Architects Regulation 2004

The regulation revolves around a small set of interlocking administrative concepts that support regulation of the architectural profession under the Act. These concepts are:

• The public register as a transparency and regulatory instrument. Section 5 prescribes the specific fields that must appear for each registered architect: full name; business phone and fax numbers and email address, if any; business address; conditions on registration; details of suspensions, cancellations and disqualifications; and for nominees, detailed history of nomination including firm name, whether primary nominee, and nomination dates (s 5(a)-(h)). The register therefore functions as both a contact directory and a compliance record.

• Limited title exceptions. The Act contains an express prohibition on certain title uses (Act, s 57(1)). The regulation identifies a set of narrow exceptions to that prohibition. Sections 6-9 operate as decriminalising or non-application provisions for specific terms and contexts. Section 6 lists "landscape architect", "naval architect" and "computer systems architect" as not caught by the Act, s 57(1). Section 7 permits use of the adjective "architectural" by businesses supplying goods in relation to architecture and permits particular employee titles for employees of registered architects. Section 8 allows interstate architects to use "architect" and "registered architect" where their use is accompanied by an indication of the local jurisdiction of their registration and where the interstate architect gives prior written notice to the architects board. Section 9 permits use of terms that describe an architectural qualification held by the person.

• Prescribed procedural rules for board nominations. Section 10 prescribes how the registrar must call for nominations and what must be included in a nomination. The notice must be public, state that only registered persons may nominate, set a close date at least two weeks after publication, and set out the information required for nomination. The nomination itself must be in writing, signed by the nominee and include contact details, registration number, and a brief description of experience as a registered architect in the ACT. The regulation defines the "prescribed period" for calling nominations as the window starting seven months before a member’s term ends and ending six months before that day (s 10(6)).

• Reporting duties on the architects board. Section 12 prescribes specific content for the architects board’s annual report in relation to complaints and occupational discipline. The board must disclose total complaint numbers, complaints about architects and about non-registered architects, and a description of kinds of complaints (s 12(1)). For occupational discipline, the report must include the name of each architect disciplined in the year, the contravention, the disciplinary action taken, and the result of any review of that decision (s 12(2)). The board must also report on other activities, with "general advice given to consumers" given as an example (s 12(3)).

• Narrow, context-dependent definitions. Section 11 provides definitions for Part 3, notably defining "architect" to include persons who were registered when the complained-of thing happened for complaints and for occupational discipline, and defining "contravention" for occupational discipline as the thing the architect did that caused discipline. The dictionary cross-references the Architects Act and the Legislation Act for other terms.

These concepts interact to create a framework where title protection is enforced by the Act except in enumerated, narrow circumstances; registration status and disciplinary history are recorded publicly; and selection of board members follows a regulated notice and nomination procedure. The regulation emphasises administrative clarity over substantive professional standards, which remain located in the Act.

The regulation identifies a defined set of affected parties and assigns duties and permissions among them. The primary categories of persons and entities affected are:

• Registered architects. The regulation dictates what information about each registered architect must appear on the public register (s 5). Registered architects are also the only persons eligible to nominate themselves for appointment as architects board members, and their nominations must contain specific information (s 10(1)-(3)). For the purposes of complaints and occupational discipline reporting in Part 3, "architect" includes persons who were registered at the time the conduct complained of or the contravention occurred (s 11(a)(i)-(ii)). The board’s annual report must disclose the names of architects who have been subject to occupational discipline along with details of the contravention and the discipline taken (s 12(2)).

• Employees of registered architects and businesses supplying goods in relation to architecture. The regulation allows employees of registered architects to use certain job titles , "architectural assistant", "architectural technician", and "architectural drafter" , without falling foul of the Act’s prohibition on title use (s 7(2)). It also permits businesses that supply goods in relation to architecture to use the adjective "architectural" to indicate their business activity (s 7(1)). The scope of "goods in relation to architecture" is not defined in the regulation itself, so businesses using the term may need to interpret that phrase or seek clarification.

