Arkaroola Protection Act 2012

The central concept is the Arkaroola Protection Area, a geographically fixed boundary defined by reference to a deposited plan in the General Registry Office as at 19 October 2011. No further amendment of that boundary is provided for; the area is locked in by statute. That fixed boundary contrasts with the management plan, which can be altered by the Minister after consultation. Mining operations and regulated activities are the activities prohibited. Mining operations are defined by cross-reference to the Mining Act 1971 and Opal Mining Act 1995, excluding rehabilitation. That definition includes exploration and production, but the exclusion for rehabilitation is significant: it allows land owners or custodians to clean up existing disturbances without breaching the prohibition. Regulated activities under the Petroleum and Geothermal Energy Act 2000 cover a broad range of petroleum and geothermal exploration, drilling, and production. The management plan is a statutory policy instrument that must further the objects of the Act. It is not a legally binding instrument on private persons directly (section 8(8)), but it binds government decision-makers (section 8(9)). That creates indirect obligations: a pastoral lessee who needs a permit under another Act will find that the permit decision must be made consistently with the plan. The plan is developed after consultation with interest holders: native title holders, land owners, lessees, tenement holders, custodians, and any Aboriginal person or organisation the Minister deems to have an interest. Consultation is entirely at the Minister’s discretion as to “such manner as the Minister thinks fit” (section 8(3), (4), (5)). There is no prescribed procedure, minimum timeframe, or right to be heard. The Minister may adopt the plan unchanged or with changes, and if changes are significant or substantial, additional consultation with interest holders is required, again as the Minister thinks fit. The objects (section 4) are multifold: conservation of habitat, ecosystems, biological diversity, landforms, landscapes, and natural features; support for cultural and spiritual values of the Adnyamathanha people; support for scientific research; fostering public appreciation; and ensuring development and land management are consistent with those objects. The objects do not create enforceable duties by themselves but guide the management plan and all administrative decisions. The custodian concept is defined as a person or body with care, control, and management of land, which would include managers of reserves or conservation areas. Leasehold land includes land under the Crown Land Management Act 2009 or a pastoral lease. The Act explicitly saves native title: section 7 says nothing in the Act affects any native title that may exist. This preserves any native title rights and interests that may be determined, but does not define what those are. The prohibition in section 10 is the strongest concept: it bars both acquisition and exercise of rights. That means existing tenements that had been granted before commencement cannot be worked; any renewal or transfer that would involve acquisition is also blocked. The Act does not provide for compensation, transitional arrangements, or grandfathering of existing operations.

The first group directly affected are mining and petroleum tenement holders who held or sought rights over land within the Arkaroola Protection Area. Any existing exploration licences, mining leases, opal mining claims, petroleum exploration permits, production licences, or geothermal energy rights that cover the Area become unexercisable. That extinguishes those rights without compensation, a substantial economic impact on those companies and their investors, especially if they had already incurred capital expenditure on exploration or infrastructure. Adjacent tenement holders are affected only to the extent that their operations must not encroach into the Area; their rights outside remain unaffected (section 10(3)). However, they may face operational constraints if the boundary runs through a deposit, because they cannot extend workings into the Area. Pastoral lessees in the Area are directly affected because the related amendment to the Pastoral Land Management and Conservation Act 1989 inserts a new condition into pastoral leases: the lessee must use the land in accordance with the management plan (Schedule 1, Part 4, item 5). That imposes a potentially significant compliance burden because the plan may restrict grazing, infrastructure, or other pastoral activities beyond what the lease previously required. Pastoral lessees also have a statutory right to be consulted during development of the plan (section 8(10)(c)) but no veto. Land owners and custodians are affected similarly: their management of land must be consistent with the management plan when exercising powers under other Acts. Native title holders, particularly the Adnyamathanha people, are recognised as interest holders with consultation rights. The Act does not derogate from native title (section 7), but if native title includes the right to access or use resources, that may conflict with the prohibition on mining. The Act does not resolve that; it only says it does not affect native title. Developers and local councils are affected because the Development Act 1993 is amended to require the Planning Strategy and Development Plan amendments to have regard to the objects of the Arkaroola Protection Act and, for parts of the Area, any change to a Development Plan must consider the management plan and the Minister responsible for the Arkaroola Act must be consulted. This imposes a new hurdle on any development approval in the Area, including tourist infrastructure, residential, or commercial projects. State government regulators under the Natural Resources Management Act 2004 must now consider the management plan when preparing regional NRM plans that cover the Area. The Minister administering the National Parks and Wildlife Act 1972 has the lead administration role and must develop and adopt the management plan. The Minister responsible for the Development Act must review Development Plans within six months after the management plan is published. The public is affected in that the Act fosters appreciation and enjoyment, but also may restrict access if the management plan prohibits certain activities. Regulation-making power under section 11 allows the Governor to prohibit or restrict any specified activity in the Area, with fines up to $10,000, potentially affecting tourists, researchers, and anyone else entering or using the land.

