Australia New Zealand Food Standards Code – Standard 1.1.1 – Structure of the Code and general provisions

The Standard organises two types of foundational legal material: structural architecture and general operative rules.

Structure and single-instrument reading

• All standards are to be read as a single instrument (s 1.1.1,2(1)). The Code is therefore intended to function as a unified regulatory text with cross-references and inter-dependent standards.

Scope and jurisdictional application

• The Code applies to food sold, processed, handled for sale, or imported into Australia or New Zealand, unless the Code provides otherwise (s 1.1.1,3(1)). The Standard expressly records which provisions are not incorporated or adopted into New Zealand law (s 1.1.1,3, Note 1) and identifies Australia‑only Chapters (for example Chapters 3 and 4) in the structural table (s 1.1.1,2(2)).

Baseline requirements for food for sale

• Composition: food for sale must comply with compositional provisions of the Code for that kind of food; the Code allows use of ‘other foods’ or ‘other ingredients’ only in accordance with the permission provided (s 1.1.1,10(2)-(4)).
• Specific prohibitions: the Standard lists categories of substances and foods that must not be in food for sale unless expressly permitted elsewhere in the Code. These include prohibited or restricted plants and fungi, coca bush, novel foods (for retail sale), cell‑cultured food, genetically modified food, irradiated food, kava, raw apricot kernels (retail sale), certain high‑caffeine concentrations, and, unless permitted, food additives, nutritive substances, processing aids, and in Australia detectable agvet chemical residues (s 1.1.1,10(5)-(6)).
• Label, packaging, and information: where Code requirements apply to the sale of food, labelling, information and packaging must comply with the Code (s 1.1.1,10(8)-(10)). Packaging must not present an ingestion hazard or risk of bodily harm (s 1.1.1,10(11)).

Interpretation and measurement

• The Code is to be interpreted by the Acts Interpretation Act 1901 (Cth) in Australia and the Interpretation Act 1999 (NZ) in New Zealand (s 1.1.1,4).
• Units of measurement are defined by Schedule 2; if a unit is not in Schedule 2, meanings are obtained from national measurement Acts and thereafter from the Systeme Internationale d’Unités (s 1.1.1,7).
• Average quantity declarations are to be calculated by the manufacturer or producer using the method they consider best represents the value, taking into account variability, and the Standard sets three acceptable calculation methods (s 1.1.1,6(2)-(3)).

Cross‑referencing and non‑binding guidance

• References to other Acts include instruments made under those Acts and the CFR is cited as the 2022 compilation where used (s 1.1.1,5(1)). FSANZ guidelines are explicitly non‑binding aids to interpretation (s 1.1.1,5(2)).

Transitional and variation effects

• If the Code is varied, food that was compliant for a kind of sale immediately before the variation is taken to remain compliant for 12 months beginning on the date of the variation unless the Code provides otherwise (s 1.1.1,9(1)). The Standard also permits separate, instrument‑specific transitional arrangements (illustrated by the Proposal P1044 variation and its Clause 4 transitional and post‑transition periods).

Labelling names and representations

• The Standard differentiates between food names shown in quotation marks and those not in quotation marks for the operation of requirements that "must be satisfied" (s 1.1.1,13). If a name is specified without quotation marks, the requirement applies to sales where a purchaser is likely to assume the product is that food.

Identity and purity

• Substances used as additives, processing aids, nutritive substances, novel foods or cell‑cultured foods must comply with Schedule 3 specifications when used in accordance with the Code (s 1.1.1,15).

Asterisks and defined terms

• The Standard explains how an asterisk flags terms defined in Standard 1.1.2,2(3) and lists several basic defined terms that are not asterisked (s 1.1.1,16).

These concepts operate by allocation of compliance obligations to producers, manufacturers, importers and food businesses, and through delegation of substantive permission for otherwise prohibited substances to other specific standards in the Code.

The Standard allocates practical obligations, permissions and interpretive rules that directly affect several discrete groups:

Food businesses and manufacturers

• They must ensure products meet compositional requirements applicable to the kind of food (s 1.1.1,10(2)-(4)), apply permitted uses only where other standards authorise them (s 1.1.1,10(5)-(6) and accompanying Note 1), calculate and declare average quantities using an appropriate method and retain supporting analysis or data (s 1.1.1,6(2)-(3)), and ensure labelling, packaging and information meet Code requirements where such requirements apply (s 1.1.1,10(8)-(10)). Packaging must not be ingestible or otherwise likely to cause harm (s 1.1.1,10(11)).