• Interstate architects. The regulation addresses architects who are registered in other local jurisdictions but who operate or market services in the ACT. Such architects may use the terms "architect" and "registered architect" provided the use is accompanied by an indication of the local jurisdiction where they are registered and the interstate architect notifies the architects board in writing before using the term (s 8(1)). The regulation defines "interstate architect" for this context as a person registered in a local jurisdiction and normally resident there (s 8(2)).

• The registrar. The registrar has positive duties under the regulation. These include posting public notices for nominations within the prescribed period and providing specific information in those notices (s 10(1)); acknowledging receipt of nominations received before the close date as soon as practicable (s 10(4)); and maintaining the register with the prescribed fields in s 5. The registrar’s actions are the mechanism by which public recruitment and register transparency are implemented.

• The architects board. The board must produce an annual report that contains prescribed complaint statistics and details of occupational discipline actions (s 12). The board is also the recipient of nominations and the entity whose composition is affected by the nomination process prescribed in s 10.

• The Minister. The Minister has a notification duty under the nomination process: the Minister must tell each nominee whose nomination was received before the close date in writing about the appointment of the new member (s 10(5)). Thus the Minister is part of the communication loop once nominations close.

• Consumers and complainants. Although not the direct subject of prescriptive duties, consumers are affected by what is recorded and published. The board’s annual report must include details about complaints and the kinds of complaints made (s 12(1)(d)). This produces information that consumers, client advisers and other market participants can use when assessing architects.

• Firms for whom architects are nominees. Section 5(d) and (h) require the register to record, where an architect is or has been a nominee, the name of each firm for which the architect is or was a nominee, whether the architect was the primary nominee, and the dates of nomination status. This affects firms whose contractual or legal responsibility depends on having a nominated architect.

Secondary effects arise from the regulation’s interaction with the Act. For example, people who hold architectural qualifications but are not registered are permitted to describe the qualification they hold (s 9), which affects how unregistered practitioners may market their credentials. The regulation also affects administrative burden and privacy exposure for architects because the board must publish names and disciplinary details in the annual report (s 12(2)). Finally, media, journalists and researchers are affected because the register and annual report provide data points for public scrutiny.

The regulation distributes a set of duties and rights among the registrar, the architects board, registered architects, interstate architects, employees of architects, and the Minister. These are concrete and narrow; the following lists the principal duties and permitted actions, with section references.

Duties of the registrar

• Maintain and publish the register with the prescribed information for each registered architect: full name; business phone and fax numbers and email address, if any; business address; conditions on registration; details of suspension, cancellation and disqualification; and nominee history (s 5(a)-(h)). The registrar must ensure these fields are captured and available under the Act’s s 11(2) requirement as fleshed out by s 5 here.

• Publish a public notice calling for nominations for an architects board vacancy within the "prescribed period" (s 10(1)). The notice must state that only registered people may nominate, the close date for nominations and the information required to be included in a nomination, and must be published on an ACT government website or in a daily newspaper circulating in the ACT (s 10(1) note).

• Acknowledge to each nominee whether their nomination was received before the close date as soon as practicable after receiving the nomination (s 10(4)).

Duties of the architects board

• Prepare an annual report that includes specific complaint statistics: the total number of complaints made in the year, the number made about architects, the number made about architects who are not registered, and a description of the kinds of complaints made about architects (s 12(1)(a)-(d)).

• In the annual report, for occupational discipline, include the name of each architect against whom disciplinary action was taken, the contravention, the occupational discipline taken, and the result of any review of the discipline decision (s 12(2)(a)-(b)). The board must also report on other activities undertaken (s 12(3)).

Rights and permitted uses

• Employees of registered architects have the right to use specified staff titles without triggering the Act’s s 57(1) prohibition: "architectural assistant", "architectural technician", and "architectural drafter" (s 7(2)).

