ANZAC Day Act 1958Former title:Anzac Day Act 1958

The Act operates through a handful of recurring legal concepts and definitions that determine scope and compliance obligations.

Commemoration and protective objective (s 3). The statute expressly frames ANZAC Day as a commemoration. That textual purpose underpins subsequent restrictions: sport, film, entertainment and auction activity before 1 p.m. are controlled to protect the day’s commemorative nature (see s 4(1), s 5(1), s 5A(1), s 5AB(1)). The Act does not prescribe the content of commemoration beyond the definition; rather it vests gatekeeping discretion in the Minister (s 4(1), s 5(1), s 5A(3)).

Ministerial permits and approvals. Multiple provisions require written approval or permits from the Minister to undertake otherwise-prohibited activity: sports (s 4(1)), film exhibitions (s 5(1)), other entertainment (s 5A(1)). The Minister may impose conditions on a permit (s 5(2), s 5A(4)); persons holding a permit must comply with those conditions (s 5(3), s 5A(5)). For entertainment permits, the Minister may only grant if the applicant has paid any prescribed fee and the Minister is satisfied the event is a genuine commemoration or would not detract from the day’s commemorative nature (s 5A(3)).

Time-of-day cutoff. A consistent temporal boundary appears: no sports, films, entertainment or public auctions may be held or conducted before 1 p.m. on ANZAC Day unless permitted (s 4(2); s 5(1); s 5A(1); s 5AB(1)). The one p.m. threshold is the principal de facto regulatory instrument.

Definitions that determine coverage (Part 3, s 5B). The Act provides detailed statutory definitions that determine which workplaces have to close on ANZAC Day. “Factory” and “manufacturing process” are broadly defined to include two-or-more-person manufacturing premises, special manufacturing processes (steam/electric power, mixing involving lead compounds, baking bread or pastry for sale, confectionery, cereal foods, fish or poultry prepared for wholesale) and premises where electricity is generated or coal gas is made (s 5B). “Warehouse” means places where goods are sold or offered for sale by wholesale (s 5B). “Bread” and “yeast‑leavened dough” receive tailored definitions (s 5B).

Statutory exemptions and Orders. Schedule 2 sets out categories of exempt factories and warehouses, including newspaper printing/distribution, gas/electric supply, necessarily continuous processes, milk supply, pastry cooks and specific limited exceptions for bread factories (Sch 2). The Governor in Council may grant class-based exemptions by Order subject to parliamentary tabling (s 5D).

The ANZAC Day Proceeds Fund (s 4A). The Fund is a Treasury-held fund receiving monies required to be paid in by this Act and other Acts (s 4A(1)-(2)). The Act prescribes the annual distribution mechanism: all money standing to the Fund’s credit on 31 August each year (including interest) is to be disbursed to organisations whose principal object is ex-service community welfare before the end of the current financial year; distributions are to follow recommendations of the Victorian Veterans Council (s 4A(3)-(4)).

Officer accessorial liability (s 5E). The Act attaches criminal liability to officers of bodies corporate where the body commits an offence under s 5(1) (films), s 5A(1) (entertainment) or s 5C(1) (factory/warehouse closure) and an officer authorised, permitted, or was knowingly concerned in the commission. Officers may rely on defences available to the body corporate but bear the same evidential burden (s 5E(1)-(4)). Officer and body-corporate definitions are tied to the Corporations Act (s 5E(5)).

Inter‑statutory primacy language. The entertainment and film prohibitions are expressed to operate “despite anything in any other Act or a statutory rule” (s 5(1); s 5A(1)). That is, the Act displaces inconsistent subordinate or other statutory provisions for the regulated activities.

Penalties as enforcement mechanism. The Act uses two penalty regimes in different provisions: monetary fine caps in older sections (e.g., “not more than $1000” for sports-related contraventions, s 4(5)-(6)) and modern “penalty units” for film/entertainment/auction and factory closure offences (s 5(1) note: 100 penalty units; s 5A(5): 100 penalty units; s 5C(1): 100 penalty units; s 5AB(1): 100 penalty units). The Act also provides that s 5E applies to offences under the specified provisions (s 5E applies by note to s 5 and s 5A).

Collectively these concepts show the statute’s architecture: temporal and activity-based prohibitions enforced by criminal/penalty sanctions, mediated by Ministerial discretion and statutory exemptions, with a centralised Fund for proceeds. The precise content of several operative terms (“sports”, “entertainment”, “manufacturing process”, “warehouse”) determines practical coverage and therefore compliance obligations.

The Act affects a range of private and public actors by imposing operational constraints, administrative duties and potential criminal exposure.

