What it does
This instrument, the ASIC (Supervisory Cost Recovery Levy,Regulatory Costs) Instrument 2018/1062, is a determination by a delegate of the Australian Securities and Investments Commission that attributes ASIC’s regulatory costs for a single financial year to specified sub-sectors (s 1; s 3; s 5-7). It names the delegate who made it and the date of the instrument (made 20 November 2018). Mechanically, the instrument performs two discrete functions:
- it declares the applicable financial year for the determination: the 2017-2018 financial year (s 5); and
- it sets ASIC’s regulatory costs for that year at $236,582,384 (s 6) and attributes that total across 48 listed sub-sectors by dollar amounts in the table at s 7 (Column 3).
The instrument does not itself impose levy liabilities, specify levy rates per entity, prescribe payment mechanisms, or create offences. The instrument is made “for the purposes of subsection 10(2) of the ASIC Supervisory Cost Recovery Levy Act 2017” under the authority of subsection 12A(6) of the Australian Securities and Investments Commission Act 2001 (s 3). The table in s 7 is the operative allocation: each row names a sub-sector (Column 2) and gives the extent, in dollars, to which ASIC’s regulatory costs are attributable to that sub-sector (Column 3). Examples of headline attributions in the table include listed corporations ($50,415,253), licensees that provide personal advice to retail clients ($25,634,226), credit providers ($24,124,482) and responsible entities ($22,769,635) (s 7 table).
Commencement is conditional on provisions of the ASIC Supervisory Cost Recovery Levy Act 2017; the instrument takes effect according to the timelines specified in subsection 11(3) or 11(4) of that Act (s 2 and Note 1). The instrument also records that subsection 9(9) of the Levy Act has the effect that the instrument can have retrospective application before the day it is registered on the Federal Register of Legislation (s 2 Note 2). Those are the mechanical effects within the four corners of the instrument.