• Businesses that supply "goods in relation to architecture" may use the adjective "architectural" to describe their business activity without the Act, s 57(1) applying (s 7(1)).

• Persons may use terms that describe an architectural qualification they hold without being subject to the Act, s 57(1) prohibition on title use (s 9).

• Interstate architects may use the terms "architect" and "registered architect" when they both (a) indicate the local jurisdiction where the architect is registered and (b) the architect informs the architects board in writing before the use (s 8(1)(a)-(b)). The regulation defines "interstate architect" as a person registered in a different local jurisdiction and normally resident there (s 8(2)).

Ministerial duty

• The Minister must tell each nominee whose nomination was received before the close date in writing about the appointment of the new member (s 10(5)). This assigns a communication step to the Minister following the appointment.

Procedural requirements for nominations

• The notice period must be at least two weeks between publication and the close date (s 10(2)). A nomination must be in writing and signed by the nominee and must include contact details, registration number, and a brief description of ACT experience as a registered architect (s 10(3)(a)-(b)(i)-(iii)).

Definitions affecting duties

• For Part 3, the term "architect" explicitly includes persons who were registered when the complained-of matter occurred or when the contravention for occupational discipline happened (s 11(a)(i)-(ii)). The term "contravention" is defined as what the architect did that caused occupational discipline to be taken (s 11).

Record and disclosure obligations

• Because the register must record suspensions, cancellations, disqualifications and nomination history (s 5(d)-(h)), registrars and architects must ensure accurate recordkeeping and timely updates to avoid stale or misleading public information. The board’s obligation to publish names and details of occupational discipline in the annual report (s 12(2)) creates a further disclosure duty.

Limitations and non-duties

• The regulation does not itself set registration qualifications, disciplinary procedures, licensing fees or criminal penalties beyond the cross-reference to the Act and the general note on penalty unit amounts in the republication header. Those substantive matters remain in the Act and other instruments.

These provisions create a narrow but concrete compliance environment. Registered architects and their employees have specified permitted uses of certain titles. The registrar and the board bear the principal operational duties around recordkeeping, public notice, and reporting.

The regulation itself does not create a catalogue of new offences with distinct penalty levels; instead it clarifies application and non-application of the Act’s protections and prescribes procedural and reporting requirements. Enforcement levers therefore operate mainly through the Act, with which this regulation interacts.

Penalty unit reference

• The republication notes the value of a penalty unit for an offence against this law as $160 for an individual and $810 for a corporation at the republication date, under the Legislation Act 2001, s 133. This figure is included in the republication explanatory material and applies where an offence in the Act or regulation refers to penalty units. The regulation does not itself specify penalty levels for non-compliance with its clauses.

Title-use enforcement and non-application

• The central enforcement-relevant aspect in this regulation is its clarification that, for certain terms and in certain contexts, the Act’s s 57(1) prohibition on the use of protected titles does not apply (ss 6-9). That means that the normal enforcement mechanism under s 57(1) of the Act (which is a prohibition) is not engaged in those enumerated circumstances. Where a use is outside those enumerated exceptions, enforcement of title misuse would remain governed by the Act’s provisions. The regulation thus narrows the enforcement scope of the Act’s title prohibitions rather than adding enforcement mechanisms.

Reporting as an enforcement and transparency mechanism

• Section 12 requires the architects board’s annual report to include details of complaints and occupational discipline, including names of disciplined architects and the contraventions and results of any review of discipline. While the regulation does not prescribe sanctions, mandating public disclosure is an enforcement-related mechanism because publication creates reputational consequences and enables public scrutiny. The regulation therefore leverages disclosure rather than additional penal sanctions as a compliance lever.

Administrative compliance and potential consequences

• The registrar and architects board have specific duties under ss 5, 10 and 12. Failure to comply with those duties could expose the responsible official or body to administrative accountability under the Act, or to review under administrative law, although the regulation itself does not set out explicit sanctions for failure to perform these administrative functions. The Act will contain the operational enforcement instruments for breaches of the Act’s duties.