Event organisers and sporting clubs. Any club, association, body corporate or person organising sports on ANZAC Day that admits persons on payment of a fee or after a donation has been sought falls within the sports definition and must obtain written Ministerial approval (s 4(1), (7)). The organiser must ensure events do not commence before 1 p.m. (s 4(2)), pay a directed portion of net profits to the ANZAC Day Proceeds Fund where the Minister so directs (s 4(3)), and supply a detailed, verified statement of receipts and expenditure within two months (s 4(4)). Failure to obtain approval or to comply with time, payment or reporting requirements triggers penalties up to $1000 and potential liability of managing committee members and directors (s 4(5)-(6)).

Venue operators and commercial entertainers. Cinemas and other venues showing films and persons providing entertainment are prohibited from showing films or providing entertainment before 1 p.m. without a permit (s 5(1); s 5A(1)). The prohibition applies to places where admission is on payment or after a donation is sought and to places where a commercial business supplies goods or services (s 5(1)(a),(b); s 5A(1)(a),(b)). Permit-holders must comply with conditions and applicants must pay any prescribed fee and satisfy the Minister about commemorative authenticity or non-detracting effect (s 5A(3)-(5)). Licensed premises (per Liquor Control Reform Act 1998 definition) are excluded from s 5A(1) at times when alcohol may be consumed in accordance with the licence (s 5A(2)).

Employers, occupiers of factories and warehouses. The occupier of a factory or warehouse is required to ensure the premises are closed and each employee given a whole holiday on ANZAC Day (s 5C(1)(a)-(b)). The obligation attaches to any premises meeting the statutory definition of “factory” or “warehouse” (s 5B). Schedule 2 lists exempt classes (e.g., newspaper printing, continuous processes, milk supply, pastry cook trade), and Governor in Council Orders may add exemptions (s 5D; Sch 2). Employees solely employed for safeguarding premises are excepted from the whole-holiday requirement (s 5C(3)). Occupiers who fail to comply commit an offence attracting 100 penalty units (s 5C(1) note).

Directors and officers of corporations. s 5E creates accessorial liability for officers of body corporates where the body commits an offence under s 5(1), s 5A(1) or s 5C(1) and the officer authorised, permitted, or was knowingly concerned. Officers include those described in s 9 of the Corporations Act and persons who take part in management (s 5E(5)). An officer can be prosecuted even if the body corporate has not been prosecuted (s 5E(4)). This affects corporate governance, insurance and risk allocation.

Victorian Veterans Council and ex-service organisations. The ANZAC Day Proceeds Fund is to be distributed to organisations whose principal object is ex-service community welfare and distributions follow the recommendations of the Victorian Veterans Council (s 4A(3)-(4)). Organisational beneficiaries are therefore recipients of statutory funding flows determined by the Council’s recommendations.

Minister, Governor in Council and Parliament. The Minister exercises approval and permit powers; the Governor in Council may grant exemptions by Order which must be laid before each House of Parliament (s 5D(1)-(2)). Those executive decisions shape local activity permissions and exemptions, and parliamentary scrutiny via tabling applies to exemptions (s 5D(2)).

Commercial sellers and auctioneers. Public auctions of land or businesses are prohibited before 1 p.m. on ANZAC Day except for online auctions that commenced earlier (s 5AB(1)-(2)). This affects timing of sales processes and property industry practice.

Regulators and prosecutors. The Act establishes offences and penalty items but does not name a specific enforcing agency. Enforcement will proceed through prosecutions under the Act; courts and regulators applying penalty-units and pecuniary penalties handle sanctions. Regulations may be made to support administration (s 6).

Indirectly affected actors include suppliers and customers whose commercial activity is time-sensitive (bakers, newspapers, electricity/gas suppliers subject to exemptions), insurers and professional advisers advising on compliance, as well as event insurers and venue managers who must accommodate permit conditions or restricted start times.

This section lists and explains the primary affirmative duties and permitted rights created or preserved by the Act, with statutory references.

Duty to seek Ministerial approval for sports (s 4(1)). No sports shall be held on ANZAC Day “except with the written approval of the Minister”. “Sports” is defined to include games, contests and exercises conducted where admission is on payment or after a donation; horse, trotting and dog races are excluded (s 4(7)). Duty-bearers include the club, association, body corporate or person by or on behalf of which sports are held, and managing committee members and directors carry secondary liability (s 4(5)-(6)).

Time-control duty (s 4(2); s 5(1); s 5A(1); s 5AB(1)). Sports, film exhibitions, other entertainment and public auctions of land/business must not commence or be conducted before 1 p.m. unless the Minister has granted a permit or approval. This is a bright-line operational duty for event timing.

Financial reporting and proceeds payment duties for sports organisers (s 4(3)-(4)). Where the Minister directs, a specified portion of net profits from approved sports must be paid within two months after the holding of the sports into the ANZAC Day Proceeds Fund (s 4(3)). Clubs/organisers must also supply a detailed statement of receipts and expenditure within two months, verified by statutory declaration (s 4(4)). These duties create an administrative reporting and cash-flow obligation.

