Application of Laws Ordinance 1973 (Coral Sea Islands)

The Ordinance deploys a small set of legal devices to achieve a larger administrative effect. Those devices and the textually anchored concepts are:

• Applied provision (defined): a provision of ACT law that, under s 3, applies in and in relation to the Territory as Territory law (s 2(1)). The definition is the hinge point: it ties the Ordinance’s effect to whatever provisions of ACT law are "for the time being in force" in the ACT and are "so far as applicable to the Territory" (s 3(1)).

• Territorial application by reference: rather than enact a new body of Territory law, the Ordinance imports an existing set of laws located in another jurisdiction and declares them to be Territory law (s 3(1)). This is a classic application-by-reference model: the content of Territory law is the content of ACT law as it stands at the relevant time, subject to the Ordinance’s limits.

• Exclusion of Acts: s 3(2) creates an express carve-out: subsection (1) does not extend to a provision of a law of the ACT that is a provision of an Act. The Ordinance therefore imports laws other than ACT Acts , which, reading the text literally, leaves regulations, ordinances, written or unwritten laws otherwise "in force" as potential applied provisions, subject to applicability to the Territory.

• Minister-centric adaptation and substitution: where an applied provision vests a power or function in a person or authority (other than a court) in relation to the ACT, s 4 deems that power or function, in relation to the Territory, to be vested in that same person or authority or in "such other person or authority as the Minister specifies." This provides an explicit discretionary mechanism for the Minister to designate who exercises the imported functions in the Territory (s 4).

• Delegation to Secretary: s 5 permits the Minister to delegate any or all of his powers under an applied provision to the Secretary to the Department of Home Affairs, but only by writing under his hand. The text also identifies that s 5 has been amended (Notes/Table of Amendments).

• Appointment of officers: s 6 authorises the Minister to appoint such officers as are necessary to execute the laws of the Territory. That is an enabling clause for staffing and administration.

• Repeal of inconsistent laws: s 7 provides for the repeal, on commencement, of laws in force in the Territory immediately before commencement that are inconsistent with any applied provision.

• Interpretive substitution for "Minister": s 2(2) instructs that, notwithstanding anything to the contrary in an applied provision, a reference in an applied provision to "a Minister" is to be read as a reference to "the Minister" as defined in the Ordinance. That is an interpretive rule aligning references in imported ACT provisions to the Commonwealth Minister administering the Coral Sea Islands Act rather than to an ACT Minister.

These concepts combine to make ACT non-Act laws function as the substantive legal content of the Territory, while providing centralised executive flexibility about who exercises the powers and how administrative resources are allocated (ss 2-7).

The Ordinance affects three broad groups by operation of its text: persons and authorities who exercise legal powers in respect of the Territory; persons and entities located in or operating within the Territory; and administrative actors responsible for implementing, interpreting and enforcing the applied provisions.

1. Executive and administrative actors

• The Minister: defined as the Minister for the time being administering the Coral Sea Islands Act 1969 (s 2(1)). The Minister gets decisive roles. The Minister may specify alternative persons or authorities to exercise powers that an applied provision vests in someone for the ACT (s 4). The Minister may delegate his powers under an applied provision to the Secretary to the Department of Home Affairs by writing (s 5). The Minister may appoint officers necessary to execute the Territory’s laws (s 6). Consequently, administrative control and decision-making reside with whoever holds the Commonwealth portfolio for the Act.

• Secretary to the Department of Home Affairs: explicitly eligible to receive delegation of "all or any" of the Minister’s powers under an applied provision (s 5). The Secretary becomes a potential primary implementing official if the Minister delegates.

• Persons or authorities to which applied provisions originally vest powers for the ACT: those persons remain able to be the Territory’s exercising bodies unless the Minister specifies otherwise (s 4). The Ordinance permits either retention of the original vesting or substitution.

2. People and entities in the Territory

• Residents, visitors, and businesses in the Coral Sea Islands Territory: the applicable ACT laws (as defined) apply "in and in relation to the Territory as laws of the Territory" (s 3(1)). Subject to the textual exclusions, private individuals, commercial operators and other entities in the Territory will be subject to any imported ACT provision that is applicable to the Territory under s 3(1). The Ordinance does not itself list particular offences or regulatory regimes; its effect is to change the source of law for substantive regulation to ACT law (s 3(1)).

