Asbestos Diseases Compensation Act 2008

Definitions and scope. The Act operates around a small set of defined concepts. An "asbestos-related condition" is defined by reference to a closed list: asbestosis, asbestos induced carcinoma, asbestos-related pleural diseases and mesothelioma (s 3(1)). The definition expressly excludes a condition evidenced solely by pleural plaques (s 3(2)). "Injured person" means someone who is suffering or has suffered from an asbestos-related condition (s 3(1)). The Act also defines "subsequent action" and "subsequent award" in relation to section 4 (s 3(1)).

Provisional damages and subsequent awards. The key substantive concept is provisional damages. Under section 4, provisional damages allow a court in the first action to award damages on the basis that the injured person will not in future develop another asbestos-related condition; if that injured person later develops another such condition linked to the same act or omission, the court may make a subsequent award to compensate for that later condition (s 4). The subsequent award is triggered only where it was proved or admitted at the time of the initial action that there was a real possibility of the injured person developing another asbestos-related condition as a result of the same act or omission (s 4).

Single-follow-up limit. The Act caps follow-up awards: if provisional damages have been paid, only one subsequent award for another asbestos-related condition can be made to the injured person (s 5). This limits the number of times a plaintiff can return for additional damages under the provisional-damages mechanism.

Interplay with prior awards and costs. The court may take the initial award into account when calculating a subsequent award (s 6). The Act requires courts and registrars to have regard to legal costs incurred in the initial action when assessing legal costs in any subsequent action brought by the same injured person, with an explicit statutory purpose of preventing awards of costs that replicate work already done (s 7(1)-(2)). Section 7(3) lists particular areas of initial action work that may duplicate effort in the subsequent action, to be considered when judging duplication: identifying defendants, identifying exposure circumstances, issues on negligence or breach of duty, and establishing the relationship and causal nexus between exposure and condition (s 7(3)(a)(i)-(iv)). The court may also consider other relevant factors (s 7(3)(b)).

Temporal application and exceptions. The Act applies to causes of action and actions commenced before or after commencement (s 8(1)). However, it does not apply to actions where the hearing had already begun before commencement or where damages were awarded or a settlement reached prior to commencement (s 8(2)(a)-(b)). The Act’s commencement is the day after Royal Assent (s 2), and the endnotes record assent and commencement dates.

Interaction with compensation statutes. The Act’s note to section 4 identifies that claims for asbestos-related conditions may be governed by other compensation regimes depending on timing and context: Workers Compensation Act 1958 for employment injuries before 4 p.m. on 31 August 1985; Accident Compensation Act 1985 for injuries on or after 31 August 1985 but before 1 July 2014; Workplace Injury Rehabilitation and Compensation Act 2013 for injuries on or after 1 July 2014; and the Wrongs Act 1958 where the injury did not arise out of or in the course of employment (note to s 4). This locates the provisional-damages regime within a broader statutory landscape of differing compensation regimes.

Limited legislative architecture. The Act is short and narrowly framed. The text indicates that Part 3 and Part 4 headings and sections were repealed (s 9; s 14 entries). The endnotes and table of amendments indicate later adjustments in relation to the 2013 workplace compensation statute (Workplace Injury Rehabilitation and Compensation Act 2013) that affect the note to section 4.

Primary affected persons. The Act primarily affects injured persons who are suffering or have suffered from an asbestos-related condition as defined by the Act (s 3(1)). That definition expressly excludes cases where the only evidence is pleural plaques (s 3(2)). Therefore plaintiffs with one of the enumerated diagnoses (asbestosis, asbestos induced carcinoma, asbestos-related pleural diseases, or mesothelioma) fall within scope, subject to the exclusion for pleural plaques.

Litigants and legal practitioners. Plaintiffs and defendants involved in civil actions for damages for asbestos-related conditions are directly affected. The Act changes how initial damages may be assessed and how follow-up claims are treated (s 4-6). Legal practitioners acting for injured persons will need to consider whether to seek provisional damages in the initial action, and to adduce proof or admission of the possibility of future asbestos-related conditions in order to qualify for a subsequent award (s 4). Practitioners acting for defendants will need to consider case strategy in light of the possibility of a later subsequent award and the statutory limit of one subsequent award (s 5).