Permits and conditions (s 5(2), s 5A(3)-(5)). The Minister may issue permits subject to specified conditions; permit-holders must comply with those conditions. For entertainment permits, the Minister’s discretion is constrained by the statutory tests: the event must be a genuine commemoration or must not detract from ANZAC Day’s commemorative nature, and prescribed fees must be paid (s 5A(3)(a)-(b)).

Duty to close factories and warehouses and grant holidays (s 5C(1)). Occupiers must ensure closure of the premises on ANZAC Day and that each employee receives a whole holiday. Exceptions exist in Schedule 2 and Orders under s 5D; safeguarding staff are excluded from the holiday requirement (s 5C(2)-(3)).

Duty to seek or observe statutory exemptions (ss 5C(2), 5D; Sch 2). Where an occupier claims exemption under Schedule 2 or by Governor in Council Order, the statutory mechanism must be followed. Orders must be tabled in Parliament (s 5D(2)), creating an administrative track for exemptions.

Financial and distribution duties of the Treasurer/administrators (s 4A). The ANZAC Day Proceeds Fund must be maintained in Treasury (s 4A(1)). Monies required to be paid into it by this Act, the Racing Act or other Acts must be paid in (s 4A(2)). All money standing to the credit at 31 August, including interest, must be distributed to ex-service welfare organisations before the end of the current financial year in accordance with the Victorian Veterans Council’s recommendations (s 4A(3)-(4)). This establishes fiscal timing and governance duties on administrators.

Accessorial liability duties for officers (s 5E). Officers of bodies corporate who authorise, permit or are knowingly concerned in the commission of specified offences commit an offence themselves (s 5E(1)-(2)). Officers may raise defences available to the body corporate (s 5E(3)), but legislative design places on officers a duty to supervise and to avoid knowingly enabling contraventions of ss 5(1), 5A(1), 5C(1).

Rights and permitted activities. The Act creates conditional rights: events may proceed earlier than 1 p.m. if a permit or written approval is obtained and conditions met (ss 4(1), 5(1), 5A(1)). Licensed premises are expressly exempt from the entertainment restriction during times when alcohol is permitted under their licence (s 5A(2)). Online auctions that have commenced prior to 1 p.m. and have not completed may continue (s 5AB(2)).

Regulatory discretion and safeguards. The Governor in Council may make regulations (s 6), the Minister may consult specified veterans’ organisations when authorising local distributions of sports proceeds for events more than 50 km from the Melbourne CBD (s 4(3)), and Orders exempting classes of factories must be tabled in Parliament (s 5D(1)-(2)). Those procedural requirements channel discretion into documented administrative actions.

Penalties and criminal consequences. Failure to meet duties triggers monetary penalties: “not more than $1000” for certain sports contraventions under ss 4(5)-(6), and 100 penalty units for film/entertainment/factory closure/auction offences where specified (s 5(1) note; s 5A(5); s 5C(1) note; s 5AB(1)). Where a body corporate commits an offence, officers can be prosecuted independently (s 5E(4)).

Taken together, these duties and rights create compliance levers: timing controls, permiting tests, reporting and payment obligations, definitional boundaries for workplace closure, and direct criminal exposure for individual officers involved in management.

The Act attaches pecuniary and criminal consequences to breaches of its substantive prohibitions and creates mechanisms for enforcement against both entities and individuals.

Penalty types and statutory amounts. The Act uses two forms of pecuniary sanctions:

• Specific dollar cap penalty: For contraventions of the sports provisions (sections 4(5) and 4(6)) the penalty is “not more than $1000.” Those provisions make the organiser (club/association/body corporate or person), managing committee members and directors liable to that cap unless they prove lack of wilful contravention or lack of knowledge/approval as applicable (s 4(5)-(6)).
• Penalty-unit-based penalties: For the film, entertainment, factory/warehouse closure and public auction offences the Act references 100 penalty units at the foot of the relevant subsections (s 5(1) note; s 5A(5); s 5C(1) note; s 5AB(1)). Penalty units are defined by the Penalty Units Act framework and change value over time; the Act therefore ties those offences to the contemporary penalty unit value.

Criminal liability of officers (s 5E). Section 5E creates accessorial liability so that an officer of a body corporate commits an offence where the corporate commits an offence under specified provisions and the officer authorised or permitted the commission or was knowingly concerned (s 5E(1)). The officer bears the same evidential burden in asserting defences as the body corporate would (s 5E(3)). Section 5E also permits prosecution of an officer whether or not the body corporate has been prosecuted or found guilty (s 5E(4)). These provisions expressly extend criminal exposure to individuals with managerial responsibility.