Privacy and defamation risk

• The obligation in s 12(2) to disclose the names of architects subject to occupational discipline and details of the contravention and the result of review introduces privacy and possible defamation risk concerns. The regulation requires publication of names and details, which creates a legal risk that is external to the regulation: persons named could seek judicial review or civil remedies if publication is inaccurate or unlawful. The regulation does not address privacy safeguards or defamation protection.

Limits on the regulation’s enforcement scope

• The regulation does not expand the Act’s disciplinary powers. It does not create new licencing offences, nor does it authorise additional investigative or coercive powers. Its impact on enforcement is therefore procedural and informational. Enforcement involving conduct, title misuse outside carved out uses, professional standards and disciplinary outcomes remains a matter for the Act and the architects board’s powers under the Act.

In summary, penalties and enforcement following from this regulation rely on: (a) the Act’s substantive prohibitions and sanctions where the regulation does not provide a non-application; (b) reputational enforcement via mandatory disclosure in the annual report (s 12); and (c) administrative accountability for failing to perform the registrar and board duties prescribed. The regulation itself does not create new monetary penalties or enforcement procedures.

The regulation is expressly made under the Architects Act 2004 and consistently cross-references that Act. It also relies on definitions and procedural terms in the Legislation Act 2001. The document therefore operates as an implementation and clarification layer beneath the Act and alongside general legislative drafting principles and administrative law.

Primary interaction with the Architects Act 2004

• The regulation directly supplements and prescribes details for several provisions of the Architects Act 2004. For example, s 5 of the regulation prescribes details to be recorded in the register pursuant to the Act, s 11(2) (the regulation’s heading to s 5 cites the Act, s 11(2)). Sections 6-9 of the regulation operate under the Act, s 57(2), by specifying particular uses that do not fall within the Act’s s 57(1) prohibition on title use. Section 12 identifies information to be included in the board’s annual report in relation to the Act, s 67. Section 10 deals with nominations for architects board members which is connected to the Act’s provisions concerning board composition and appointment (the regulation references the Act in its headings and the dictionary defines "architects board member" by reference to the Act, s 70(1)(c)).

Dependency on the Legislation Act 2001

• The regulation relies on the Legislation Act for interpretive rules and definitions. Section 2 explicitly states that the dictionary at the end forms part of the regulation and notes the Legislation Act s 155 and s 156(1) for the application of definitions. The public notice mechanism referenced in s 10(1) is defined in the Legislation Act dictionary as notice on an ACT government website or in a daily newspaper circulating in the ACT. The republication prefatory notes indicate that editorial amendments have effect as if made under the Legislation Act, part 11.3.

Cross-references and operational interdependence

• The regulation’s permitted uses of titles depend on the Act’s prohibition. The non-application provisions are framed as "The Act, section 57(1) does not apply to…" (ss 6-9). That framing means the Act’s substantive rules are the baseline and the regulation narrows the application in specified ways. Where a use is not listed, the Act’s s 57(1) remains applicable. Therefore a user or regulator must read the Act and this regulation together to determine legality of title use.

• The dictionary notes that many terms used in this regulation have the same meaning they have in the Architects Act 2004 (dict note 3). For example the regulation defers to the Act’s definitions for "local jurisdiction" and "registered". This linkage means that any amendment to definitions in the Act may change the meaning of terms in the regulation, and that regulatory interpretation will often refer back to the Act.

Interaction with privacy, administrative law and disclosure obligations

• Section 12 requires publication of names and disciplinary details in the architects board’s annual report. This disclosure interacts with privacy obligations under broader law, and with administrative law constraints on public agencies. The regulation does not specify privacy exemptions or data-handling requirements; those obligations will be governed by other applicable laws and policies. Agencies preparing the report will need to reconcile s 12 disclosure requirements with data-protection responsibilities and any relevant FOI or public-sector information management rules.

