Archives (Records of the Parliament) Regulations 2019

The instrument builds a bespoke regime for parliamentary records by defining a small set of core concepts and delegating tailored powers and duties to parliamentary officers and the Director‑General of the Archives. These concepts determine the pathway of a record from creation to archival custody and public access.

Classifications. The inserted section 23A defines Class A, Class B and Class C records by reference to origin, function and control. Class A captures formal parliamentary outputs and committee materials that have not been authorised for publication, including the Journals of the Senate, Votes and Proceedings of the House and records laid before or tabled in either House (s 23A(1)(a)-(c)). It also includes committee-presented records not authorised for publication and certain departmental minutes or committee-related departmental records (s 23A(1)(d)-(e)). Class C captures records containing information protected by s 64V of the Parliamentary Service Act 1999 or records determined by the Presiding Officer under a procedure that requires Director‑General agreement (s 23A(1)(c)(i) and (ii); s 23A(2)). Class B is a residual category covering parliamentary records that are not Class A, not Class C and not excluded (s 23A(1) second definition).

Excluded records. The library collection for which the Parliamentary Librarian is responsible and the Parliament’s art collection are expressly excluded from these Divisions (s 7(4); Schedule 1, s 23A, excluded record). That keeps those holdings under separate arrangements.

Presiding Officer and Head of Department. The instrument centralises control in institutional parliamentary officers. "Presiding Officer" is defined contextually to be the President (Senate), the Speaker (House) or both for certain bodies (s 23A). "Head of the Department" is defined separately for each Parliamentary Department (Clerk of the Senate, Clerk of the House, Secretary of Department of Parliamentary Services, Parliamentary Librarian for Parliamentary Librarian-held records, Parliamentary Budget Officer for PBO records) (s 23A).

Transfer and custody. New ss 27-31A in Schedule 1 set out transfer mechanics. The Presiding Officer may agree in writing with the Director‑General to transfer Class A and Class C records to the care of the Archives (new s 27(1)-(2)). For Class B records that are part of the Commonwealth’s archival resources, the person responsible must transfer the record according to Archives-approved arrangements (new s 27(3)-(5)), with a statutory 15 year maximum retention before transfer (s 27(5)(b)).

Access and availability. The Archives’ access rights are qualified. For Class A and Class C records, Archives access requires written consent of the Presiding Officer or Head of the Department and compliance with conditions they set (new s 28(1)). For Class B records, Archives is entitled to access at a reasonable time subject to Part provisions, but s 29 provides numerous ways for Parliament or Presiding Officers to restrict access by resolution or determination (new s 29(1)-(1A)). All records transferred to the Archives must be made available to the originating parliamentary body for its use as reasonably required, but records older than 15 years must not leave the custody of those with custody except as necessary for parliamentary business (new s 30(1)-(2)).

Public access and exemption. The instrument makes Class A and Class C records "exempt records" (new item inserting s 30 before s 33(1) as s 30(1AA)). Class B records are the focus of the public access rules in Division 3 as modified. Class A and Class C records may be made publicly available only with permission of the Presiding Officer or by parliamentary practice that is not a disapproved administrative practice (new s 31A).

Parliamentary practice and disapproval. The instrument recognises "parliamentary practice" separately from normal administrative practice and gives the Archives power to notify Departments in writing of disapproved administrative practices; such disapproval prevents reliance on that practice to exclude Archives’ operation (s 23A parliamentary practice; s 24(2)(c) as modified; transitional s 40D).

Transitional measures. The instrument contains multiple transitional provisions preserving pre-existing permissions, approvals and agreements (s 40C), and applying new determinations to prior decisions (s 40E). It also repeals the prior Archives (Records of the Parliament) Regulations in full (Schedule 2).

Collectively, these concepts shift custodial and access decision-making toward parliamentary institutional officers while preserving an operational role for the Director‑General and the Archives under negotiated agreements and statutory triggers.

The instrument assigns responsibilities and decision powers to a set of identifiable actors and alters how those actors interact with the National Archives. The directly affected entities are the Senate, the House of Representatives, committees of either House, Parliamentary Departments and certain named officers.

