Architects Regulations 2005

The regulations lock several recurring concepts into precise administrative form.

Board composition and nomination: reg 4 prescribes the organisations that may nominate candidates for ministerial appointment under s 7(1)(b) of the Act: the Royal Australian Institute of Architects, the Association of Consulting Architects , Australia, the University of Western Australia and Curtin University of Technology. Elections of registered member directors are governed by a postal nomination and voting process set out in regs 5-11. The Board circulates nomination papers and notices to all registered persons at their registered address, sets a return day and publishes elected members’ names on a Board website (regs 5, 7, 10).

Registration: reg 12 gives the concrete criteria that the Board will require of a natural person for registration under s 29(b) of the Act. Those include an accredited architectural qualification or an equivalent qualification or equivalent attained standard (with the Architects Accreditation Council of Australia able to advise), passing the prescribed national written examination and interview examination (reg 13), and being a “fit and proper person” without disqualifying convictions (reg 12(c)-(d)). The regulations delegate timetabling, fee obligations for sitting examinations and misconduct handling during examinations to the Board (reg 14).

Corporate licensing: reg 15A prescribes that certain Aboriginal corporations and transitional corporations are treated as bodies corporate for the Act’s definition. Reg 15 articulates corporate licensing requirements under s 31(b), which forefront Board approval of the corporation’s constitution or internal rules, acceptability of each director, and that all architectural work must be done under direct control and supervision of a registered person who is an officer or employee. It also requires the person with ultimate responsibility for architectural work to be a registered officer or employee and allows the Board to assess the means by which the corporation will comply.

Register divisions and renewal mechanics: reg 16 divides the register into practising and non‑practising divisions. Reg 16A fixes the nominal expiry date for registrations and licences to 30 June in the year following grant, where the registration/licence occurs after 2007. Reg 16B and 16C set transitional renewal periods and the mechanics and discretion for postponing renewal due dates where hardship is shown; reg 16C specifically fixes renewal fees’ due dates (for years after 2008, 30 September, subject to Board discretion).

Insurance and reporting: reg 17 prescribes a minimum professional indemnity insurance cover of $1,000,000 and cross‑references that figure to s 32(2)(c) where the Act requires corporations to hold architect insurance. Regs 18-19 require documentary proof of insurance (a document from insurer or broker detailing period, amount and categories of persons covered) and set reporting deadlines for individuals (30 September each year and 14 days after change) and corporations (initial grant 28 days, renewal 14 days, and 14 days after any change).

Disciplinary definitions: reg 20 lists conduct that, for s 56(2) of the Act, constitutes unprofessional conduct as an architect. The list includes false or misleading representations about registration division, misuse of another registrant’s or licensed corporation’s name, permitting unregistered persons or corporations that are not licensed to practise in one’s name, signing or claiming work not directly supervised, fee‑sharing or commission practices beyond remuneration from the client, failing to disclose direct or indirect pecuniary interests in products or services (except public company interests) and using such products without the client’s written acknowledgment and consent.

Fees and administrative requirements: Schedule 1 contains itemised fees for registration applications, licence applications, registration and licence fees, renewals, exam fees (notably items 12-13 for the National Examination Paper and Examination by Interview), restoration fees and charges for certified copies and amendments. The Board has express discretion under reg 22 to reduce, waive or refund fees for certified copies and amendments in limited circumstances.

Throughout the text, the repeated phrase “acceptable to the Board” (for corporate constitutions, directors, means of complying, names, etc.) establishes the Board’s evaluative discretion as a central operating principle of the regulatory scheme (regs 15, 25 and elsewhere).

The regulations affect several discrete groups, with different obligations and levers:

• Natural persons seeking registration as an architect. They must hold accredited or Board‑equivalent qualifications or demonstrate equivalent competency (reg 12), pass the National Examination Paper and Examination by Interview (regs 13-14), pay exam fees (reg 14(2) and Schedule 1 items 12-13), supply insurance particulars if applicable (reg 18), and observe renewal mechanics (regs 16A-16C, Schedule 1 items 3 and 5). Registered persons are electors in Board elections and potential candidates (Part 2, regs 5-11).