3. Pre-existing Territory law and office-holders

• Any law in force in the Territory immediately before the Ordinance’s commencement that is inconsistent with an applied provision is repealed (s 7). That affects persons and institutions that relied on prior local legal regimes by replacing or eliminating those regimes where inconsistent.

Who pays and who bears administrative cost

• The Ordinance implies that the Commonwealth, acting through the Minister and any delegated officers, will bear administrative costs of administering the applied ACT laws in the Territory (ss 4-6). The Minister may appoint officers (s 6) and delegate to the Secretary (s 5), which creates staffing and departmental overhead. Private persons in the Territory will bear compliance costs arising from being subject to ACT laws; those costs vary with the content of applied provisions.

Who decides and what choices change

• The Minister decides, operationally, who exercises substituted powers (s 4), whether to delegate to the Secretary (s 5), and which officers to appoint (s 6). Private actors’ legal obligations change insofar as ACT law applies to them as Territory law (s 3(1)). The Ordinance also instructs that references to "a Minister" in applied provisions mean the Minister defined in the Ordinance, aligning decision-making functions with the Commonwealth portfolio rather than ACT Ministers (s 2(2)).

Boundaries and exclusions

• The Ordinance expressly does not extend its importing effect to provisions that are "a provision of an Act" of the ACT (s 3(2)). This textual limitation narrows which ACT laws can be applied directly under the Ordinance, leaving a class of ACT primary legislation outside the operation of the importation mechanism.

The statutory text contains no provisions addressing fees, funding, or enforcement resourcing beyond appointment and delegation authorities, so concrete cost-allocation mechanics must be supplied by administrative decisions exercised under the delegated powers (ss 4-6).

The Ordinance itself does not create a long list of duties or rights in the way a substantive statute would. Instead, it imposes institutional and interpretive duties and creates mechanisms that give rise to substantive duties and rights by bringing ACT law into force in the Territory. The key duties and rights are therefore derivative: they are the obligations and entitlements that flow from the applied provisions once they operate as Territory law. The Ordinance determines who administers those duties and how they can be assigned.

Derivatives of duty and rights by operation of the Ordinance

• Duty to comply with applied provisions: once a provision of ACT law that is "for the time being in force" and "so far as applicable to the Territory" is declared an applied provision (s 3(1)), its substantive obligations become duties that persons in the Territory must observe. The Ordinance itself does not enumerate these duties; it makes them effective by reference.

• Administrative duty of the Minister to designate competence: where an applied provision vests a power or function in a person or authority for the ACT, the Ordinance deems that power or function to be vested in that person or authority or "such other person or authority as the Minister specifies" in relation to the Territory (s 4). The Minister therefore has a duty, implicit in the mechanism, to specify when substitution is necessary and to ensure that a person or authority exercises the power in the Territory. The text leaves the mechanics and standards for such specification to executive decision-making.

• Duty to maintain records of delegations and appointments: s 5 requires delegation "by writing under his hand" to the Secretary. That textual requirement imposes a formal recordkeeping duty on the Minister for any delegation. Similarly, s 6 contemplates appointments of officers, which will generate standard employment and administrative duties (appointment instruments, terms, supervision).

• Right to expectation of legal continuity: s 7 repeals inconsistent pre-existing Territory laws, but that repeal gives affected persons legal certainty regarding which law governs going forward. The Ordinance therefore realigns legal rights and obligations by prioritising applied provisions over inconsistent prior Territory laws.

Interpretive duties

• Read references to "a Minister" as the Minister: s 2(2) is an interpretive instruction that requires applied provisions containing references to "a Minister" to be read as if they referenced the Minister administering the Coral Sea Islands Act. This changes rights and duties attached to ministerial functions in applied provisions by locating those functions within the Commonwealth ministerial framework rather than the ACT executive.

