate: If you represent a business or institution likely to be affected, engage with the Minister’s office, NCA, and road transport authority early about parking scheme design, permit categories (including construction zone or volunteer permits), and fee structures. Because the instrument creates the potential for permit and fee regimes to materially affect operations, early negotiation may secure more predictable administrative treatment.

Stay alert to amendments: Although the applied ACT laws are fixed "as in force at the time this instrument commences" (s 6(2)), the Commonwealth can amend the instrument or make new legislative instruments under the Legislation Act regime. Monitor changes to the Ordinance‑based instruments, the Minister’s designations, and NCA agreements.

In short, compliance requires early and specific spatial identification of where the applied laws operate, granular review of the applied provisions and carve‑outs, proactive permit and fee management for activities in open public areas on National Land, careful record‑keeping to meet evidentiary challenges, and engagement with the Minister/NCA and legal advisers to manage administrative review and enforcement risk.