Courts and registrars. The Act assigns specific duties to courts and registrars. Courts have the discretion to award provisional damages and to make subsequent awards (s 4, s 6). Courts and registrars are required to have regard to legal costs incurred in the initial action when assessing legal costs in a subsequent action, and to consider specified factors when determining duplication of costs (s 7(1), s 7(3)). Thus registrars exercising costs assessment functions are directly constrained by the statutory list of factors.

Employers, insurers and compensation agencies. The Act interacts with various compensation regimes depending on the timing and circumstances of employment (note to s 4). Employers, insurers and relevant workers compensation bodies will be affected in as much as claims may sit concurrently with or be informed by those regimes, and in that the Act’s provisions regarding provisional damages and subsequent awards will influence litigation risk and settlement strategy (note to s 4). The statutory note distinguishes which compensation act applies by reference to employment dates and the 1 July 2014 commencement of the Workplace Injury Rehabilitation and Compensation Act 2013 (note to s 4).

Dependants and statutory amendments. The Act’s stated purposes include amending the Wrongs Act 1958 in relation to dependants’ claims for damages arising from deaths caused by dust-related conditions (s 1(c)). The text of this Act itself sets out the provisional-damages scheme; the amendment purpose indicates an intended effect on dependants’ claims under the Wrongs Act, but the operative provisions in this Act concern provisional damages and costs (s 1).

Temporal classes. Individuals whose actions were already in hearing or settled prior to this Act’s commencement are differently affected. The transitional provision excludes actions where the hearing had commenced before the commencement, or where damages were awarded or a settlement reached before commencement (s 8(2)(a)-(b)). The Act otherwise applies to causes of action and actions that arose or were commenced before or after commencement (s 8(1)).

Rights of injured persons. An injured person defined in section 3 has the right, through the litigation process, to seek provisional damages in respect of an asbestos-related condition where it is proved or admitted at trial that there is potential for the development of another asbestos-related condition as a consequence of the same act or omission (s 4). Where provisional damages are awarded, the injured person has a statutory route to a subsequent award should they later develop another asbestos-related condition within the scope of the initial proof or admission (s 4). The Act restricts an injured person to only one subsequent award where provisional damages have been paid (s 5). Injured persons whose condition is evidenced only by pleural plaques do not qualify as having an asbestos-related condition under this Act (s 3(2)), and therefore lack the rights created by the provisional-damages mechanism.

Court and registrar duties. Courts have the power to make both initial and subsequent awards under section 4, and may take the initial award into account when assessing the amount of a subsequent award (s 4, s 6). Courts and registrars are required to have regard to the legal costs incurred in the initial action when assessing legal costs in a later action by the same injured person (s 7(1)). The statute expressly states the purpose of that requirement: to ensure that legal costs awarded in a subsequent action are not for work undertaken in the initial action (s 7(2)). When considering potential duplication, the court or registrar must consider the matters enumerated in s 7(3)(a)(i)-(iv), and any other factors that they deem appropriate (s 7(3)(b)).

Duties to plead evidence/admissions. The right to a subsequent award is conditional on there having been proof or an admission in the initial action that the injured person may in future develop another asbestos-related condition as a result of the same act or omission (s 4). This creates a practical duty on the party seeking provisional damages to ensure that the initial record contains the necessary proof or admission to invoke the subsequent-award mechanism.

Limitations on multiplicity of awards. The Act imposes a duty on the courts to enforce the statutory cap of one subsequent award per injured person where provisional damages are paid (s 5). This duty constrains both plaintiffs and defendants in their expectations about repeated litigation and potential liabilities.

Transitional constraints. Parties and courts must observe the transitional rules in section 8. The Act applies to causes of action and actions commenced before and after commencement (s 8(1)), but it does not apply where the hearing had already started or where damages were already awarded or a settlement reached before commencement (s 8(2)(a)-(b)). Parties with actions in these statuses have rights and duties informed by those exclusions.