Delegation and substitution mechanics affecting duties and rights

• Delegation to the Secretary (s 5) and specification under s 4 shift the locus of decision-making and therefore shift who owes administrative duties and who may be sued for exercise or non-exercise of powers. For example, if the Minister delegates his powers under an applied provision to the Secretary, duties created under that applied provision will be administered by the Secretary as delegate.

Constraints on duties and rights

• Exclusion of ACT Acts (s 3(2)) constrains which ACT legislative rights or regulatory duties can be imported. The Ordinance therefore does not, on its face, import ACT Acts’ specific rights or duties.

Practical consequence

• Practitioners must look beyond this Ordinance to the content of the applied ACT provisions to identify precise duties and rights. The Ordinance supplies the legal conduit and administrative assignment rules for those duties and rights to operate in the Territory (ss 2-7).

The Ordinance does not itself create new substantive offences, penalties or a bespoke enforcement regime. Instead, it creates the mechanism by which enforcement provisions contained in ACT law may operate in the Territory, subject to the following structural features and limitations in the Ordinance.

Imported enforcement provisions

• Where an applied provision includes penal rules, enforcement mechanisms, criminal offences, administrative sanctions, or compliance frameworks (as part of the laws of the ACT "for the time being in force"), those mechanisms apply in the Territory as Territory law by operation of s 3(1). The Ordinance therefore makes the ACT’s enforcement architecture available to the Territory, but only in relation to non-Act ACT laws that are applicable to the Territory (s 3(2)).

Institutional locus of enforcement

• The Ordinance adjusts the institutional locus of enforcement in two ways. First, references to "a Minister" in an applied provision must be read as references to the Minister administering the Coral Sea Islands Act (s 2(2)), meaning ministerial enforcement discretion is vested at Commonwealth ministerial level rather than ACT ministerial level. Second, where authority to exercise powers or functions is vested in a person or authority for the ACT, s 4 deems that power or function, in relation to the Territory, to be vested either in the same person or authority or in such other person or authority as the Minister specifies. This gives the Minister the capacity to reassign enforcement functions to other officials or bodies for the Territory, and s 5 allows the Minister to delegate his powers under applied provisions to the Secretary to the Department of Home Affairs (s 5). Those provisions change who can enforce applied provisions and who can be held administratively accountable.

Administrative enforcement resources

• The Ordinance permits the Minister to appoint such officers as are necessary to execute the laws of the Territory (s 6). That provision anticipates an administrative enforcement presence and creates the authority to hire staff to carry out enforcement and compliance activity. The Ordinance does not specify funding or resource levels; those are administrative matters to be addressed through executive action.

Repeal and its enforcement implications

• s 7 repeals inconsistent pre-existing Territory laws. Where those repealed laws carried penalties, enforcement under them ceases from commencement where inconsistency exists. Enforcement attention therefore shifts to applied provisions as the operative legal framework.

Procedural and evidentiary considerations

• The Ordinance contains no express procedural rules for prosecutions, summary proceedings, evidence, or specialised enforcement steps. Those procedures, if any, will be those provided in the applied ACT provisions that operate as Territory law. Users must therefore consult the text of any applied ACT provision for procedural directions.

Limits on judicial functions

• s 4 expressly excludes courts from the deeming language about vesting powers and functions ("not being a court"). That textual exclusion preserves judicial independence and the separate operation of courts. The Ordinance does not create or modify courts; it only allocates executive administrative powers.

Practical implication for enforcement strategy

• Enforcement of any substantive duties in the Territory will ordinarily be carried out by the persons or authorities designated under the applied provisions, by persons or authorities specified by the Minister under s 4, or by officers appointed under s 6, and can be delegated to the Secretary under s 5. Practitioners should therefore trace enforcement authority from the text of the applied ACT provision, through any s 4 Ministerial specification, to any s 5 delegation and appointments made under s 6.

This Ordinance is an enabling cross-referencing instrument; understanding its interactions requires following the chain from the Ordinance to the ACT law it imports and to the Coral Sea Islands Act 1969, which it expressly recognises as the controlling Act.