The Minister administering the National Parks and Wildlife Act has a duty to develop a management plan as soon as practicable after commencement (section 8(1)). That duty is not time-bound beyond “as soon as practicable”, giving the Minister flexibility but also potential for delay. Consultation with interest holders is mandatory before developing or altering the plan and after preparing a draft (sections 8(3)-(5)). The Minister must consult adjoining interest holders as well. However, the manner of consultation is entirely at the Minister’s discretion (“in such manner as the Minister thinks fit”), so there is no duty to hold hearings, provide written submissions, or respond to representations. The Minister must undertake additional consultation if changes after public consultation are significant or substantial (section 8(6)(b)). The Minister must publish the adopted plan in the Gazette for it to have effect (section 8(7)). All persons and bodies involved in administering an Act must, when exercising powers and functions in relation to the Area, act consistently with and seek to further the management plan (section 8(9)). That duty applies to all state and local government decision-makers under any Act - not just those listed. It is a positive duty to further the plan, which goes beyond merely not contradicting it. The Minister responsible for the Development Act must ensure a review of relevant Development Plans within six months after the first publication of the management plan, to determine amendments needed for consistency (section 9(1)). That review must consider the views of the Minister administering this Act (section 9(2)). The Minister also has the right to initiate development plan amendments for consistency with the management plan (Schedule 1, Part 2, item 3). The Minister administering this Act cannot acquire or exercise mining rights for the Area (section 10(1)). Adjacent tenement holders retain all rights over land outside the Area (section 10(3)). Native title holders have their rights unaffected (section 7) and are entitled to consultation as interest holders. Interest holders generally have a right to be consulted but not to consent or veto. There is no right to compensation for loss of mining rights. The regulations may impose duties on any person undertaking prohibited activities, including compliance with prescribed requirements, and the regulations may create offences punishable by fines up to $10,000 (section 11(2)(c)). The Governor can prohibit or restrict any activity in the Area, not just mining, effectively creating a broad regulatory power over all land use. The regulations may delegate discretion to the Minister or any other person (section 11(3)(b)). There is no duty on the Minister to act reasonably or proportionately in exercising that discretion; the only constraint is the purpose of the Act.