Importers

• The Code’s labelling and packaging provisions apply to imported food with the labelling or packaging intended for sale; non‑labelling/packaging requirements also apply to imported food (s 1.1.1,12). The Imported Food Control Act 1992 (Cth) is invoked by the Standard’s Division 4 note to bar importation of food that fails to meet applicable Code standards, other than label information for packaged food (Division 4, Note 1(4)).

Retailers and distributors

• They are affected by the prohibition on selling food that does not comply with requirements of the Code (Division 4, Note 1(1)(b)) and by the rule that a person must not sell or advertise food packaged or labelled contrary to the Code (Division 4, Note 1(1)(c)-(d)). The “sold as” naming rules determine when compositional standards for named foods will be triggered in a retail sale (s 1.1.1,13).

Public authorities and enforcement agencies

• State and territory application Acts adopt the Code and provide enforcement powers against persons who fail to comply; the Standard lists those Acts (Division 4, Note 1(3)). The Standard itself does not create the enforcement regime; it relies on the application Acts and the Imported Food Control Act for penalties and prohibitions (Division 4, Note 1).

Regulators and policy actors

• FSANZ and regulators in each jurisdiction use the Code plus guidelines (FSANZ guidelines are non‑binding interpretive aids, s 1.1.1,5(2)) and are the bodies responsible for drafting variations and transitional arrangements. The Amendment History shows which standards and provisions FSANZ has inserted, amended or repealed and records the compilation practice and commencement methodology (Amendment History and “About this compilation”).

Consumers and downstream users

• The Standard indirectly affects consumers through labelling and safety rules that determine what may be sold as a named food (s 1.1.1,13), the presence or absence of certain categories of foods on the market (s 1.1.1,10(5)-(6)), and packaging safety rules (s 1.1.1,10(11)). Businesses’ label and composition decisions, driven by the Code, shape consumer choice and information.

Standard 1.1.1 is therefore targeted at the regulated community , manufacturers, importers, retailers and enforcement agencies , with effects on consumers deriving from those regulated behaviours. The Code’s role as a unifying instrument means the day‑to‑day legal obligations of those actors are dispersed across the other named standards referenced in this Standard; Schedule 3 and Standard 1.6.1 are explicit cross‑references for identity/purity and microbiological limits respectively (s 1.1.1,15; s 1.1.1,11).

Duties imposed on persons involved in the manufacture, importation, sale or advertising of food are stated directly and by cross-reference. The Standard allocates duties principally to ensure conformance with Code requirements, and it reserves detailed permissions to other standards.

Primary duties

• Compliance with Code requirements for food business conduct and food intended for sale: under the application Acts, a person must comply with any requirement imposed by a provision of the Code in relation to the conduct of a food business, food intended for sale, or food for sale (Division 4, Note 1(1)(a)). This note lists required compliance with composition, labelling, packaging and advertising provisions found in the Code as a whole.
• Prohibition on selling non‑compliant food and misleading packaging: a person must not sell any food that does not comply with a requirement in the Code that relates to the food, and must not sell or advertise food packaged or labelled in contravention of the Code (Division 4, Note 1(1)(b)-(d)).
• Prohibition on false description for sale promotion: a person must not, for the purpose of effecting or promoting the sale of any food, cause the food to be advertised, packaged or labelled in a way that falsely describes the food (Division 4, Note 1(1)(e)). The Standard defines false description in the same note where a prescribed standard exists but the product does not comply (Division 4, Note 1(2)).

Specific compositional duties and prohibitions

• Foods for sale must comply with compositional Code provisions; they may include other foods only where the standard permits (s 1.1.1,10(2)-(4)). Subsection (5) enumerates categories that food for sale must not be unless expressly permitted (for example novel foods for retail sale, genetically modified food, cell‑cultured food, irradiated food, kava, raw apricot kernels) (s 1.1.1,10(5)). Subsection (6) prohibits food from containing certain substances as ingredients or components unless expressly permitted (e.g., food additives, nutritive substances, processing aids, detectable agvet chemical residues in Australia) (s 1.1.1,10(6)).

Obligations about labelling and information

• Where labelling, information or packaging requirements apply, these must be complied with (s 1.1.1,10(8)-(10)). Warning statements or specific words required by the Code must be used without modification (s 1.1.1,8(1)); other required statements may be modified provided the modification does not contradict or detract from the effect of the statement (s 1.1.1,8(2)).