Interaction with the Coral Sea Islands Act 1969

• The Ordinance defines "the Act" as the Coral Sea Islands Act 1969 (s 2(1)) and states its operation is "subject to the Act and subsection 2(2)" (s 3(1)). That reservation means the importation of ACT laws into the Territory is constrained to the extent the Coral Sea Islands Act imposes limitations or conditions. The Ordinance therefore functions as subordinate or complementary to the Coral Sea Islands Act; it does not purport to override the Act.

Interaction with laws of the Australian Capital Territory

• The Ordinance imports the "provisions of the laws of the Australian Capital Territory for the time being in force in the Australian Capital Territory" so far as they are "applicable to the Territory" (s 3(1)). Effectively, the content and operation of Territory law, post-Ordinance, will be whatever those ACT provisions provide, subject to applicability and the s 3(2) exclusion for ACT Acts. The Ordinance therefore creates a legal linkage in which ACT law that is not a provision of an ACT Act can be applied wholesale or in part to the Territory.

• The textual instruction in s 2(2) that references in an applied provision to "a Minister" be read as the Minister defined by the Ordinance reshapes Ministerial references in applied ACT law. That read-across aligns executive accountability for applied ACT law to the Commonwealth Minister rather than to an ACT Minister.

Interaction with pre-existing Territory laws

• s 7 provides that "all laws in force in the Territory immediately before the commencement of this Ordinance that are inconsistent with any applied provision are repealed." This is a direct conflict-resolution device: where a pre-existing Territory law conflicts with an applied ACT provision, the pre-existing law is removed. The Ordinance therefore gives applied provisions priority over inconsistent local rules at the time of commencement.

Limits and boundaries

• The express exclusion of ACT Acts (s 3(2)) creates a boundary. Primary legislation of the ACT that is a provision of an Act is not brought into operation by this Ordinance. This leaves two possible classes of ACT legal content for importation: (a) non-Act written laws (for example, subordinate instruments, regulations, ordinances) and (b) unwritten law or other legal rules "in force" in the ACT as defined in s 2(1). The Ordinance therefore does not create a blanket transfer of all ACT law; it is selective by its wording.

Delegation and inter-governmental exercise of powers

• s 4 and s 5 provide mechanisms to rearrange which person or authority exercises powers in the Territory. Those clauses allow the Commonwealth Minister to specify an alternate exercising authority (s 4) and to delegate powers to the Secretary to the Department of Home Affairs (s 5). In practice, that establishes a chain in which applied ACT law may be administered by Commonwealth officials. The Ordinance thus adjusts the locus of administration between ACT-origin institutions and Commonwealth departmental structures.

Judicial and court interactions

• s 4 excludes courts from the deeming of vested administrative powers ("not being a court"). The Ordinance does not create new courts nor modify judicial powers; it provides for executive administration. Any judicial scrutiny of the exercise of applied provisions in the Territory will be through whatever judicial mechanisms apply to the Territory’s legal order, but the Ordinance itself contains no text modifying judicial competence.

Practical drafting interaction

• Because the Ordinance applies ACT provisions "so far as applicable to the Territory," there is a gap-filling and filtering interaction: legal drafters and administrators must determine applicability on a provision-by-provision basis. The Ordinance leaves those applicability determinations to implementation and, potentially, to courts, where contested.

The compilation accompanying this Ordinance records the original Ordinance No. 1 of 1973 and later Ordinances that affected it. The Notes and tables in the compilation set out the following compilation history.

Table of Ordinances (as reproduced)

• No. 1, 1973 , notified 19 Oct 1973 , commenced 19 Oct 1973.
• No. 1, 1976 , notified 3 Dec 1976 , commenced 3 Dec 1976.
• No. 1, 1979 , notified 24 Dec 1979 , commenced 24 Dec 1979.

Table of Amendments (as reproduced)

• Provision affected: s 5 , How affected: amended (am.) by No. 1, 1976; No. 1, 1979.

Interpretation of the Notes supplied in this compilation

• The compilation states the Ordinance was prepared on 10 March 2002 "taking into account amendments up to Ordinance No. 1 of 1979." It therefore represents the text as amended by the 1976 and 1979 Ordinances to s 5. The Notes explicitly identify that s 5 has been amended in 1976 and 1979, but the compilation does not supply the text of the earlier variants; it supplies only the consolidated current text.

