49 Steps before giving termination notice
(1) The Minister must not terminate a lease under subsection 48(1) unless: (a) the notices required by subsections (2) and (3) have been given; and (b) the Minister has considered the reasons (if any) submitted by the lessee in accordance with paragraph (2)(c). (2) The Minister must give a notice in writing to the lessee: (a) specifying the contraventions of the lease in respect of which the notice is given; and (b) stating that the Minister is considering terminating the lease; and (c) inviting the lessee to submit to the Minister written reasons, within the period ending not later than 15 business days after the lessee is given the notice, why the lessee considers that the lease should not be terminated. (3) As soon as reasonably practicable after the Minister gives a notice to a lessee under subsection (2), the Minister must give a copy of the notice to any person with a registered interest in the lease or in the land comprised in the lease.
