ASIC Corporations (Generic Calculators) Instrument 2026/41

The instrument is structured around a small set of core concepts defined in Part 1 and then operationalised in Part 2. Understanding those defined terms is essential to applying the exemptions and conditions.

Financial calculator. The instrument defines "financial calculator" as a facility, device, table or other thing used to make a numerical calculation or find out the result of a numerical calculation relating to a financial product, other than a superannuation calculator (s 6). The definition is expressly limited to numerical calculation outputs, and the notes make clear that the thing will not be a financial calculator to the extent its output goes beyond the numerical result and a description of what that result is,for example, to the extent it makes a recommendation about a particular financial product (s 6 note). The exclusion of superannuation calculators is explicit (s 6 definition of superannuation calculator and the opening summary at s 5).

Assumptions and estimate. "Assumptions" are the factors that may be changed by the user and are applied by a financial calculator to work out the estimate (s 6). An "estimate" is the result of the numerical calculation performed by the financial calculator (s 6). The instrument differentiates between default assumptions (applied unless changed by a user) and user-chosen inputs, and requires that default assumptions be reasonable for working out the estimate (s 8(1)(c)).

Present value. When a calculator produces an estimate of an amount payable at a future time, and the estimate is of an amount payable 2 or more years in the future, the instrument requires a specific disclosure: a clear and prominent statement setting out the present value of the estimate (s 8(1)(e)(iv)). The instrument prescribes the present value formula in the definitions, C/(1 + r)^n, with C being the future estimate, n the number of years (including part years) between present and the future time, and r defaulting to 0.025 (2.5 per cent) unless the user inputs another assumed inflation rate (s 6; note explaining default 2.5 per cent).

Statutory assumptions. The instrument recognises "statutory assumptions", defined as assumptions that reflect a rate or amount fixed by legislation, with a note that statutory assumptions include a rate of taxation (s 6). The conditions treat statutory assumptions separately: electronic calculators must enable the user to change any assumptions other than a statutory assumption, but the note clarifies that calculators are not required to include statutory assumptions, and may permit users to change them (s 8(1)(b) and its note).

Exemption architecture. The central legal mechanism is an exemption from compliance with particular provisions of the Corporations Act: subsection 911A(1) licence requirement and, for licensees, Divisions 2-4 of Part 7.7 in relation to that advice (s 7(1)). The instrument is therefore a statutory instrument that modifies, for the specified activities, the application of the Corporations Act by exercise of the powers in paragraphs 926A(2)(a) and 951B(1)(a) (s 3).

Conditions and notice. The exemptions are conditional. The instrument requires reasonable steps by the provider to meet a set of operational and disclosure conditions (s 8(1)(a)-(g)), specifies the content and standard of required statements (s 8(2)), requires a seven-year retention of the calculator (s 8(1)(g)), and includes a loss-of-exemption rule tied to failure to notify ASIC of material non-compliance within 30 days of knowing or being reckless about such failure (s 7(2)).

Temporal and repeal elements. The instrument commences the day after registration (s 2) and will be automatically repealed at the start of 1 April 2031 (s 9). It also repeals the earlier instrument ASIC Corporations (Generic Calculators) Instrument 2016/207 (Schedule 1).

These main concepts show that the instrument is focused narrowly on numerical-calculation tools that produce estimates, setting out both the boundaries of what counts as a qualifying calculator and the operational and disclosure measures a provider must adopt in order to avoid licensing and certain disclosure obligations under the Corporations Act.

The instrument operates on a defined class of actors and an indirectly affected set of users and regulators. The primary legal subjects are persons who "provide financial product advice through, or through making available, a financial calculator" (s 7(1)). That phrase encompasses any person who, by operating, hosting or otherwise making available a qualifying calculator as defined (s 6), causes the calculator to provide the numerical outputs that amount to financial product advice.

Providers. Affected providers include individuals, companies, app developers, website operators and other entities that supply or host a qualifying financial calculator for use by others, provided the calculator is not a superannuation calculator (s 6). The instrument does not distinguish between commercial providers and non-commercial operators; it applies to any "person" meeting the description in s 7(1). For providers who already hold an AFS licence, the instrument offers an additional benefit by exempting them from Divisions 2-4 of Part 7.7 in relation to the calculator-based advice (s 7(1)(b)).

