Australia New Zealand Food Standards Code – Standard 1.4.2 – Agvet chemicals

The Standard establishes several tightly defined concepts and relationships that determine legal permissibility of chemical residues in food for sale. These concepts are explicitly defined in s 1.4.2,3 and used throughout ss 1.4.2,4 and 1.4.2,5.

• Agvet chemical: The term links back to the Agvet Code , that is, an agricultural chemical product or a veterinary chemical product within the meaning of the Agvet Code (s 1.4.2,3 Note). The Standard therefore operates only in relation to chemicals classified under the Agvet Code (the instrument itself is not the Agvet Code).

• Permitted residue: A chemical is a permitted residue for the purposes of this Standard only if it is identified in Schedule 20 (for MRLs) or Schedule 21 (for ERLs) as a permitted residue in relation to that agvet chemical (s 1.4.2,3(1) and s 1.4.2,2).

• Maximum residue limit (MRL): For each agvet chemical and specified food, Schedule 20 sets the MRL, the numeric upper limit of the permitted residue in that food (s 1.4.2,3; s 1.4.2,4(2)). The Standard explains that MRLs have been determined by reference to Good Agricultural Practice (GAP) and a public health risk assessment, but that statement is presented as a Note explaining the basis for the MRLs rather than a procedural requirement in the operative provisions (s 1.4.2,2 Note).

• Extraneous residue limit (ERL): Schedule 21 contains ERLs which are permitted residues that may be present when the residue arises from environmental sources rather than from direct or indirect use of an agvet chemical on food. An ERL only applies where that environmental-origin condition is satisfied (s 1.4.2,3; s 1.4.2,5(1)(d) and s 1.4.2,5(2)).

• Calculation for multi-ingredient foods: Where a food for sale contains two or more ingredients and one or more of those ingredients are listed in the relevant Schedule, the Standard requires calculation of an aggregate MRL using an explicit weight-weighted formula. The formula aggregates the contributions of each listed ingredient (MRL(j) times Weight(j)) and divides by the total Weight to produce an overall permissible amount for the composite food (s 1.4.2,4(3) and s 1.4.2,5(3)). The Standard defines the variables used in the formula (N, Weight(j), Weight and MRL(j)).

• Portion of the commodity for analysis: When calculating the amount of a permitted residue in a food, only the amount in the portion of the commodity specified in Schedule 22 is to be calculated (s 1.4.2,3(2)(a)). This ties the analytical and compliance measurement to a schedule that specifies the edible or sampled portion applicable to the MRL.

• Processed foods: If a maximum amount of a permitted residue is not specified for a processed food, the same maximum amount applies to both the processed and the unprocessed food (s 1.4.2,3(3)). This creates a default rule that processed derivatives inherit the parent commodity’s MRL unless a specific processed-food MRL is set.

Collectively, these concepts create a technical compliance framework in which permissibility is a function of (a) listing in the relevant schedule, (b) measuring the residue in the specified portion of the commodity, (c) comparing the measured amount against a single-ingredient MRL or a calculated composite MRL for multi-ingredient foods, and (d) in the case of ERLs, verifying the residue’s environmental origin (ss 1.4.2,3 to 1.4.2,5). The Standard therefore allocates decision-making to the schedules and to the act of measurement and calculation rather than to discretionary adjudication within the operative clauses.

This Standard affects the following actors and activities as shown or implied by its operative text.

• Food for sale: The permissibility regime applies to "a food for sale" , the operative wording in ss 1.4.2,4(1) and 1.4.2,5(1) expressly governs when a food for sale may contain a permitted residue. The Standard therefore impacts anyone placing food for sale into the Australian market.

• Producers and users of agvet chemicals: The definition of agvet chemical links to the Agvet Code (s 1.4.2,3 Note). Producers who apply agricultural or veterinary chemical products to commodities destined for human food must operate within the MRLs listed in Schedule 20 and, where applicable, be mindful that some residues may only be treated as permitted ERLs if they arose from environmental sources (s 1.4.2,2; s 1.4.2,5(1)(d)).

