Assistance for Severely Affected Regions (Special Appropriation) (Coronavirus Economic Response Package) Act 2020

The Act rests on a compact of appropriation, conditional payments via agreements, delegated execution and delegated rule‑making. The central fiscal concept is a single line appropriation of $1 billion out of the Consolidated Revenue Fund for a stated set of pandemic‑related economic support purposes (s 4(1) and (2)). That appropriation is not divided in the text; instead the Minister may make rules that set amounts to be appropriated for specified purposes under the appropriation (s 7(2)(b)). The Act therefore separates the statutory allocation (the $1 billion high‑level cap and purposive statement) from the more granular allocation and eligibility design, which the executive will generally make through rules and written agreements.

Another core concept is universality of the written‑agreement requirement. For every category of recipient,States and Territories (s 5(1)), constitutional corporations (s 5(2)) and other persons (s 5(3)),the Act mandates that the terms and conditions on which payments are made must be set out in a written agreement and that the recipient must comply with those terms and conditions. The Act thus uses contract as the mechanism to impose conditions on recipients rather than embedding substantive eligibility criteria or conditions in many statutory elements. The Act does not itself specify the content of those agreements or set objective eligibility thresholds; it confines itself to imposing the requirement of a written contract and making certain powers available to the Minister and accountable authorities to conclude them (s 5(4)).

Delegation and administrative structure are expressed tightly. A Minister may delegate the power to make agreements to an official who is an SES employee or who holds an equivalent or higher position (s 6(1)). In exercising delegated powers, the delegate must comply with any directions of the Minister (s 6(2)). Accountable authorities of non‑corporate Commonwealth entities have symmetric delegation and direction obligations (s 6(3)-(4)). The Acts Interpretation Act 1901 is expressly invoked for the meaning of SES employee and acting SES employee (s 6 note), thus folding in that interpretive definition.

Rule‑making is both broad in scope and explicitly bounded. The Minister’s power to make rules by legislative instrument under s 7(1) reaches matters required or permitted by the Act, and matters necessary or convenient for giving effect to it. The rules may prescribe payment circumstances and amounts, and can allocate administration to another Minister (s 7(2)). The Act sets upper bounds on executive regulation by forbidding the rules from creating offences or civil penalties, imposing tax, granting coercive powers of arrest/detention or entry/search/seizure, or directly amending the Act text (s 7(3)). The Act also records that other legislative authority may be relied upon for spending the appropriation, including the Act’s own purposes and the Financial Framework (Supplementary Powers) Regulations 1997 (s 7(4) Note). The rules are defined as a statutory instrument, which concentrates design and detail-making with the executive while leaving certain hard lines to primary legislation.

The temporal and financial constraints are equally central. The $1 billion ceiling (s 4(1)) caps total fiscal exposure under this appropriation. The hard deadline for payments under this appropriation,no payments after 30 June 2021,is a statutory sunset that converts any residual appropriation into unusable funds after that date (s 8). The commencement clause establishes immediate effect from the day after Royal Assent (s 2).

Finally, the Act cross‑references existing governance concepts rather than repeating them. Several key terms are defined by reference to the PGPA Act and to the Constitution (s 3). That means practitioners must read this Act together with those instruments to determine who may act on behalf of the Commonwealth, who counts as a Commonwealth entity and what legal form a recipient constitutional corporation has.

The Act creates or affects a discrete set of institutional and private actors through the appropriation and contract requirement. At the top level, the payer is the Commonwealth operating from the Consolidated Revenue Fund; payments are limited to the appropriation of $1 billion (s 4(1)). The practical decision‑makers enacted into the text are Ministers and accountable authorities of non‑corporate Commonwealth entities, each of whom may enter written agreements on behalf of the Commonwealth (s 5(4)). Ministers can also delegate to senior executive officials; accountable authorities can delegate to SES employees or equivalents (s 6). Rules may vest another Minister with administration of a specified amount (s 7(2)(c)). Therefore the Act affects executive decision‑makers across portfolios by giving them instruments and discretion to allocate and administer the funds.