Users. Retail clients who use calculators will be affected indirectly because the instrument prescribes specific disclosures and functional features that must be presented to users (s 8(1)(d)-(f)). Those user-facing effects include the ability to change assumptions (for electronic calculators), the right to print or store results where electronic, required statements about purpose and limitations and the obligation to provide present value for long-dated estimates (s 8(1)(b), (e)(i)-(iv), (f)).

Regulator. The Australian Securities and Investments Commission (ASIC) is directly involved in the enforcement architecture to the extent the instrument requires notification to ASIC when material non-compliance has not been rectified within 30 days of the provider knowing, or being reckless with respect to whether there are reasonable grounds to believe, they had failed to comply with a condition (s 7(2)). The instrument also imposes record-keeping that ASIC could inspect, namely keeping a copy of the financial calculator for seven years from when it was first made available (s 8(1)(g)).

Excluded categories. Superannuation calculators are explicitly excluded from the definition of "financial calculator" and therefore from the scope of the exemption (s 6). The instrument also narrows its scope by specifying that a thing will not be a financial calculator to the extent its output makes a recommendation about a particular financial product (s 6 note). That limitation means tools that go beyond numerical outputs and add prescriptive product recommendations fall outside the exemption and so remain subject to licensing and disclosure obligations under the Corporations Act.

Who bears costs and duties. The compliance burdens fall primarily on providers: they must implement functional features (changeable assumptions, print/store options), create and display the specified statements, preserve the calculator for 7 years and notify ASIC of material non-compliance within the 30-day window (s 8(1)(b), (e), (f), (g); s 7(2)). Users gain greater transparency (statements, ability to change inputs) but do not receive a regulatory entitlement to licensed personal advice from the calculator. ASIC is positioned to receive notifications and to inspect records, although the instrument does not set out particular enforcement procedures beyond the loss of exemption rule.

Temporal stakeholders. The instrument has an expiry at the start of 1 April 2031 (s 9). Providers and intermediaries must therefore account for the instrument’s sunset when planning ongoing compliance, record retention and product design.

The instrument creates a bundle of duties that a provider must satisfy to rely on the exemption, and creates limited rights , notably the right to be exempt from the licence requirement and from certain disclosure duties in specified circumstances , conditional on compliance with those duties.

Rights conferred by the instrument. If a person meets the conditions set out in the instrument, subsection 7(1) establishes that they "do not have to comply with" two statutory obligations: the licensing requirement in subsection 911A(1) in respect of providing financial product advice through a qualifying calculator (s 7(1)(a)); and, if the provider is an existing financial services licensee, Divisions 2, 3 and 4 of Part 7.7 of the Corporations Act in relation to that advice (s 7(1)(b)). Those are the principal rights created by the instrument.

Core duties to qualify for the rights. The duties are set out in s 8(1)(a)-(g) and s 8(2). They are phrased as obligations to take "reasonable steps" to ensure that the following matters occur:

• No advertising or promotion of a specific financial product by the calculator (s 8(1)(a)). The provider must ensure the calculator itself does not advertise or promote a specific product.

• If the calculator is electronic, it must enable the user to change any of the assumptions (the default assumptions) other than a statutory assumption (s 8(1)(b)). The instrument’s note clarifies that inclusion of statutory assumptions is not required, but if they are included the calculator may permit user change.

• The default assumptions (including any statutory assumptions), unless changed by the user, must be reasonable for working out the estimate (s 8(1)(c)).

• The calculator must display to the user, or have printed on it, an explanation of why the default assumptions are reasonable for producing the estimate (s 8(1)(d)). This is an affirmative explanatory duty.

• The calculator must display to the user in the ordinary course of use, or have printed on it, specified statements: a clear and prominent statement about purpose and limitations; a clear and prominent explanation of the impact of any significant limitation; a clear and prominent statement of the assumptions; where the estimate is for an amount payable at a future time of 2 or more years, a clear and prominent statement of the present value of the estimate; and a clear and prominent statement that the calculator is not intended to be relied on for making a decision and that the user should consider obtaining licensed advice (s 8(1)(e)(i)-(v)).