Statutory purpose statement. Section 1 lists the Act’s purposes, which include permitting the award of provisional damages, and amending other statutes in relation to asbestos-related and dust-related claims (s 1). The statutory purpose supplies interpretive context for duties such as the costs constraint (s 7(2)), but the operative duties and rights are those expressly set out in sections 3-8.

Absence of criminal or administrative penalties. The Act does not create criminal offences, fines, administrative penalties, or a bespoke enforcement agency. The legislative text contains no penal provisions; enforcement occurs through the civil courts by way of awards and costs directions under the Act’s provisions (s 4-7). Any enforcement of rights and duties created by the Act is therefore through ordinary civil litigation processes.

Court enforcement mechanisms. The Act empowers courts to make initial awards and subsequent awards in civil actions for damages arising from asbestos-related conditions (s 4). It also empowers courts to have regard to earlier awards when assessing subsequent damages (s 6). The statutory instrument for enforcement is the court’s judgment and costs orders: initial awards, subsequent awards, and costs orders. The Act directs courts and registrars to consider prior legal costs when ordering costs in subsequent actions, which is an internal costs-management enforcement mechanism (s 7(1)-(3)).

Limits and caps as enforceable constraints. Section 5’s limit of one subsequent award after provisional damages has been paid is an enforceable, statutory constraint that courts must apply when entertaining subsequent proceedings by the same injured person (s 5). Section 8 sets enforceable temporal rules governing the Act’s application to proceedings commenced or heard before the Act’s commencement (s 8).

Procedural effect rather than sanction. Because the Act governs the structure of damages awards and costs assessment rather than imposing sanctions, the main enforcement effect is procedural: courts will apply the Act when awarding damages or assessing costs, and parties’ remedies or obligations are realised through that process. There are no separate enforcement powers outside the general civil jurisdiction of the courts described in the Act.

Dependants’ claims and external enforcement. The Act’s purposes include amending the Wrongs Act 1958 in relation to dependants’ claims arising from dust-related deaths (s 1(c)). The operative provisions in this Act deal with provisional damages and costs; any enforcement mechanisms that affect dependants’ claims would derive from amendments to the Wrongs Act rather than this Act’s enforcement machinery. The Act itself provides no new enforcement instruments for dependants’ claims within its text.

Interaction with workers compensation and injuries statutes. The Act explicitly locates claims for asbestos-related conditions within the framework of several compensation statutes, by way of the note to section 4. It identifies that an injured person’s claim may involve an injury to which the Workers Compensation Act 1958 applies where the injury arose out of or in the course of employment before 4 p.m. on 31 August 1985 (note to s 4(a)); the Accident Compensation Act 1985 applies where the injury arises out of or in the course of employment, or was due to the nature of employment on or after 4 p.m. on 31 August 1985 but before 1 July 2014 (note to s 4(b)); the Workplace Injury Rehabilitation and Compensation Act 2013 applies where the injury arises out of or in the course of employment, or was due to the nature of employment on or after 1 July 2014 (note to s 4(ba)); and the Wrongs Act 1958 applies if the injury did not arise out of or in the course of the injured person’s employment (note to s 4(c)). The note therefore situates the Act’s provisional-damages regime alongside, and subject to, overlapping compensation regimes determined by the date and nature of the employment-related injury.

Statutory amendments and cross-references. The Act’s stated purposes include amending the Accident Compensation Act 1985 and the Wrongs Act 1958 in relation to asbestos-related or dust-related claims (s 1(b)-(c)). The text of this Act provides the provisional-damages scheme; the precise amendments to those other Acts are not reproduced in the text supplied, but the purposes indicate intended cross-Act effects. The endnotes identify that amendments to this Act were made consequential to the Workplace Injury Rehabilitation and Compensation Act 2013 (Workplace Injury Rehabilitation and Compensation Act 2013, No. 67/2013, s 649(Sch. 9 item 1), with commencement on 1 July 2014), the technical effect being reflected in the note to section 4 (endnotes and table of amendments).

