#### 41CW Exemption from Part 3 of the Environment Protection and Biodiversity Conservation Act 1999 (1) Part 3 of the Environment Protection and Biodiversity Conservation Act 1999 does not apply to: (a) actions authorized by the historic section 41 authority or by a rehabilitation authority; or (b) actions that a person has the power to perform under section 41 or 41CC of this Act because such an authority is in force. > Note: For historic section 41 authority, see subsection 5(1). (2) Subsection (1) only applies to actions that are taken in accordance with any conditions or restrictions specified in, or any requirements imposed by, the historic section 41 authority or the rehabilitation authority.