• If the calculator is electronic, it must not prevent the user from readily printing or electronically storing the estimate (s 8(1)(f)).

• The provider must keep a copy of the financial calculator for 7 years from its first availability (s 8(1)(g)).

Standard of detail. Section 8(2) imposes an additional content standard: any statement or explanation required under s 8(1)(d) or (e) must contain as much detail as a retail client using the calculator would reasonably expect to find having regard to the nature of the calculator. This ties the content standard to an objective user expectation test.

Notification duty as condition precedent to maintaining the right. Subsection 7(2) is functionally an enforcement-linked duty: it provides that the exemption does not apply if 30 days have elapsed since the person knew, or was reckless as to whether there were reasonable grounds to believe, they had failed (other than in an immaterial respect) to comply with a condition and they had not notified ASIC of the failure. This operates as a duty to notify ASIC promptly (within the 30-day window) if a material non-compliance has occurred or been discovered.

Record-keeping duty. The seven-year retention obligation in s 8(1)(g) is a discrete duty that supports accountability and potential inspection.

Limits and exclusions. The instrument sets clear negative duties: the provider must ensure the calculator does not advertise or promote a specific financial product (s 8(1)(a)), and must ensure that any electronic calculator allows user export of estimates (s 8(1)(f)). It also sets a boundary on the right to be exempt: holding the right is conditional and can be lost as described in s 7(2).

No additional rights granted. The instrument does not create a standalone entitlement to provide licensed advice outside the exemption, nor does it alter other unspecified provisions of the Corporations Act. The rights are explicitly limited to non-compliance with the specific provisions listed in s 7(1), and only in relation to advice provided through the qualifying calculator.

Practical effect of duties. The combined effect is that a provider who implements the technical and disclosure features required and who monitors and reports material non-compliance has a conditional statutory right not to be treated as requiring an AFS licence for calculator-derived advice, and for licensees, not to be subject to the specified disclosure divisions for the same advice (s 7(1); s 8(1)). The duty to maintain detailed, retail-facing explanations and to record and preserve the calculator for seven years establishes an evidentiary trail that supports reliance on the exemption.

The instrument itself does not prescribe new civil or criminal penalties; it operates by granting or withholding statutory exemptions from obligations in the Corporations Act. Its enforcement architecture is therefore primarily about qualification for, and loss of, statutory relief rather than introducing separate sanctioning mechanisms in the instrument text.

Loss of exemption as an enforcement mechanism. The primary enforcement consequence set out in the instrument is the loss of the exemption where the conditions are not satisfied and the provider does not notify ASIC within a specified period. Specifically, s 7(2) provides that the exemption does not apply if 30 days have elapsed since the person knew, or was reckless with respect to whether there were reasonable grounds to believe that the person had failed, other than in an immaterial respect, to comply with a condition of the instrument without the failure having been notified to ASIC. The text therefore creates an operational penalty in the form of removal of the statutory exemption for failure to notify within the 30-day window. The practical effect of losing the exemption is that the provider becomes subject to the Corporations Act obligations that the instrument temporarily removed (s 7(1)).

Implicit enforcement via the Corporations Act. Although the instrument does not itself state consequences beyond loss of exemption, the practical legal consequence of losing the exemption is that the provider will have to comply with the usual Corporations Act requirements, including licensing obligations under subsection 911A(1) and, if a licensee, the disclosure Divisions of Part 7.7 in relation to that advice (s 7(1)). The instrument does not set out the statutory penalties or regulatory steps that ASIC or other authorities might take for contraventions of the Corporations Act; such outcomes would be governed by the Act itself, not by this instrument. The instrument therefore changes the regulatory status of the activity but does not itself create a new penalty schedule.

ASIC’s role and notification. Section 7(2) explicitly references notification to ASIC as the key procedural step that preserves the exemption where a material failure has occurred. The instrument does not specify the form or content of the notification, nor any follow-up procedure, but it makes notification a condition precedent to maintaining the exemption beyond the 30-day discovery reckoning.