Amendment and commencement links

• The endnotes provide the legislation and amendment history showing the regulation was made as part of the Architects Act 2004, and later amended by Acts including the ACT Civil and Administrative Tribunal Legislation Amendment Act 2008, Statute Law Amendment Acts, the Construction and Energy Efficiency Legislation Amendment Act 2013, the Red Tape Reduction Legislation Amendment Act 2015 and the Statute Law Amendment Act 2022 (endnotes 3 and 4). These amendments show the regulation has been updated in response to broader legislative changes, and that it must be read in the context of those amendments.

Limits to interaction

• The regulation does not attempt to modify the substantive elements of registration criteria, disciplinary procedures, or professional standards; those remain located in the Architects Act and any other instruments made under the Act. It does not purport to override requirements in other statutes (for example building codes, planning laws or consumer protection statutes) so users should be aware that compliance with the regulation does not discharge obligations elsewhere.

Operational implication

• Practitioners, registrars and the board should interpret the regulation as a procedural and disclosure layer that must be read with the Act and with administrative law and privacy obligations. Where the regulation creates permitted uses or reporting obligations, those will have to be coordinated with other statutory frameworks.

The regulation contains an explicit amendment history recorded in the republished instrument’s endnotes. The legislative history shows the regulation was made as part of the Architects Act 2004 and has been amended several times. The key amendment events listed in the endnotes are:

• Original creation: The regulation was made as part of the Architects Act 2004, cited as A2004-20, s 102 and sch 1. The regulation was originally titled Architects Regulations 2004 and subsequently renamed under the Legislation Act 2001 (endnotes, legislation history).

• ACT Civil and Administrative Tribunal Legislation Amendment Act 2008 (A2008-36): Amendments from 2008 are recorded with commencement events. The 2008 amendments included changes to definitions for Part 3 (s 11), specifically insertion and substitution of definitions for "architect" and "contravention" (amendment history shows s 11 def architect am A2008-36 amdt 1.55 and def contravention sub A2008-36 amdt 1.56). The 2008 amendments were notified and commenced in 2008 and early 2009 (endnotes 3).

• Statute Law Amendment Act 2009 (A2009-20) and Statute Law Amendment Act 2011 (No 3) (A2011-52): These Acts effected further editorial and technical amendments, including changes to the dictionary and other minor edits (amendment history entries: dict am A2009-20 amdt 3.15, amdt 3.16; A2011-52 amdt 3.11; and others).

• Construction and Energy Efficiency Legislation Amendment Act 2013 (A2013-31): This Act removed the former schedule 1 prescribing qualifications for registration (amendment history shows sch 1 om A2013-31 s 8), indicating a policy shift to relocate or change how qualifications are prescribed.

• Red Tape Reduction Legislation Amendment Act 2015 (A2015-33): Further amendments were made in 2015 affecting s 10 (nominations) and dictionary entries (amendment history lists s 10 am A2009-20 amdt 3.14; A2015-33 amdt 1.17, amdt 1.18; dict am A2015-33 amdt 1.19 etc.). These carried into republication R7 with effect from 14 October 2015.

• Statute Law Amendment Act 2022 (A2022-14): The latest recorded amendment in the endnotes. The 2022 amendments were notified 10 August 2022, with certain parts commencing 24 August 2022. The amendment history entry lists s 10 am A2022-14 amdt 3.7 among changes. The republication is effective 24 August 2022.

The endnotes also provide a republication chronology (endnote 5) showing successive republications and effective dates from 2004 onwards, indicating periodic consolidations and editorial republications.

What the amendment history concretely shows

• The regulation has been subject to iterative refinement rather than wholesale replacement. Many changes have been editorial or definitional, while some substantive changes include removal of a schedule prescribing qualifications and adjustments to nomination procedures and definitions in Part 3.

• The regulation’s content has, over time, migrated toward procedural clarity: the current instrument emphasises register fields, nomination procedure timing and reporting obligations, while prescription of qualifications was removed in 2013, which means qualifications are no longer contained in this regulation.