Parliamentary bodies. The Senate and the House of Representatives are primary actors. Records "in the possession of the Senate, the House of Representatives or a Parliamentary Department" are subject to Divisions 2 and 3 of Part V as modified (s 7(2)-(3)). Committees of Parliament and joint committees are included through definitions of committee and parliamentary body (Schedule 1, s 23A).

Parliamentary Departments and officers. The instrument identifies specific departmental heads: the Clerk of the Senate, the Clerk of the House of Representatives, the Secretary of the Department of Parliamentary Services, the Parliamentary Librarian (for certain records), and the Parliamentary Budget Officer (s 23A, Head of the Department). These officers control custody, make written determinations, and can set conditions for access under the modified regime (new ss 27-29, 28).

The Presiding Officer. Many powers are concentrated in the Presiding Officer. The Presiding Officer can make written determinations about Class C records (s 23A(2), requiring Director‑General concurrence), grant or withhold permission for access or transfer, and make written agreements with the Director‑General to restrict access or transfer timelines (new ss 24(2)(b), 27(1), 29(1), 29(3)). The Presiding Officer is also the party whose written consent is required to permit destruction or other disposal of Class B records (new s 24(4)).

The Director‑General and the Archives. The Director‑General (of the National Archives) retains a statutory role: agreements with the Presiding Officer, concurrence on certain determinations (s 23A(2)(b)), approval of arrangements for transfer of Class B records, and entitlement to access records subject to the Act and these regulations (new ss 27-29, 28). The Archives must also make records transferred into its care available to the parliamentary body for use as reasonably required (new s 30(1)).

Members of Parliament and entrusted Parliamentary Service staff. The definitions and Class C mechanics affect records that contain information protected under s 64V of the Parliamentary Service Act 1999, which prohibits certain entrusted persons from disclosure. Those records may be classified Class C, affecting access and transfer rights (s 23A(1)(c)(i); see cross-reference to Parliamentary Service Act 1999 s 64V in Schedule 1).

The public and researchers. Public access is impacted: Class B records are the principal records subject to Division 3 public access rules, but Class A and Class C records are exempt and may be released only with permission or under parliamentary practice (new s 31A; new item inserting s 30(1AA)). The effect is to limit public access to many parliamentary records unless the relevant parliamentary authority permits release.

Entities previously governed by the earlier Regulations. The prior Archives (Records of the Parliament) Regulations are repealed in full (Schedule 2). Transitional provisions preserve existing permissions, approvals and agreements (s 40C), affecting parties to prior arrangements.

Indirectly affected parties include legal and compliance professionals, journalists and academics who rely on access to parliamentary records. Their ability to obtain records will now be mediated by the new classes, Presiding Officer permissions, written agreements with the Archives and the Archives’ own operational arrangements.

The Regulations impose duties, set timeframes and allocate rights primarily among parliamentary custodians, the Presiding Officer and the Director‑General of the Archives. The following are the principal operational obligations and statutory entitlements created or confirmed by the instrument.

Application of modified Divisions. The Regulations make Divisions 2 and 3 of Part V of the Archives Act apply to parliamentary records, subject to the modifications in Schedule 1 (s 7(2)-(3)). That is the enabling clause for all duties and rights that follow.

Classification and custody duties. Responsible custodians must classify and identify records as Class A, B or C as defined in s 23A. Class B records that have been determined to form part of the Commonwealth’s archival resources under section 3C must be transferred to the care of the Archives under arrangements approved by the Archives (new s 27(3)-(4)). Transfer timing is mandated: transfer must occur as soon as practicable after the record ceases to be required to be readily available for parliamentary purposes, and in any event within 15 years of the record coming into existence (new s 27(5)(a)-(b)). The person responsible for custody is duty-bound to cause the transfer (new s 27(4)).