The Act itself does not create any primary penalty for breaching section 10. The prohibition on acquiring or exercising mining rights under a mining Act is not directly punishable under this Act. Instead, enforcement relies on the mining Acts: if a person attempts to exercise a right that is extinguished, the relevant mining Act’s enforcement provisions would apply, including possible offences for unauthorised mining. However, section 10(2) says it has effect despite any other Act, so a mining Act cannot authorise the activity. Practically, any mining activity after commencement would be unlawful and the relevant mining regulator could take enforcement action, such as directions, suspension of licences, or prosecution under the mining Act. The Act does empower the Governor to make regulations that can prohibit or restrict any specified activity in the Area (section 11(2)(a)). Those regulations can prescribe fines not exceeding $10,000 for offences against the regulations (section 11(2)(c)). The regulations can also provide for facilitating proof of offences (section 11(2)(d)). This gives a flexible tool to impose criminal penalties on activities that are not themselves mining but are contrary to the objects, such as unauthorised earthworks, vegetation clearing, or commercial activity. The $10,000 maximum fine is moderate; it is a summary offence level. The Minister or another body could also seek an injunction in the Supreme Court to restrain a breach of the Act or regulations if the regulations so provide (not specifically in the Act, but the general law would likely apply). There is no provision for civil penalties, remediation orders, or naming of offenders. The Act does not create a private right of action; enforcement is entirely through public authorities. Because the management plan is policy only (section 8(8)), a breach of the plan by a government decision-maker is not directly punishable, but could be subject to judicial review if the decision-maker fails to act consistently under section 8(9). The Pastoral Land Management and Conservation Act amendment makes compliance with the management plan a condition of the pastoral lease; breach of a lease condition could lead to forfeiture or other remedies under that Act, including termination. The Natural Resources Management Act amendment requires regional plans to have regard to the management plan; failure to do so could affect the validity of the regional plan. Overall, the enforcement structure is indirect, relying on existing frameworks in other Acts plus the new regulation-making power. The absence of a direct penalty for the core prohibition is a notable feature, but the practical effect is that any mining is simply void as a matter of law.

Section 6 states that except where the contrary intention appears, this Act is in addition to and does not limit or derogate from any other Act. That means the Arkaroola Protection Act layers on top of existing law. The key exception is section 10(2), which gives the prohibition on mining primacy over any other Act. So the Mining Act, Opal Mining Act, Petroleum and Geothermal Energy Act, and any other Act that might purport to authorise mining are overridden within the Area. That includes the Crown Land Management Act, the Pastoral Land Management and Conservation Act (pastoral leases often permit mining), and the Development Act. The prohibition is blanket. The related amendments modify four other Acts. Development Act 1993: The Planning Strategy (section 22) must now also have regard to the objects of the Arkaroola Protection Act, not just the previous criteria. The Minister can amend a Development Plan for consistency with the management plan (section 24 new paragraph (fbc)), and for any amendment relating to the Area the Minister must consult the Arkaroola Minister (section 24 new paragraph (d)). This gives the Arkaroola Minister influence over planning decisions that could otherwise permit incompatible development. Natural Resources Management Act 2004: Regional NRM plans that relate to the Area must take into account the management plan under this Act (section 75 new paragraph (fa)). This includes regional water allocation plans, pest management plans, and other natural resource management schemes. Pastoral Land Management and Conservation Act 1989: Pastoral leases over the Area now include an implied condition requiring the lessee to use the land in accordance with the management plan (section 22 new subparagraph (vii)). That is a significant additional obligation on pastoral lessees, who may have pre-existing rights under the lease that are now qualified by the plan. Native Title Act: Section 7 preserves native title rights unaffected. The interaction with the Native Title (South Australia) Act 1994 is that any native title determination over the Area would not be extinguished by this Act. However, if native title includes a right to access and use resources, that right may be limited by the prohibition on mining, but the Act says it does not affect native title - a potential legal tension. A future native title determination may need to reconcile the two. National Parks and Wildlife Act 1972: The Minister administering that Act is the administrator of this Act, but the Area is not automatically a national park. The management plan and the objects align with conservation, but the Act does not transfer the land to Crown reserve. The interaction is procedural: the same Minister oversees both, but the legal regimes remain separate. The management plan under this Act must be consistent with the objects, which include conservation, but there is no requirement to accord with park management plans under the National Parks and Wildlife Act. The Act also interacts with common law property rights. The prohibition effectively extinguishes mineral rights that may have been held by the Crown or granted to third parties. The Act does not provide compensation, which could raise acquisition of property issues under the South Australian Constitution or the Commonwealth Constitution (section 51(xxxi)). That interaction is not dealt with in the text but is a latent legal risk.