Temporal and procedural interaction. Section 8 governs how the Act applies to causes of action and actions begun before or after commencement, and provides exceptions where hearings had already started or where damages were already awarded or a settlement reached before commencement (s 8(1)-(2)). That means that the Act’s procedural and substantive changes to damages awards and costs assessment will not retroactively alter outcomes in proceedings where hearing or settlement predated commencement. For matters in progress at commencement, parties must attend to s 8 to determine whether the provisional-damages regime attaches.

Interaction with costs regimes. Section 7 modifies the exercise of judicial discretion over costs awards in subsequent actions by requiring courts and registrars to have regard to initial-action costs and to consider duplication factors (s 7(1)-(3)). This sets a specific, statutory overlay on pre-existing rules about costs and cost assessment, requiring courts and registrars to incorporate the specified considerations into their costs determinations in subsequent asbestos-related actions.

Repeals and internal restructuring. The text shows that Part 3 and Part 4 headings and certain sections were repealed (s 9; s 14). The table of amendments in the endnotes records the Act’s assent date, commencement information for certain sections, and cross-references to the Workplace Injury Rehabilitation and Compensation Act 2013. Readers and practitioners must therefore refer to the Act text and the tables of amendments to see which parts remain in force and how they interact with subsequent legislative developments.

Assent and commencement. The Asbestos Diseases Compensation Act 2008 received assent on 25 November 2008 and came into operation on 26 November 2008, the day after assent (s 2; endnotes). The endnotes record the Minister’s second reading speech dates: Legislative Assembly 9 October 2008 and Legislative Council 30 October 2008, and provide the long title of the Bill.

Internal repeals. The Act text notes that Part 3 (heading and sections 9-11) and Part 4 (heading and sections 12-14) have been repealed by provisions cited as No. 69/2008 s 11 and s 14 respectively (text entries for s 9 and s 14). The presence of these internal repeal statements indicates that the Act’s present operative structure is limited to Part 1 and Part 2 as shown in the version supplied.

Subsequent legislative interaction. The endnotes include a table of amendments showing that the Workplace Injury Rehabilitation and Compensation Act 2013 (No. 67/2013) made amendments affecting the Asbestos Diseases Compensation Act 2008. Specifically, the endnotes record that s 649(Sch. 9 item 1) of the 2013 Act commenced on 1 July 2014 and relates to provisions amending the Asbestos Diseases Compensation Act 2008; the note to section 4 was amended accordingly to reflect which workplace compensation statute applies depending on the date of injury or employment (endnotes, table of amendments). The Version No. 004 (incorporating amendments as at 1 July 2014) thus reflects the effect of that later Act on the cross-referencing note to s 4.

No further explanatory amendments recorded. The endnotes include a heading "Explanatory Details" but state there are no entries at the date of publication of this version. That indicates no additional explanatory materials or retrospective amendment notes were included in the endnotes for this version (endnotes, Explanatory Details).

Limited amendment footprint. Overall the Act is short, and its amendment history in the supplied text is limited: the critical recorded amendment reflects the change to the ancillary note to section 4 following the 2013 workplace compensation statutory overhaul, and certain internal parts are recorded as repealed (endnotes; s 9; s 14). Users seeking the current law should check the Version No. and the endnotes table of amendments for any further changes beyond 1 July 2014.

No cases cited in the Act. The statutory text supplied contains no references to judicial decisions, reported cases, or prior litigation construing the provisions. The Act itself is a statutory instrument creating a procedural and substantive framework; the supplied material does not include any litigation history or reported judicial interpretations.

Legislative record entries. The endnotes supply limited legislative-history information useful to a researcher preparing for litigation: the second reading speech dates (Legislative Assembly 9 October 2008; Legislative Council 30 October 2008), the date of assent (25 November 2008), and the commencement date (26 November 2008) (endnotes). These entries give context to the legislative intent as recorded in parliamentary proceedings, but the Act text itself is the only operative material supplied.

No explanatory memorandum entries. The endnotes include an "Explanatory Details" section but indicate that there are no entries at the date of publication for this Version (endnotes). Therefore no explanatory memorandum or adjudicative material is included in the supplied text to illuminate legislative intent beyond the statutory purpose clauses in section 1.