What the amendment history tells a reader

• The only part of the Ordinance the compilation records as having been amended is s 5 (delegation by Minister). The presence of those amendments suggests parliamentary or executive attention was focused on the delegation mechanics for the Minister’s powers under applied provisions. Because the compilation does not record amendment specifics beyond that s 5 was amended, the reader must rely on the consolidated text now included (s 5) to know the current delegation power: the Minister may, by writing under his hand, delegate to the Secretary to the Department of Home Affairs all or any of his powers under an applied provision.

• The Table of Ordinances shows the Ordinance and its amendments were notified and commenced in the 1970s. The compilation states it reflects amendments up to 1979. No later amendments are recorded in the supplied compilation.

Limitations of the compilation’s amendment record

• The compilation’s Notes are limited to the material presented. If further amendments occurred after 1979, they are not represented in the supplied compilation. The reader should treat the amendment table as the complete amendment history only insofar as the compilation asserts amendments up to 1979 and does not purport to be an up-to-date record beyond that date.

The supplied Ordinance compilation contains no recorded judicial decisions, cases, or litigation history related to this Ordinance. The Notes, Tables of Ordinances and of Amendments, and the Ordinance text itself do not cite any cases, nor do they summarise disputes or judicial interpretations.

What the absence of recorded litigation in the compilation means

• The absence of cases in the compilation does not establish that no dispute has ever arisen; it only shows no cases are recorded within the text and notes provided. Practitioners wishing to identify litigation engaging this Ordinance must therefore check court records and case law databases beyond the materials in this compilation.

Potential sources of litigation (text-based, not historical)

• The Ordinance’s language suggests several interpretive issues likely to generate litigation if contested, although no cases are recorded here. Those issues include (a) the scope of "so far as applicable to the Territory" in s 3(1) and how to determine applicability clause-by-clause; (b) the meaning and operation of s 3(2)’s exclusion of "a provision of an Act"; (c) the legal effect and limits of s 4’s deeming power and the Minister’s discretion to "specify" another person or authority to exercise the power; (d) the formal requirements and legal effect of delegations made under s 5 "by writing under his hand"; and (e) the implications of s 7’s repeal of inconsistent pre-existing Territory laws. Any real-world litigation would need to focus on text-based constructions of these clauses.

Issues a court might be asked to resolve

• Applicability: whether a particular ACT provision is sufficiently "applicable" to the Territory, such that it becomes an applied provision under s 3(1).

• Classification: whether a given ACT legal instrument qualifies as "a provision of an Act" for the purposes of the s 3(2) exclusion, or whether it is a subordinate instrument or other form of law that can be imported.

• Delegation formalities and limits: whether a delegation to the Secretary under s 5 met the "writing under his hand" requirement and whether the substance of any s 4 specification exceeded the Minister’s power.

• Repeal scope: determining whether a pre-existing Territory law is truly "inconsistent with any applied provision" such that s 7 effectually repealed it.

Because the compilation contains no judicial decisions, none are discussed or cited here. Practitioners must search external case-law resources for any judicial treatment.

This Ordinance’s brevity masks a number of practical and interpretive pitfalls that practitioners should watch for when advising clients or administering laws in the Territory. The following items are textual, administrative, and compliance "gotchas" grounded in the Ordinance’s language.

1. Act exclusion is narrow but potentially consequential (s 3(2))

• s 3(2) states subsection (1) does not extend to a provision of a law of the ACT that is "a provision of an Act." That exclusion means primary ACT Acts are not automatically applied to the Territory under this Ordinance. A practitioner cannot assume a named ACT Act provision is an applied provision without confirming whether it is one of the excluded "provision of an Act." The Ordinance does not define "Act" for this purpose beyond ordinary meaning; careful textual analysis will be required when determining whether an ACT instrument is an Act or another form of law.