• Licensed corporations that practise architecture. They must have constitutions and internal management rules acceptable to the Board, have directors acceptable to the Board, ensure all architectural work is done under the direct control and supervision of a registered officer or employee, and ensure a registered officer has ultimate responsibility for the work (reg 15). Licensed corporations must provide documentary proof of insurance within 28 days of initial grant or 14 days of renewal or change (reg 19).

• Employers and officers of corporate practices. The requirement that architectural work be done under direct control and supervision of a registered officer or employee forces corporate practices to structure labour and supervisory arrangements so that registered persons are employed or hold officer roles (reg 15(c)-(e)). The Board must approve the means by which the corporation complies (reg 15(d)).

• The Architects Board and the registrar. The Board is given procedural duties , calling nominations (reg 5), preparing candidate lists and sending voting papers (regs 6-7), counting and checking votes (reg 8), and publishing elected members (reg 10). The registrar conducts counts and receives statutory notices such as changes in practising status (reg 24).

• Specific nominating bodies. The regulations directly prescribe four bodies entitled to nominate persons for ministerial appointment under the Act: RAIA, Association of Consulting Architects , Australia, University of Western Australia, and Curtin University of Technology (reg 4). Those bodies thus have concentrated influence on ministerial appointments.

• Clients and the public. The rules on professional conduct, disclosure of interests (reg 20(g)-(h)), and notification of insurance coverage (regs 18-19) are designed to shape information flows to clients and public scrutiny (for example the need for client written acknowledgment and consent in certain cases, reg 20(h)).

• Practitioners’ advisers and insurers. The documentary requirements for insurance mean insurers and brokers must provide documentation capable of showing period, amount and categories covered to the Board (regs 18-19). Examination‑preparation providers and accreditation bodies (the Architects Accreditation Council of Australia) are implicated in the qualification and exam regimes (regs 12-13).

• Persons dealing with the register. Those who request certified copies or amendments pay fees under Schedule 1 (items 8-9), and the Board has discretion to reduce, waive or refund such fees in specified circumstances (reg 22).

Penalties under the regulations directly affect registered persons who vote more than once in Board elections (penalty $2,000, reg 11(1)) and registered persons/licensed corporations who fail to keep certificates available for inspection ($1,000, reg 23). Disciplinary consequences for unprofessional conduct are governed by the Act but the regulations identify particular behaviours that trigger disciplinary proceedings under s 56(2) (reg 20).

This section summarises enforceable duties and entitlements created or specified by the regulations.

Duties on applicants for individual registration

• Hold an accredited architectural qualification or provide evidence of equivalence or attainment of an acceptable standard after the Board considers Advice from the Architects Accreditation Council of Australia where relevant (reg 12(a)(i)-(iii)).
• Be assessed eligible to sit, and pass, the National Examination Paper and the Examination by Interview as set by the Architects Accreditation Council of Australia (regs 12(b), 13).
• Pay prescribed examination fees for eligibility assessment and sitting the examinations (reg 14(2); Schedule 1 items 12-13).
• Not have disqualifying convictions and be a “fit and proper person” (reg 12(c)-(d).

Duties on corporations seeking a licence

• Have a constitution or internal rules acceptable to the Board, and have directors acceptable to the Board (reg 15(a)-(b)).
• Ensure all architectural work is performed under the direct control and supervision of a registered person who is an officer or employee of the corporation (reg 15(c)).
• Provide evidence of the means by which the corporation will comply with the supervision requirement (reg 15(d)).
• Ensure that the person with ultimate responsibility for architectural work is a registered officer or employee (reg 15(e)).
• Obtain Board approval for the proposed trading or practice name if required (reg 15(f) and reg 25).

Duties on registered persons and licensed corporations

• Maintain and make available at their registered address a certificate of registration or licence document for inspection by any person during business hours (reg 23(1)-(2); penalty $1,000).
• For registered persons, advise the registrar in writing within 30 days of starting or stopping practice when moving between division 1 and division 2 of the register (reg 24(1)-(3)).
• Maintain at least $1,000,000 professional indemnity insurance and provide a document from the insurer or broker showing period, amount and categories covered (reg 17; reg 18(1), reg 19(1)).
• Provide insurance information to the Board annually by 30 September and within 14 days of any change for individuals, and within set timeframes for corporations on grant, renewal, or change (reg 18(2), reg 19(2)).