Recipients expressly captured by the Act are States and Territories (s 5(1)), constitutional corporations (s 5(2)) and other persons (s 5(3)). Each category is subject to the same structural requirement that the funds be provided on terms and conditions set out in a written agreement and that the recipient comply with those terms. The definition of constitutional corporation is by reference to paragraph 51(xx) of the Constitution (s 3), which imports constitutional law concepts into statutory eligibility and means that private corporations within that constitutional classification are potential recipients. The “other persons” category is broad on its face and will include individuals, non‑constitutional corporations and non‑corporate bodies; the Act does not impose a statutory list of eligible entities beyond the listed categories, but it insists on a written agreement before payment (s 5(3)). The statutory definition of accountable authority, Commonwealth entity, non‑corporate Commonwealth entity and official is taken from the PGPA Act (s 3), so entities and officials governed by the PGPA Act are directly affected via these cross‑references.

Specified Commonwealth authorities are identifiable beneficiaries in one part of the text. The Act lists reimbursement of Commonwealth entities, including the Great Barrier Reef Marine Park Authority and the Director of National Parks, for fees and charges that are waived as an included purpose of the appropriation (s 4(2)(f)). That inclusion makes clear that fee waiver reimbursements to those authorities are within the ambit of appropriation and that they may be paid under appropriate agreements.

Providers of practical administrative support, such as officials who will negotiate and sign agreements, SES employees who may be delegated powers, and legal teams drafting agreements and rules, are affected on an operational level. The Act imposes particular processes on them: agreements must be in writing and delegates must be appointed in writing to be valid (s 5(4), s 6(1) and (3)). Any Ministerial directions to delegates must be followed (s 6(2), (4)), which places compliance obligations on delegates and on the accountable authorities who will supervise delegates.

Finally, the Act affects parliamentary processes in a narrow way by providing for rules to be made by legislative instrument (s 7(1)). The text does not elaborate parliamentary oversight mechanisms, but the choice of legislative instruments as the secondary lawform places the design of operational criteria and allocations within the executive’s statutory rule‑making capacity (s 7(1)-(2)). This design decision affects recipients because eligibility criteria and payment conditions are likely to appear in those rules and in the written agreements that the rules permit or require.

The Act imposes a small set of clear duties and confers practical rights relevant to entering and administering payments under the appropriation. The primary duty imposed on the Commonwealth is to restrict payments to the appropriation of $1 billion and to the purposes outlined in the Act; the Commonwealth is also bound not to pay money from this appropriation after 30 June 2021 (s 4(1); s 8). The Act does not create positive entitlements to payment for any class of recipient; instead it supplies financial capacity and procedural rules for making payments. The Act repeatedly uses mandatory language,“must” and “must comply”,to impose enforceable duties on both payers and recipients with respect to written agreements (s 5(1)-(3)).

For recipients, the central duty is to comply with the terms and conditions set out in the written agreement that accompanies any payment under this appropriation (s 5(1)(b), (2)(b), (3)(b)). The Act makes acceptance of the written agreement the vehicle for imposing conditions. It does not prescribe the content of those terms and conditions in the Act itself; the content is left to the agreement, subject to any rules the Minister may make and to directions imposed under delegations. For States and Territories, constitutional corporations and other persons the duty to comply with the agreement is identical in form.

On the Commonwealth side, the Act sets out duties about form and authority for concluding written agreements. Only a Minister or an accountable authority of a non‑corporate Commonwealth entity may enter an agreement on the Commonwealth’s behalf under s 5(4). Ministers and accountable authorities have a duty to ensure that their delegates, if any, are appointed in writing and that delegates comply with any directions given (s 6(1)-(4)). Delegates themselves have a duty to comply with directions from the delegating Minister or accountable authority when exercising their delegated powers (s 6(2), (4)). The statutory requirement that delegations be in writing and that delegates comply with directions provides internal control lines to the executive.

The Act confers rule‑making rights to the Minister. The Minister may make rules by legislative instrument prescribing matters required or permitted by the Act, or matters necessary or convenient to give effect to it (s 7(1)). Those rules can define the circumstances in which payments are made, set amounts to be appropriated for specified purposes, and allocate administration of a specified amount to another Minister (s 7(2)). However the Act expressly denies the rules power to create offences or civil penalties, to provide coercive law‑enforcement powers, to impose a tax, or to directly amend the Act (s 7(3)). These boundaries limit what the Minister can achieve through rules and reserve certain powers to primary legislation.

