95 Secretary’s power to waive overpayment debt

(1) The Secretary may, on behalf of the Commonwealth, waive the Commonwealth’s right to recover the whole or part of an overpayment debt from a debtor only in the circumstances described in section 96 or 97. (2) A waiver takes effect on the date of effect specified in the waiver (which may be earlier or later than the day the decision to waive is made).

Note: If the Secretary waives the Commonwealth’s right to recover all or part of a debt, this is a permanent bar to recovery of the debt or part of the debt—the debt or part of the debt effectively ceases to exist.
