#### 40 Conciliation 40 Conciliation > > (1) The Commissioner is to refer a complaint made by a party to an apprenticeship or traineeship to a conciliator in the first instance. > > > (2) The conciliator must attempt to bring the parties to a settlement acceptable to each of them. > > > (3) If such a settlement is not achievable, the Commissioner is to deal with the complaint in accordance with this Part. > > > (4) In this section— > > > > conciliator means a person employed in the Department who is authorised in writing by the Commissioner as a conciliator for the purposes of this section. > > **s 40:** Subst 2017 No 42, Sch 1 \[44\].