Board and electoral duties

• Send nomination papers and notices to registered persons’ recorded registered addresses (reg 5(2)-(3)); ensure candidate lists exclude improperly nominated persons (reg 6); send voting papers at least 14 days before the return day when a vote is required (reg 7); open and count votes and check results (reg 8); publish names of elected members on a Board website (reg 10).

Rights and discretions

• Candidates and electors have a right to receive nomination forms, candidate statements and voting papers, and to be represented on the Board through election or prescribed nominations (regs 5-11).
• The Board has a broad evaluative discretion: approvals and acceptabilities are repeatedly required to be “acceptable to the Board” for corporate constitutions, directors, names, and the corporate means of complying with supervision requirements (reg 15, reg 25).
• The Board may, in limited circumstances, reduce, waive or refund fees for certified copies and register amendments when it considers it appropriate (reg 22).
• Registered persons and licensed corporations may apply to the Board for consent to use a name other than the name recorded in the register, and the Board may impose conditions such as display of name and registration number and availability of the responsible person’s certificate (reg 25).

Disciplinary triggers expressly defined

• Regulation 20 enumerates a non‑exhaustive set of behaviours constituting unprofessional conduct for the purposes of the Act’s s 56(2). These include false statements about registration status, misuse of names, allowing unregistered persons or unlicensed corporations to practise in one’s name, misrepresenting supervision, improper financial arrangements, and failing to disclose or seek consent for pecuniary interests in products or services used in projects (reg 20(a)-(h)).

Fees and payment obligations

• Schedule 1 prescribes exact dollar amounts for a range of transactions including application fees (items 1-2), registration and licence fees (items 3-4), renewals (items 5-6), restoration and certified copy fees (items 7-11), and examination fees (items 12-13). These amounts are binding until amended.

Collectively, these duties and rights create an administrative architecture that controls entry, corporate practice structure, information flows to the Board and clients, and electoral participation in Board governance.

The regulations set several discrete penalty provisions and establish reporting and procedural duties that feed into the Act’s enforcement machinery.

Statutory fines contained in the regulations

• Voting more than once in a Board election is an offence punishable by a fine of $2,000 (reg 11(1)). The regulation clarifies that a casting vote under reg 8(3) and Board member selections under reg 9(c) are not included within the term “vote” for this offence (reg 11(2)).
• Failure to make a certificate of registration or licence document available for inspection during business hours at the registered address is an offence subject to a fine of $1,000 (reg 23(1)-(2)).

Disciplinary enforcement linkage

• Regulation 20 specifies conduct that constitutes unprofessional conduct “for the purposes of section 56(2)” of the Act. This means the listed behaviours are designated as grounds for the Act’s disciplinary processes. The regulations do not themselves set out the Act’s sanctioning options, but they operate as determinative inputs to the Board’s or tribunal’s discretion under the Act to investigate and discipline. As such, many enforcement consequences are administered under the Act rather than within these regulations.

Administrative enforcement mechanisms

• The Board is required to publish elected members’ names on its website (reg 10). Publication is an operational enforcement of transparency and may have reputational effects rather than directly sanctioning individuals.
• The Board has the power to require insurance particulars and to set timeframes for when insurance information must be provided (regs 18-19). Failure to supply required documentation will engage the Act’s compliance and disciplinary powers.

Fee supervision and discretionary relief

• The regulations create obligations to pay fees (Schedule 1) and allow the Board to reduce, waive or refund specific fees in prescribed circumstances (reg 22). The Board’s discretion over fees can be applied administratively, potentially avoiding enforcement action where relief is granted.

Procedural compliance that supports enforcement

• The nomination and voting process includes procedural safeguards such as signature requirements on nomination forms (reg 6(2)(a)), cut‑off times for receipt of nominations and votes (reg 5(2)(b)(iii), reg 7(3)(e)), and verification and counting protocols involving the registrar and at least one other person (reg 8). These mechanisms reduce the administrative risk of contested elections which might otherwise produce enforcement or dispute costs.

