Australia New Zealand Food Standards Code – Standard 1.6.1 – Microbiological limits in food

• Food businesses producing, packaging or marketing foods listed in S27,4. Any operator whose product appears in the S27,4 table is directly affected because the lot acceptance criteria (n, c, m, M) apply to their lots when tested. 1. Confirm product scope in S27,4. For every product or lot, verify whether the food is listed in the table to section S27,4. The S27,4 table supplies the Column 2 sample size n, Column 3 allowable count c, Column 4 threshold m, and Column 5 maximum M that determine whether a lot is unacceptable under s 1.6.1,2. Do not assume generic values; consult the specific table entry for the food.

2. Prepare for the prescribed sampling plan. Where a lot is listed, plan to take the number of sample units equal to n as required by s 1.6.1,3(2). Maintain documented sampling protocols that replicate how the sample units were taken, stored and transported. If an authorised officer arrives to sample, be ready to document chain-of-custody and to preserve sealed retail packages intact.

3. Understand authorised officer discretion. Where there is a consumer complaint or suspected food poisoning incident, be prepared for an authorised officer to take fewer sample units or smaller samples per s 1.6.1,3(3). Ensure records and product retention practices account for the possibility of reduced sampling and that any internal investigations mirror the statutory sampling practices.

4. Preserve sample integrity. Do not divide samples intended for submission, per s 1.6.1,3(4)(a). If samples consist of sealed packages ordinarily sold by retail, submit them unopened and intact as required by s 1.6.1,3(4)(b). 5. Use prescribed laboratory methods and the correct editions. For products other than packaged water, packaged ice or mineral water, ensure laboratories use the relevant method prescribed by Australian Standard AS5013, or a method referenced by AS5013 and prescribed by ISO, or an equivalent method determined via AS/NZS 4659 or ISO 16140.2:2016 as allowed by s 1.6.1,3(5)(a). For packaged water, ice and mineral water, use AS/NZS 4276 under s 1.6.1,3(5)(b). Confirm the edition of each referenced Standard that was in force at commencement as required by s 1.6.1,3(6), and document method versions employed in reports.

6. Implement Listeria controls and validation. For ready-to-eat foods, determine whether growth of Listeria monocytogenes will occur using the objective tests in s 1.6.1,4(1). That requires measuring pH and water activity, confirming refrigerated shelf life, recording freezing status where applicable, or conducting a validation showing Listeria will not increase by more than 0.5 log cfu/g over the food’s stated shelf life. If the product does not receive a listericidal process, determine whether it qualifies for the deeming provision in s 1.6.1,4(2) by demonstrating Listeria will not exceed 100 cfu/g within expected shelf life. For ready-to-eat processed finfish and fresh cut and packaged horticultural produce, note the specific inclusion in s 1.6.1,4(3).

7. Maintain records and evidence. Keep documented evidence of how sample units were taken (including dates, lot identifiers and chain-of-custody), laboratory method versions and reports, pH and water activity measurements, shelf-life determinations, and any validation studies. Such records will be essential where a determination under s 1.6.1,2 leads to enforcement, or where an authorised officer reduces sample numbers under s 1.6.1,3(3).

8. Coordinate with accredited laboratories. Engage laboratories that can demonstrate capability in the prescribed methods and familiarity with the edition of the standards frozen at the Standard’s commencement. Confirm accreditation, method validation records, and the laboratory’s quality control procedures in writing.

9. Update compliance practice when S27,4 or referenced standards change. Because the Standard depends on the S27,4 table and specific named external standards, check for amendments to S27,4 or legislative amendments to the Code. Also monitor whether the Code has been amended to update references to newer editions of AS5013, AS/NZS 4659 or ISO 16140.2 because s 1.6.1,3(6) fixes the applicable editions to those in force at commencement unless the Code is amended.

10. Prepare internal incident response plans. Given the authorised officer discretion to take fewer samples in complaint or suspected poisoning events (s 1.6.1,3(3)), businesses should have incident response plans that preserve evidence, retain intact retail packages where possible, and enable rapid validation testing and coordination with public health authorities.

Following these steps aligns operational practice with the Standard’s technical prescriptions and creates an auditable trail that supports compliance and defences against enforcement action arising from microbiological findings.