Record-keeping as an enforcement enabler. The seven-year retention obligation in s 8(1)(g) assists enforcement by creating an evidentiary basis for ASIC to examine the calculator as it was first made available. Retention of a copy for seven years supports ASIC’s ability to assess whether the provider complied with the display and explanation obligations required under s 8(1)(d)-(e).

No express criminal or administrative fines in this instrument. The legislative text does not introduce separate fines or administrative penalties in the instrument itself. Consequently, the instrument’s compliance and enforcement regime is primarily mediated by (a) the loss of the exemption where notification is not timely, and (b) whatever enforcement powers and sanctions exist in the Corporations Act and other regimes that would apply once the exemption no longer shields the provider.

Sunset and repeal. The instrument is explicitly repealed at the start of 1 April 2031 (s 9). The expiry is itself an enforcement consideration in the sense that providers must plan for the point at which the exemption will cease to exist and either transition to other compliance regimes or discontinue the activity as structured.

Practical enforcement risk for providers. From the instrument alone, providers face a compliance risk of losing the exemption if they fail to meet the conditions, and an operational obligation to notify ASIC within the 30-day window in the event of material non-compliance (s 7(2)). The absence of specified civil or criminal penalties in the instrument does not eliminate the risk that, once the exemption is not available, the provider could be required to obtain an AFS licence or be subject to the Corporations Act’s enforcement mechanisms.

This instrument is an exemptive legislative instrument made under specified powers in the Corporations Act and it operates by modifying the application of certain Corporations Act obligations to particular calculator-based activities. Its interaction with other laws is therefore primarily mediated via the Corporations Act and legislative definitions the instrument relies upon.

Source of power and scope. The instrument is made under paragraphs 926A(2)(a) and 951B(1)(a) of the Corporations Act 2001 (s 3). It exercises the statutory power to make instruments that exempt persons from particular provisions of the Act. The exemptions granted are expressly bounded: they apply only to the licensing requirement in subsection 911A(1) and, for licensees, Divisions 2, 3 and 4 of Part 7.7 "in relation to that advice" (s 7(1)). The instrument therefore does not purport to amend the text of the Corporations Act; it operates by statutory exemption under the Act’s delegated powers.

Scope relative to the Corporations Act. The instrument’s exemptions create a carve-out from specified Corporations Act duties for qualifying calculator-based advice. Any interaction with other provisions of the Corporations Act that are not explicitly mentioned in s 7(1) is unchanged by the instrument. The instrument therefore leaves intact the remainder of the statutory scheme unless and until persons lose the exemption under s 7(2). The instrument does not state that it overrides other statutes; it operates within the Corporations Act’s delegated-exemption framework.

Statutory assumptions. The instrument recognises "statutory assumptions", defined as assumptions reflecting a rate or amount fixed by legislation, with a note that statutory assumptions include a rate of taxation (s 6). This acknowledges that other legislation may set rates or amounts that constitute statutory assumptions for calculators, and it draws a line between changeable assumptions and assumptions fixed by other law. The instrument permits but does not require calculators to include statutory assumptions, and electronic calculators must allow users to change any assumptions other than a statutory assumption (s 8(1)(b) and its note).

Interaction with consumer-facing regulatory duties. The instrument exempts specified disclosure obligations (Divisions 2-4 of Part 7.7) for licensed providers only in relation to calculator advice (s 7(1)(b)). The instrument does not purport to exempt providers from other consumer-protection statutes or obligations that may apply at Commonwealth or state level, nor does it state that it affects the operation of other regulator regimes. The instrument is silent on how it interacts with other Commonwealth laws, state laws, or industry codes, meaning providers must consider other applicable legal obligations separately.

Record retention and auditability. The requirement to keep a copy of the calculator for seven years (s 8(1)(g)) creates an explicit point of interaction with any other legal or regulatory obligations that rely on retained records, including ASIC oversight under the Corporations Act. Providers who are subject to other statutory retention requirements will need to reconcile those obligations; the instrument’s seven-year retention is a clear minimum for the calculator itself as first made available.

Exclusion of superannuation calculators. The instrument expressly excludes superannuation calculators (s 6 definition), which means that calculators relating to superannuation products or RSA products remain subject to the ordinary operation of the Corporations Act and any other statutes that apply to superannuation. The instrument therefore preserves the separate regulatory posture applicable to superannuation matters.

