Australia New Zealand Food Standards Code – Schedule 12 – Nutrition information panels

Schedule 12 to the Australia New Zealand Food Standards Code prescribes the visual and content format of nutrition information panels (NIPs) that must accompany foods covered by selected provisions of Standard 1.2.8 and related provisions in the Code. The Schedule provides ready-made, prescriptive examples , in HTML table form , for NIPs that correspond to particular subsections of Standard 1.2.8 and certain other Code provisions (for example, subsection 1.2.8,6(2), 1.2.8,6(3), 1.2.8,6(5), 1.2.8,8(3), paragraph 2.6.4,5(2)(b), subsection 2.9.2,11(3) and subsection 2.10.3,5(3)) (see S12,2 to S12,7). The Schedule is presented as a Standard under the Food Standards Australia New Zealand Act 1991 (Cth) (Note 1) and therefore forms part of the Australia New Zealand Food Standards Code that applies in Australia and, where adopted, in New Zealand (Note 2).

Mechanically, the instrument supplies:

distinct template examples for different label regimes (basic NIP, extended NIP with fat sub-groups, percentage daily intake (PDI) column, specialised panels for formulated caffeinated beverages, foods for infants and certain chewing gum products) (S12,2 to S12,7);
specific field labels and units to be used (for example, Energy: kJ (Cal); Protein: g; Sodium: mg (mmol); other nutrients in g, mg, μg as appropriate) (S12,2 to S12,7);
labelling notes about subgroup indicators and the conditional use of the word "total" (S12,3 note);
the PDI example specifies the reference energy intake used for the percentage calculation (8700 kJ) (S12,4);
an example showing where compositional declarations may be placed adjacent to or following an NIP for formulated caffeinated beverages (S12,5);
tailored examples for infant foods and for calcium in chewing gum demonstrating how additional, food-specific information can be accommodated adjacent to standard nutrient fields (S12,6; S12,7).

Schedule 12 Nutrition information panels

S12—1 Name

This Standard is Australia New Zealand Food Standards Code – Schedule 12 – Nutrition information panels.

S12—2 Format for nutrition information panel—subsection 1.2.8—6(2)

For subsection 1.2.8—6(2), the format for a nutrition information panel is:

<table cellspacing="0" cellpadding="0" style="width:397.9pt; margin-right:auto; margin-left:auto; border:1pt solid #000000; border-collapse:collapse"><tbody><tr><td colspan="3" style="width:329.4pt; border-bottom:1pt solid #000000; padding-right:4.9pt; padding-left:4.9pt; vertical-align:top"><p class="FSCtblMainC"></p><p class="FSCtblMainC"><span>NUTRITION INFORMATION</span></p><p class="FSCtblMainC"><span></span></p><p class="FSCtblMain"><span>Servings per package: (insert number of servings)</span></p><p class="FSCtblMain"><span>Serving size: g (or mL or other units as appropriate)</span></p></td></tr><tr style="height:28.1pt"><td style="width:109.6pt; border-bottom:1pt solid #000000; padding-right:5.4pt; padding-left:4.9pt; vertical-align:top"><p class="FSCtblMain"><span></span></p></td><td style="width:107.75pt; border-bottom:1pt solid #000000; padding-right:5.4pt; padding-left:5.4pt; vertical-align:top"><p class="FSCtblMain"><span>Quantity per serving</span></p></td><td style="width:90.45pt; border-bottom:1pt solid #000000; padding-right:4.9pt; padding-left:5.4pt; vertical-align:top"><p class="FSCtblMain"><span>Quantity per 100 g (or</span><br><span>100 mL)</span></p></td></tr><tr><td style="width:109.6pt; padding-right:5.4pt; padding-left:4.9pt; vertical-align:top"><p class="FSCtblMain"><span>Energy</span></p></td><td style="width:107.75pt; padding-right:5.4pt; padding-left:5.4pt; vertical-align:top"><p class="FSCtblMain"><span>kJ (Cal)</span></p></td><td style="width:90.45pt; padding-right:4.9pt; padding-left:5.4pt; vertical-align:top"><p class="FSCtblMain"><span>kJ (Cal)</span></p></td></tr><tr><td style="width:109.6pt; padding-right:5.4pt; padding-left:4.9pt; vertical-align:top"><p class="FSCtblMain"><span>Protein</span></p></td><td style="width:107.75pt; padding-right:5.4pt; padding-left:5.4pt; vertical-align:top"><p class="FSCtblMain"><span>g</span></p></td><td style="width:90.45pt; padding-right:4.9pt; padding-left:5.4pt; vertical-align:top"><p class="FSCtblMain"><span>g</span></p></td></tr><tr><td style="width:109.6pt; padding-right:5.4pt; padding-left:4.9pt; vertical-align:top"><p class="FSCtblMain"><span>Fat, total</span><br><span>—saturated</span></p></td><td style="width:107.75pt; padding-right:5.4pt; padding-left:5.4pt; vertical-align:top"><p class="FSCtblMain"><span>g</span></p><p class="FSCtblMain"><span>g</span></p></td><td style="width:90.45pt; padding-right:4.9pt; padding-left:5.4pt; vertical-align:top"><p class="FSCtblMain"><span>g</span></p><p class="FSCtblMain"><span>g</span></p></td></tr><tr><td style="width:109.6pt; padding-right:5.4pt; padding-left:4.9pt; vertical-align:top"><p class="FSCtblMain"><span>Carbohydrate</span><br><span>—sugars</span></p></td><td style="width:107.75pt; padding-right:5.4pt; padding-left:5.4pt; vertical-align:top"><p class="FSCtblMain"><span>g</span></p><p class="FSCtblMain"><span>g</span></p></td><td style="width:90.45pt; padding-right:4.9pt; padding-left:5.4pt; vertical-align:top"><p class="FSCtblMain"><span>g</span></p><p class="FSCtblMain"><span>g</span></p></td></tr><tr><td style="width:109.6pt; padding-right:5.4pt; padding-left:4.9pt; vertical-align:top"><p class="FSCtblMain"><span>Sodium</span></p></td><td style="width:107.75pt; padding-right:5.4pt; padding-left:5.4pt; vertical-align:top"><p class="FSCtblMain"><span>mg (mmol)</span></p></td><td style="width:90.45pt; padding-right:4.9pt; padding-left:5.4pt; vertical-align:top"><p class="FSCtblMain"><span>mg (mmol)</span></p></td></tr><tr><td style="width:109.6pt; padding-right:5.4pt; padding-left:4.9pt; vertical-align:top"><p class="FSCtblMain"><span>(insert any other nutrient or biologically active substance to be declared)</span></p></td><td style="width:107.75pt; padding-right:5.4pt; padding-left:5.4pt; vertical-align:top"><p class="FSCtblMain"><span>g, mg, </span><span>μ</span><span>g (or other units as appropriate)</span></p></td><td style="width:90.45pt; padding-right:4.9pt; padding-left:5.4pt; vertical-align:top"><p class="FSCtblMain"><span>g, mg, </span><span>μ</span><span>g (or other units as appropriate)</span></p></td></tr></tbody></table>

The central legal concept in Schedule 12 is prescription by example: the Schedule supplies internal format examples for nutrition information panels that correspond to specific Code provisions. Rather than defining nutritional values or measurement methodology, Sched‑ule 12 standardises the presentation, labelling terminology and placement of data within a panel. The identified Code cross‑references indicate when each template is the applicable format (for example, the format for subsection 1.2.8,6(2) is set out in S12,2; the format for subsection 1.2.8,6(3) and related subclauses is in S12,3; percentage daily intake panels are exemplified in S12,4).

Key formatting and labelling elements the Schedule standardises:

Headings and introductory lines: the header "NUTRITION INFORMATION" and the lines "Servings per package: (insert number of servings)" and "Serving size: g (or mL or other units as appropriate)" appear consistently in the examples (S12,2 to S12,7).
Mandatory nutrient rows and units: energy, protein, total fat and its specified sub‑groups (saturated, trans, polyunsaturated, monounsaturated), cholesterol, carbohydrate and sugars, dietary fibre, sodium, and a placeholder for "any other nutrient or biologically active substance to be declared" with appropriate units (g, mg, μg) are included in the examples (S12,2 to S12,4).
Variants: S12,3 displays a denser panel with multiple fat sub‑groups and sub‑sub‑groups indicated by notes (* and **) and shows how subgroup labelling is to be presented in the first column; S12,4 adds a separate column for percentage daily intake per serving, with the explanatory note that PDIs are calculated on an 8700 kJ average adult diet.
Food‑type specific examples: S12,5 shows the inclusion of a "COMPOSITION INFORMATION" section adjacent to the NIP for formulated caffeinated beverages (with a list of vitamins and active constituents); S12,6 addresses infant foods and shows where claimed fatty acids should be inserted; S12,7 shows a chewing gum example and includes an explanatory footnote about "average quantity of calcium released during 20 minutes of chewing."