Practical consequence for practitioners

• Regular reference to the endnotes is necessary for historical context and to confirm current operative text. Entities relying on older versions of the regulation should consult the republication and endnotes to identify any substantive changes because earlier versions may have included provisions that were later omitted or relocated.

The republished regulation does not include any case law, judicial decisions, or administrative tribunal determinations. The text, the dictionary and endnotes contain only legislative and editorial history, amendment records and commencement dates. There are no references to litigation, no citations of cases, and no summaries of judicial interpretations within the document.

Implications of absence of litigation references

• The regulation itself is a subordinate instrument and typically administrative in nature. Judicial consideration of the regulation would likely appear in reported decisions under the Architects Act or in disputes concerning application of title protection, disciplinary processes or the content of annual reporting. However, such decisions are not cited or summarised within the regulation’s republication text.

• Practitioners seeking to understand how courts or tribunals have interpreted the interaction between this regulation and the Architects Act must consult external case law databases or tribunal records. The regulation’s absence of litigation history in its endnotes does not mean there is no relevant jurisprudence; it only means the instrument itself does not catalogue it.

Where disputes might arise, hypothetically grounded in the regulation’s text

• Disagreements could arise over the scope of permitted uses under ss 6-9, for example whether a particular business use of "architectural" falls within "supplies goods in relation to architecture" or over whether an interstate architect complied with the requirement to indicate the local jurisdiction and notify the board in writing before using "architect" commercially (s 8).

• Publication requirements in s 12, particularly naming architects subject to occupational discipline, could lead to challenges on privacy or defamation grounds, or judicial review claims where procedural fairness in the disciplinary decision is alleged.

• Procedural disputes about nominations under s 10 might give rise to administrative law challenges if a person alleges the registrar failed to follow the notice and nomination procedures or that the Minister failed to perform the notification duty in s 10(5).

Because the regulation does not include litigation content, an advocate or researcher will need to consult tribunal and court records, and the Act’s enforcement and review provisions, to identify applicable authorities and outcomes.

The regulation’s brevity conceals several practical pitfalls that responsible officers and practitioners should note. These are not judgments but flag areas where the regulation creates operational ambiguity, compliance friction, or potential legal exposure.

1. Ambiguity of "goods in relation to architecture" (s 7(1))

• The regulation permits businesses that "supply goods in relation to architecture" to use the term "architectural" to indicate the business. The regulation does not define "goods in relation to architecture". That gap yields uncertainty for businesses that provide services, software, furniture, materials, digital products or mixed goods and services with a design component. Without a statutory definition in the regulation or cross-reference to a defined term in the Act, a business may be uncertain whether its use is protected by s 7(1) or falls within the Act’s s 57(1) prohibition.

2. Narrow employee title carve-outs (s 7(2))

• Only three staff titles are explicitly permitted for employees of a registered architect: "architectural assistant", "architectural technician", and "architectural drafter". Firms that use other titles that include "architect" or similar words risk contravening the Act if those titles are not captured in the carve-out. Human resources and marketing teams must align job titles with the regulation to avoid exposure.

3. Interstate architect prior written notice requirement (s 8)

• Interstate architects may use "architect" in the ACT if they both display jurisdictional registration and notify the architects board in writing before use. The regulation requires prior written notification, not contemporaneous notice. Absent timely written notice, an interstate architect may be vulnerable to enforcement under the Act if they market or offer services in the ACT without having complied with s 8(1)(b).

4. Timing window for nominations (s 10(6) and s 10(2))

• The "prescribed period" for calling for nominations is unusual: it begins seven months before a board member’s term ends and finishes six months before that day. This creates a one-month window in which the registrar must publish notices for nominations to be validly sought within the prescribed period. Practitioners should not assume "prescribed period" is a long open window; it is a defined window whose placement may be unintuitive. Additionally the close date must be at least two weeks after publication (s 10(2)), so scheduling is constrained.