Practical consequence for litigators. In the absence of supplied judicial interpretations, practitioners will need to rely on the plain text of the Act when making or defending provisional-damages applications, and on future or external case law not included in the supplied material for contested points such as what constitutes sufficient proof or admission of a future asbestos-related condition, the exercise of discretion in awarding a subsequent award, and the quantification of duplication in legal costs under s 7(3). The supplied Act text provides the statutory framework that courts will apply, but does not contain litigation history to indicate how courts have interpreted or applied these provisions.

Pleural plaques exclusion. A condition evidenced solely by pleural plaques is not an asbestos-related condition under the Act (s 3(2)). That exclusion is absolute in the wording of the definition. Parties and counsel must therefore not assume that evidence of pleural plaques alone will bring a claimant within the provisional-damages regime.

Conditionality of subsequent award. The right to a subsequent award hinges on proof or admission in the initial action that the injured person may at some time in the future develop another asbestos-related condition due to the same act or omission (s 4). If that proof or admission is not made in the initial action, the statutory mechanism for a subsequent award will not be available. The necessary proof or admission should therefore be made part of the initial action record if a later claim is anticipated.

Only one subsequent award. Where provisional damages have been paid, only one subsequent award is permitted (s 5). That cap can be unintuitive for cases where an injured person might face multiple distinct future asbestos-related conditions; the Act limits the follow-up remedy to one event. Parties should plan litigation and settlement strategy with that statutory cap in mind.

Costs duplication scrutiny. Courts and registrars must have regard to legal costs incurred in the initial action when assessing costs in subsequent actions (s 7(1)-(2)). The statute requires consideration of specific factors when determining duplication (s 7(3)(a)(i)-(iv)). Practitioners must ensure initial-action costs are properly itemised and that subsequent-action costs are demonstrably for distinct work, because the court or registrar will actively exclude duplication. The statute’s stated purpose is to prevent costs being awarded for work done in the initial action (s 7(2)).

Transitional exclusions. Although the Act applies to causes of action arising and actions commenced before or after commencement (s 8(1)), it does not apply where the hearing had commenced before commencement or where damages were awarded or a settlement reached before commencement (s 8(2)(a)-(b)). Parties whose matters were already at hearing or settled before the Act’s commencement cannot retroactively invoke the provisional-damages regime. Conversely, where a settlement before commencement included provisional damages, the Act’s treatment of provisional damages may be relevant.

Evidence and admissions. The Act permits a court to act where it is proved or admitted that a future asbestos-related condition may develop (s 4). The necessity of either proof or admission means that tactical decisions about whether to admit the possibility of future conditions in an initial action carry material consequences for the availability of subsequent relief.

Interaction with compensation regimes. The note to section 4 identifies different compensation statutes applying depending on timing and employment context (note to s 4). Practitioners must map the claim to the correct statutory regime, for example distinguishing pre-31 August 1985 workers compensation entitlements (Workers Compensation Act 1958) from later regimes and the 1 July 2014 commencement of the Workplace Injury Rehabilitation and Compensation Act 2013 (note to s 4). The Act itself does not elaborate offsets or interaction rules beyond the note: such matters may be governed by the other compensation statutes or by common law.

Limited scope of the Act. The Act is narrowly focused on the provisional-damages mechanism and costs duplication in subsequent asbestos-related actions. It does not create a general multi-stage damages procedure for other diseases, nor does it specify how subsequent awards should be quantified beyond permitting courts to regard the initial award (s 6). Expectation management is required: many issues are left to judicial discretion guided by the statutory framing rather than detailed statutory formulas.

Internal repeals and version checking. The text indicates that Parts 3 and 4 headings and certain sections have been repealed (s 9; s 14). Practitioners must check current versions and the table of amendments (endnotes) to avoid relying on repealed provisions or obsolete structures in the Act.