• Food processors and manufacturers of multi-ingredient products: The Standard prescribes how to calculate the permissible residue in multi-ingredient foods using the weight-weighted formula (s 1.4.2,4(3); s 1.4.2,5(3)). Food manufacturers combining listed and unlisted ingredients must calculate the aggregate MRL based on the weight of the listed ingredients and the total weight of the composite food to determine compliance.

• Importers and traders operating in Australia: The Standard applies in Australia only (s 1.4.2,1 Note 3). Imported foods offered for sale in Australia will be assessed against the MRLs and ERLs in Schedule 20 and Schedule 21, and will therefore involve importers and customs-facing traders in compliance decisions.

• Analytical laboratories and regulators: Compliance requires measurement of residues in the portion specified in Schedule 22 (s 1.4.2,3(2)(a)). Laboratories analysing foods for sale must therefore sample and measure the portion identified in Schedule 22 and report amounts against the numeric limits or computed composite MRLs.

• Officials administering the Code and related Acts: The Standard is made under the Food Standards Australia New Zealand Act 1991 (Cth) and is identified as the MRL Standard for that Act (s 1.4.2,1 Notes). The application Acts render food unsuitable if it contains certain foreign chemicals unless permitted by the Code (Note 4). Regulatory authorities that apply the Code will be the decision-makers when testing results indicate residues above or below permitted limits.

Stakeholders not specifically enumerated in the Standard but implicated functionally include retailers, who must ensure food for sale complies (s 1.4.2,4(1)), and advisers (e.g., agronomists, veterinarians, compliance consultants) who assist producers to meet listed MRLs. The Standard’s focus on Schedules 20 to 22 means that the most immediate effect on any given actor depends on whether the particular agvet chemical and food of interest are listed and how the specified portion and any processed-food exceptions are drafted in the Schedules (s 1.4.2,3(4); s 1.4.2,3(3)).

This Standard creates a set of affirmative permissions and correlative duties built around the schedules. The text specifies what is permitted and the measurement rules to determine compliance; it does not itself articulate criminal sanctions or administrative penalties (the application Acts do that outside the Standard). The operative duties and rights are as follows.

Rights (permission to contain residues)

• A food for sale may contain a permitted residue of an agvet chemical if the agvet chemical is listed in Schedule 20 (MRL) and the food is listed in relation to that agvet chemical in Schedule 20, and the amount of the permitted residue complies with the relevant single-ingredient MRL or the multi-ingredient calculation (s 1.4.2,4(1) to (3)).
• A food for sale may contain a permitted residue of an agvet chemical listed in Schedule 21 if the food is listed in relation to that agvet chemical in Schedule 21, the amount complies with the relevant limit or the multi-ingredient calculation, and the presence of the permitted residue arose from environmental sources rather than from direct or indirect use of an agvet chemical on food (s 1.4.2,5(1)(a)-(d); s 1.4.2,5(2)-(3)).

Duties (conditions to maintain those rights)

• Duty to consult the Schedules: The right to contain a residue is conditional on the chemical and the food being correctly listed in the relevant schedule (s 1.4.2,4(1)(a)-(b); s 1.4.2,5(1)(a)-(b)). The operative duty is to ensure listing status before asserting permissibility.
• Duty to measure in the specified portion: When calculating the amount of a permitted residue, only the portion of the commodity specified in Schedule 22 is to be calculated (s 1.4.2,3(2)(a)). Conformity with this sampling/measurement rule is a precondition to any numeric comparison.
• Duty to apply the multi-ingredient formula where applicable: If the food has two or more ingredients and one or more of them are listed in the relevant schedule, the overall amount must be calculated by weighting each listed ingredient’s MRL by its weight in the composite and dividing by the total weight (s 1.4.2,4(3); s 1.4.2,5(3)). Producers and manufacturers must follow the formula where it applies.
• Duty as to origin for ERLs: For residues falling under Schedule 21, the presence of the residue must have arisen from environmental sources and not from direct or indirect use of an agvet chemical on food (s 1.4.2,5(1)(d)). This places an evidential or factual nexus requirement on the source of the residue.
• Duty to sum multi-chemical residues: If the permitted residue consists of more than one chemical compound, the amount of all such chemicals present must be calculated (s 1.4.2,3(2)(b)).