Record‑keeping and handling requirements

• If the Code sets requirements for handling of food (for example Chapter 3 in Australia) or record‑keeping, those requirements must be complied with (s 1.1.1,14(1)-(2)). The Standard does not itself prescribe the records, but requires compliance where such requirements are specified elsewhere in the Code.

Calculation and measurement duties

• Manufacturers or producers must calculate declared “average quantity” of substances by choosing one of three methods that best represents the average and must account for factors such as seasonal variability (s 1.1.1,6(2)-(3)). Units and symbols must conform to Schedule 2 or national measurement laws where not defined in the Schedule (s 1.1.1,7).

Identity and purity duties

• Substances added to food and certain novel products must meet Schedule 3 specifications when used in accordance with the Code (s 1.1.1,15).

Rights and delegations

• The Standard delegates specific permissions to other parts of the Code. For example, where subsections (5) or (6) of s 1.1.1,10 prohibit certain items, those prohibitions are expressly subject to permissions elsewhere in the Code, such as food additive rules in Standard 1.3.1 or novel food rules in Standard 1.5.1 (s 1.1.1,10, Note 1). The producer or manufacturer therefore has the right to use substances where an express permission exists in the relevant standard.
• The Standard gives manufacturers discretion to select the method for calculating average quantity (s 1.1.1,6(2)), provided it best represents the average. That is a delegated operational choice rather than a hard technical rule.

Interactional duties

• The Code’s application is subject to and must be read with interpretation Acts in each jurisdiction (s 1.1.1,4). It also acknowledges that FSANZ guidelines are available to assist interpretation but are not legally binding (s 1.1.1,5(2)).

Transitional duty relief

• When the Code is varied, foods compliant before the variation are treated as compliant for 12 months after the variation commencement unless the Code provides otherwise (s 1.1.1,9(1)), giving a limited compliance relief window for business adaptation. Instrument‑specific transitions may alter that default, as with the Proposal P1044 transitional and post‑transition windows documented in the Standard’s application table.

Enforcement and sanctions

• The Standard does not itself state penalties but records that under application Acts a person may be subject to prohibition on selling non‑compliant food and on importing food that does not meet Code standards, referencing state Food Acts and the Imported Food Control Act 1992 (Cth) for enforcement (Division 4, Note 1). The absence of penalty detail in the Standard means sanctions are located in the application and imported food statutes.

These duties create practical compliance obligations for parties at every point in the food supply chain, with procedural discretion (for example on average quantity calculation) balanced against strict prohibitions and mandatory wording rules.

The Standard itself does not set out a schedule of fines, criminal penalties or administrative sanctions. Instead, it places enforcement responsibility with application Acts and with Commonwealth import controls, and it records the operative obligations that those Acts address.

Enforcement framework recorded in the Standard

• The Division 4 explanatory Note states that in Australia the Code is enforced under application Acts in each State and Territory, plus Commonwealth law for imported food. Under those Acts, a person must comply with any requirement in the Code in relation to food business conduct, food intended for sale or food for sale; must not sell food that does not comply; and must not sell or advertise food packaged or labelled contrary to the Code (Division 4, Note 1(1)(a)-(d)). The Note also recounts that a person must not deliberately cause false descriptions in advertising or packaging for promotional purposes (Division 4, Note 1(1)(e)), and defines false description where a prescribed standard exists but the product does not comply (Division 4, Note 1(2)).

Importation enforcement

• The Standard records that under the Imported Food Control Act 1992 (Cth), a person is prohibited from importing food that does not meet applicable Code standards, other than those relating to label information of packaged food, and prohibited from dealing with imported food that does not meet applicable label information standards (Division 4, Note 1(4)). The Code’s s 1.1.1,12 clarifies which Code provisions apply to imported food (labelling and packaging as packed for sale, and other Code provisions).

Where penalties are located

• Because the Standard does not itself create sanctions, penalties (including fines, seizure, injunctions, licence suspensions, or criminal sanctions where provided) are to be found in the enforcement Acts named in the Standard (the various State and Territory Food Acts and the Imported Food Control Act). The Standard lists the relevant Acts (Division 4, Note 1(3)), for example Food Act 2003 (NSW), Food Act 1984 (Vic), Food Act 2006 (Qld), Food Act 2008 (WA), and equivalents for South Australia, Tasmania, the ACT and the NT.