Interaction via loss of exemption. If a provider fails to comply with conditions and does not notify ASIC as required, s 7(2) removes the exemption. The practical interaction here is that, on removal of the exemption, the provider is again subject to the unmodified Corporations Act obligations, including licensing and disclosure duties cited in s 7(1), and to any enforcement mechanisms that those obligations carry.

Sunset and prior instruments. The instrument repeals the earlier ASIC Corporations (Generic Calculators) Instrument 2016/207 (Schedule 1), and is itself repealed at the start of 1 April 2031 (s 9). The temporal interplay here requires providers to track which instrument is operative and to plan for the periodic legislative housekeeping that affects the regulatory baseline.

In sum, the instrument is an exemption under the Corporations Act that modifies the application of specific Act provisions to calculator-based advice, while leaving the remaining statutory and legislative landscape intact. Providers must therefore map compliance not only against the instrument’s conditions but against the broader statutory and regulatory matrix that remains in force.

The instrument itself contains limited internal history and the Schedule records the repeal of a predecessor instrument. The following items are present in the instrument text and constitute its formal amendment and lifecycle record as set out in the instrument.

Making and date. The instrument was made by Kate Metz, a delegate of the Australian Securities and Investments Commission, on 17 March 2026. That date appears immediately beneath the instrument title and signature block within the text.

Commencement. The instrument commences on the day after it is registered on the Federal Register of Legislation (s 2). The instrument therefore does not specify an absolute calendar commencement date within its text; the commencement is operationally tied to registration.

Authority for making the instrument. The instrument cites the delegated power under paragraphs 926A(2)(a) and 951B(1)(a) of the Corporations Act 2001 as the authority for its making (s 3). This demonstrates that the instrument is an exercise of a statutory power to make exemptive instruments under the Corporations Act.

Repeal of predecessor instrument. Schedule 1, item 1 explicitly repeals ASIC Corporations (Generic Calculators) Instrument 2016/207 in full ("The whole of the instrument. Repeal the instrument.") (Schedule 1). That repeal is part of the instrument’s effect and should be treated as an explicit replacement of the earlier instrument.

Sunset. The instrument itself legislates a sunset: it is repealed at the start of 1 April 2031 (s 9). That fixed expiry date is part of the instrument’s lifecycle and effectively makes the instrument a time-limited grant of exemption unless further legislative action extends or replaces it prior to that date.

Schedules and amendments within the instrument. Section 4 notes that each instrument specified in a Schedule is amended or repealed as set out in the applicable items in the Schedule, and that any other item in a Schedule has effect according to its terms. In the present instrument Schedule 1 contains only the repeal of the 2016 instrument. The instrument therefore contains a limited set of schedule actions constrained to that repeal.

Notes and explanatory text. The instrument contains notes embedded within definitions and other provisions (for example, a note explaining the 2.5 per cent default inflation assumption in the present value formula, and notes clarifying the scope of "financial calculator" and the treatment of statutory assumptions). Those notes assist interpretation but do not change operative text. The presence of those notes is part of the instrument record and offers insight into the drafting intent visible within the instrument text.

Absence of subsequent amendments in the text. The instrument text provided does not include any later amending instrument, re-issue or modification. The instrument therefore stands as made on 17 March 2026, subject to commencement upon registration and with repeal at the start of 1 April 2031. Any changes made after that date would need to be recorded in separate amending instruments, which are not present in the supplied text.

In short, the internal amendment history recorded in the instrument is limited: it replaces the 2016 instrument, it was made 17 March 2026, it commences on registration, and it will be repealed 1 April 2031 unless further instruments intervene.

The instrument text contains no reference to litigation, judicial decisions, or case law construing its provisions. There are no named cases, no references to prior adjudications, and no recorded disputes within the instrument itself. The instrument therefore presents a statutory text without any contemporaneous judicial interpretation included in the document.