Corollary code effect

• The Standard sits within the Code and interacts with the application Acts’ rules about when food is unsuitable: paragraph 1.1.1,10(6)(d) provides that a food for sale must not have, as an ingredient or component, a detectable amount of an agvet chemical unless expressly permitted by the Code (s 1.4.2,1 Note 4). The corollary duty is that, absent a permit under this Standard and its Schedules, any detectable agvet chemical renders the food unsuitable for sale under the application Acts.

Non-specified areas in the operative text

• The Standard does not specify testing methods, detection limits, laboratory accreditation requirements, record-keeping obligations, or enforcement procedures. It also does not set the units or measurement techniques; it refers only to the "amount" identified in the Schedules (s 1.4.2,3 and ss 1.4.2,4 to 1.4.2,5). Those matters will be addressed by regulators, the application Acts, the Schedules or other instruments outside the operative text of this Standard.

In short, the Standard grants conditional rights to contain residues but ties those rights to listing status, portion-based measurement, explicit calculation rules for composite foods and, for ERLs, the environmental origin of the residue. The duties are largely technical and evidentiary; the enforcement consequences flow from other parts of the Code and the application Acts.

The Standard itself contains no penalty provisions and does not set out enforcement mechanisms. The operative text repeatedly situates the Standard within the broader Code and references the application Acts for legal effect. Two specific source-grounded points are relevant.

• The Standard is an instrument under the Food Standards Australia New Zealand Act 1991 (Cth) and forms part of the Australia New Zealand Food Standards Code (s 1.4.2,1 Note 1 and Note 2). It is identified as the Maximum Residue Limits Standard for that Act (s 1.4.2,1 Note 2). That characterisation indicates its role within the regulatory framework, but the Standard does not itself specify sanctions, infringement notices or penalty amounts.

• The application Acts (referred to at Note 4) provide that food is unsuitable if it contains, among other things, a chemical agent that is foreign to the nature of the food, and paragraph 1.1.1,10(6)(d) of the Code provides that a food for sale must not have, as an ingredient or component, a detectable amount of an agvet chemical or a metabolite or degradation product of the agvet chemical unless expressly permitted by the Code (s 1.4.2,1 Note 4). That placement means the enforcement consequence , an item of food being "unsuitable" , is recorded elsewhere in the Code and implemented under the application Acts. Enforcement activity, including seizure, prohibition of sale, recall or other administrative measures, would therefore be driven by those other provisions rather than by this Standard’s operative clauses.

What the Standard does supply for enforcement purposes are clear numeric and calculative thresholds. Inspectors, analysts and courts (if called upon) can apply:

• single-ingredient MRL numeric limits (s 1.4.2,4(2); s 1.4.2,5(2)), and
• composite product calculations using the weight-weighted formula (s 1.4.2,4(3); s 1.4.2,5(3)), together with the procedural rule that measurement is to be taken only from the portion specified in Schedule 22 (s 1.4.2,3(2)(a)).

Limitations and enforcement risk

• The Standard does not specify analytical methods, detection limits, or sampling regimes. Those matters will materially affect enforcement outcomes in practice because the application Acts and enforcement agencies must rely on laboratory results and sampling protocols that are not set out in this Standard. The Standard’s reference to "detectable amount" in paragraph 1.1.1,10(6)(d) (cited at s 1.4.2,1 Note 4) interacts with, but does not define, detection thresholds. Consequently, enforcement depends on the application Acts, enforcement agency policies and the Schedules (which are not reproduced in this text) to fill those procedural gaps.

