40 Effect of change of name (1) A change of name of an incorporated association under section 38 is not taken to— (a) create a new legal entity; or (b) prejudice or affect the identity of the body corporate constituted by the association or its continuity as a body corporate; or (c) affect the date of incorporation of the association; or (d) affect the property, or the rights and obligations of the (e) render defective any legal proceedings by or against the (2) If the name of an incorporated association has been changed, any legal proceedings that could have been continued or instituted by or against the association in its former name may be continued or instituted by or against the association in its new name.