What the regulations do not specify

• The regulations do not themselves list the full range of sanctions or appeal rights available following disciplinary findings; those are set out in the Architects Act 2004. The regulations also do not specify inspection powers, infringement notice regimes, or criminal penalties beyond the two monetary penalties noted above. Enforcement therefore depends on coordination between the Act’s powers and the procedural detail the regulations provide.

Implementation risk

• Several obligations are framed as being “acceptable to the Board” (for example reg 15(a), (b), (d), (f); reg 25). That wording creates administrative discretion for approval and rejection. From an enforcement perspective, this means compliance will often turn on the Board’s assessment and the quality of documentary submissions rather than on an objective external standard specified in the regulations.

In short, the regulations combine prescriptive monetary penalties for a narrow set of conduct with documentary, reporting and procedural requirements that primarily feed into the Act’s broader disciplinary framework. The Board’s discretionary approvals and the reporting obligations are the main levers for regulatory compliance, while the regulations themselves prescribe only limited direct fines.

The regulations operate as subordinate legislation to the Architects Act 2004. They repeatedly reference and implement Act provisions, supplying the practical rules required by statutory sections:

• Implementing Act provisions. Many regulations point back to specific sections of the Act: reg 4 prescribes bodies for s 7(1)(b) appointments; regs 5-11 give effect to the Board election provisions in s 7(1)(c) and related sections; reg 12 responds to registration requirements in s 29(b); reg 15 implements corporate licensing requirements under s 31(b); regs 17-19 interface with s 32 and s 54 regarding architect insurance; reg 20 supplements s 56(2) by listing examples of unprofessional conduct; regs 21-22 and Schedule 1 implement fee and cost provisions referenced in s 71(2)(j), s 33 and related sections.

• National bodies and instruments. Regulation 12 and 13 explicitly reference the Architects Accreditation Council of Australia as a source of advice on equivalence of qualifications and as the setter of the National Examination Paper and the Guide for Candidates for the Examination by Interview. The regulations therefore bind applicants to nationally framed examination content and accreditation advice even though the Board administers the process.

• Commonwealth corporations legislation. Reg 15A expressly incorporates into the Act’s definition of “corporation” for licensing purposes specified entities under Commonwealth law: Aboriginal and Torres Strait Islander corporations under the Corporations (Aboriginal and Torres Strait Islander) Act 2006 s 700‑1, and transitional corporations under the Corporations (Aboriginal and Torres Strait Islander) Consequential, Transitional and Other Measures Act 2006 Schedule 3 item 1(1). This is an integration point between state professional regulation and Commonwealth corporation forms.

• Mutual recognition and other regulatory amendments. The compilation table records amendment instruments including a 2022 Commerce Regulations Amendment (Mutual Recognition) Regulations amendment (SL 2022/121) that amended regulations (for example reg 5 amended SL 2022/121 r.4; reg 17 amended SL 2022/121 r.6; reg 18 amended r.7; reg 19 amended r.8). These references indicate that the regulations have been adjusted to fit inter‑jurisdictional recognition mechanisms and updated administrative detail; those changes interact with mutual recognition obligations under broader commonwealth/state schemes.

• Administrative law and statutory discretion. The Board’s repeated requirement that constitutions, directors, names and means of supervision be “acceptable to the Board” opens the exercise of administrative discretion to review under state administrative law principles where a person is aggrieved. The regulations do not specify appeal routes for every Board decision, so review rights would be determined by the Act, general administrative law and any specified appeal mechanisms.

• Evidence and contractual interactions. The requirement that registered persons and corporations hold and disclose insurance (reg 17-19) intersects with contractual allocation of risk in construction and design contracts. The regulations do not change contract law, but they impose documentary proof and timing obligations that practising architects must manage in contract performance and tendering.