• For ERLs, enforcement is not only about numeric comparison but also about factual determination of origin, since ERLs are only permitted when residues "arose from environmental sources, and not from direct or indirect use of an agvet chemical on food" (s 1.4.2,5(1)(d)). This introduces a non-numeric evidentiary dimension into enforcement that may require investigation, record inspection and possibly scientific provenance testing; the Standard does not prescribe how to discharge this evidentiary burden.

In sum, the Standard provides the compliance thresholds and calculation methods that enforcement agencies will apply. The penalties and enforcement instruments themselves sit in the Code’s application Acts and other enforcement policies and are not specified in this Standard. Enforcement practicality will therefore depend on how the application Acts, regulatory agencies and Schedules operationalise sampling, laboratory methods, detection thresholds and provenance proof for ERLs.

The Standard explicitly situates itself within the wider statutory and regulatory architecture; the operative text names the linked instruments and explains boundaries of application.

• Relationship with the Food Standards Australia New Zealand Act 1991 (Cth): The Standard is made under the FSANZ Act and is an element of the Australia New Zealand Food Standards Code (s 1.4.2,1 Note 1). The Standard is identified as the Maximum Residue Limits Standard for the purposes of the FSANZ Act (s 1.4.2,1 Note 2). That linkage means the FSANZ Act’s processes for making, amending and publishing standards apply to this instrument.

• Interaction with application Acts and the Code’s general suitability rules: The Standard references that the application Acts provide food is unsuitable if it contains chemical agents foreign to the nature of the food, and cites paragraph 1.1.1,10(6)(d) (s 1.4.2,1 Note 4). The permission structure in ss 1.4.2,4 and 1.4.2,5 operates as an exception to the general prohibition on detectable agvet chemical residues in food for sale; where an MRL or ERL applies the food is not unsuitable by reason of that permitted residue. Thus, this Standard functions as an exclusionary rule within the Code: it specifies when residues that would otherwise render food unsuitable are permitted.

• Agvet Code and Agricultural and Veterinary Chemicals Code Act 1994 (Cth): The Standard relies on the Agvet Code’s definitions for the term "agvet chemical" and notes that the Agvet Code is contained in the Schedule to the Agricultural and Veterinary Chemicals Code Act 1994 (Cth) (s 1.4.2,3 Note). The Standard therefore applies only to chemicals classified under the Agvet Code and not to other chemical residues that may be regulated under different legal instruments.

• New Zealand Food Act 2014: The Standard applies in Australia only (s 1.4.2,1 Note 3). The note draws a jurisdictional boundary by stating that in New Zealand maximum residue limits for agricultural compounds are set out in a Maximum Residue Limits Standard issued under the Food Act 2014. This creates separate legal frameworks in the two countries, with this Standard governing Australian permissibility.

• Interaction with Schedules 20, 21 and 22: The operative permissions in ss 1.4.2,4 and 1.4.2,5 are contingent on the content of Schedules 20 and 21, and the measurement portion is specified in Schedule 22 (s 1.4.2,2; s 1.4.2,3(2)(a); s 1.4.2,3(4)). The Schedules thus act as the primary instruments of detail: the Standard furnishes the framework and calculations, while the Schedules furnish the chemical-by-chemical and food-by-food specifics essential for day-to-day compliance.

Practical interactional effects and limits

• The Standard does not specify procedural rules for enforcement, laboratory accreditation, sampling protocols or detection thresholds; those operational aspects are therefore to be found elsewhere in the Code, the application Acts or agency policies. That separation means that the legal outcome of a measured residue will depend not only on the numeric MRL in the Schedule but also on how other instruments and agencies implement sampling and testing.

