9 Names of associations

(1)  *[Section 9 Subsection (1) amended by No. 9 of 1982, s. 7 and Sched. 10 ]*The Commissioner shall not grant to an association a certificate of incorporation under –

(a) a name that is identical with a name by which –

(i) another association is incorporated under this Act;

(ii) [Section 9 Subsection (1) amended by No. 42 of 2001, Sched. 1, Applied:15 Jul 2001] a company is registered under the Corporations Act;

(iia) [Section 9 Subsection (1) amended by No. 42 of 2001, Sched. 1, Applied:15 Jul 2001] .  .  .  .  .  .  .  .  

(iii) a business name is registered under the Business Names Act 1962 ;

(iv) [Section 9 Subsection (1) amended by No. 42 of 2001, Sched. 1, Applied:15 Jul 2001] a co-operative housing society is incorporated under the Co-operative Housing Societies Act 1963  –

or that so nearly resembles any such name as, in the opinion of the Commissioner, to be calculated to deceive; or

(b) except with the consent of the Minister, a name that, in the opinion of the Commissioner, is undesirable or is a name, or a name of a kind, that the Minister has directed the Commissioner not to accept for registration.