• Data and privacy interfaces. The requirement to publish elected members’ names on the Board website (reg 10) and to hold and supply insurance particulars to the Board (regs 18-19) interacts with privacy law obligations. The regulations do not themselves set privacy rules; that remains a separate compliance obligation for the Board and for registrants when handling personal data.

Overall, the regulations are expressly designed to work with, and to give effect to, the Architects Act 2004 while incorporating national examination standards and selected Commonwealth statutory definitions. They do not override other state or Commonwealth laws but impose professional requirements that will constrain how practitioners structure corporate entities, insurance arrangements, advertising and supervision.

The regulations include a compilation table that records the instruments and dates of amendment. Key chronological points and notable inserted provisions in the compilation notes are:

• Original instrument: Architects Regulations 2005, published 15 November 2005, commenced 16 November 2005 (r 2 and Gazette reference).

• Architects Amendment Regulations 2007, published 28 December 2007, with most substantive provisions commencing 1 January 2008. These amendments inserted regs 16A, 16B and 16C which set registration/licence durations and transitional renewal arrangements (see regs 16A-16C and the footnotes referencing Gazette 28 Dec 2007 p. 6411-14).

• Architects Amendment Regulations 2009, published 30 June 2009, took effect 1 July 2009 on most matters. This instrument inserted reg 15A, which extends the meaning of “corporation” to include Aboriginal and transitional corporations under specified Commonwealth Acts (reg 15A and footnote: Gazette 30 Jun 2009 p. 2621‑2).

• Architects Amendment Regulations 2013, referenced in the compilation table with commencement 1 July 2013 for substantive provisions.

• Commerce Regulations Amendment (Fees and Charges) Regulations 2017 Part 2, indicating fee adjustments and related changes effective 1 July 2017.

• Architects Amendment Regulations 2021 (SL 2021/7), which amended at least reg 10 (publication of names on website) and added reg 22 (discretion to reduce/waive/refund fees under s 44(2) or 45) as cited (see reg 10 amendment note and reg 22 insertion: SL 2021/7 r.5). Most substantive provisions commenced 30 January 2021.

• Commerce Regulations Amendment (Fees and Charges) Regulations 2021 Pt 2 effective 1 July 2021.

• Commerce Regulations Amendment (Fees and Charges) Regulations 2022 Pt 2 effective 1 July 2022; Commerce Regulations Amendment (Mutual Recognition) Regulations 2022 Pt 2 (SL 2022/121) effective 1 July 2022 which amended multiple regs (noted in line amendments such as reg 5 amendment SL 2022/121 r.4 and reg 17-19 amended SL 2022/121 r.6-8).

• Commerce Regulations Amendment (Fees and Charges) Regulations 2023 Pt 2 (SL 2023/35) effective 1 July 2023. This instrument inserted reg 21 and Schedule 1 as indicated by internal notes "[Heading inserted: SL 2023/35 r. 5.]" and “Regulation 21 inserted: SL 2023/35 r.4” and Schedule 1 inserted.

Specific inserted or amended regulations noted in the text

• Reg 15A was inserted in 2009 (Gazette 30 Jun 2009 p. 2621-2).
• Regs 16A-16C were inserted in 2007 (Gazette 28 Dec 2007 p. 6412-13).
• Reg 16D was deleted by SL 2022/121 r.5 as noted.
• Reg 17 was amended by SL 2022/121 r.6 to set the minimum insurance cover at $1,000,000.
• Regs 18 and 19 were amended by SL 2022/121 r.7-8 to update reporting timeframes.
• Reg 10 was amended by SL 2021/7 r.4 to require publication of elected members on the Board’s website.
• Reg 22 was inserted by SL 2021/7 r.5 to give the Board discretion to reduce, waive or refund certain fees.

Fees schedule updates

• Schedule 1 was inserted or substantially updated by SL 2023/35 and lists precise fee amounts for registration, licences, renewals, examinations and other transactions. The compilation table records Commerce Regulations amendments that have impacted fees in 2017, 2021, 2022 and 2023.

The compilation table provides a running history of the major amendment instruments and the dates on which most substantive provisions came into operation. The inserted provisions highlighted above materially affect renewal timing, corporate definitions, insurance minimums and the scheduling of fees.

