107Auditor may make representation

107 Auditor may make representation (1) An auditor of an incorporated association who receives a notice from the association under section 106(4)(a) may, within 7 days after receiving the notice, make a written representation, not exceeding a reasonable length, to the secretary of the association. (2) Subject to section 108, if the auditor makes a representation under subsection (1), a resolution proposing the auditor's removal is of no effect unless— (a) the secretary gives a copy of the representation to all members of the association prior to the meeting at which the resolution is to be considered; and (b) the auditor is allowed to attend the meeting and address the members present prior to the vote on the resolution. (3) A document required to be given to a member of an incorporated association under this section may be given— (a) personally; or (b) by post; or (c) by any other means authorised under the rules of the association. (4) All costs associated with giving a document to the members of an incorporated association under this section are to be borne by the association.