5. Content obligations and signature requirement for nominations (s 10(3))

• A nomination must be in writing, signed by the nominee and include the nominee’s contact details, registration number and a brief description of ACT experience. Nominations that omit required elements risk being treated as invalid. The registrar must communicate whether a nomination was received before the close date "as soon as practicable" (s 10(4)), a standard that invites questions about what constitutes "as soon as practicable" in tight timelines.

6. Broad public disclosure in the annual report (s 12(2))

• The board must include the name of each architect subject to occupational discipline and describe the contravention and disciplinary action. This mandatory naming raises privacy, reputational and potential legal exposure for the board where matters are complex, under review, or subject to appeal. There is no qualification in the regulation for pending appeals, stays or confidentiality orders; the regulation requires disclosure of the "result of any review of the decision to take occupational discipline" but does not specify timing around reporting where appeals are pending.

7. Definition of "architect" for complaints and discipline (s 11)

• For complaints, "architect" includes a person who was registered when the thing complained of happened; for occupational discipline, it includes a person who was registered when the contravention happened. This retrospective reach means former registrants may be captured by complaint and discipline processes and their names may appear in the board’s annual report if action is taken. Individuals who ceased registration may be surprised by continuing exposure.

8. Interaction with other statutes and privacy obligations

• The regulation requires public disclosure and maintenance of records. This interacts with privacy laws and records management obligations outside the document. The regulation does not specify redaction rules or privacy safeguards.

9. Register content sensitivity and accuracy obligations (s 5)

• The register must reflect suspensions, cancellations, disqualifications and nominee history. Errors or delayed updates could mislead the public and cause legal or reputational costs. The regulation assigns the registrar responsibility for the register fields; however no explicit update timetable is prescribed in this instrument.

10. Absence of guidance on enforcement consequences for failure to comply with procedural duties

• The regulation does not set out penalties for failing to perform the prescribed administrative duties. This leaves uncertainty about enforcement and remedies where, for example, the registrar fails to publish notice within the prescribed period, or the board fails to include required information in the annual report.

In practice, these "gotchas" point to areas where administrative planning, careful internal processes, and liaison with the board or the registrar are required. Entities should not assume informal compliance is sufficient in the absence of explicit definitional clarity.

This section provides practical, source-grounded steps for the principal actors affected by the regulation: registrars, the architects board, registered architects and their employers, interstate architects, and the Minister. Each step references the relevant provision in the regulation so that compliance actions map directly to statutory text.

For the registrar

• Register fields. Ensure the register captures and is able to publish the fields specified in s 5: full name; business phone and fax number and email address (if any); business address; conditions on registration; details of any suspension, cancellation or disqualification; and nominee history (the firm(s) served, whether primary nominee, start and end dates). Implement data-entry and verification procedures so that each field is accurate and up to date. Where fields are conditional ("if any"), record null values in a way that avoids misleading omissions.

• Nomination notices. Where an architects board member’s term is approaching, identify the "prescribed period" defined in s 10(6). That period starts seven months before the term ends and ends six months before that day. Within that period publish a public notice on an ACT government website or in a daily newspaper circulating in the ACT stating the call for nominations, that only registered people may nominate, the close date (which must be at least two weeks after publication, s 10(2)), and the information required for nomination (s 10(1)(a)-(d)). Record the date of publication and the close date to evidence compliance with the two-week minimum.

• Receipt and acknowledgement of nominations. Adopt a standard operating procedure to receive nominations in writing and to confirm as soon as practicable whether a nomination was received before the close date (s 10(4)). Maintain a timestamped log of nominations, including the content required by s 10(3)(b)(i)-(iii) that you must check for completeness: contact details, registration number, and a brief description of ACT experience.

• Register maintenance and update schedule. Establish a system for prompt updating of register entries to reflect conditions, suspensions, cancellations and disqualifications. Ensure audit trails for changes to mitigate legal risk from stale information.