Implications of absence of litigation in the instrument. Because the instrument contains no litigation history, those interpreting or applying it cannot rely on any authoritative judicial construction provided within the instrument’s text. Practical application will therefore rest on the plain language of the instrument and any administrative guidance ASIC may issue externally. The instrument’s internal notes (for example explaining the 2.5 per cent default and the scope limitation for outputs that go beyond numerical results) provide drafting context, but they are not judicial gloss.

Areas likely to attract future interpretive questions. Although the instrument is textually concise, certain provisions may invite legal interpretation in future disputes because the instrument uses terms and standards that are partly fact-sensitive:

• The term "financial product advice" is used in s 7(1) to identify who benefits, but the instrument does not define that phrase within its own text. Absent judicial guidance in the instrument, disputes about whether a particular calculator’s output qualifies as "financial product advice" will turn on the interaction between the instrument text and definitions or principles in the Corporations Act, and potentially on administrative rulings that ASIC may provide.

• The obligation to take "reasonable steps" to ensure specified features are present (s 8(1)) uses a standard that is context-dependent. What constitutes reasonable steps in design, disclosure and testing could be litigated if a provider loses the exemption and the question arises whether they met the reasonable-steps standard.

• The phrase "clear and prominent" used in the required user-facing statements (s 8(1)(e)) is a qualitative standard that has been the subject of litigation in other regulatory settings. The instrument itself does not supply metrics or thresholds, which could lead to disputes about adequacy of disclosure.

• The 30-day rule in s 7(2) turns on whether the person "knew, or was reckless with respect to whether there are reasonable grounds to believe" that they had failed to comply. That mens rea formulation could generate contested factual inquiries about what the person knew and whether recklessness exists.

No cases named in the instrument. Because the instrument does not invoke or name any cases, and the supplied text includes no litigation record, there is no instrument-contained jurisprudence to cite. Practitioners therefore must apply the text and anticipate that interpretive issues will be resolved later through administrative decision-making or judicial processes, none of which are documented in the instrument.

The instrument has several concrete traps for practitioners, designers and compliance officers. The following points are grounded in the instrument text and identify areas where providers may unintentionally fall outside the exemption or face operational uncertainty.

1. Outputs that go beyond numerical results remove the exemption. The definition of "financial calculator" excludes a thing to the extent that its output goes beyond the numerical result and a description of what that result is; the note specifically says it will not be a financial calculator to the extent it makes a recommendation about a particular financial product (s 6 note). Practical implication: if a calculator starts to give product recommendations, ranked product lists, or prescriptive purchasing advice, it falls outside the instrument’s scope and the provider will not benefit from the exemption.

2. Superannuation calculators are excluded. The instrument explicitly excludes superannuation calculators from the definition of "financial calculator" (s 6). Providers must segregate superannuation-related calculators or treat them as subject to the ordinary regulatory baseline.

3. "Advertising or promoting a specific financial product" is not defined. Section 8(1)(a) requires the provider to take reasonable steps to ensure the calculator does not advertise or promote a specific financial product, but the instrument does not define "advertise" or "promote". This creates uncertainty about whether, for example, product-linked examples, branded comparison tables, or contextual hyperlinks would be captured. Providers should treat any linkage that could be perceived as product endorsement as risky.

4. The default assumption standard is fact-sensitive. The requirement that default assumptions be "reasonable" (s 8(1)(c)) and the concomitant obligation to explain why they are reasonable (s 8(1)(d)) are subjective. Section 8(2) requires that explanations contain as much detail as a retail client would reasonably expect. Providers must therefore calibrate defaults and explanatory detail to the likely knowledge level and expectations of retail clients for the relevant calculator.

5. Present value requirement has a prescriptive formula and default inflation rate. For estimates of amounts payable 2 or more years in the future, s 8(1)(e)(iv) requires a clear and prominent present value statement, and s 6 prescribes C/(1 + r)^n with r = 0.025 as default. Implementers must ensure the calculator computes present value exactly as formulated and that users can change r where permitted. Failing to follow the formula or to display present value could jeopardise the exemption.

6. Electronic calculators must allow change of assumptions but can lock statutory assumptions. Section 8(1)(b) requires electronic calculators to enable the user to change any assumptions other than a statutory assumption; the note clarifies that inclusion of statutory assumptions is optional and that calculators may permit changing them. Providers must document whether statutory assumptions are included and how they are presented, because locking otherwise-changeable inputs may be problematic.