Agreements and written consents. The Presiding Officer may make a written agreement with the Director‑General to allow Class A and Class C records to be transferred to the care of the Archives (new s 27(1)). The Director‑General must agree with determinations under s 23A(2) for Class C records (s 23A(2)(b)). The Archives’ access to Class A and Class C records requires written consent of the Presiding Officer or Head of Department and may be subject to conditions they set in writing (new s 28(1)(a)-(c)). The Presiding Officer’s written consent is required before the Archives may permit destruction or disposal of a Class B record (amendment to s 24(4)).

Records availability to Parliament. The Archives must ensure that Class A, Class B and Class C records transferred to its care are made available, as reasonably required, for use by or at the direction of the parliamentary body from which they came (new s 30(1)). That duty is subject to the constraints in agreements under s 29(3A) and the restriction that records older than 15 years must not be made available in a manner that involves their leaving the custody of their custodians except when necessary for parliamentary business (new s 30(2)).

Access entitlements and limitations. The Archives is entitled to access Class B records at a reasonable time (new s 28(2)). For Class A and Class C records, access is subject to consent and conditions (new s 28(1)). Section 29 creates statutory routes by which the Senate, the House, or the Presiding Officer can determine that certain records are not to be transferred, are not to be accessed, or are to be accessed only under specified conditions (new s 29(1)). Where the Archives seeks access to a Class B or Class C record not in its care and the custody-holder considers a Presiding Officer determination may be appropriate, the custody-holder must notify the Archives and the Presiding Officer, and Archives’ entitlement to access is suspended for up to one month (new s 29(1A)-(1B)).

Public access and exemptions. Class A and Class C records are designated exempt records (new item inserting s 30(1AA)). Class B records remain subject to Division 3 public access rules as modified. A Class A or Class C record, or part of one, may be made available for public access only with permission of the Senate by resolution where laid before the Senate, or otherwise with permission of the Presiding Officer, or in accordance with a parliamentary practice that has not been disapproved by the Archives (new s 31A).

Destruction and disposal constraints. The Archives is not authorised to permit destruction or other disposal of a Class B record without the written consent of the Presiding Officer (amended s 24(4)). Destruction procedures for Class B records must be followed in accordance with processes approved and followed by the Archives and the Presiding Officer (amended ss 25 and related provisions).

Transitional continuity. Existing permissions, approvals and agreements in force immediately before commencement are continued to the extent relevant to the new scheme (new ss 40C-40E). That creates obligations to honour prior arrangements until varied or revoked, and requires custodians and Archives to track prior permissions in their compliance efforts.

Procedural duties. Various procedural duties are imposed on custody-holders, including obligations to notify the Archives and the Presiding Officer (new s 29(1A)) and to comply with rules about custody and inspection in written agreements (new s 29(3A)(b)-(c)). The instrument also provides that Arrangements under s 64 for custody by a person other than the Archives must enable the Archives to meet its obligations under these subsections (notes to s 29 and s 30).

These duties and rights create a structure in which parliamentary institutions retain strong control over transfer, access, publication and disposal decisions while coordinating with the Director‑General and Archives via written agreements and statutory timeframes.

The Regulations themselves do not create freestanding criminal offences or penalty regimes within the text supplied. Instead, they modify application of Part V of the Archives Act 1983 and create mechanisms of control, consent, and agreement that govern transfer, access and disposal of parliamentary records. Enforcement and penalties therefore must be located in the underlying Act and in the administrative mechanisms established by these Regulations.

No new fines or criminal penalties are introduced in this instrument. Enforcement is effected through statutory rights and obligations, administrative consents, and contractual or quasi-contractual agreements. The key enforcement levers in the Regulations are the following.

Decision controls and refusals. The Presiding Officer and parliamentary bodies can make determinations by resolution or in writing that limit Archives’ access, prevent transfer, or specify access conditions (new s 29(1)). Those determinations are binding on the Archives, which "must comply with the determination" (new s 29(1)). Compliance here is a statutory duty; failure to comply would be an administrative non-compliance issue under the Archives Act framework.

Contractual and agreement enforcement. The Presiding Officer and the Director‑General may enter written agreements under new s 27(1) and new s 29(3). The Agreements must conform to s 29(3A) and provide for conditions, care, and inspection arrangements. Enforcement of agreements will be by their terms and under the general law of contract and the enforcement provisions of the Archives Act as applicable.