The regulations themselves, and the compilation notes printed here, do not cite any litigation or court decisions. There are no cases named in the text of the regulations or in the compilation table.

Consequently the regulations as published do not record precedent, appellate determinations, or judicial commentary on their interpretation or application. Any litigation history relevant to the Architects Act 2004 or these regulations would need to be sourced from external legal databases and court records.

Practitioners seeking precedent on issues such as:

• interpretation of “acceptable to the Board” in licensing decisions,
• the operation of reg 20’s disciplinary listings in s 56 proceedings,
• disputes about election procedure or alleged double voting in Board elections,
• challenges to Board decisions on corporate licencing or name consent, should consult WA tribunal and court decisions, administrative law reports and any published determinations of the Board or related disciplinary bodies. The regulations themselves provide no commentary or case law history to rely upon.

Where the regulations reference other bodies or instruments (for example the Architects Accreditation Council of Australia examinations or Commonwealth corporation definitions), relevant case law may also appear in decisions that consider inter‑jurisdictional recognition, professional discipline, or administrative law standards for statutory discretion. Those lines of jurisprudence are not included in the regulations and must be researched separately.

The regulations are detailed but contain multiple points where small errors or misunderstandings may produce compliance risk or unintended consequences. The following are practical pitfalls drawn directly from the text.

“Acceptable to the Board” as a recurring, discretionary standard

• The regulations repeatedly require things to be “acceptable to the Board”: corporate constitutions, directors, means of complying with supervision, practice names and other matters (reg 15(a)-(b),(d),(f); reg 25). This is a broad evaluative standard with no fixed objective criteria in the regulations. Practitioners should not assume that compliance with a standard contract or a typical corporate constitution will automatically be approved; documentary evidence and clear statements about supervisory arrangements are likely necessary.

Corporate supervision requirement

• Reg 15(c) requires that “all architectural work to be done by the corporation is to be done under the direct control and supervision of a registered person who is an officer or employee of the corporation.” This is not satisfied by a registered principal acting as an external consultant or by a non‑employee director who provides occasional oversight. If corporate structures rely on subcontracting or external consultant arrangements where the registered architect is not an officer or employee, the firm could be non‑compliant or unable to obtain a licence.

Ultimate responsibility must be an officer or employee

• Reg 15(e) requires the person who will have ultimate responsibility for the work to be a registered person who is an officer or employee. The regulations do not define “ultimate responsibility” in detail; corporate applicants should be explicit in applications about who will hold that role and how authority is documented.

Insurance reporting timeframes

• For individuals, annual insurance information must be provided by 30 September each year, and within 14 days of any change (reg 18(2)(a)-(b)), unless the information has already been provided to the Board within the preceding 3 months (reg 18(3)). For licensed corporations, initial grant requires documentation within 28 days, renewals within 14 days and any change within 14 days (reg 19(2)(a)-(c)). Missing these windows creates compliance exposure and may affect licensing or renewal.

Examination fees and eligibility assessments

• The fee for assessment and taking the National Examination Paper is set at $665 (Schedule 1 item 12) and the Examination by Interview fee at $565 (Schedule 1 item 13). These are non‑trivial costs and applicants should budget accordingly. The Board may also require an assessment of eligibility for examinations; reg 14(2) cross‑references Schedule 1 fees.

Voting and elections procedural strictness

• Nomination forms must be signed and include a statement about qualifications, experience and reasons for nomination, and must be received by the deadline (reg 6(2)(a)-(c)). Voting papers are sent by post to registered addresses; failure to receive or deliver by these means can disenfranchise a registrant. Also, voting more than once carries a $2,000 fine (reg 11(1)), and “vote” excludes casting votes and selections under reg 9(c) (reg 11(2)), so individuals must understand which acts count as voting.

Name consent and advertising obligations

• If a registrant or licensed corporation wants to practise under a name not recorded in the register, they must apply in a Board form and pay the fee (reg 25(1) and Schedule 1 item 14). The Board may impose conditions such as requiring that the registered person’s name and registration number be displayed on stationery, advertisements, job signs and public materials, and that the responsible registrant’s certificate be available for inspection at the registered address (reg 25(3)). Failure to comply with such conditions risks disciplinary action under reg 20 and the Act.