• For ERLs, the Standard imports a legal factual determination , whether the residue "arose from environmental sources" , that will interact with evidentiary rules and investigative powers under the application Acts and enforcement instruments. The Standard itself does not set out how origin is to be demonstrated.

• The Standard’s default that processed foods inherit an unprocessed-food MRL unless a specific processed-food MRL is specified (s 1.4.2,3(3)) creates an interaction with processing and labelling laws: a processed food may be compliant under this Standard because the underlying commodity MRL applies, but other laws (labelling, imported food requirements, trade rules) may impose separate obligations. Those additional rules are not in this Standard, so stakeholders must consult the broader Code and other legislation.

In short, Standard 1.4.2 is a technical, schedule-driven instrument that interfaces with the FSANZ Act, the application Acts (which render food unsuitable), the Agvet Code and (in New Zealand) the Food Act 2014. The Standard provides thresholds and formulas; administrative and evidential procedures, enforcement powers, and many operational details are located in other instruments and agencies’ policies.

The compilation displayed is current as at the commencement date 1 March 2016 and includes amendments up to Amendment No. 161 (as prepared by Food Standards Australia New Zealand on 1 March 2016). The Standard’s own commencement note records 1 March 2016 as the operative date (s 1.4.2,1 Note , Commencement).

The Amendment History provided in the text explains the following process and content items:

• The Standard was published in the Food Standards Gazette No. FSC96 on 10 April 2015 as part of Amendment 154 (F2015L00415 , 31 March 2015). This indicates the instrument’s initial Gazette publication and cross-references an amendment number and FRLI registration code.
• The compilation has since been amended as follows: Section affected , Std heading; Amendment No. 161; FRLI registration/Gazette entries F2016L00120 and FSC103 dated 22 February 2016; Commencement 1 March 2016; How affected , amended; Description of amendment , correction of typographical error in Note 3. This identifies a technical amendment correcting a typographical error in the Standard’s notes (the amendment is recorded in the table within the compilation).

The compilation also explains how uncommenced amendments or provisions scheduled to cease are handled for stakeholders:

• Uncommenced amendments or provisions ceasing to have effect may be reflected in the Standard as shaded boxed text with the relevant commencement or cessation date. The text notes that such amendments will be reflected in a compilation registered on the Federal Register of Legislative Instruments (FRLI) once the relevant date passes and will be shown in the Amendment History (compilation notes).

Abbreviations used in the Amendment History table are listed (ad=added or inserted, am=amended, exp=expired or ceased to have effect, rep=repealed, rs=repealed and substituted), and the table records at least the correction described above.

Operational implications of the amendment structure

• The Standard is presented as a compilation that includes any commenced amendment affecting the compilation to that date. This means that the operative Schedules and operative clauses are to be read in their amended form as at the compilation date (1 March 2016). Stakeholders must therefore consult the current FRLI compilation for the authoritative, up-to-date text including Schedules.

• The amendment record in the compilation is sparse in the text provided: only one substantive amendment is recorded (correction of a typographical error in Note 3 under Amendment 161). The compilation indicates the Standard has been subject to at least one post-publication correction but does not list other line-item amendments to Schedules or operative clauses in the supplied text.

• The Standard’s amendment mechanism is the FSANZ Act section 92 route, unless otherwise indicated (compilation note). That reference indicates the legal process used to make or amend this instrument, but the compilation does not include procedural detail beyond that reference.

Users should therefore consult the Federal Register of Legislative Instruments compilation and the FRLI registration entries for the full amendment history and to verify whether there have been subsequent amendments or commencement/cessation changes since 1 March 2016. The compilation itself explicitly records that it is prepared by FSANZ on that date and is current up to Amendment No. 161.

The text supplied contains no case law, judicial citations or references to litigation involving Standard 1.4.2. The Standard’s compilation and amendment history sections list administrative actions (publication and correction) but do not record any disputes, court decisions or tribunal determinations.