Finally, the Act confers a limited right to reimbursement for certain Commonwealth entities through the definition of purposes that include reimbursing entities for waived fees and charges (s 4(2)(f)). That right is, however, subject to the agreement process and to the overall appropriation cap and temporal limit. The Act does not convert that purpose into an unconditional entitlement; any such reimbursement will be effected through the agreement framework established in s 5.

The Act contains no new criminal offences or civil penalty regimes. It expressly prevents the rules made under s 7 from creating an offence or civil penalty (s 7(3)(a)), and the main body of the Act does not introduce any separate penal sanctions. Enforcement therefore will be primarily contractual and administrative rather than penal: payment conditions are attached via written agreements and recipients are required to comply with those terms (s 5(1)-(3)). Consequences for non‑compliance are not specified in the Act itself; any remedies or enforcement mechanisms must be provided for in the written agreements or in other applicable legal instruments. The Act leaves the content of enforcement mechanisms to agreement drafting and to whatever rules the Minister may validly make under s 7(1)-(2), subject to the limits on punitive or coercive rule content set out in s 7(3).

Administrative controls over spending are provided by the delegation and direction regime. Delegates exercising delegated authority to make agreements must comply with directions from the Minister or the accountable authority (s 6(2), (4)). Those direction obligations are a control point: the Minister or accountable authority retains supervisory control over delegation exercise and thereby a route for administrative enforcement of policy directives when agreements are being executed.

The Act also embeds financial constraints that operate as an enforcement mechanism of sorts: the appropriation cap ($1 billion) (s 4(1)) and the time limit for payments (no payments after 30 June 2021) (s 8) are statutory limits that terminate the executive’s capacity to make further payments under this appropriation once exhausted or expired. That creates a hard budgetary discipline which enforces limits on exposure without the Act spelling out specific sanctions.

Because the Act relies on written agreements for substantive conditions and compliance terms, practitioners should expect contractual enforcement pathways, repayment clauses, clawbacks, suspension of payments, termination for breach and similar mechanisms,to be placed in the agreements. Those specific enforcement mechanisms are not contained in the Act and must be drafted into individual agreements or rules. The Act rules out creating offences or civil penalties via rules (s 7(3)(a)), so any punitive consequences must be contractual or arise under other existing law.

The Act’s silence on judicial review, merits review or statutory appeal pathways means that remedies for disputes about administrative decisions under this appropriation will depend on the usual corpus of public law and contract law. The Act does not itself create a statutory cause of action or provide a specific statutory appeals process.

The Act deliberately cross‑references and imports concepts from existing statutes and instruments rather than restating them. Primary definitional interactions are explicit in s 3: accountable authority, Commonwealth entity and non‑corporate Commonwealth entity have the meanings given in the Public Governance, Performance and Accountability Act 2013; official also has the meaning given in that Act (s 3). The Acts Interpretation Act 1901 is invoked by note to define the terms SES employee and acting SES employee as they appear in the delegation provisions (s 6 note). The definition of constitutional corporation in s 3 refers to paragraph 51(xx) of the Constitution, meaning constitutional concepts of federal legislative power inform who counts as a constitutional corporation under the Act.

The Act allows the executive to rely on other legislative authority for spending the appropriation. The rules provision includes a note making explicit that subsection 2 (the enumerated rule powers) does not limit sources of legislative authority for spending money appropriated by this Act (s 7(4)). The note lists two examples the Commonwealth might rely on: the purposes set out in section 4 and provisions of the Financial Framework (Supplementary Powers) Regulations 1997 (s 7(4) Note). That explicit interaction signals that departments and legal advisers must read this Act alongside the Financial Framework Regulations and whatever other appropriation and expenditure law applies to particular payments.

Rule‑making by legislative instrument (s 7(1)) situates the Act within the parliamentary‑executive instrument architecture. The Act’s use of legislative instruments means operational criteria, amounts and administration arrangements will be made in secondary law. The Act restricts the rules from imposing offences, taxes or coercive powers (s 7(3)), thereby limiting the ways the executive can alter legal obligations via secondary instruments. The choice to use rules to allocate amounts or to designate another Minister for administration (s 7(2)(b)-(c)) creates potential overlaps with other statutory regimes that govern Ministerial powers and the administration of grant programmes; the Act itself does not resolve which existing statutory grant frameworks will apply. Practitioners must therefore map any rules to the relevant statutory frameworks under which payments will ultimately be made.