Division changes and notice periods

• Register divisions are split between practising and not currently practising (reg 16). Registered persons moving between divisions must notify the registrar within 30 days of starting or stopping practise (reg 24(1)-(3)). Failing to notify the registrar on time could complicate insurance and legal responsibility for work done.

Fee amounts and possible changes

• Schedule 1 sets precise fees, but the Board and commerce amendment instruments have updated fees several times (compilation table). Practices should verify current fees at the Board website before lodging applications to avoid inadvertent underpayment.

Document availability and inspection

• Certificates of registration and licence documents must be available for inspection during business hours at the registered address (reg 23(1)-(2)). The regulations make this a public inspection right and impose a penalty; remote practices or those without a public office should ensure they have a physical address and accessible documentation.

Disciplinary list details

• Reg 20 lists specific examples of unprofessional conduct such as failing to obtain client written acknowledgement and consent when using products in which the architect has a pecuniary interest (reg 20(g)-(h)). This creates strict disclosure and consent requirements even if the pecuniary interest is minor, except for interests in public companies which are excluded from the disclosure obligation.

Nominating bodies and appointment influence

• Reg 4 prescribes only four bodies for ministerial nominations. Those bodies therefore have formalised influence over certain appointed Board positions. Applicants and stakeholders should be aware of the composition mechanics when seeking appointment or engagement with the Board.

Transitional renewal timing quirks

• The transitional provisions (regs 16A-16C) include historical directions about renewal due dates and hardship deferrals for 2008 and beyond. While many are transitional, reg 16A fixes that registrations and licences granted after 2007 have effect until 30 June in the following year. Renewal due dates after 2008 are generally 30 September (reg 16C(4)), but the Board can set alternate dates on application in hardship cases. Misreading these dates can cause unintentional lapsing.

Collect these procedural points into compliance checklists. The regulations are precise on timeframes and documentary requirements; small administrative slips can produce discipline, fines or inability to lawfully practise.

The following is a practical compliance checklist aligned to the regulations, suitable for practitioners, practices, and compliance teams. Each action references the controlling regulation.

Registration pathway for natural persons (regs 12-14, Schedule 1)

1. Establish qualifying education or equivalence:
   • Hold an architectural education course qualification accredited by the Board under s 10(c) or establish equivalence or acceptable standard with Board consideration of advice from the Architects Accreditation Council of Australia (reg 12(a)(i)-(iii)).
2. Apply for assessment to sit examinations:
   • Complete the Board’s assessment process and pay the assessment/examination fee (reg 14(2); Schedule 1 item 12 for National Examination Paper; item 13 for Examination by Interview).
3. Sit and pass required examinations:
   • Prepare for the National Examination Paper and Examination by Interview as per the Architects Accreditation Council of Australia materials cited in reg 13.
4. Disclose convictions and confirm fitness:
   • Ensure any relevant criminal history is reviewed; do not apply if convicted of offences rendering one unfit (reg 12(c)-(d)).
5. Submit application and fees:
   • Lodge the registration application with the fee (Schedule 1 item 1 application; item 3 registration fee) and other documents required by the Board under s 33 and the regulations.

Corporate licensing compliance (reg 15, reg 15A)

1. Confirm entity type:
   • If the corporation is an Aboriginal or transitional corporation under the Commonwealth Acts cited, use reg 15A to confirm status.
2. Prepare constitution and governance documentation:
   • Ensure the corporation’s constitution or internal management rules are drafted so they will be “acceptable to the Board” (reg 15(a)). Be ready to provide the Board with documents evidencing the arrangement.
3. Ensure directors are acceptable:
   • Collect and supply directors’ particulars for the Board’s assessment (reg 15(b)).
4. Ensure supervisory and ultimate‑responsibility arrangements:
   • Document how all architectural work will be under the direct control and supervision of a registered person who is an officer or employee, and identify the registered person who will have ultimate responsibility (reg 15(c)-(e)). Provide the Board with the “means by which the corporation proposes to comply” (reg 15(d)).
5. Apply and pay fees:
   • Lodge the licence application with the fee (Schedule 1 item 2 application; item 4 licence fee) and any required declarations.