What can be drawn from the source?

• The Standard identifies its legal context, including references to the FSANZ Act, the Agvet Code and the application Acts. Any litigation about the Standard’s operation, interpretation of its schedules, or enforcement outcomes would appear in court records or be noted in later compilations, but no such material is included in this compilation as supplied.

• The Standard creates a set of technical rules (numeric MRLs in Schedule 20, ERLs in Schedule 21, and portion and sampling rules in Schedule 22) and cross-references the Code’s general prohibition on detectable agvet chemicals (paragraph 1.1.1,10(6)(d), cited in s 1.4.2,1 Note 4). Litigation that arose would likely engage statutory interpretation questions (e.g. how to apply the multi-ingredient formula, what constitutes "environmental sources" for an ERL, how to define the "portion" in Schedule 22, or what counts as "detectable"), but the Standard as provided does not record any such litigation.

Limitations and practical consequences

• Because the compilation includes no litigation history, stakeholders seeking precedent or judicial interpretation of the specific provisions (for example, the operational meaning of "arose from environmental sources" in s 1.4.2,5(1)(d) or the application of the multi-ingredient MRL formula in s 1.4.2,4(3)) must search external legal databases, court records or regulatory decisions. The Standard itself neither cites cases nor directs readers to adjudicative materials.

• Absence of recorded litigation in this compilation does not mean disputes have not occurred; it simply means this compilation does not capture them. The compilation makes clear that it is current up to 1 March 2016 (Amendment No. 161). Any litigation arising after that date will not appear in the supplied document.

In short, this compilation contains no litigation history. Stakeholders requiring judicial or tribunal guidance on ambiguous provisions will need to consult external legal records and later compilations.

The Standard is precise in some technical respects but omits or delegates important operational details. The following are practical "gotchas" that arise directly from the text and should be treated as concrete compliance traps rather than speculative commentary.

1. Listing is dispositive: only residues of agvet chemicals that are listed in Schedule 20 or Schedule 21 are permitted under this Standard (s 1.4.2,4(1)(a); s 1.4.2,5(1)(a)). If a chemical or a particular food-chemical pairing is absent from the relevant Schedule, any detectable amount renders the food unsuitable under paragraph 1.1.1,10(6)(d) unless some other Code provision permits it (s 1.4.2,1 Note 4). Do not assume implied permissions.

2. Portion specified in Schedule 22 controls measurement: when calculating the amount of a permitted residue, the Standard directs that only the portion of the commodity specified in Schedule 22 is to be calculated (s 1.4.2,3(2)(a)). If sampling or analysis is done on a different portion, the numeric comparison may be invalid for Code compliance purposes.

3. Processed foods inherit unprocessed MRLs unless specified: the default is that if no maximum amount is specified for a processed food, the same maximum amount applies to both the processed and the unprocessed food (s 1.4.2,3(3)). This may cause surprising results for processed products if stakeholders assume processing reduces residue or that processing-specific MRLs always exist.

4. Multi-ingredient calculation is technical and binding: for composite foods containing one or more listed ingredients the overall permissible amount must be calculated by the formula that weights each listed ingredient’s MRL by its weight and divides by the total weight (s 1.4.2,4(3); s 1.4.2,5(3)). Practical errors in ingredient weights or rounding can affect compliance. The formula requires identifying N (the number of listed ingredients), enumerating Weight(j) for each listed ingredient and using the total Weight; incomplete ingredient accounting risks non-compliance.

5. ERLs require origin proof: Schedule 21 permissions apply only where the presence of the permitted residue "arose from environmental sources, and not from direct or indirect use of an agvet chemical on food" (s 1.4.2,5(1)(d)). That is a non-numeric, evidentiary condition; the Standard does not prescribe how to prove origin. Parties relying on ERLs must be prepared to demonstrate environmental provenance.