The appropriation withdraws funds from the Consolidated Revenue Fund to make payments (s 4(1)). That connects to the broader Commonwealth budgetary and appropriation law landscape. The Act’s commencement and time limit provisions interact with fiscal‑year timing and with other appropriation authorities: payments are prohibited after 30 June 2021 (s 8), so any payments must be finalised within the appropriation window. The Act also contemplates reimbursements to particular Commonwealth entities for waived fees (s 4(2)(f)), which will interface with the financial arrangements and fee‑setting regimes that apply to those entities. For example, if a Commonwealth agency waives a fee under separate statutory authority, the Act authorises reimbursement of that forgone revenue subject to agreement.

Finally, because the Act relies on written agreements to impose conditions on recipients (s 5(1)-(3)) the Act will interact with contract law and with any statutory frameworks that affect public contracts, grants or funding arrangements. However the Act itself does not prescribe the content or the legal form of those agreements beyond requiring they be in writing and that the recipient must comply with their terms.

The text provided is the Act as enacted in 2020, assented to on 24 March 2020 and with commencement the day after assent, recorded as 25 March 2020 (s 2; header information). The printed commencement table includes the specific commencement detail that the whole of the Act commences the day after Royal Assent (s 2 and the commencement table). The Act also contains a publishing note that the table relates only to the provisions of the Act as originally enacted and will not be amended in the published version to deal with later amendments (s 2(2)), which is a publishing caveat rather than an operative amendment. No amending provisions, schedules or later enactments are included in the text you provided.

Because this deep dive is restricted to the text supplied, there are no later amendments recorded in the source materials attached to this brief. The Act’s internal structure shows no inserted or footnoted later edits; it contains commencement, definitions, appropriation, terms for payments, delegation, rules and a time limit without any amendment markers. The Act also includes a short note recording the dates of the Minister’s second reading speech in both Houses (23 March 2020), but the text contains no legislative history narrative or subsequent amendment clauses.

Practitioners relying on this analysis should note that the Act itself expressly contemplates that the Minister may make rules and that other legislative instruments or regulatory provisions, including the Financial Framework (Supplementary Powers) Regulations 1997, could provide authority for spending (s 7(4) Note). Any subsequent amendments to those rules, to the Financial Framework Regulations or to the PGPA Act definitions that this Act cross‑references would change the practical operation of this appropriation. However, those potential changes are outside the text provided here and are not recorded in this document.

The supplied text contains no litigation history and does not cite any judicial decisions. The end of the Act records the dates of the Minister’s second reading speech in both the House of Representatives and the Senate (23 March 2020), but there are no cases, proceedings, or judicial determinations referenced in the instrument as supplied. The Act does not create offences or civil penalties (and expressly prevents rules from doing so) (s 7(3)(a)), and it frames enforcement as contractual and administrative; the instrument itself contains no recorded disputes or litigation record.

Because there is no litigation material in the source, this section records that no cases, appeals, or court rulings are referenced in the Act as provided. Practitioners who need to understand any judicial interpretation of the Act will need to consult external case law databases and court records for proceedings that may have arisen after the enactment, since no such material is included in the statutory text at hand.

1. Appropriation cap and time limit are hard limits: The appropriation is expressly limited to $1 billion (s 4(1)) and the Commonwealth must not pay money under that appropriation after 30 June 2021 (s 8). Any operational plan that contemplates payments beyond the cap or the date cannot be executed under this appropriation.

2. Written agreement requirement covers everyone: Payments to States and Territories, to constitutional corporations and to other persons each require the terms and conditions to be set out in a written agreement and require compliance by the recipient (s 5(1)-(3)). There is no alternative statutory payment mechanism in the Act; all payments under this appropriation must be accompanied by a written agreement.