The Schedule also contains notes that qualify the templates:

the asterisk system identifying sub‑group and sub‑sub‑group nutrients (S12,3 note);
the instruction that the word "total" following "protein" or "dietary fibre" need only be included if it is immediately followed by a sub‑group (S12,3 note);
units for sodium may be presented as mg (mmol) in each applicable column (appearing across S12,2 to S12,7).

Finally, the Schedule sits within the broader Code and legislative framework: it is a Standard made under the Food Standards Australia New Zealand Act 1991 (Cth) (Note 1), applied in Australia and incorporated/adopted in New Zealand under the Food Act 2014 (NZ) where relevant (Note 2). The amendment and transitional material explains when changes to the Schedule took effect and provides transitional flexibility for industry during changeovers.

The Schedule’s practical reach extends to all parties who produce, package, import, supply or label foods that fall within the Code provisions linked to the examples. At minimum, affected parties include:

Food manufacturers and brand owners required to label packaged foods under the Code subsections referenced. The Schedule sets out the format that the nutrition information panel must take where those Code subsections apply (S12,2 to S12,7). Therefore manufacturers who supply foods subject to those subsections must adopt a panel consistent with the corresponding example.
Importers and distributors who place packaged foods on the Australian and New Zealand markets. Because the Schedule forms part of the Code (Note 1, Note 2), imported goods must meet the same presentation expectations in the jurisdictions where the Code applies or is adopted.
Packaging designers and labelling vendors who produce printed or pre‑printed packaging and product labels. The Schedule’s templates prescribe layout elements (header text, columns, sequence of nutrients, unit conventions and special notes) that label suppliers must reproduce in finished labels or packaging artwork (S12,2 to S12,7).
Food testing laboratories and nutrition analysts who prepare the numerical declarations to be inserted into the panel. While the Schedule does not prescribe analytical methods, it requires numeric values for specific nutrients and units to be displayed in particular columns and formats, thus creating demand for nutrient quantification that supports labelling (see the repeated fields and unit formats across S12,2 to S12,7).
Regulatory enforcement agencies and compliance officers in Australia and New Zealand. The Schedule is a standard within the Code and therefore becomes operative for inspection and compliance purposes in jurisdictions that have adopted the Code (Note 1; Note 2).
Retailers who repackage or display product information, and private label producers who supply products under a retailer’s brand. They must ensure that labelling artwork they order or accept complies with the format where Code subsections require it.

Financially, the immediate costs fall onto the business that prepares product packaging and declares nutrition information. Costs include label redesign, plate or print run changes, and the generation or updating of nutrient declaration data. The Schedule’s transitional provisions recorded in the application, saving and transitional provisions table (notably the transitional variation for the 2015 amendments and the transition period commencing 1 March 2016 and ending 18 January 2017) create temporal flexibility, but require firms to decide which Code version they will comply with during the transition period (see the transitional variation clause details). Where the Schedule prescribes food‑type specific additions (for example, composition information for formulated caffeinated beverages in S12,5, claimed fatty acids for infant foods in S12,6, or average release information in S12,7), producers of those foods bear additional content obligations relative to simple packagers of non‑specialised foods.

Regulatory sovereignty is also relevant: the Schedule is made under the FSANZ Act 1991 (Cth) and applies in Australia, while the Code provisions that apply in New Zealand are incorporated or adopted under the Food Act 2014 (NZ) (Note 2). This means domestic regulators decide on adoption and enforcement, and businesses operating across jurisdictions must follow the regime applicable in each jurisdiction.