Custodial obligations and transfer mandates. For Class B records determined as part of the Commonwealth’s archival resources under s 3C, the person responsible for custody must cause transfer to the Archives under Archives-approved arrangements and within defined timeframes, including a maximum 15-year period (new s 27(3)-(5)). A failure to effect transfer could expose custodians to administrative consequences under the Archives Act or to internal parliamentary accountability mechanisms; the Regulations themselves place the duty on the person responsible.

Restrictions on destruction. The Archives is not authorised to permit destruction or other disposal of a Class B record without the written consent of the Presiding Officer (amended s 24(4)). That is a statutory prohibition on the Archives acting alone; enforcement is operationally through the Archives’ compliance with the Act.

Administrative notices and disapproval. The Archives can notify Parliamentary Departments in writing that it disapproves a normal administrative practice; that notification affects whether the practice can be relied on to displace Archives’ rights (amended s 24(2)(c); transitional s 40D). The mechanism is administrative; enforcement is by continued Archives restriction of recognition of the administrative practice.

Reliance on the Archives Act. The Regulations sit as subordinate instrument under the Archives Act 1983 (s 3). Any penalties, offences, or enforcement procedures in the Archives Act apply as modified by these Regulations. The instrument does not reproduce those penalty provisions, so practitioners must consult the Archives Act for criminal or civil sanctions applicable to contraventions of the Act itself.

Transitional protections. The instrument preserves existing permissions, approvals and agreements (new s 40C), and the continuation of those permissions does not prevent their revocation or variation. Enforcement or challenge to such revocations would follow normal administrative law channels.

In summary, enforcement is largely administrative and contractual. The Presiding Officer and parliamentary bodies hold rights to restrict access and transfer; the Archives has statutory duties to comply and to make records available to parliamentary bodies under agreed conditions. Any application of penalties or remedies for non-compliance must be sought under the underlying Archives Act or by ordinary administrative law processes; the Regulations themselves set out rights, duties and procedural conditions rather than express penalty clauses.

The Regulations operate by modifying the application of Divisions 2 and 3 of Part V of the Archives Act 1983 to parliamentary records and by cross-referencing other statutes that govern confidentiality and administrative procedures. The instrument expressly relies on, and refers to, provisions in other Commonwealth statutes.

Enabling statute: Archives Act 1983. The Regulations are made under the Archives Act 1983 (s 3), and they expressly provide that Divisions 2 and 3 of Part V of that Act apply to parliamentary records subject to the modifications in Schedule 1 (s 7(1)-(3)). Consequently, the Archives Act is the primary legal framework, and these Regulations must be read as an amendment in effect to Part V as applied to parliamentary records.

Parliamentary Service Act 1999. The definition of Class C record specifically imports s 64V of the Parliamentary Service Act 1999 by reference. A Class C record includes "a record containing information that section 64V of the Parliamentary Service Act 1999 prohibits an entrusted person from disclosing" (Schedule 1, s 23A(1)(c)(i)). This cross-reference ties record classification, and thus access and transfer rights, to the confidentiality obligations imposed by the Parliamentary Service Act.

Legislation Act 2003. The instrument references the Legislation Act 2003 on the mechanics of legislative instruments and determinations. Schedule 1 notes that determinations may be made individually or by reference to a class, citing subsection 13(3) of the Legislation Act 2003 (s 23A(2) note). That governs how Presiding Officer determinations about classes of records may be drafted and published.

Other provisions of the Archives Act. The Regulations make multiple references to procedural requirements already in the Archives Act. For example, references to section 3C (archives resources determination) affect when Class B records must be transferred (new s 27(3)). The notes to s 29 and s 30 reference arrangements under section 64 for custody by persons other than the Archives, indicating the statutory obligation of those custody arrangements to enable the Archives to meet its obligations under the amended Division 2 and Division 3 provisions (s 29(3A) note; s 30 note).

