#### 21 Acting non‑executive Directors (1) If a non‑executive Director is, or is expected to be, absent from duty or from Australia or, for any other reason, unable to perform the functions of his or her office, the Governor‑General may appoint a person to act as a non‑executive Director during the period of the absence or inability. > Note: For rules that apply to acting appointments, see sections 33AB and 33A of the Acts Interpretation Act 1901. (2) The Governor‑General may: (a) determine the terms and conditions of appointment, excluding remuneration and allowances, of a person acting as a non‑executive Director; and (b) terminate such an appointment at any time. (3) A person acting as a non‑executive Director shall be paid the same remuneration and allowances as are payable to a non‑executive Director. (7) In this section, non‑executive Director does not include the staff‑elected Director.