For the architects board

• Annual report content. Prepare the annual report to include the prescribed complaint and disciplinary information in s 12. That requires maintaining accurate complaint logs that record complaint counts, complaint subject (registered architect or not), and a categorisation that supports a description of the kinds of complaints made about architects (s 12(1)(a)-(d)). For occupational discipline, maintain records of each architect disciplined, the contravention, the occupational discipline taken, and the result of any review (s 12(2)(a)-(b)). Build time into the report preparation schedule to capture any late-year disciplinary outcomes and ensure any review outcomes are accurately described.

• Data governance and privacy. Because s 12(2) requires naming architects and describing contraventions, review data governance and privacy compliance frameworks to manage personal data and to assess whether any additional privacy obligations under other law apply. Where disciplinary matters are under review or appeal, work with counsel to determine the appropriate description and timing in the annual report consistent with the regulation’s requirements and other legal obligations.

• Other activities. Include a section on other board activities (s 12(3)), such as consumer advice, education or outreach. Keep contemporaneous records of such activities throughout the year to support accurate reporting.

For registered architects and their employers

• Ensure register information accuracy. Check the register entry for each architect to confirm that full name, business contact details, address, and history are correctly recorded. Where changes occur (change of business address, email, nominee status or conditions on registration) notify the registrar promptly to update the register fields in accordance with s 5.

• Title usage for employees. Use only the permitted employee titles set out in s 7(2) for employees who work for a registered architect: "architectural assistant", "architectural technician" and "architectural drafter". Avoid other titles that include "architect" unless you have legal advice confirming they do not contravene the Act or the regulation.

• Use of "architectural" by businesses. If your firm supplies goods in relation to architecture and wishes to use the adjective "architectural" to describe your business (s 7(1)), document how the product or good supplied qualifies as a "good in relation to architecture". Maintain marketing and product descriptions that can justify use of "architectural" if challenged, recognising the regulation does not define the phrase.

For interstate architects

• Prior written notice. If you are an interstate architect wishing to use "architect" or "registered architect" in the ACT, prepare and send written notification to the architects board before using the term in the ACT (s 8(1)(b)). Ensure that any public use is accompanied by something indicating the local jurisdiction where you are registered (s 8(1)(a)). Retain proof of the board notification and ensure marketing materials display the jurisdictional qualification.

For the Minister

• Nominee communication. After nominations close and an appointment is made, the Minister must tell each nominee whose nomination was received before the close date in writing about the appointment of the new member (s 10(5)). Ensure systems are in place for timely written notification, and maintain records of the communications.

Cross-cutting practical actions

• Legal review of ambiguous terms. Where the regulation uses terms not defined within the instrument , for example "goods in relation to architecture" , consider seeking legal advice to interpret the scope in relation to your facts. Do not rely on informal understandings. Where organisations will rely on the carve-outs in ss 6-9, document the factual basis for that reliance.

• Recordkeeping for retrospective exposure. Because s 11 extends "architect" for complaints and discipline to persons who were registered at the time the relevant event occurred, maintain historical records (registration dates, work records, communications) to respond to complaints or discipline that arise after a registration change or cessation.

• Policy and privacy alignment. Coordinate annual reporting, register maintenance and nomination processes with broader government data protection and records management policies. This reduces the risk of publication that violates privacy obligations or that reveals information prematurely in respect of ongoing proceedings.

• Implement internal controls and audit trails. For registrars and boards, implement version control and audit logs for register changes and annual report drafting to provide evidentiary support of procedural compliance. Time-stamp nomination receipts and authorisations. Keep copies of public notices and evidence of publication dates.

By mapping each compliance activity to the relevant section of the regulation, actors can create checklists and workflow steps that align with statutory obligations. Absent detailed definitions in the regulation itself, where ambiguity exists actors should document their interpretive reasoning and, where necessary, seek clarification from the board, the registrar, or legal counsel.