3. The purposes listed are illustrative not exhaustive: Section 4(2) is prefaced by “without limiting subsection (1)”, so the enumerated purposes are examples that fall within the appropriation but are not exclusive. Any additional purpose will still need to be compatible with the appropriation and with any rules and agreements made to allocate funds.

4. Rules can allocate amounts and administrators: The Minister may make rules that set amounts to be appropriated for specified purposes under the appropriation and that provide for another Minister to administer a specified amount (s 7(2)(b)-(c)). That means the executive can effect a division of the $1 billion across purposes and Ministers through secondary instruments.

5. Rules cannot create offences or confer coercive powers: The Act proscribes the rules from creating offences or civil penalties, providing powers of arrest, detention, entry, search or seizure, imposing a tax, or directly amending the Act (s 7(3)). Drafting must avoid attempting to do these things by rule.

6. Delegation limited to SES or equivalent: A Minister’s power to delegate agreement‑making is limited to officials who are SES employees or hold equivalent or higher positions (s 6(1)). Accountable authorities have the same limitation (s 6(3)). Delegations must be in writing and delegates must obey directions (s 6(2), (4)). Do not assume delegation beyond those grades is valid under this Act.

7. Agreements may be signed only by specified Commonwealth actors unless delegated: Agreements for the purposes of s 5 may be entered into on behalf of the Commonwealth by a Minister or an accountable authority of a non‑corporate Commonwealth entity (s 5(4)). Only where a valid delegation under s 6 exists may an official sign, and that delegation must be in writing.

8. Reimbursements to Commonwealth authorities are specifically included: Reimbursing Commonwealth entities, including the Great Barrier Reef Marine Park Authority and the Director of National Parks, for waived fees and charges is an explicit purpose (s 4(2)(f)). Ensure any fee waivers tightly map to reimbursement agreements to avoid gaps between agency waivers and Commonwealth reimbursement authority.

9. Reliance on external definitions: Key terms (accountable authority, Commonwealth entity, non‑corporate Commonwealth entity, official) are defined by reference to the PGPA Act (s 3). Practitioners must consult the PGPA Act to determine which bodies and persons count under those terms for delegation and agreement‑making purposes.

10. The Act does not prescribe agreement content or eligibility criteria: The Act mandates written agreements but does not specify eligibility thresholds, detailed conditions or enforcement mechanisms. Those substantive terms will come from the rules and from the agreements themselves. If you expect a uniform national eligibility test or standardised clawback mechanism, it will only exist if created in the rules or the written agreements.

11. Other legislative authority may be used for spending: The Act’s rules provision expressly clarifies that other sources may provide legislative authority for spending the appropriation, including the Financial Framework (Supplementary Powers) Regulations 1997 (s 7(4) Note). Funds could therefore be disbursed under frameworks outside the Act’s text, which requires cross‑reference checks.

12. No penal regime in the Act for misuse of funds: The Act contains no statutory offences for misuse of the appropriation and disallows rules that would create such offences; therefore recovery, penalties or enforcement must be contractual or rely on other existing statutory provisions.

For Commonwealth officials and Ministers

• Confirm delegation instruments are in writing and valid. The Act allows a Minister and an accountable authority of a non‑corporate Commonwealth entity to make agreements on the Commonwealth’s behalf (s 5(4)), and allows delegation only to SES employees or officials holding equivalent/higher positions (s 6(1), (3)). Ensure any delegation instrument is signed, recorded and that delegates are notified of any directions they must follow (s 6(2), (4)).

• Use written agreements for every payment. The Act makes the written agreement requirement mandatory for payments to States and Territories, constitutional corporations and other persons (s 5(1)-(3)). Draft agreements to include the payment amount, purpose, reporting and audit requirements, compliance conditions, consequences of breach (contractual remedies), termination rights and any instrument by which administration responsibilities are conferred under the rules (s 7(2)(c)).

• Align agreement timelines with the statutory cutoff. All payment disbursements under this appropriation must occur on or before 30 June 2021 (s 8). Agreements should contain payment schedules and milestones that ensure funds are legally disbursed within that window. Include clauses stating that payments will not be made after 30 June 2021 and that unspent funds revert or are otherwise handled in accordance with the Commonwealth’s finance law.