Parliamentary rules, standing orders and practice. The instrument distinguishes parliamentary practice from normal administrative practice. "Parliamentary practice" is defined to include standing orders, sessional orders, resolutions, rulings of the President or Speaker and practices approved by the President or Speaker (s 23A parliamentary practice). Several provisions defer to such practices (e.g. new ss 24(2)(c), 26(1B)(d), 31A(b)), producing an interaction between statutory rules and internally adopted parliamentary practices. The Archives retains a role in notifying disapproved normal administrative practices of Parliamentary Departments; disapproval affects whether an administrative practice can be used to displace statutory rights (s 24(2)(c); transitional s 40D).

Transitional and repeals. The instrument repeals the prior Archives (Records of the Parliament) Regulations in full (Schedule 2). Transitional provisions preserve permissions, approvals and agreements made under the old instrument for continued effect under the new scheme where applicable (new s 40C). Those cross-instrument interactions may require custodians to map and reconcile former permissions against the new classes and conditions.

Administrative law and procedural fairness. Because the Regulations vest discretionary powers (for example, Presiding Officer determinations) and create obligations on a public authority (the Archives), standard administrative law principles and remedies remain relevant. The instrument itself contains no internal review or appeal mechanisms; judicial review and other remedies under administrative law would apply to decisions made under the amended framework, as they would when decisions are made under the parent Archives Act.

In sum, the Regulations reframe the application of the Archives Act to parliamentary records and interlock with the Parliamentary Service Act 1999, the Legislation Act 2003, standing orders and parliamentary practice. Practitioners should read the Regulations alongside the underlying statutory provisions they amend or reference in order to understand applicable obligations, confidentiality duties and the routes by which records become subject to transfer, access restrictions or public availability.

The instrument contains its own commencement and repeal mechanics and explicitly replaces the prior regulatory instrument for parliamentary records. The document sets out limited amendment history within its text and transitional arrangements.

Commencement. The Regulations commence the day after registration (s 2(1)). The instrument records that the whole instrument is taken to have commenced on 13 March 2019, the day after registration, per the table in s 2. The instrument notes that the commencement table relates only to the original instrument as made and will not be amended to deal with later amendments (s 2 note).

Source authority and making. The Regulations are made under the Archives Act 1983 (s 3), and were made by the Governor‑General on 7 March 2019 with the Attorney‑General’s command as shown on the face of the instrument.

Repeal of prior Regulations. Schedule 2 repeals the whole of the previous Archives (Records of the Parliament) Regulations (Schedule 2, item 1: "The whole of the instrument,Repeal the instrument"). That is an express substitution of the prior regulatory framework with this instrument.

Modifications of the Archives Act. Schedule 1 contains multiple amendments and substitutes of provisions of Part V of the Archives Act 1983 as they apply to parliamentary records. Those modifications include substitution of headings, insertion of new definitions (new s 23A), replacement of numerous sections in Divisions 2 and 3 (for example, repealing and substituting ss 27-31A), and insertion of transitional provisions at the end of Division 3 (new ss 40C-40E). The instrument therefore operates as a comprehensive update to how Divisions 2 and 3 apply to parliamentary records.

Transitional provisions and continuity. Schedule 1 contains a suite of transitional provisions designed to carry forward permissions, approvals and agreements made under the old regulations or "old" provisions. Section 40C ensures that permissions in force under the old regime continue in force under the corresponding new subparagraphs. Section 40E provides transitional application of determinations regarding transfer and access and addresses determinations made prior to commencement. Section 40D applies the notification rule about disapproved administrative practices whether the notification occurred before, on or after commencement.

No later amendments are recorded within the text provided. The instrument itself contains an internal note that the commencement table will not be amended to reflect later amendments, suggesting any future amendments will be recorded separately.

Practical consequence for records management. Because the Regulations replace the prior instrument and preserve earlier permissions and agreements subject to variation or revocation (s 40C(6)), entities holding parliamentary records must map existing disposals, permissions and agreements against the new classes and operational requirements. Agreements made under the old regime continue in force as if made under the new subsections to the extent specified (s 40C(4)-(5)), but remain subject to revocation or variation.