7. Printing and storing results is mandatory for electronic calculators. Paragraph 8(1)(f) obliges electronic calculators not to prevent users from readily printing or electronically storing the estimate. This can conflict with certain UI/UX designs where printing is awkward or where sharing is intentionally restricted. Providers need to enable straightforward export or print functionality.

8. Record retention starts from first availability. Providers must keep a copy of the calculator for 7 years from when it is first made available (s 8(1)(g)). For products that evolve, the original version must be preserved. Failure to retain historical versions undermines the provider’s ability to demonstrate compliance with disclosure content as it existed when users relied on the tool.

9. The 30-day notification window is short and linked to knowledge or recklessness. If a provider becomes aware, or is reckless about whether there are reasonable grounds to believe, they have materially failed to comply, the exemption will not apply if 30 days have elapsed and ASIC has not been notified (s 7(2)). Providers must put internal monitoring and incident-response procedures in place to ensure timely notification to ASIC.

10. "Clear and prominent" and "significant limitation" are qualitative thresholds. Requirements in s 8(1)(e)(i)-(ii) to state purpose and limitations and to explain the impact of any significant limitation are expressed in qualitative terms without numerical thresholds. Providers must make conservative disclosure choices to meet what retail clients would reasonably expect per s 8(2).

11. The exemption is time-limited. The instrument is repealed at the start of 1 April 2031 (s 9). Providers should plan for transition well before that date, including preserving records for the required seven-year period and assessing whether the business model still fits post-repeal.

12. Limited scope of Divisions disapplied for licensees only. The exemption from Divisions 2-4 of Part 7.7 applies to licensees only in relation to calculator advice (s 7(1)(b)). It does not provide a general exemption from other regulatory duties licensees may have under the Corporations Act or other laws.

13. The instrument does not define the procedure for notifying ASIC. Section 7(2) requires notification but the instrument is silent on the form, content or channel of notification, leaving procedural uncertainty that providers must manage with conservative practice, including contemporaneous documentation of notification.

14. Interaction with other legal duties not addressed. The instrument does not mention other Commonwealth, state or territory obligations that might affect calculators, leaving open the possibility that other regulatory regimes apply without modification by this instrument.

These “gotchas” follow directly from the instrument text. Providers and advisers should treat them as concrete compliance points rather than theoretical concerns.

The instrument sets out explicit operational and disclosure conditions (s 8) that a provider must satisfy to rely on the exemption in s 7(1). The following is a compliance checklist mapped to the instrument’s provisions and to the practical steps that will support a defensible reliance on the exemption.

1. Confirm scope and eligibility

• Verify the calculator is a "financial calculator" as defined, namely a facility, device, table or other thing used to make numerical calculations relating to a financial product, and ensure it is not a superannuation calculator (s 6). If the output goes beyond numerical results and a description, such as by making product recommendations, the tool falls outside the exemption.

2. Product design controls

• Ensure the calculator does not advertise or promote any specific financial product (s 8(1)(a)). Conduct a content review to remove product names, promotional graphics, comparison links, or affiliate product sections from the calculator interface.

• For electronic calculators, provide user controls that enable changing any assumption other than a statutory assumption (s 8(1)(b)). Ensure the UI clearly marks which assumptions are statutory and not user-editable, if any are included.

• Default assumptions must be reasonable for computing the estimate (s 8(1)(c)). Document the rationale and sources for defaults, including calculations, benchmarks, or authoritative inputs used to justify reasonableness.

3. Explanatory and disclosure requirements

• Implement an explanation showing why the default assumptions are reasonable, and make it accessible to users (s 8(1)(d)). The explanation must contain as much detail as a retail client would reasonably expect, given the calculator’s nature (s 8(2)). Use plain-language summaries combined with links to more detailed methodology documentation.