• Coordinate rule‑making with operational design. The Minister may make rules by legislative instrument to prescribe circumstances in which payments may be made, to set amounts for specified purposes and to provide for another Minister to administer a specified amount (s 7(1)-(2)). If the executive intends to divvy the $1 billion across programmes or sectors, design the rules to set clear eligibility criteria, application and assessment processes, and administrative accountability while respecting the express prohibitions (no offences, taxes, coercive powers) in s 7(3).

• Ensure legal authority for fee reimbursements is clear. If reimbursing Commonwealth entities for fee waivers (s 4(2)(f)), document the basis for the waiver, the decision to reimburse, and the matching payment agreement. Cross‑check any reimbursement against the agency’s statutory fee regime and the terms of the appropriation to avoid creating an unauthorised payment.

• Maintain records and reporting consistent with PGPA obligations. Although the Act does not restate PGPA obligations, it imports PGPA definitions (s 3). Accountable authorities and officials should ensure their financial records, audit trails and internal approvals comply with PGPA requirements and with the written agreements supporting each payment.

For States, Territories, corporations and other recipients

• Expect a written agreement and comply with its terms. The Act requires a written agreement for any payment (s 5(1)-(3)). Recipients should review draft agreements carefully and ensure they can meet reporting, audit and compliance obligations. Agreements are likely to contain repayment or clawback provisions; confirm these in advance.

• Check whether you are classed as a constitutional corporation. For corporate entities, confirm whether you fall within the constitutional corporation definition used in s 3. That status affects the contractual pathway and may influence negotiation and compliance positions.

• Plan project timelines to fit the appropriation window. Recipients must ensure that any activities or projects funded under this appropriation commence and are funded within the appropriation’s permissible payment window ending 30 June 2021 (s 8). Where multi‑year programmes are contemplated, clarify how funds will be disbursed and whether ongoing costs will be otherwise funded.

• Require clarity on scope and use of funds. Because the Act’s purposes list in s 4(2) is non‑exhaustive, agreements should specify permissible uses of funds, reporting categories and outcomes to avoid post‑payment disputes about whether a payment falls within the appropriation purpose.

For legal and compliance advisers

• Map statutory intersections before counsel sign‑off. The Act cross‑references the PGPA Act and the Acts Interpretation Act for definitions and uses of terms (s 3; s 6 note) and contemplates reliance on the Financial Framework (Supplementary Powers) Regulations 1997 (s 7(4) Note). Check those instruments to determine who may sign, what reporting is required and which expenditure rules apply to particular payments.

• Draft agreements to fill statutory silences. The Act mandates written agreements but leaves substance, eligibility criteria and enforcement mechanisms to the agreements and to rules. Agreements should therefore articulate eligibility tests, audit and reporting mechanisms, timing, clawback and recovery rights, and dispute resolution processes. Because rules cannot create offences or taxes, use contractual mechanisms and existing statutory enforcement tools where necessary.

• Anticipate administrative direction obligations. Delegates must comply with directions from delegating Ministers or accountable authorities (s 6(2), (4)). Ensure delegates have documented instructions and that those instructions are consistent with policy and law. Include processes for recording directions and for ensuring delegates understand their compliance obligations.

• Ensure funds flow is consistent with appropriation law. The appropriation cap and the sunset date are statutory constraints (s 4(1); s 8). Legal advisers should ensure that disbursement schedules, payment authorisations and remittance all fit within the appropriation and the payment window to avoid unauthorised expenditure.

Summary checklist

• Confirm who will enter agreements for the Commonwealth (Minister or accountable authority) and whether delegation is required (s 5(4); s 6).
• Ensure delegation instruments are in writing and delegates are SES or equivalent (s 6).
• Draft written agreements with precise terms on use of funds, reporting, audit and recovery mechanisms (s 5(1)-(3)).
• Coordinate rule‑making to allocate amounts and administrators where needed, consistent with limits on rules (s 7(2); s 7(3)).
• Track the $1 billion cap and the 30 June 2021 payment cutoff to ensure legal disbursement (s 4(1); s 8).
• Cross‑check PGPA Act definitions and any Financial Framework Regulations referenced in s 7(4) Note before execution.

Adherence to these steps aligns operational practice with the Act’s mandatory structures and with the statutory constraints that govern who pays, who decides and what recipients must do.
