9 Certificate of incorporation (1) If the Director receives an application under section 8, the Director may, if the Director considers it appropriate, issue to the association a certificate of incorporation. (2) If the association is a trading association, the certificate of incorporation must state that fact. (3) The Director must refuse to issue a certificate of incorporation: (a) to an association if its name is a prescribed unauthorised name unless the Minister consents to its incorporation under that name; and (b) in the case of a trading association if: (i) the ethnic community specified in the application is not a prescribed ethnic community; or (ii) satisfied the constitution of the association is unreasonable or unfair. (4) The Director may refuse to issue a certificate of incorporation on another ground the Director considers appropriate.