6. "Detectable amount" is referenced but not defined here: paragraph 1.1.1,10(6)(d) (cited in s 1.4.2,1 Note 4) refers to a "detectable amount" of an agvet chemical; this Standard does not define detectability or analytical thresholds. That means outcomes may hinge on sampling and laboratory detection methods established elsewhere in the Code, agency policy or laboratory practice. Practitioners should not assume a fixed universal detection limit from this text alone.

7. The Standard does not specify units, sampling protocols or analytical methods: the Schedules identify amounts, but the operative text does not set units, sampling plans, lab accreditation, or methods. Those procedural details determine whether a measured value counts as compliant and must be sought in other instruments.

8. Multiple chemicals as a single permitted residue: if a permitted residue consists of more than one chemical, the Standard requires calculating the amount of all such chemicals that are present (s 1.4.2,3(2)(b)). Where a residue entry spans multiple compounds, simple single-compound testing may miss the total permitted residue calculation.

9. Jurisdictional boundary: the Standard applies in Australia only; New Zealand uses a different instrument under the Food Act 2014 (s 1.4.2,1 Note 3). Parties operating across both jurisdictions must not assume reciprocal coverage.

10. Schedules are central but not reproduced here: the Standard repeatedly defers to Schedule 20, Schedule 21 and Schedule 22 for the operative details (s 1.4.2,2, s 1.4.2,3(4), s 1.4.2,4(1)-(2), s 1.4.2,5(1)-(3)). Without the Schedules you cannot determine whether a particular chemical-food pairing is permitted or what the numeric MRL/ERL is. The operative rules are thus incomplete in isolation.

11. ERL vs MRL distinction: ERLs are conceptually narrower and conditional on environmental origin (s 1.4.2,3; s 1.4.2,5(1)(d)). Mistaking an ERL for an MRL can produce a compliance failure if the residue originated from use rather than the environment.

12. Evidence and record-keeping expectations implicit but unspecified: because the Standard requires origin-determination for ERLs and portion-based measurement, firms should expect to produce evidence (grower records, chain-of-custody, processing information), but the Standard does not specify record-keeping requirements. Those expectations will derive from enforcement practice under the application Acts.

Each of these points is anchored in the text of the Standard as presented. They change the practical compliance task from a simple numeric comparison into a structured set of determinations: (a) is the chemical-food pairing listed, (b) is it listed as an MRL or ERL, (c) which portion in Schedule 22 applies, (d) for composite foods, have the weights and MRLs been correctly combined, and (e) for ERLs, can the environmental origin be demonstrated.

Complying with this Standard requires following the schedule-based permissions and the measurement and calculation rules set out in ss 1.4.2,3 to 1.4.2,5. The following sequence is a source-grounded compliance checklist derived from the Standard.

1. Identify whether the substance is an agvet chemical as defined in the Standard

• Confirm that the chemical in question is an "agvet chemical" (agricultural chemical product or veterinary chemical product within the meaning of the Agvet Code) (s 1.4.2,3 Note). The Standard only governs such chemicals.

2. Check Schedule listing and classification

• Consult Schedule 20 to see whether the chemical-food pairing is listed with an MRL (s 1.4.2,4(1)(a)-(b)).
• If not listed in Schedule 20, consult Schedule 21 to see whether an ERL applies for that chemical-food pairing (s 1.4.2,5(1)(a)-(b)).
• If neither schedule lists the pairing, the Standard does not permit the residue; under paragraph 1.1.1,10(6)(d) a detectable amount would render the food unsuitable (s 1.4.2,1 Note 4).

3. Determine the correct portion for measurement

• For the food in question, identify the portion specified in Schedule 22. The Standard requires calculating the amount only in that specified portion (s 1.4.2,3(2)(a)). Sample and analyse that portion.

4. Measure residue amounts using appropriate laboratory methods (note the Standard does not specify methods)

• The Standard refers to the "amount" identified in the Schedules but does not set analytical methods or units (s 1.4.2,3). Use accredited laboratory methods and sampling practices that are accepted by relevant enforcement agencies, because the Standard’s legal permissibility will be determined using measured values and those agencies’ procedural rules.