2. Applicability test is open-ended (s 3(1))

• The Ordinance applies ACT laws "so far as applicable to the Territory." There is no definition or test in the Ordinance for "applicable to the Territory." Determining applicability will require analysis of whether the subject matter and operative text of the ACT provision make sense in the Coral Sea Islands Territory context. This could produce disputes and administrative uncertainty, particularly where an ACT provision presumes infrastructure, local institutions, or populations not present in the Territory.

3. Minister substitution power is broad (s 4)

• s 4 allows the Minister to specify "such other person or authority" to exercise a power that, for the ACT, is vested in someone else. The phrase "such other person or authority as the Minister specifies" is capacious. Practitioners should note that the Minister can centralise or reassign administrative authority for the Territory at his or her discretion; organisational charts and enforcement responsibilities may change without amendment to substantive law.

4. Delegation requires "writing under his hand" (s 5)

• Delegations under s 5 must be "by writing under his hand" to the Secretary to the Department of Home Affairs. That phrase imposes a formal requirement on the Minister. Delegations that fail to meet that formal requirement might be vulnerable to legal challenge as unauthorised or ineffective. Practitioners advising on delegations should ensure the formality is satisfied and recorded.

5. Repeal is retrospective only to commencement (s 7)

• s 7 repeals "all laws in force in the Territory immediately before the commencement of this Ordinance that are inconsistent with any applied provision." That is a cut-off test at commencement. Laws introduced after commencement are not automatically captured by s 7; their relationship with applied provisions depends on their content and later administrative choices. Advice should therefore consider timing and transitional issues.

6. References to "a Minister" reinterpreted (s 2(2))

• s 2(2) requires that any reference to "a Minister" in an applied provision be read as a reference to the Minister defined by the Ordinance. Imported provisions that assume an ACT Minister with particular statutory remit will instead be anchored to the Commonwealth Minister administering the Coral Sea Islands Act. That reinterpretation can change the identity of the decision-maker and the applicable conventions, including ministerial directions, procedural expectations and political accountability.

7. Courts explicitly excluded from s 4 substitution (s 4)

• s 4’s deeming of vested powers excludes courts ("not being a court"). The Ordinance therefore leaves judicial competence separate; powers that are judicial in nature cannot be reassigned by s 4. Parties relying on judicial procedures or seeking judicial remedies should recognise the Ordinance leaves the judicial role intact, but administrative jurisdiction may be reassigned.

8. The Ordinance is an importing device, not a content source (s 3(1))

• The Ordinance itself contains limited substantive rules. To determine what law applies in practice, one must identify the applied provisions from ACT law. This creates an evidentiary and drafting burden: practitioners must locate and track the relevant ACT provisions "for the time being in force" and assess their applicability.

9. Administrative capacity is left to executive action (ss 5-6)

• While the Ordinance authorises delegation and appointment of officers, it does not provide budgets, staffing levels, or operational procedures. The absence of explicit resource provisions means practical enforcement and administration depend on executive decisions, which may create implementation lags or variability in enforcement.

10. Repeal may remove local protections or sources of rights (s 7)

• Where pre-existing Territory laws provided local rights, privileges or procedural protections inconsistent with applied ACT provisions, s 7’s repeal may remove those local protections. Advisers must check pre-existing Territory laws for potentially lost rights.

These "gotchas" flow directly from the Ordinance’s phrasing and structural design (ss 2-7). They affect legal certainty, administrative allocation of power, and compliance obligations.

Compliance with the legal architecture established by this Ordinance requires two parallel lines of action: (A) for administrative actors and decision-makers who exercise or allocate power under the Ordinance; and (B) for private persons and entities operating in the Territory who must follow the applied ACT provisions.

A. For Ministers, delegates and officials (implementers)

1. Confirm the scope of applied provisions

• Compile and maintain an authoritative register of ACT provisions that are "for the time being in force" and assess each provision’s applicability to the Territory under s 3(1). Because the Ordinance imports ACT law "so far as applicable," an administrative assessment, recorded in a formal instrument or memorandum, should document the rationale for treating each provision as applied.

2. Observe the exclusion for ACT Acts

• For each candidate ACT instrument, assess whether it is "a provision of an Act" and therefore excluded by s 3(2). Maintain documentary evidence showing the legislative character of the instrument if its status could be contested.