Regulatory decision points and discretion

• Enforcement will be exercised under those Acts by regulators in each jurisdiction. The Standard itself provides decision mechanics for compliance checks, for instance microbiological compliance for lots is determined under Standard 1.6.1 (s 1.1.1,11), and identity and purity are judged against Schedule 3 specifications (s 1.1.1,15). These cross‑references create determinative standards that enforcement agencies can rely on when exercising powers under the application Acts.

Guidance versus mandatory text

• The Standard notes FSANZ guidelines are non‑binding (s 1.1.1,5(2)). Regulators may use guidelines to interpret the Code but enforcement measures are based on the Code and application Acts, not on guidelines alone.

Transitional enforcement relief

• The Standard’s effect‑of‑variations rule grants a default 12‑month transitional tolerance for products that were compliant before a variation (s 1.1.1,9(1)). Regulators should apply that transitional rule unless a variation or instrument provides otherwise. The Standard also records instrument‑specific transitional provisions, such as the Proposal P1044 transition and post‑transition windows with defined dates and special non‑application of s 1.1.1,9 (Proposal P1044 table, F2021L00145).

Practical enforcement implications

• Enforcement agencies will treat the Code’s compositional, labelling, packaging and information provisions as the substantive standards and will look to the relevant application Acts for powers and sanctions. Because the Standard lists specific prohibited categories and where permissions are located, enforcement will generally follow the Code’s cross‑references (s 1.1.1,10 and Note 1). The Standard’s lack of internal penalty schedules means practitioners must consult the relevant application Act for precise enforcement consequences.

In short, enforcement is realised by external statutes and agencies; this Standard supplies the substantive standards and interpretive rules they are to enforce rather than the punitive machinery.

The Standard is expressly framed as an instrument that operates alongside and is implemented through other legal instruments. Its text sets out the points of interaction and cross‑reference.

Interpretation Acts and interpretation rules

• The Standard directs that the Code be interpreted under the Acts Interpretation Act 1901 (Cth) in Australia and the Interpretation Act 1999 (NZ) in New Zealand (s 1.1.1,4). This places statutory rules about interpretation, commencement, time computation, and other interpretive mechanics under the respective national Acts when questions of meaning arise.

Application Acts and enforcement statutes

• The Standard is enforced under application Acts in each State and Territory; Division 4 Note 1 lists the specific Food Acts (for example, Food Act 2003 (NSW), Food Act 1984 (Vic), Food Act 2006 (Qld) etc.). Those Acts give regulatory powers, offences and penalties for failure to comply with Code provisions (Division 4, Note 1(3)). The Standard also interacts with the Imported Food Control Act 1992 (Cth) for imported food (Division 4, Note 1(4); s 1.1.1,12 clarifies applicability to imported food).

Cross‑references within the Code

• The Standard references many other standards as the locus of substantive permissions and limits. For example, permission to use food additives is located in Standard 1.3.1, nutritive substances in Standard 1.3.2, processing aids in Standard 1.3.3, agvet chemical residue rules in Standard 1.4.2, prohibited plants and fungi in Standard 1.4.4, novel foods in Standard 1.5.1, genetically modified food in Standard 1.5.2, irradiated food in Standard 1.5.3 and kava in Standard 2.6.3 (s 1.1.1,10, Note 1). Microbiological limits are linked to Standard 1.6.1 (s 1.1.1,11). Identity and purity specifications are located in Schedule 3 (s 1.1.1,15).

International references

• The Standard permits references to other instruments and specifically states that references to the Code of Federal Regulations refer to the 2022 compilation of the US CFR (s 1.1.1,5(1)(b)). This provides a mechanism for invoking internationally published standards where the Code does so.

Guidelines and non‑binding material

• FSANZ guidelines developed under the FSANZ Act are to assist interpretation but are expressly not legally binding (s 1.1.1,5(2)). This interaction means guidelines can influence regulator interpretation and industry practice without directly creating legal obligations.

New Zealand adoption and divergence

• The Standard documents specific Code provisions not incorporated into or adopted under New Zealand’s Food Act 2014 (NZ) and lists items that do not apply in New Zealand, such as Standard 1.4.2 (agvet chemicals), Standard 1.6.2 (processing requirements for meat), Standard 2.9.1 (infant formula products), Chapter 3 (food safety standards), and Chapter 4 (primary production and processing standards) (s 1.1.1,3 Note 1). It also notes other exclusions in the table and Amendment History. This delineation identifies the Code as a joint instrument whose application is tailored by domestic adoption law.