Insurance and ongoing reporting (regs 17-19)

1. Maintain minimum cover:
   • Maintain professional indemnity insurance of at least $1,000,000 as required by reg 17.
2. Obtain documentary proof:
   • Secure from insurer or broker a document showing period, amount and categories of persons covered (reg 18(1) and reg 19(1)).
3. Report to the Board on schedule:
   • For individuals, provide insurance information by 30 September annually and within 14 days of change, unless already provided within the previous 3 months (reg 18(2)-(3)).
   • For licensed corporations, provide the insurance document within 28 days of initial licence grant, within 14 days of renewal notification, and within 14 days of any change (reg 19(2)).

Record‑keeping, certificates and notices (regs 23-25, 24)

1. Make certificates available:
   • Ensure certificates of registration and licence documents are physically available for inspection during business hours at the registered address (reg 23(1)-(2)); maintain a physical registered address for inspection.
2. Notify changes in practising status:
   • If moving between division 1 (practising) and division 2 (non‑practising) of the register, notify the registrar in writing within 30 days of the change (reg 24(1)-(3)).
3. Apply for name consent where required:
   • If intending to practise under a name not recorded in the register, submit a written application in the Board’s form, pay the fee (Schedule 1 item 14), provide requested information and statutory declarations if required, and be prepared to comply with conditions imposed by the Board such as public display of the responsible registrant’s name and registration number (reg 25(1)-(3)).

Elections and Board participation (Part 2, regs 5-11)

1. For candidates:
   • Ensure nomination form is correctly completed and signed, include the required statement on qualifications and reasons for nomination, and deliver by the time specified in the notice sent to registered address (reg 5(2)(a)-(b), reg 6(2)).
2. For electors:
   • Expect voting paper at least 14 days before the return day, follow the instructions exactly and return the paper so it is received by the Board by the return day (reg 7(2)-(3)). Do not vote more than once; multiple votes attract a $2,000 fine (reg 11(1)).
3. Follow-up:
   • Check the Board website for publication of elected members’ names (reg 10).

Fee management and relief (reg 21, reg 22, Schedule 1)

1. Budget for fees:
   • Consult Schedule 1 for current amounts for applications, registrations, licences, renewals, restoration, certified copies and examinations. Confirm current price list with the Board before lodgement.
2. Seek fee relief where applicable:
   • If applying for a certified copy of the register or to amend particulars under s 45 and reg 21, check whether fee reduction, waiver or refund may be available under reg 22 and, if appropriate, make a written application to the Board explaining why relief is appropriate.

Disciplinary risk management (reg 20)

1. Avoid conduct listed as unprofessional:
   • Do not misrepresent registration division (reg 20(a)), do not use names of others in connection with services unless they are partners or employees (reg 20(b)), do not allow unregistered persons or corporations to practise in your name (reg 20(c)-(d)), and ensure signed documents truthfully represent the extent of your direct supervision (reg 20(e)).
2. Disclose and obtain consent for pecuniary interests:
   • Where you have a direct or indirect pecuniary interest in products or services you recommend or use (other than interests in public companies), disclose this to the client in writing and obtain written acknowledgment and consent prior to using such products or services (reg 20(g)-(h)).

Administrative best practice

• Maintain contemporaneous records of insurance documents, supervisory arrangements, employment contracts showing registered persons as employees or officers, minutes or evidence of Board‑level decisions about corporate compliance, and copies of any consents from the Board for trading names.
• Where the Board’s approval is required, seek pre‑application meetings or guidance if available and supply evidence rather than unsupported assertions about compliance approaches. Given the Board’s evaluative role, detailed and transparent submissions reduce the risk of rejection or enforcement action.

If an adverse administrative decision is taken (for example refusal to licence), consider administrative review options under state administrative law and check the Act for internal appeal or review mechanisms. The regulations themselves do not set out appeal procedures for every decision, so consult the Act and legal counsel promptly.