• Ensure the calculator displays, prominently and clearly, the following in ordinary use or on printed output (s 8(1)(e)(i)-(v)):

  • A clear statement of the calculator’s purpose and its limitations.
  • A clear explanation of the impact of any significant limitation.
  • A clear statement of the assumptions used.
  • If the estimate is for an amount payable 2 or more years in the future, a clear statement of the present value using the prescribed formula (C/(1 + r)^n) with default r = 0.025 unless the user inputs another inflation rate (s 6 and s 8(1)(e)(iv)).
  • A clear statement that the calculator is not intended to be relied upon for making a financial decision and a recommendation to consider obtaining advice from a financial services licensee before making a financial decision (s 8(1)(e)(v)).

• Use design elements that ensure statements are "clear and prominent" , for example, visible without scrolling on the result page, high-contrast text, and unambiguous headings. Retain evidence that these features were readily visible to a typical retail client.

4. Printing and storage functionality

• For electronic calculators, enable users to readily print or electronically store the estimate (s 8(1)(f)). Provide a print-friendly view and an option to download results in a common format (PDF or text), and ensure the print view includes the required statements noted above.

5. Record-keeping

• Preserve a copy of the calculator as first made available, and maintain versioned copies for seven years from first availability (s 8(1)(g)). Archive code, UI screenshots, default assumptions, methodology documentation, and any scripts that generate results. Time-stamp archives and store them in an auditable repository.

6. Monitoring, incident response and notification

• Implement monitoring to detect compliance failures or deviations from the required features (for example, changes in defaults, broken printing functionality, or inadvertent insertion of product promotion).

• If a material failure occurs, institute a prompt internal escalation and notification procedure so that ASIC can be notified within the 30-day period specified in s 7(2). The instrument does not prescribe the form of notification; therefore document the content and timing of the notification and retain proof of submission.

7. Present value computation

• For long-dated estimates, implement the exact present value formula C/(1 + r)^n as defined in s 6, with r defaulting to 0.025. Ensure the interface shows the calculation inputs (C, r, n) and allows permitted adjustments (for electronic calculators) to r. Document the default choice of 2.5 per cent and the rationale (as per the instrument note).

8. Statutory assumptions

• Identify any statutory assumptions that would be relevant to the calculator (s 6). If statutory assumptions are included in default settings, clearly label them and document the legislative source. Remember that electronic calculators are not required to permit changes to statutory assumptions but they may do so (s 8(1)(b) note).

9. Consumer-facing language and user expectations

• Draft the user-facing explanations in language that retail clients would reasonably expect. Section 8(2) ties required detail to retail client expectations, so user testing with representative retail clients will help calibrate the level of explanation. Keep records of such testing.

10. Legal and compliance documentation

• Prepare a compliance register mapping each s 8 requirement to design elements, policies and archived evidence. Maintain an incident log for any deviations and proof of remedial steps taken.

11. Governance and oversight

• Assign accountability for the calculator to a named compliance owner who is responsible for ensuring ongoing alignment with the instrument, for the seven-year retention, and for the notification duty in s 7(2). Ensure periodic audits to verify that defaults remain reasonable and that required statements are present and prominent.

12. Plan for sunset and prior versions

• Track the instrument’s repeal date (start of 1 April 2031) and integrate that date into product roadmaps. Preserve archived versions consistent with the seven-year retention requirement and plan for transition scenarios when the exemption no longer applies.

13. Interaction with other legal obligations

• Because the instrument does not address other legal duties, perform a separate assessment of other Commonwealth, state or territory obligations and industry codes that may apply to the calculator. Document that assessment and its outcome.

14. Conservative approach where wording is ambiguous

• Where the instrument uses qualitative standards such as "reasonable steps", "clear and prominent" and "significant limitation", adopt conservative design and disclosure practices when in doubt. More detailed, user-oriented explanations and prominent visibility reduce the risk that the instrument’s conditions will be judged unmet.

15. Evidence to support "reasonable steps"

• Keep implementation records demonstrating testing, accessibility checks, version control, user interface design decisions, and the rationale for defaults and disclosures. These materials are likely to be the primary evidence that a provider took "reasonable steps" in meeting s 8 obligations.

By mapping each obligation in s 8 to concrete technical, disclosure and governance steps, providers can assemble a compliance package that supports a defensible claim to the exemption under s 7(1) while also meeting the record-keeping and notification contingencies set out in the instrument.