For a practitioner advising on compliance or historical obligations, the key amendment events to record are the repeal of the prior Regulations (Schedule 2), the commencement date (s 2), and the insertion of the new class-based regime and transitional provisions in Schedule 1.

This instrument does not itself report or reference any litigation. The text of the Archives (Records of the Parliament) Regulations 2019 contains no citations to judicial decisions, nor does it include a schedule or notation of litigation history. The instrument makes statutory and administrative changes and preserves prior permissions and agreements under transitional provisions, but it does not include or summarise any court rulings or tribunal decisions.

Given the absence of cases or litigation references in the instrument itself, there are two points of note for practitioners:

• Administrative decisions under the modified regime, such as Presiding Officer determinations, written agreements with the Director‑General, or the Archives’ compliance with those determinations, will be susceptible to judicial review and other remedies under general administrative law where there are arguable error of law, procedural fairness defects or jurisdictional error. The instrument does not add internal review mechanisms; judicial review remains the external control mechanism.

• The instrument cross-references the Archives Act 1983 and the Parliamentary Service Act 1999. Any historic litigation applying those statutes to parliamentary records will need to be located in case law databases and considered alongside the modified provisions. Because the Regulations change the substantive and procedural landscape for access and transfer, pre-existing litigation concerning the prior regulatory regime may be relevant as context but will not be cited or updated in this instrument.

In short, there is no litigation history recorded in this instrument. Practitioners seeking case law should consult court and tribunal records for decisions under the Archives Act, the Parliamentary Service Act, or judicial review of parliamentary administrative decisions. The instrument’s transitional provisions preserve prior permissions and agreements but do not provide a litigation history.

The Regulations introduce a number of operational traps and friction points that are likely to matter in practice. The following matters are concrete, source-grounded risks and awkward edges to watch.

Class distinctions matter. The entire operational regime turns on whether a record is Class A, B or C (Schedule 1, s 23A). Misclassification changes transfer duties, access entitlements, and public release rules. For example, Class B records are subject to a mandatory transfer timeline in certain circumstances (new s 27(3)-(5)), whereas Class A and Class C records are treated as exempt and may be retained under parliamentary control unless an agreement is made (new s 27(1)-(2); new s 30(1AA)). Poorly documented classification decisions will create disputes about whether the Archives or a parliamentary body is responsible for transfer or access.

Presiding Officer controls. Many significant actions require the Presiding Officer’s written consent or determination. The Presiding Officer can prevent transfer, limit Archives access, and must give written consent for destruction of Class B records (amended s 24(4); new s 29(1)). That concentrates practical gatekeeping in a single institutional actor, whose decisions can be made by resolution or in writing. Practitioners should note that a Presiding Officer determination may require Director‑General concurrence for certain Class C determinations (s 23A(2)(b)), adding a two-party check.

15-year transfer clock. For Class B records that are archival under s 3C, the custody-holder must effect transfer within 15 years of creation in any event (new s 27(5)(b)). That creates discrete scheduling obligations. It is easy to miss the date of "coming into existence" for records created incrementally or across systems, so retention schedules must be precise. Also, a record need not be transferred if the Presiding Officer determines that it is not to be transferred, with Director‑General concurrence (note to s 27 and s 29(1)).

Access suspension window. Where the Archives seeks access to a Class B or Class C record not in its care and a custody-holder considers it may be appropriate for the Presiding Officer to determine whether access should be allowed, the custody-holder must notify the Archives and the Presiding Officer (new s 29(1A)). The Archives’ entitlement to access is suspended until the earlier of one month from notification or withdrawal. That creates a one-month operational window in which access can be delayed by a custody-holder simply by notifying the Archives. Procedures must be established to manage such notifications, or access requests will be delayed by operation rather than on substantive grounds.

Exemptions for parliamentary outputs. Class A records include records laid before a House, Journals, Votes and Proceedings and committee records that have not been authorised for publication (s 23A(1)(a)-(d)). Those are exempt records and require parliamentary permission for public release (new s 31A). For researchers and journalists accustomed to Freedom of Information-style access, this can be a surprise: a large subset of parliamentary records is outside ordinary public access unless the Presiding Officer or a House resolution permits release.