For plaintiffs and their advisers. If an injured person wishes to preserve the possibility of a subsequent award under the Act, ensure that the initial action includes proof or, where appropriate, an admission that the injured person may at some time in the future develop another asbestos-related condition as a result of the act or omission giving rise to the claim (s 4). Lodge pleadings and expert evidence that identify the realistic risk of subsequent asbestos-related conditions; make clear in judgment or settlement documentation whether provisional damages are being awarded. Be mindful that the initial award will be assessed on the assumption that the injured person will not develop another asbestos-related condition, and that any later subsequent award will depend on the earlier proof or admission (s 4, s 6).

Document initial-action legal costs. Because courts and registrars must have regard to initial-action legal costs when assessing costs in a subsequent action (s 7(1)), carefully record and itemise all legal work undertaken in the initial action, with particular attention to work identified in s 7(3)(a)(i)-(iv): identifying defendants, establishing exposure circumstances, negligence or breach of duty inquiries, and causal nexus work. When later claiming costs in a subsequent action, segregate new work from work already undertaken so the court or registrar can assess duplication. Anticipate that costs relating to identification of defendants or exposure may be treated as already incurred.

Plead provisional damages if required. To obtain the statutory framework for a subsequent award, expressly seek provisional damages in the initial proceedings or ensure the court’s order or judgment records the necessary findings or admissions (s 4). Failure to do so may foreclose the statutory route to a later award. Where settlement is contemplated, consider whether to include express provisional-damages language in the settlement documents.

For defendants, employers and insurers. If defending an action, consider the potential consequences of admitting the possibility of future asbestos-related conditions. An admission or proof in the initial action may enable a later subsequent award (s 4). If admitting liability or certain facts, consider the strategic implications for future exposure to additional claims and the statutory one-subsequent-award cap (s 5). Preserve contemporaneous records about employment, exposure, and steps taken to reduce exposure risk, since those records relate to matters courts must consider when assessing causal nexus and other factors enumerated in s 7(3)(a).

Map the compensation regime. Establish early which compensation statute applies to the injured person’s workplace injury, using the dates and contexts set out in the note to section 4: the Workers Compensation Act 1958 for employment injuries before 31 August 1985; the Accident Compensation Act 1985 for injuries from 31 August 1985 to before 1 July 2014; the Workplace Injury Rehabilitation and Compensation Act 2013 for injuries on or after 1 July 2014; and the Wrongs Act 1958 where the injury did not arise from employment (note to s 4). This determines overlapping obligations and procedural considerations outside the Asbestos Diseases Compensation Act’s own provisional-damages device.

Costs strategy. Both sides should plan costs strategy with s 7 in mind. Plaintiffs should avoid seeking duplicated costs in a subsequent action. Defendants should challenge any costs claims that appear to duplicate work done in the initial action, and make submissions under s 7(3) about the listed categories of prior work. Registrars and courts will be asked to apply the statutory considerations.

Transitional checks. Before bringing or defending an action, check whether the matter falls within the transitional exceptions in s 8(2): if the hearing had commenced before the Act’s commencement or if damages were awarded or a settlement reached before commencement, the Act does not apply to that action. The Act otherwise applies to causes of action and actions arising or commenced before or after commencement (s 8(1)), so timing of commencement and hearing steps is decisive.

Clinical and evidential preparation. Ensure relevant medical and occupational exposure evidence is obtained early so that the initial action can either prove or permit an admission that a future asbestos-related condition is possible. Expert medical opinions should address the likelihood and timing of later conditions, and forensic occupational histories should document exposure circumstances, employers, and dates. These materials feed both the initial award assessment and any future subsequent award under s 4.

Record settlement terms carefully. If settling, consider whether to include express terms addressing provisional damages and the potential for a subsequent award, because a settlement reached before commencement of the Act is excluded from its operation (s 8(2)(b)). Clear settlement drafting reduces later disputes about whether provisional damages were intended and whether the Act applies.

Version control and statutory checking. Practitioners should check the most recent consolidated version of the Act and the table of amendments (endnotes) to confirm current text and any amendments made after 1 July 2014, particularly insofar as the Act cross-references other compensation statutes and internal repeals (endnotes; s 9; s 14).