The Schedule supplies prescriptive formats that operate as the referenced "format for a nutrition information panel" for specified Code subsections. The practical duty flowing to a food business is to present declared nutritional information in the format appropriate to the Code subsection that applies to that product. The Schedule repeatedly begins its examples with formulaic words such as "For subsection 1.2.8,6(2), the format for a nutrition information panel is:" (S12,2), indicating that when that subsection of Standard 1.2.8 applies, the sample is the intended format. This creates a duty to use the relevant template fields and headings where those Code provisions require a NIP.

Specific duties or content expectations the Schedule implies or makes explicit include:

Display of the heading "NUTRITION INFORMATION" and inclusion of "Servings per package: (insert number of servings)" and "Serving size: g (or mL or other units as appropriate)" (S12,2 to S12,7).
Presentation of nutrient lines with prescribed labelling and units: energy in kJ (Cal), protein in g, fat (total) with indicated subgroups (saturated; trans; polyunsaturated; monounsaturated) where applicable, cholesterol in mg, carbohydrate with sugars as a subgroup, dietary fibre, sodium in mg (mmol), and a placeholder for any other nutrient or biologically active substance (S12,2 to S12,4).
Where percentage daily intake information is included, the Schedule’s example requires a dedicated PDI column and an explanatory footnote stating that percentage daily intakes are based on an average adult diet of 8700 kJ (S12,4).
For formulated caffeinated beverages, the Schedule supplies an example of "COMPOSITION INFORMATION" that may be placed adjacent to or after the NIP to list caffeine, vitamins and other included substances and their units (S12,5).
For infant foods and chewing gum calcium claims, the Schedule gives examples of where special composition information or explanation should be placed and what wording may be used (S12,6; S12,7).

The Schedule also sets out conditional formatting guidance: notes accompanying S12,3 explain that an asterisk (*) indicates a sub‑group nutrient and double asterisks (**) indicate a sub‑sub‑group, and the word "total" need only follow "protein" or "dietary fibre" where a subgroup follows immediately (S12,3 note). Therefore there is a duty to apply these wording conventions only where relevant.

Rights or procedural aspects are less overtly stated in the Schedule. It does not, for example, specify appeal rights, exemptions or testing methodologies within the Schedule text itself. However, the application and transitional provisions recorded at the end make explicit transitional options for industry when amendments take effect, stipulating that during the transition period a food may comply with either the Code as in force without the variations or the Code as amended by the variations, but not a combination of both (see transitional variation clause summarised in the instruments table). The transitional clause also provides a 12‑month stock‑in‑trade deemed compliance period commencing on 18 January 2017 for foods that complied with the Code before that date. Those transitional provisions create a temporary procedural right to adopt the earlier or the new labelling approach within the transition window (application table).

The Schedule itself does not enumerate enforcement sanctions, nor does it set out an exhaustive list of circumstances that trigger the use of a particular template; those matters are handled elsewhere in the Code and the FSANZ legislative framework (Note 1).

Schedule 12 does not itself create civil penalties, criminal offences or an enforcement regime. It is a Standard under the Food Standards Australia New Zealand Act 1991 (Cth) and forms part of the Australia New Zealand Food Standards Code (Note 1). Enforcement and penalties for non‑compliance with the Code are therefore matters for the broader legislative and regulatory framework under which the Code is adopted and enforced, including applicable State and Territory food legislation in Australia and, in New Zealand, the Food Act 2014 where the Code provisions are incorporated or adopted (Note 2).

What the Schedule does supply is prescriptive content and format that will be used by regulators and compliance officers to determine whether a nutrition information panel conforms to the format required under the linked Code subsections. Non‑conformance with the prescribed format is a compliance issue under the Code. The Schedule therefore functions as a standard of presentation that regulatory authorities will consider when assessing labelling compliance, even though it does not itself set out enforcement mechanisms or penalty levels.

The Schedule’s transitional variation and application notes are also material for enforcement timing: the transitional table specifies a transition period and a deferred stock‑in‑trade deemed compliance period (see the application, saving and transitional provisions table). That transitional material affects when a label must comply with the new formatting obligations and provides temporary tolerance for existing stock. Enforcement action respecting labels that were lawfully produced under the pre‑variation Code and remain in stock during the specified transition may be governed by the transitional clauses (for example, a food is "deemed to comply with the Code as amended by the above variations for a period of 12 months commencing on 18 January 2017 if the food otherwise complied with the Code before that date" , transitional table).