Archives access conditioned by consent. For Class A and Class C records, Archives access requires written consent of a Presiding Officer or Head of Department and must occur at reasonable times and under conditions they set (new s 28(1)(a)-(c)). This can impede routine Archives work such as appraisal and digitisation if consents are delayed or withheld. The Presiding Officer can make determinations limiting Archives’ rights; the Archives must comply (new s 29(1)). Practically, Archives operational planning needs to build in Parliamentary consents and scheduling.

Disposal constraints and consent. The Archives cannot permit destruction or other disposal of a Class B record without the Presiding Officer’s written consent (amended s 24(4)). This effectively vests final control over destruction with the Presiding Officer, not the Archives. For custodians relying on disposal authorisations or routine retention schedules approved previously by the Archives, this creates an extra administrative step.

Parliamentary practice vs administrative practice. The instrument distinguishes "parliamentary practice" from "normal administrative practice" and allows certain actions to be valid if they conform to parliamentary practice, except where the Archives has notified disapproval of a normal administrative practice (s 23A; amended s 24(2)(c); s 40D transitional). The interplay creates ambiguity: administrative units may believe a practice qualifies, but if Archives has disapproved it in writing, reliance on that practice will be ineffective. Officers must maintain records of disapproval notices and practice classifications.

Transitional complexity. The instrument carries forward many pre-existing permissions, approvals and agreements (new s 40C(1)-(5)) but allows them to be varied or revoked. That requires custodians to reconcile old permissions with the new class-based permissions. An unexamined legacy permission might not align with the new categories and could be inadvertently relied upon.

Custody vs availability rules. The Archives must ensure records transferred into its care are available to the parliamentary body as reasonably required (new s 30(1)), but records older than 15 years must not leave custody except where necessary for parliamentary business (new s 30(2)). This creates a tension between availability and physical custody: making records available by allowing them to leave Archives custody is restricted for older records. Practical arrangements for in-situ digitisation, supervised inspection, and reproduction need to take this restriction into account.

Delegation and concurrence points. Some decisions require concurrence with the Director‑General (s 23A(2)(b)), while others are unilateral powers of the Presiding Officer or require Senate/House resolution (new s 29(1)). Practitioners must care about who makes the decision, whether a concurrence is required, whether the decision must be in writing, and how it is recorded.

In short, classification, Presiding Officer permissions, timeframes, and procedural notices are the functional difficulties that will produce operational errors and disputes if not carefully managed with documented processes.

Compliance under the revised framework requires mapping existing record collections to the new classes, documenting decision rights, establishing procedures for notifications and consents, and harmonising archival workflows with parliamentary practices and the Archives’ operational needs. The instrument sets concrete steps; the following is a practical checklist directly grounded in the Regulations.

1. Inventory and classify records to the new classes (Schedule 1, s 23A)

   • Create a register that maps records to Class A, Class B, Class C or excluded record (library collection or art collection).
   • For Class C, check whether any record contains information that s 64V of the Parliamentary Service Act 1999 prohibits an entrusted person from disclosing; where relevant, flag that record as potentially Class C (s 23A(1)(c)(i)).
   • Document the classification rationale and the date of "coming into existence" to support the 15-year transfer rule for Class B records (new s 27(5)(b)).

2. Assign custodians and ensure role clarity (Schedule 1, s 23A definitions)

   • Identify the appropriate "Head of the Department" for each set of records: Clerk of the Senate, Clerk of the House, Secretary of Department of Parliamentary Services, Parliamentary Librarian or Parliamentary Budget Officer as applicable.
   • Record who has custody for committee-held records and who is authorised to notify the Presiding Officer under new s 29(1A).

3. Review existing permissions, approvals and agreements (Transition, new s 40C)

   • Compile all pre-existing permissions, approvals and written agreements under the old Regulations.
   • Confirm which of those continue in force under new s 40C, and prepare to vary or revoke them if operationally necessary in consultation with the Director‑General.