The Act was assented to on 8 March 2012 and came into operation on 26 April 2012 by proclamation published in the Gazette on that date. The legislative history records only one amendment: the Biodiversity Act 2025 (No 29 of 2025, assented 26 June 2025) which, under schedule 5 clause 3, is noted as “uncommenced” at the time of the version provided. The content of that amendment is not specified in the source. It is likely a consequential amendment to update references following the enactment of the new Biodiversity Act, but because it is uncommenced it has no force. No other amendments have been made to the principal Act since its enactment. The Act therefore stands as enacted in 2012, with no substantive changes in over a decade. The lack of amendment history may indicate the Act has operated without major controversy or that its provisions have been accepted as sufficient. The uncommenced amendment from 2025 may reflect a broader consolidation of biodiversity legislation in South Australia, but until proclaimed, it has no effect. For practitioners, the absence of amendment history means the text is stable, but they should check whether the 2025 amendment has been proclaimed since the version provided. The Act’s long title and objects have not been altered. The related amendments to the Development Act, Natural Resources Management Act, and Pastoral Land Management and Conservation Act have been in place since 2012 and have not been further amended. There is no evidence of any intervening amendment that altered the boundaries, the prohibition, or the management plan provisions.

The Act itself does not mention any litigation, and we are not to invent case history. No cases are referenced in the text. The source provides no information about court proceedings challenging the Act or its application. That does not mean no litigation has occurred; it simply is not recorded in the instrument. Given the prohibition’s impact on valuable mining rights, one would expect potential challenges on constitutional grounds (acquisition of property on just terms under the Commonwealth Constitution) or administrative law challenges to the management plan or prohibition. However, without source evidence, we cannot assert any specific case. Practitioners should be aware that the absence of reported litigation may indicate that no compensation claims or constitutional challenges have succeeded, or that disputes were resolved without court judgment. The Act’s clear wording and the breadth of the saving provision for native title may have discouraged some challenges. The regulations power has not been tested in court under this Act. The management plan’s status as policy (section 8(8)) could be challenged if administrative decisions rely on it in a way that affects rights; such a challenge would be on usual judicial review grounds (unreasonableness, procedural fairness if mandatory consultation was not properly conducted). The consultation provisions are highly discretionary, so a challenge to the adequacy of consultation would be difficult. The lack of a compensation provision is notable: if a tenement holder had an existing right that was extinguished, they might argue that the South Australian Parliament lacked power to extinguish without compensation, but state legislation ordinarily can extinguish rights. The Commonwealth Constitution’s just terms requirement only binds the Commonwealth, not the states directly, but the state could be bound if the right arises under Commonwealth legislation or if the acquisition is for a Commonwealth purpose. Likely the mining Acts are state legislation, so no constitutional compensation right arises. This may explain the absence of litigation. Overall, the litigation history is a blank canvas, and the Act appears to have operated with little judicial scrutiny.

The most significant gotcha is the absence of compensation for the extinguishment of existing mining rights. Section 10(1) prohibits the acquisition or exercise of rights from the date of commencement. Any tenement holder who had already invested in exploration or development cannot work those rights and receives no statutory compensation. That creates a permanent windfall loss for those holders and raises a potential property rights concern, but the Act is clear. The narrow definitions also hold traps. Mining operations expressly excludes rehabilitation of land, so a company could still enter the Area to clean up old workings, but only if the rehabilitation is not a cover for further extraction. However, “directly related to operations for the rehabilitation of land” is not defined, so there is uncertainty about what ancillary activities are allowed. The management plan is policy only (section 8(8)), so it cannot directly stop a person from entering the land or undertaking non-mining activities, but it binds government decision-makers. A pastoral lessee might assume they can continue traditional grazing without reference to the plan, but the amendment to the Pastoral Land Management Act makes the plan a lease condition, so breaching the plan could be a breach of the lease leading to forfeiture. The plan could restrict stock numbers or water use, imposing new costs. Consultation rights are weak. Interest holders must be consulted, but the Minister decides how. There is no right to a hearing, to receive a draft before finalisation, or to require responses to submissions. An interest holder who feels inadequately consulted has limited legal recourse because the Minister’s discretion is broad. The prohibition in section 10(1) applies to rights under a “mining Act”. That includes the three specified Acts. But what about activities authorised under other Acts that are analogous to mining? For example, geothermal energy extraction is covered by the Petroleum and Geothermal Energy Act, so it is caught. But what about excavation for a pipeline under the Pipelines Act? Not a mining Act, so arguably not prohibited. However, the regulation power under section 11(2)(a) can prohibit or restrict any specified activity, so the government could close that loophole via regulation. The management plan must be reviewed and published in the Gazette, but there is no requirement for periodic review or update. Once adopted, it stands indefinitely unless the Minister chooses to alter it. That could lead to the plan becoming outdated. The Minister has no duty to review it. The Act does not provide for transitional arrangements for mining tenements in existence at the commencement date. Rights “cannot be acquired or exercised” - that language extinguishes existing rights without a savings clause that is typical in such legislation. Tenement holders risk being in breach if they attempt to exercise any such right, even if they were granted before the Act. The boundary is fixed by reference to a plan as at 19 October 2011. If the deposited plan is inaccurate or ambiguous, there is no mechanism for correcting the boundary without amending the Act. The regulations have a broad scope and can prohibit any activity in the Area, potentially catching activities like scientific research, tourism, or Aboriginal cultural practices that are otherwise encouraged by the objects. The fine of $10,000 is low for a mining company but could still be a criminal conviction, affecting corporate reputation. The regulations can also delegate discretion to the Minister or any other person, potentially allowing for permit systems without the checks of primary legislation.