Because the Schedule is part of the Code, the practical enforcement pathway is:

regulators identify non‑compliant labelling by reference to the Schedule’s format examples where the corresponding Code subsection applies;
any enforcement or penalty action, including warning notices, infringement notices, seizure or prosecution, would follow from the enforcement powers in the relevant domestic food laws and policy instruments implementing the Code (the Schedule does not recite or reproduce these powers).

Users seeking the exact enforcement consequences , penalty amounts, prosecutorial discretions, or interstate differences , must look to the Food Standards Australia New Zealand Act 1991 (Cth), respective State and Territory food laws, and the Food Act 2014 (NZ) for the specific enforcement mechanisms and penalty schedules. The Schedule itself provides the compliance standard for the content and layout of NIPs rather than the enforcement apparatus.

Schedule 12 is expressly a component of the Australia New Zealand Food Standards Code and is made under the Food Standards Australia New Zealand Act 1991 (Cth) (Note 1). That structural placement directs how the Schedule interacts with other legal instruments and regulatory systems.

Interaction with the Code

The Schedule supplies templates keyed to particular Code provisions, for example subsection 1.2.8,6(2), 1.2.8,6(3), 1.2.8,6(5), and other subsections explicitly referenced at the start of the Schedule. This means Schedule 12 must be read alongside Standard 1.2.8 and the other referenced provisions; the Schedule provides the format "for" those subsections (see S12,2 and S12,3 opening lines). The NIP content obligations themselves are in Standard 1.2.8; Schedule 12 gives the appearance and sequence that regulators will expect under those content rules.

Interaction with the FSANZ Act and amendments

Note 1 states the Schedule is a standard under the FSANZ Act 1991 (Cth). Amendments to the Schedule are made under s 92 of that Act unless otherwise indicated; the application, saving and transitional provisions table explicitly records variation instruments and their commencement and transitional arrangements (application table). Thus the Schedule interacts with the FSANZ Act’s procedures for making, registering and commencing standards and variations under that Act.

Interaction with State/Territory and New Zealand law

Note 2 explains that the provisions of the Code that apply in New Zealand are incorporated in, or adopted under, the Food Act 2014 (NZ). That means that in New Zealand the Schedule’s content and format requirements apply only to the extent they have been incorporated or adopted under the domestic Food Act and relevant regulations. In Australia, operation and enforcement of the Schedule’s format requirements will occur via the States’ and Territories’ implementation of the Code and associated food safety laws and enforcement mechanisms.

Interaction with product‑specific Code provisions

Schedule 12 provides specialised panels that correspond to specific Code requirements for particular food classes: e.g., the "COMPOSITION INFORMATION" example for formulated caffeinated beverages (S12,5) corresponds to paragraph 2.6.4,5(2)(b) and shows how compositional declarations may be placed adjacent to or following the NIP; the infant food example is tied to subsection 2.9.2,11(3) (S12,6); and the chewing gum calcium example aligns with section 2.10.3,5(3) (S12,7). These examples illustrate how Schedule 12 is intended to work in tandem with substantive food‑type specific Code rules.

Practical interplay with labelling obligations

Where Standard 1.2.8 requires nutrient declarations, the Schedule’s formats prescribe how those declarations should be arranged, their headings and units, and where explanatory footnotes should appear (for example, the PDI explanatory footnote in S12,4). Firms therefore must ensure that numeric declarations prepared under Standard 1.2.8 are presented in the format prescribed by Schedule 12 where the Code subsection points to that template.

Transitional interaction

The Schedule’s own amendment history and the attached transitional variation illustrate legal interactions over time: the transitional clause in the application table , which allows foods to comply with either the previous Code or the amended Code during a specified period but not a combination of both, and which provides a deemed compliance stock‑in‑trade window , shows how the Schedule interacts with the temporal effect of amendments made under the FSANZ Act (application table).

In short, Schedule 12 operates as a presentation standard that interacts with substantive Code obligations in Standard 1.2.8 and related provisions, and it is embedded within the FSANZ statutory amendment and commencement framework and the domestic food regulatory systems in Australia and New Zealand.

