What it does
This instrument determines ASIC’s supervisory cost recovery levy figures for the 2021-22 financial year. It does three mechanical things.
First, it declares its name and commencement mechanics (ss 1-2). The instrument “commences on the day after it is registered on the Federal Register of Legislation” (s 2(1)). It also specifies the days on which it takes effect if particular disallowance-related provisions of the ASIC Supervisory Cost Recovery Levy Act 2017 apply (s 2(2)(a)-(b)), and the instrument’s notes explicitly state that section 11 of the Levy Act contains special disallowance and taking-effect provisions, and that subsection 10(8) of the Levy Act permits retrospective application before registration (Notes to s 2).
Second, it states the statutory authority under which it is made. The instrument is made by a delegate of ASIC under subsection 12A(6) of the Australian Securities and Investments Commission Act 2001 for the purposes of subsection 10(2) of the ASIC Supervisory Cost Recovery Levy Act 2017 (s 3).
Third, and substantively, it fixes the levy determination for the applicable financial year. It identifies the applicable financial year as 2021-22 (s 5), sets the aggregate amount of ASIC’s regulatory costs for that year at $313,308,684 (s 6), and attributes portions of that total to a list of specified sub-sectors in a tabulated schedule (s 7 and accompanying table). The table assigns specific dollar amounts to 48 line items labelled by sub-sector (for example, Listed corporations , $47,138,480; Superannuation trustees , $32,165,493; Credit providers , $31,837,090). The table is the operative allocation of ASIC’s regulatory costs across the enumerated sub-sectors (s 7).
The instrument does not itself set individual entity rates or collection mechanisms. It relies on definitions and further mechanics in the Levy Act: s 4(a) defines “Act” for this instrument as the ASIC Supervisory Cost Recovery Levy Act 2017 and s 4(b) imports unspecified definitions from that Act into the instrument where expressions are used but not defined here. The instrument therefore functions as an allocation schedule and a statutory determination of aggregate and sub-sector-attributed regulatory costs; payment, billing, enforcement, and per-entity calculation are not set out in this instrument but are addressed by the Levy Act and related legislative framework (see s 3 for authority link).