For mining and petroleum companies, compliance is straightforward: cease all mining operations and regulated activities within the Arkaroola Protection Area immediately. Do not apply for new tenements, extensions, or production approvals that cover the Area. If you hold an existing tenement that covers the Area, do not enter the land for exploration, extraction, or drilling. You may only undertake rehabilitation of land (filling excavations, revegetation, erecting signs) that is directly related to rehabilitation of the site. Before conducting rehabilitation, seek a legal opinion on whether the activity is within the exclusion. Monitor the definition of mining operations under the relevant mining Act, as amendments to those Acts could alter what is prohibited. Comply with any regulations made under this Act that may impose further restrictions or conditions on accessing the land. Adjacent tenement holders should ensure their operations do not extend into the Area; survey boundaries carefully and keep records showing all works are outside the line. Manage any communications with the Minister about the management plan, but be aware that consultation is at the Minister’s discretion; you cannot compel a hearing. Pastoral lessees in the Area must comply with the management plan as a condition of their lease. Obtain a copy of the management plan from the Gazette once published. If the plan imposes restrictions on grazing, water use, infrastructure, or fire management, you must comply. Failure could lead to enforcement action under the Pastoral Land Management and Conservation Act, potentially including forfeiture of the lease. Liase with the Minister if the plan is being developed to make submissions about the impact on pastoral operations. Developers and local councils must ensure that any development proposal within the Area is consistent with the management plan. The Development Plan must be reviewed and amended within six months of the plan’s publication; until then, any development approval given by the council must still be consistent with the management plan because the Development Act now requires consideration of the management plan and consultation with the Arkaroola Minister. Submit a development application early and seek pre-application advice from the relevant planning authority about consistency. Native title holders and Aboriginal organisations with a recognised interest should engage in the management plan consultation process promptly. While the Act does not require their consent, their views must be considered. If they wish to propose specific protections for cultural sites or practices, they should provide written submissions during the draft stage. They can also request to be recognised as interest holders if the Minister is of the opinion they have a particular interest (section 8(11)). The general public and tourists need only comply with any regulations that prohibit or restrict activities. As the Act gives power to prohibit activities beyond mining, check whether any regulations are in force before entering the Area for recreation, camping, or scientific research. Expect that fines up to $10,000 apply. The management plan may also contain guidance on permissible activities; it is not legally binding on individuals but may be used by regulators as a basis for prosecuting activities that are damaging to the objects. All persons should maintain records of any consultations, notices, or approvals received from the Minister or other authorities. Because the Act does not confer any private right of action, enforcement is public; but private compliance minimises risk. Any entity that has lost mining rights should seek independent legal advice on whether any claim for compensation or other remedy is available under general law or the Constitution, although the Act does not provide one. Compliance also means monitoring the legislative history to see if the uncommenced 2025 Biodiversity Act amendments are proclaimed, as they may affect related provisions.
