What it does
This ASIC class order (CO 01/1256, as compiled to 4 October 2005) is a narrow declaratory instrument made under subsection 88B(2) of the Corporations Act 2001. Its operative effect is to declare that specified classes of members of particular professional accounting bodies are "qualified accountants for the purposes of the Act" (opening recital and operative paragraphs (a)-(d)). The declaration is not expressed as an amendment to the Corporations Act itself; it is rendered by ASIC by exercise of the power in s 88B(2) and recorded in this class order.
Mechanically, the instrument operates by listing four classes of persons who are taken to be qualified accountants for the Corporations Act: members of CPA Australia who are entitled to use “CPA” or “FCPA” and who are subject to and comply with CPA Australia’s continuing professional education requirements (para (a)); members of The Institute of Chartered Accountants in Australia who are entitled to use “CA”, “ACA” or “FCA” and who are subject to and comply with that body’s continuing professional education requirements (para (b)); members of the National Institute of Accountants who are entitled to use “PNA”, “FPNA”, “MNIA” or “FNIA” and who are subject to and comply with that body’s continuing professional education requirements (para (c)); and certain members of specified foreign professional bodies who meet a two-part test: at least three years’ practical experience in accounting or auditing and who are providing a certificate for the purposes of paragraph 708(8)(c) or paragraph 761G(7)(c) of the Corporations Act to a person resident in the same country as the member, where that country is not Australia (para (d)(i)-(ii)). The instrument’s Interpretation section defines the eligible foreign professional bodies by name (Interpretation list (a)-(g)).
The class order is precise about scope and conditions. For the three Australian bodies (CPA Australia, ICAA, NIA) the declaration is conditional on two factual states: entitlement to specified post‑nominals and being subject to and in compliance with the respective body’s continuing professional education requirements. For foreign bodies the declaration is conditional on practical experience and a residency-linked certification activity; that declaration only operates when a certificate is provided to a person resident in the same (non‑Australian) country as the member, and is for specific paragraphs of the Corporations Act. The instrument does not purport to create offences or to prescribe enforcement mechanisms; it is a declaration of qualification status for Corporations Act purposes. The compilation notes and instrument table record subsequent amendments and the instruments that amended or added paragraphs (see Table of Instruments and Table of Amendments).