3. Use formal delegations and specifications

• If the Minister wishes to delegate powers, comply with s 5’s formal requirement: delegate "by writing under his hand" to the Secretary to the Department of Home Affairs when delegating under s 5. Keep the delegation instrument on file and publish or otherwise make it available where necessary for accountability. When specifying "such other person or authority" under s 4 to exercise powers in the Territory, produce a written specification setting out scope and limits. These documents provide administrative clarity and resist legal challenge.

4. Appoint officers with clear briefs

• Use s 6 authority to appoint officers necessary to execute the laws of the Territory. Give appointees written instruments of appointment that set out delegated powers, reporting lines and recordkeeping obligations. Ensure employment terms comply with any relevant Commonwealth employment law or applicable administrative standards.

5. Document repeal consequences

• Where s 7 operates to repeal inconsistent pre-existing Territory laws, prepare a transition schedule identifying repealed provisions, their practical effects, and transitional measures to avoid regulatory gaps.

B. For private persons and commercial actors (compliance with substance)

1. Identify which ACT provisions apply to your activity

• Determine which ACT non-Act laws are applied to the Territory (reference the implementing register). Because the Ordinance does not itself list specific regulatory obligations, compliance requires identifying the applied provision’s substantive requirements, sanctions and procedural obligations.

2. Read ministerial references as directed

• Where an applied ACT provision delegates or conditions action on a decision by "a Minister," read that to mean the Minister administering the Coral Sea Islands Act (s 2(2)). That changes who to approach for statutory consents, approvals, or review.

3. Monitor administrative changes

• Track specifications under s 4 and delegations under s 5 that may reassign who issues permits or enforces obligations in the Territory. Administrative responsibility can shift; keeping abreast of those changes avoids compliance surprise.

4. Check for repeal of local rules

• Verify whether any pre-existing Territory laws that previously governed aspects of your operations have been repealed by s 7. Where a repeal has occurred, do not rely on prior local permissions or protections without confirming they remain in force.

5. Seek clarity on applicability

• If the applicability of a particular ACT provision to the Territory is uncertain, seek a formal administrative ruling, a public ruling from the Minister or delegate if available, or written advice. Where legal uncertainty cannot be resolved administratively, consider seeking judicial clarification.

C. Practical recordkeeping and evidence

1. Maintain a compliance file

• Keep copies of the applied ACT provisions relied upon, the Minister’s specifications under s 4 (if any), any delegations to the Secretary under s 5, appointment instruments under s 6, and any notices or guidance published about the application of ACT law to the Territory. These documents will be necessary to demonstrate compliance and to challenge or defend enforcement actions.

2. Use the formalities to challenge improper action

• If a delegation or specification is alleged but not evidenced in writing (for s 5) or authoritative specification (for s 4), those formal flaws may be relevant to administrative law challenges. Practitioners should check whether the required writing and recordkeeping exists.

D. Interaction with other legal advice

• Because the Ordinance imports other law rather than creating detailed substantive norms itself, compliance will often require specialist advice about the specific ACT provisions applied. Engage counsel or regulatory advisers who can read the applied ACT texts and translate them into practical obligations for operations in the Territory.

E. Administrative resourcing and enforcement readiness

• Administrators should budget for appointments and enforcement resources contemplated by ss 5-6. The Ordinance enables appointments and delegations but does not provide funding. Implementers should organise the administrative tools, staffing and operational procedures needed to enforce applied ACT provisions efficiently.

Summary checklist

• Identify applied ACT provisions and confirm their legal form (not an "Act") and applicability (s 3(1)-(2)).
• Record any Ministerial specifications reassigning administrative authority (s 4).
• Where delegating powers to the Secretary, ensure delegations are "by writing under his hand" (s 5).
• Appoint officers with clear instruments of appointment (s 6).
• Review pre-existing Territory laws for inconsistency and ensure transitional effects of repeal are managed (s 7).
• Maintain a compliance file evidencing these steps and seeking administrative clarification where ambiguity about applicability or delegated authority exists.

Following these steps aligns operational practice with the Ordinance’s textual requirements and the administrative mechanisms it creates (ss 2-7).