Schedule 12 contains an explicit amendment history and records its preparation and compilation details. The Schedule was published in the Food Standards Gazette No. FSC96 on 10 April 2015 as part of Amendment 154 (F2015L00482 - 2 April 2015). The document accompanying the Schedule indicates it is compilation No. 2 of Schedule 12 as in force on 13 April 2017 (up to Amendment No. 168) and was prepared by Food Standards Australia New Zealand on 13 April 2017. The Schedule also indicates it includes any commenced amendment affecting the compilation to that date.

The tabular amendment history at the end of the Schedule lists subsequent amendments to specific sections and provides instrument identifiers, FRL registration numbers and commencement dates. The entries in the table include, among others:

S12,3 amended by Amendment No. 159. The FRL registration is F2015L01931 (3 December 2015), and the Gazette reference is FSC101 (7 December 2015), with a commencement date of 1 March 2016. The amendment was to insert cross‑references to Standard 1.2.8 (table entry: S12,3, A’ment No. 159).
S12,4 amended by Amendment No. 161. The FRL registration is F2016L00120 (18 February 2016), and the Gazette reference is FSC103 (22 February 2016), with a commencement date of 1 March 2016. The amendment related to the omission of text from the nutrition information panel example deemed not relevant (table entry: S12,4, A’ment No. 161).
The table to S12,7 was amended by Amendment No. 168. The FRL registration is F2017L00414 (11 April 2017), Gazette FSC110 (13 April 2017), with a commencement date of 13 April 2017. The stated change replaced "serve" with "serving" for consistency (table entry: table to S12,7, A’ment No. 168).

Additionally, an explicit "Australia New Zealand Food Standards Code - Transitional Variation 2015 (Proposal P1037 - Amendments associated with Nutrition Content & Health Claims)" is included in the application, saving and transitional provisions section. That transitional variation is recorded in the instruments table and the summary explains:

Clause 4 establishes a transition arrangement for variations made by Item [6] of the Schedule;
The transition period commences on 1 March 2016 and ends on 18 January 2017 (bolded in the summary);
Subclause 4(3) provides that during the transition period a food may comply with either the Code as in force without the variations or the Code as amended by the variations, but not a combination of both; and
Subclause 4(4) provides a stock‑in‑trade exemption/deeming provision: foods that otherwise complied with the Code before 18 January 2017 are deemed to comply with the amended Code for a 12‑month period commencing on 18 January 2017.

The Schedule also carries an "Amendment History" preamble explaining that amendments are made under section 92 of the FSANZ Act 1991 unless otherwise indicated, that amendments do not have a specific date for cessation unless indicated, and that the table provides information about each amendment to the Schedule, including commencement or cessation information. The compilation note explains that uncommenced amendments or provisions ceasing to have effect may be reflected in later compilations.

This history shows a pattern of iterative changes, largely focused on cross‑referencing the correct Code provisions and cleaning up exemplar language and presentation. The transitional variation in particular provided industry with a discrete transition window and a stock‑in‑trade grace period for initial adoption of the amended formats.

The Schedule itself does not record any litigation history. The Schedule text contains no references to judicial decisions, appeals, prosecutions or case law, and it names no legal proceedings. The instrument is a standards document providing label format examples and an amendment record; it does not include or summarise court answers to disputes about format compliance.

Because the Schedule is an administrative standard within the Australia New Zealand Food Standards Code, any legal contestation about its application, interpretation or enforcement would be litigated under the broader statutory framework (for example, under the Food Standards Australia New Zealand Act 1991 (Cth), relevant State or Territory food laws in Australia, or the Food Act 2014 in New Zealand), but the Schedule contains no internal summary of such litigation nor does it cite any cases. Users seeking litigation outcomes that bear on interpretation or enforcement of NIP format obligations therefore must consult case law databases, regulatory prosecution records and enforcement decisions outside of the Schedule itself.

In short, there is no litigation history recorded within Schedule 12 as provided.