5. Apply the single-ingredient numeric comparison or the multi-ingredient formula

• If the food for sale consists of a single commodity listed in Schedule 20 or Schedule 21, compare the measured amount in the Schedule-22 portion against the numeric limit identified for that food and chemical (s 1.4.2,4(2); s 1.4.2,5(2)).
• If the food for sale has two or more ingredients and one or more are listed in the relevant Schedule, compute the composite MRL by applying the weight-weighted formula:
  • Overall MRL = (sum over j of (Weight(j) × MRL(j))) ÷ Weight
  • where j runs over the N ingredients listed in the Schedule, Weight(j) is the weight of the jth listed ingredient, and Weight is the total weight of the food (s 1.4.2,4(3); s 1.4.2,5(3)). Use the specified portion weights from Schedule 22 where applicable.

6. For ERLs, establish provenance

• If relying on an ERL (Schedule 21), ensure that the presence of the residue "arose from environmental sources, and not from direct or indirect use of an agvet chemical on food" (s 1.4.2,5(1)(d)). Keep documentation and evidence that supports the environmental origin (e.g., environmental monitoring data, location-based exposure records, absence of on-farm application records), recognising the Standard itself does not prescribe the evidentiary form.

7. Address composites where a permitted residue comprises multiple chemicals

• If a permitted residue consists of more than one chemical, calculate the amount of all such chemicals present in the food (s 1.4.2,3(2)(b)). Ensure laboratory analysis covers all constituent compounds of the permitted residue.

8. Processed-food consideration

• If dealing with processed food, check whether a processed-food MRL is specified. If no processed-food MRL is specified, the same maximum applies to the processed and unprocessed food (s 1.4.2,3(3)). Adjust sampling and calculations accordingly.

9. Record-keeping and traceability (implicit)

• Although the Standard does not impose specific record-keeping provisions, compliance with its requirements, particularly regarding ERL provenance, composite calculations and portion-specific measurements, will require traceable records of ingredient weights, production and processing steps, applicator records (for growers) and laboratory reports. Expect enforcement to demand such evidence under the application Acts (s 1.4.2,1 Note 4).

10. Keep schedules and amendments under review

• The permissibility of a residue depends on the Schedules. The Standard’s amendment history indicates that Schedules may be corrected or amended (Amendment No. 161 corrected a typographical error in Note 3). Keep the current FRLI compilation and schedule entries under periodic review to ensure an up-to-date basis for compliance (compilation notes).

Practical compliance risks within the Standard

• The Standard does not set detection limits or sampling standards. Compliance in practice will therefore require alignment with the relevant enforcement agencies’ policies and laboratory standards. Variations in analytical sensitivity may change whether an amount is "detectable", which matters because paragraph 1.1.1,10(6)(d) is framed in terms of detectability as well as numeric exceedance (s 1.4.2,1 Note 4).

• The obligation to demonstrate environmental origin for ERLs introduces a factual proof requirement that is likely to be assessed by regulators on a case-by-case basis. Producers or processors who expect to rely on ERLs should maintain proactive environmental monitoring and documentary evidence of absence of use.

• For composite foods, accurate accounting of weights and ingredient proportions is essential for applying the formula correctly. The formula’s arithmetic is deterministic; mistakes in ingredient accounting or improper rounding can create non-compliance even where individual ingredients meet their single-ingredient MRLs.

Following this sequence, and ensuring documentation aligns with the measurement and provenance requirements set out in the Standard, implements the text’s operative compliance obligations (ss 1.4.2,3 to 1.4.2,5). Where the Standard is silent , on sampling plans, analytical methods, or enforcement procedure , practitioners must look to the Code’s application Acts and the enforcement agencies’ technical guidance.
