12 When person is a worker

(1)  [Section 12 Subsection (1) amended by No. 11 of 2013, Sched. 1, Applied:01 Jul 2013] For the purposes of this Act, a person is a worker if the person is engaged or works under a contract of service or training contract with an employer.

(2)  [Section 12 Subsection (2) amended by No. 11 of 2013, Sched. 1, Applied:01 Jul 2013] Subsection (1) applies in relation to a contract of service whether the contract is or was express or implied, oral or in writing.

(3)  Subsection (1) applies in relation to manual labour, clerical work or otherwise.