Transition and variation interactions

• The Standard prescribes a default 12‑month transition for food that was compliant before a Code variation (s 1.1.1,9(1)), unless the Code or the variation provides otherwise. It also records instrument‑specific transition provisions, such as Proposal P1044’s transitional and post‑transition periods and specific non‑application of s 1.1.1,9 to that variation (Proposal P1044 table, F2021L00145).

Measurement law interaction

• Units of measurement not assigned in Schedule 2 are to be interpreted under the National Measurement Act 1960 (Cth) in Australia or the Weights and Measures Act 1987 (NZ), and thereafter the Systeme Internationale d’Unités (s 1.1.1,7). This creates a vertical relationship between the Code and national metrology laws.

Identity and purity specifications

• Schedule 3 contains specifications for identity and purity of listed substances; the Standard requires compliance with those specifications where substances are used in or sold for use in food in accordance with the Code (s 1.1.1,15). Enforcement of those specifications will be realised via application Acts.

In practical terms this Standard functions as the Code’s connective tissue: it instructs where to look for substantive permissions and prohibitions, ties interpretation to national interpretation Acts, and situates enforcement in domestic food and import control statutes. Practitioners must therefore read the Standard together with the specific substantive standards it references and with the application Acts and import controls that implement and enforce those provisions.

The Standard provides a detailed, dated record of amendments, compilation practice and commenced changes up to the compilation date. The compilation information states the document is compilation No. 16 of Standard 1.1.1 as in force on 2 September 2025 and includes amendments up to Amendment No. 243 (prepared by FSANZ on 2 September 2025). The Amendment History entries included in the Standard record the mechanics of change and indicate the section affected, amendment number, FRL registration and Gazette details, commencement (or cessation) dates, and how the Code text was altered. Select entries and themes evident from the recorded amendments are:

• Early reorganisation and insertion of standards: Amendment 157 (Sept 2015, commencement 1 March 2016) inserted references to new standards (e.g., insertion reference to 1.2.12 in one entry and corrections to names of standards) and Amendment 161 later repealed a reference (with a commencement note in 2017). The Amendment History documents multiple minor numbering and typographical corrections (for instance A’ment No. 172, 7 Sept 2017).
• Additions and removals of specific standards and chapters: Amendment 168 (11 April 2017) removed a reference to Chapter 5 and replaced references to certain standards (1.2.12, 4.2.4A) as shown in the amendment table, reflecting reorganisational adjustments.
• Specific content insertions: Amendment 159 (Dec 2015) added a paragraph relating to raw apricot kernels to s 1.1.1,10(5)(f) and corresponding Note entries (commenced 1 March 2016). Amendment 182 (29 Nov 2018) omitted a Note under Schedule 22.
• Proposal P1044 transitional arrangements: The application table documents the Food Standards (Proposal P1044 - Plain English Allergen Labelling) Variation (FRLI F2021L00145, Gazette 24-25 Feb 2021) and sets out a Clause 4 transitional provision (Item [1] of the Schedule, A’ment No. 197). The table specifies the transition period (25 Feb 2021 to 25 Feb 2024) and a post‑transition period (26 Feb 2024 to 26 Feb 2026) and notes subclause 4(1) provides that s 1.1.1,9 does not apply to those variations; subclause 4(2) and 4(3) set out the allowed conditions of sale during transition and post‑transition.
• Recent structural insertions (2022-2025): The Amendment History records insertions of new standards and schedules: for example, Amendment 214 inserted new Standard 3.2.2A (Food Safety Management Tools), Amendment 229 added Standard 2.8.3 (Native bee honey) on 22 July 2024, Amendment 210 (12 Aug 2022, commencing 12 Feb 2025) inserted Standards 4.2.7, 4.2.8 and 4.2.9, and Amendment 239 (18 June 2025) inserted new Standard 1.5.4 and Standard 3.4.1 and new Schedule 25A (Permitted cell‑cultured foods) and other consequential repeals and substitutions (for example 1.1.1,10(5)(b) and 1.1.1,10(6)(f) were repealed and substituted to include new references to cell‑cultured foods).
• Terminology updates: Amendment 243 (FRL F2025L009882, Gazette Sept 2025, commencement 2 Sept 2025) replaced the term “Food produced using gene technology” with “Genetically modified food” in several locations, including 1.1.1,2 and 1.1.1,10. Several other amendment entries provide the exact changes to subsection numbering, textual corrections and substitution of standards.
• Compilation and uncommenced amendments: The Standard explains that the compilation includes commenced amendments up to 2 Sept 2025. It also notes that uncommenced amendments or provisions ceasing to have effect may appear in shaded boxed text in future FRL‑registered compilations, and describes abbreviations used in the amendment table (ad, am, exp, rep, rs).