The Schedule looks straightforward, but it contains a number of practical traps and conditional features that can affect compliance if overlooked:

Format is prescriptive and specific to Code subsections

Each HTML example is tied to particular Code subsections (for example, S12,2 is "For subsection 1.2.8,6(2)"; S12,3 is "For subsection 1.2.8,6(3) and 1.2.8,6(5)" etc). Using the wrong template for a product because of a mis‑classification under the Code will produce a panel that does not correspond to the Code subsection that governs the product (S12,2; S12,3). The Schedule’s wording suggests a strict mapping between product type/subsection and sample format.

Words and labels are conditional

The note in S12,3 that "The word 'total' following 'protein' or 'dietary fibre' in the first column of the panel need only be included if it is followed immediately by a sub‑group" is an easy oversight. If a label mechanically inserts "total" everywhere, the label may not conform to the exact formatting conventions the Schedule presents (S12,3 note).

Subgroup and sub‑subgroup notation

The asterisk (*) and double asterisk (**) system flags sub‑groups and sub‑sub‑groups. Failure to apply these markers correctly in the table layout could be interpreted as non‑conformity with the specific example, particularly where the Code requires the display of sub‑group nutrients (S12,3 note).

Percentage daily intake reference energy

The PDI example in S12,4 includes a footnote: "Percentage daily intakes are based on an average adult diet of 8700 kJ." Using a different reference value without clear legal foundation or failing to include the explanatory footnote will deviate from the Schedule example (S12,4).

Placement of composition information for formulated caffeinated beverages

S12,5 shows composition information "adjacent to or following a nutrition information panel" for formulated caffeinated beverages. Labelling producers must ensure the composition block is correctly located in relation to the NIP; placing it elsewhere could be a technical non‑conformance with the example (S12,5).

Food‑type specific explanatory notes and averages

The chewing gum example (S12,7) includes an explanatory footnote: "*average quantity of calcium released during 20 minutes of chewing". The inclusion of time‑based release figures and the word "average" signals that the Schedule expects contextual statements to be included where relevant. Omitting or misplacing such explanatory text could make a label inconsistent with the example (S12,7).

Units and dual unit presentation

Sodium is shown as "mg (mmol)" throughout the examples. The Schedule expects specific units alongside some nutrients. Failure to display the unit in the specified place may be read as non‑compliance even if the numeric declaration is present (S12,2 to S12,7).

Transition mechanics: no mixing of old and new

The transitional variation summarised in the application table permits compliance with either the pre‑variation Code or the amended Code during the transition period, but it expressly forbids combining elements of both. A label that mixes fields or layout elements from both versions risks non‑compliance (application table, transitional variation clause 4(3)).

Stock‑in‑trade deemed compliance timing

The stock‑in‑trade protection is time‑limited and conditional: foods that complied with the Code before 18 January 2017 are "deemed" to comply with the amended Code for 12 months commencing on 18 January 2017. Businesses relying on that deemed compliance must be aware of the expiry date and ensure relabelling or run‑down of stock before the lapse (application table, subclause 4(4)).

HTML examples vs practical print constraints

The Schedule’s examples are presented as HTML tables. Translating those HTML table layouts into physical packaging on small or irregular pack shapes requires interpretation. The Schedule does not provide alternative small pack exemptions in this text; users must confirm applicable small‑packaging rules elsewhere in the Code. The Schedule’s template detail (column widths, border styles) could be interpreted strictly by enforcement bodies, making translation choices potentially contentious.

These "gotchas" show that the Schedule’s compliance obligations are often about formatting precision and placement as much as about numeric accuracy. Firms should not assume that having the correct nutrient numbers is sufficient if the panel’s layout, headings, footnotes and units do not match the applicable Schedule example for their product.

Compliance with Schedule 12 requires a combination of legal classification, label design discipline and timing awareness. The steps below follow directly from the Schedule’s content and the transitional material it records.

Identify the applicable Code subsection

Determine which subsection of the Code applies to the food in question (for example, Standard 1.2.8 provisions or specific provisions such as paragraph 2.6.4,5(2)(b), subsection 2.9.2,11(3) or subsection 2.10.3,5(3)). The Schedule’s templates are mapped to specific subsections; use the template corresponding to the subsection that governs your product (see the opening lines to S12,2 through S12,7).