4. Establish transfer procedures and timelines

   • For Class A and Class C records, consider whether to enter a written agreement with the Director‑General to allow transfer to the care of the Archives (new s 27(1)-(2)).
   • For Class B records determined part of archival resources under s 3C, implement Archives-approved arrangements for transfer and ensure systems will cause transfer as soon as practicable after the record is no longer required and in any event within 15 years of creation (new s 27(3)-(5)).
   • Maintain a schedule of transfer dates to ensure statutory timeframes are met.

5. Prepare written agreement templates and clauses (new s 29(3)-(3A))

   • Draft template written agreements between the Presiding Officer and the Director‑General that satisfy s 29(3A) requirements: enabling Archives to meet obligations under ss 30(1) and 31(1), specifying conditions of holding, and providing for care and regular inspection if needed.
   • Include clauses addressing custody, conditions for access by the parliamentary body, and procedures for inspection and digitisation requests.

6. Consents and notices protocol

   • Build workflow for obtaining Presiding Officer written consent where required, for example, before destruction or disposal of Class B records (amended s 24(4)).
   • Set up notification procedures when Archives seeks access and the custody-holder believes a Presiding Officer determination may be appropriate; ensure timely notification to Archives and Presiding Officer as required by s 29(1A). Track the one-month suspension period in which Archives’ entitlement is paused (s 29(1B)).

7. Access arrangements and conditions (new s 28)

   • For Class A and Class C records, prepare standard condition templates to be applied when granting Archives access: time windows, security requirements, supervision and use constraints.
   • For Class B records, set procedures to process Archives’ access requests at reasonable times, consistent with new s 28(2) and s 29.

8. Publication and public access governance

   • Create an approvals process for public release of Class A and Class C records that requires either the Presiding Officer’s permission or an applicable parliamentary practice that is not disapproved by Archives (new s 31A).
   • Maintain a register of disapproved normal administrative practices notified by Archives that would render a practice invalid for releasing records (amended s 24(2)(c); transitional s 40D).

9. Physical custody and movement controls

   • For records older than 15 years, ensure procedures prevent their leaving custody except where necessary for parliamentary business (new s 30(2)). Document "necessary for the proper conduct of business" criteria to justify any movement.
   • For digitisation or external inspections, plan alternatives that allow use without lifting custody, such as onsite supervised access, digital copies retained by Archives, or secure transfers authorised under a written agreement.

10. Audit trail and recordkeeping

• Keep written records of all determinations, consents and agreements (e.g. Presiding Officer determinations under s 29(1), Director‑General concurrence under s 23A(2)(b)).
• Log transfers, access events, and any destruction permissions with timestamps, signatories and associated resolutions.

11. Coordination with the Archives

• Engage proactively with the Director‑General to negotiate agreements under new s 27(1) and s 29(3), and to obtain guidance on Archives-approved arrangements for Class B transfers.
• Ensure custody arrangements under section 64 for third-party custody permit the Archives to meet obligations under new s 29(3A) and s 30(1) (notes to s 29 and s 30).

12. Training and governance

• Provide training for staff on classification criteria, the Presiding Officer notification process, and disposal consent requirements.
• Establish an escalation path for contested classifications or requests for internal review, recognising that judicial review remains available under administrative law where necessary.

13. Legal review and confidentiality checks

• For records touching on duties under the Parliamentary Service Act 1999 s 64V (confidentiality of entrusted persons), consult legal counsel before any disclosure, transfer or publication to assess whether the record properly qualifies as Class C and whether Director‑General concurrence is required for determinations (s 23A(1)(c)(i); s 23A(2)).

14. Reconciliation of legacy arrangements

• Map legacy permissions and approvals continued under s 40C against the new classes, and identify any conflicts. Where conflicts exist, engage early with the Presiding Officer and Director‑General to vary or revoke legacy permissions in a controlled manner consistent with the instrument’s transitional provisions.

Following this checklist will address most statutory obligations established by the Regulations. The underlying Archives Act and other referenced statutes must also be consulted where the Regulations modify specific sections; practitioners should cross-reference the Act for penalties, administrative review mechanisms and other operative provisions not reproduced in this instrument.