Practically, the Amendment History demonstrates that FSANZ uses a combination of insertions, repeals, substitutions and instrument‑specific transitional arrangements to adjust the Code. The history reveals particular policy directions reflected in new standards for cell‑cultured foods, food safety management tools, and native bee honey, while also documenting discrete labelling reforms (Proposal P1044) and terminology changes relating to genetically modified foods.

For legal practitioners and compliance officers, the Amendment History section is the authoritative log for commencement dates and transitional regimes, and identifies which versions of standards apply at specific times. The compilation statement makes explicit which amendment number and date combination produced the current text.

The Standard, as presented, does not contain any judicial decisions, case citations or adjudicative summaries. The text and accompanying materials supplied in this compilation include no litigation history entries and name no cases. Where the Standard discusses enforcement and compliance it does so by reference to the application Acts and the Imported Food Control Act 1992 (Cth) rather than by describing judicial outcomes. For example, Division 4 Note 1 explains the enforcement duties that application Acts impose and lists the relevant State and Territory Food Acts, but it does not record prosecutions, appeals, or judicial interpretations (Division 4, Note 1(1)-(4)).

Implications for practitioners

• Absence of decisions in the Standard means that any litigation footholds, such as judicial interpretation of “sold as” or “false description” principles, will be found in the case law generated under the application Acts and associated statutes, not in the text of this Standard. Practitioners must therefore consult relevant State/Territory and Commonwealth case law to understand how courts have interpreted the Code’s provisions when adjudicating enforcement actions, mislabelling claims, or disputes over whether a product meets a named food standard.
• The Standard does, however, supply the normative language and cross‑references that litigation will pivot around: the definitions, the labelling rules (for mandatory statements in s 1.1.1,8), the “sold as” tests (s 1.1.1,13), compositional prohibitions (s 1.1.1,10), and the microbiological and identity/purity cross‑references (s 1.1.1,11; s 1.1.1,15). These provisions will typically be the foundation for regulatory prosecutions and civil claims under the application Acts.

What is not contained

• No decisions, no administrative determinations, and no tribunal or court summaries are included in this Standard’s text or its Amendment History. The compilation is a statutory instrument and amendment log; it does not duplicate or summarise enforcement outcomes.

Because litigation results are not part of this Standard, readers seeking precedential treatment of its provisions must turn to the enforcement Acts, administrative tribunal determinations and relevant case law in the applicable jurisdiction.

This Standard contains several operational features and drafting choices that create practical pitfalls for practitioners and businesses. The following items are specific, grounded in the Standard text, and likely to trip up non‑specialist users.

1. “Must not” lists versus permissions elsewhere

• s 1.1.1,10(5)-(6) contains an explicit list of items food for sale must not be or contain unless expressly permitted by the Code (for example, novel foods for retail sale, cell‑cultured food, genetically modified food, irradiated food, kava, raw apricot kernels, certain high caffeine concentrations, and detectable agvet residues in Australia). The “unless expressly permitted” carve‑outs mean compliance depends on cross referencing the correct enabling standard (e.g., Standard 1.3.1 for additives, Standard 1.5.1/1.5.4 for novel or cell‑cultured foods). Missing that cross‑reference can lead a business to incorrectly assume permission exists.
• Note 1 to s 1.1.1,10 lists the standards that typically contain permissions; practitioners must consult those exact standards rather than infer permissions from other regulatory instruments.

2. Quotation marks and “sold as” tests

• s 1.1.1,13 distinguishes the effect of a food name presented in quotation marks versus not. If a name appears without quotation marks, the requirement applies to any sale in which a purchaser is likely to assume the food is that named product. Conversely, if in quotation marks, the requirement applies only if that name is used in connection with the sale. Misreading this distinction can produce unexpected obligations (or the reverse) when labelling goods such as “soy milk” or “ginger beer”.