Select the correct Schedule template

Use the precise example provided by Schedule 12 for that subsection: the basic NIP format (S12,2), the extended multi‑fat subgroup NIP (S12,3), the PDI example (S12,4), the formulated caffeinated beverage example with composition information (S12,5), the infant food panel (S12,6), or the chewing gum example (S12,7). Do not mix elements from different templates unless the Code expressly permits.

Populate the fields with declared values and units

Insert the numeric declarations for each listed nutrient in the correct column and with the prescribed units: energy in kJ (Cal), protein in g, fat and its subgroups in g, cholesterol in mg, carbohydrate and sugars in g, dietary fibre in g, sodium in mg (mmol), and other nutrients in appropriate units (g, mg, μg) (S12,2 to S12,7). For the “other nutrient” placeholder, include the unit as indicated.

Follow subgroup labelling rules

Apply the asterisk notation for subgroup and sub‑subgroup nutrients as per S12,3. Include the word "total" after "protein" or "dietary fibre" only if the label immediately follows with a sub‑group, consistent with the Schedule’s note (S12,3 note).

Percentage daily intake (PDI) calculation and footnote

If including a PDI column (as in the S12,4 example), calculate the percentage using the reference diet of 8700 kJ and include the explanatory footnote stating that PDIs are based on an average adult diet of 8700 kJ (S12,4).

Composition information placement

For products covered by paragraph 2.6.4,5(2)(b) (formulated caffeinated beverages), place the compositional declarations (caffeine, thiamin, riboflavin, niacin, B6, B12, pantothenic acid, taurine, glucuronolactone, inositol or other specified constituents) adjacent to or following the NIP as shown in S12,5.

Food‑specific content

For infant foods, follow the S12,6 example and include "insert claimed fatty acids" where the template requires it. For products such as calcium‑containing chewing gum, include the explanatory average release information and RDI notation as shown in S12,7.

Unit presentation and labelling placement

Ensure unit conventions are followed exactly (for example sodium as "mg (mmol)") and that headings such as "Quantity per Serving" and "Quantity per 100 g (or 100 mL)" are present and accurate (S12,2 to S12,7). The header "NUTRITION INFORMATION" and the serving lines must be included.

Transitional compliance timing

Consult the Schedule’s transitional variation summary and the instruments table for applicable transition windows. For the 2015/2016 variation, the transition period was stated as commencing on 1 March 2016 and ending on 18 January 2017, with a 12‑month stock‑in‑trade deeming period commencing on 18 January 2017 for certain variations (application table). During an active transition period, choose whether to comply with the previous Code version or the amended Code but do not combine elements of both. Track the expiry of any deemed compliance period and plan relabelling or stock run‑down accordingly.

Document the label design choices and supporting data

Maintain records showing how the nutrient values were derived and why a particular Schedule template applies. The Schedule does not set analytical methods, so retain laboratory reports, formulation records and decisions about serving size and servings per package as part of compliance evidence. If the product is imported, ensure import documentation shows conformity to the format required in the destination jurisdiction.

Confirm jurisdictional adoption

If selling in New Zealand, confirm that the relevant Code provisions (and the Schedule to the extent adopted) have been incorporated under the Food Act 2014 (NZ) in the applicable form in New Zealand (Note 2). Differences in local implementation or enforcement practice between Australian States/Territories and New Zealand may affect compliance obligations in each market.

Seek authoritative clarification when in doubt

Where the appropriate template is ambiguous for a product type, or where packaging constraints (small packs, unusual shapes) make reproduction of the template problematic, seek authoritative clarification from the relevant regulator. The Schedule itself provides the intended format, but does not set out exceptions or small pack variations in this text; those may be found elsewhere in the Code or in jurisdictional guidance.

Who pays and who decides

The commercial entity responsible for labelling or the proprietor placing the food on the market pays for label redesign and any supporting testing. Regulatory agencies decide whether a panel conforms by reference to the Schedule and the linked Code provisions. The Schedule’s prescriptive format means those agencies have a clear standard against which to assess layout conformity, and firms must either meet that standard or seek permitted alternatives where provided elsewhere in the Code.

Following these steps will align label layout and content with the Schedule’s examples. Because the Schedule prescribes format, practical compliance hinges on correct subsection classification, careful reproduction of headings, units, subgroup labelling and footnotes, and attention to transitional timing.