3. Average quantity calculation is a manufacturer’s discretion with evidential obligations

• s 1.1.1,6(2)-(3) permits manufacturers to choose among three methods to calculate declared average quantities and requires consideration of lot‑to‑lot variability, including seasonal changes. The Standard does not prescribe sampling frequencies or statistical thresholds; regulators and courts will expect producers to have reasoned, documented choices. A contractor or manufacturer who declares an average without data or defensible method risks non‑compliance.

4. Mandatory wording cannot be modified; other statements can only be modified without detracting

• s 1.1.1,8(1) requires warning statements or specified words to be expressed exactly; s 1.1.1,8(2) permits modification of other required statements only where the modification does not contradict or detract from the statement’s effect. This can produce fine line disputes about whether a variant formulation or translation of a statement detracts from meaning in a given context.

5. Packaging ingestion hazard and ancillary items

• s 1.1.1,10(11) prohibits packaging items that could be swallowed or otherwise likely to cause bodily harm if taken into the mouth. The provision explicitly captures promotional inserts, moisture absorbers, oxygen absorbers and other items packaged with food. Businesses using novel packaging inserts must consider physical risk as well as chemical composition.

6. Import labelling carveouts and ambiguity

• s 1.1.1,12(1)-(2) applies Code labelling and packaging provisions to imported products with the labelling and packaging with which they are intended to be sold. However, Division 4, Note 1(4) to the Standard states the Imported Food Control Act 1992 (Cth) prohibits importation of food not meeting applicable standards other than label information for packaged food. The interaction can be complex: imported food that meets foreign label norms may still be non‑compliant on packaging or content under the Code, and the Standard requires compliance except for some labelling aspects under the Imported Food Control Act.

7. Overlap between categories and aggregate limits

• Note 2 to s 1.1.1,10 warns of overlaps between categories (for example, some substances may be both food additives and nutritive substances) and that total amounts may be regulated irrespective of the use category. Businesses must therefore aggregate uses across different functional classifications to ensure total exposures do not exceed limits referenced elsewhere in the Code.

8. Transition rules can be overridden or made instrument‑specific

• s 1.1.1,9 provides a 12‑month default transitional compliance period following a variation. However, instrument‑specific transitions, like Proposal P1044, may exclude application of the default rule and impose longer or staged transition/post‑transition windows. Practitioners must check the amendment instrument and not rely only on s 1.1.1,9.

9. Identity and purity are specification‑driven

• s 1.1.1,15(1)-(2) ties substances used in food to Schedule 3 specifications. Failure to check Schedule 3 for identity and purity specifications can lead to product non‑compliance even where the functional use of a substance is permitted under another standard.

10. Asterisk system is imperfect and terms may be defined without asterisk

• s 1.1.1,16 explains the asterisk convention for defined terms, but also notes that some basic defined terms used throughout the Code are not asterisked. Reliance on asterisks alone to find definitions will therefore miss several key terms (for example “food”, “label”, “serving”, “sugars”). Practitioners must consult Standard 1.1.2 definitions rather than infer from asterisks.

11. No penalties in the Standard itself: enforcement varies by jurisdiction

• Because penalties and enforcement powers are located in application Acts and the Imported Food Control Act, the scale and nature of enforcement consequences differ across jurisdictions. This matters for national businesses that must coordinate compliance with multiple enforcement regimes.

Each of these gotchas arises directly from the Standard’s text and accompanying notes. Compliance risk is therefore not only substantive (what ingredients are allowed) but procedural and evidential (how averages are calculated, what wording is exactly mandatory, how transitions operate, which jurisdiction’s enforcement Act applies).

This section provides actionable compliance checkpoints grounded in the Standard’s provisions. The steps are organised for manufacturers, importers and retailers and focus on documentary, labelling, compositional and operational controls required by the Code.

1. Map product against the Code’s structure

• Confirm whether the food falls under Chapters/Standards that apply in your jurisdiction (see the Code structure s 1.1.1,2(2) and the New Zealand exclusions in s 1.1.1,3 Note 1). For example, Chapter 3 and Chapter 4 provisions apply in Australia only.

2. Confirm compositional permissions and prohibitions

• Check s 1.1.1,10(2)-(6) for general prohibitions and then identify the specific enabling standard that permits the ingredient or process (see Note 1 to s 1.1.1,10, which lists likely enabling standards like Standard 1.3.1 for additives, Standards 1.5.1/1.5.4 for novel/cell‑cultured foods, etc.). Do not assume a functional use equals permission; obtain the specific clause in the enabling Standard authorising the use and any limits.

3. Ensure identity and purity specifications are met

• Where substances are listed in s 1.1.1,15, verify compliance with Schedule 3 specifications. Maintain suppliers’ certificates of analysis referencing the relevant Schedule 3 specification and retain that documentation for inspection.

4. Labelling and information compliance

• If a labelling requirement applies to your sale, ensure the labelling content and form complies with the Code’s labelling standards (s 1.1.1,10(8)). For any required warning statements or specific words (s 1.1.1,8(1)) use the exact wording in the Code; for other required statements any modifications must not contradict or detract from their effect (s 1.1.1,8(2)). Where a product is sold “as” a named food, apply the tests in s 1.1.1,13 to determine whether the requirement for that named food has been triggered.

5. Average quantity declarations

• For any constituent listed as an “average quantity” in the Code, select and document one of the methods in s 1.1.1,6(3) (analysis of the product, calculation from ingredient composition, or calculation from generally accepted data). Document the rationale for method selection and the data underpinning the declared numbers, and retain these records to demonstrate you took seasonal and lot‑to‑lot variability into account (s 1.1.1,6(2)).

6. Units and measurement

• Use units and their symbols as listed in Schedule 2; if a unit is not in Schedule 2, check the National Measurement Act 1960 (Cth) or the Weights and Measures Act 1987 (NZ); otherwise use SI units (s 1.1.1,7).

7. Microbiological and lot controls

• Ensure lot‑based testing and microbiological limits comply with Standard 1.6.1 as required by s 1.1.1,11. Implement sampling and acceptance/rejection procedures tied to Standard 1.6.1 specifications and retain lot test records.

8. Packaging safety

• Assess all packaging materials and items placed within packaging (promotional inserts, moisture absorbers, oxygen absorbers etc.) for ingestible hazards and choking risk per s 1.1.1,10(11). Keep risk assessments and consumer safety testing outcomes on file.

9. Importation procedures

• For imported foods, confirm that labelling and packaging as imported are compliant with Code labelling and packaging requirements s 1.1.1,12(1)-(2), and ensure the product meets other applicable Code provisions as per s 1.1.1,12(3). Understand that the Imported Food Control Act 1992 (Cth) prohibits importing food that does not meet applicable standards except for certain label information (Division 4, Note 1(4)).

10. Record‑keeping and traceability

• Where the Code requires records or handling procedures (for instance Chapter 3 in Australia), implement and maintain those records (s 1.1.1,14(1)-(2)). Maintain supplier documentation, test results, batch/lot records and labelling artwork approvals for enforcement review.

11. Transitional compliance planning

• When the Code is varied, check s 1.1.1,9 for the default 12‑month transitional window and inspect the instrument amending the Code for instrument‑specific transitional arrangements (the Proposal P1044 table illustrates variation specific transition and post‑transition periods). For any amendments that exclude s 1.1.1,9, follow the variation’s transitional provisions.

12. Use FSANZ guidance while understanding it is non‑binding

• Consult FSANZ guidelines to assist interpretation (s 1.1.1,5(2)) but do not rely on guidelines as substitutes for compliance with the Code or the enforcement Acts.

13. Legal and regulatory checklists for marketing claims

• Before making nutrition, health or related claims, check the relevant Code standards (for instance the nutrition claims standards listed under Part 1.2) and ensure claims comply with the Code’s labelling and health claim rules. Where a representation could be a “sold as” identity, verify applicable identity standards per s 1.1.1,13.

14. Jurisdictional compliance and enforcement mapping

• Map the product to the relevant application Act(s) listed in Division 4 Note 1(3) and confirm that enforcement and penalty exposure is understood for each jurisdiction in which the product will be sold. For imports, confirm obligations under the Imported Food Control Act 1992 (Cth).

15. Documented compliance and risk assessments

• For each product maintain a compliance file including: compositional compliance checklists referencing Code clauses and enabling standards, supplier COAs tied to Schedule 3 where applicable, average quantity calculation documentation, labelling artwork approvals showing mandatory wording usage, packaging safety assessments, lot test records for microbiological limits, and a record of any transitional regime relied upon.

By following these steps and maintaining contemporaneous documentation mapped to the specific Code provisions cited above (for example ss 1.1.1,6, 1.1.1,7, 1.1.1,8, 1.1.1,10, 1.1.1,11, 1.1.1,12, 1.1.1,15), a business will be in a materially stronger position to demonstrate compliance to regulators operating under the application Acts and the Imported Food Control Act.