Procedural enforcement mechanisms. The Act does not designate a specific agency or regulator to enforce its provisions. Enforcement will occur via prosecution for statutory offences under the Act; costs and jurisdictional allocation reflect normal prosecutorial practice in Victoria. The Minister has permit and approval authority; the Governor in Council has power to make Orders exempting classes (ss 4(1); 5D(1)). Regulations may be made to address forms and other matters necessary to administer the Act (s 6), which could set out application forms, fees, or other procedural requirements for enforcement and compliance.

Defences and evidential allocations. The Act provides limited statutory defences in the sports provisions: no person is liable under ss 4(5)-(6) if it is shown the person did not act wilfully (s 4(5)) or that failure occurred without the person’s knowledge or approval (s 4(6)). For officers under s 5E, defences available to the body corporate are available to the officer but the officer bears the same burden of proof (s 5E(3)). There is no general reasonable excuse defence expressly written into the entertainment/film/factory provisions outside these statutory provisions.

Enforceability of financial directions. Section 4(3) requires directed portions of net profit from approved sports to be paid into the ANZAC Day Proceeds Fund within two months of the event. Non-compliance with s 4(3) is captured by ss 4(6) (penalty for failure to comply with subsections (3) or (4)). Organisers must supply verified financial statements within two months (s 4(4)); failing that attracts penalty exposure.

Parliamentary and administrative oversight. Orders exempting classes of factories or warehouses are subject to tabling in Parliament as soon as practicable after they are made (s 5D(2)). This gives a parliamentary oversight mechanism for exemptions though the Act does not prescribe parliamentary veto power.

Practical enforcement contours. In practice, enforcement will operate through notice and prosecution. The Act’s “despite anything in any other Act” language for entertainment and film (s 5(1); s 5A(1)) means that conflicts with other legislation do not limit prosecutorial action under this Act. The officer-liability provisions in s 5E permit direct action against managers and directors, which shifts enforcement leverage from corporate-only to individual-level accountability.

Risk allocation. The Act places significant compliance risk and potential criminal exposure on event organisers, employers of factories/warehouses, and corporate officers. Enforcement is structured as criminal/penal prosecution rather than administrative fines only, which affects practical consequences (criminal records, potential sentencing outcomes, and reputational effects) though the statute itself predominantly specifies pecuniary outcomes rather than custodial penalties.

The Act is drafted to interact with, and to take precedence over, some other legislative frameworks in particular contexts, while also being integrated into broader statutory networks for definitions and penalties.

Express primacy over other Acts and statutory rules for film and entertainment. Sections 5(1) and 5A(1) state that the prohibitions operate “despite anything in any other Act or a statutory rule (within the meaning of the Subordinate Legislation Act 1994).” That language is explicit displacement: where another Act or subordinate instrument permits films or entertainment earlier in the day, the ANZAC Day Act’s prohibition will prevail for covered venues and activities unless a Ministerial permit is obtained (s 5(1); s 5A(1)).

Cross-references to the Corporations Act for officer definitions and to the Liquor Control Reform Act for licensing. Section 5E borrows the terms “body corporate” and “officer” with reference to definitions in the Corporations Act (s 5E(5)) and section 5A(2) exempts licensed premises within the meaning of the Liquor Control Reform Act 1998 when alcohol may be consumed. These cross-references integrate the Act with broader corporate and liquor regulatory frameworks and influence who is subject to officer liability and which venues may lawfully host entertainment notwithstanding s 5A(1).

Interaction with the Racing Act and other Acts for Fund receipts (s 4A(2)). The ANZAC Day Proceeds Fund receives monies required by this Act, the Racing Act 1958 or any other Act (s 4A(2)). The table of provisions and endnotes list the Racing Act as relevant, showing specific cross‑statutory funding relationships. Funds originating in other Acts are therefore channelled into the ANZAC Day Proceeds Fund and distributed under s 4A(3)-(4).

Overlap with Public Holidays Act and Shop Trading Reform. The endnotes identify related legislation that contains references to ANZAC Day, including the Public Holidays Act 1993, Shop Trading Reform Act 1996, Gambling Regulation Act 2003 and Liquor Control Reform Act 1998. The Act itself notes that nothing in s 4 affects Sunday law but otherwise that the sports provisions operate notwithstanding anything in any Act, regulation or by‑law (s 4(8)). Interplay with shop trading and public holiday rules therefore requires reading both Acts where retail trading and public holiday pay entitlements may arise.

Penalty‑unit framework. The Act uses penalty units for several offences (e.g., s 5(1) note; s 5A(5); s 5C(1) note; s 5AB(1)). Penalty unit values are set in other legislation (Penalty Units Act or relevant Victorian framework), so monetary exposure under the Act will vary with changes to that external scale.

Orders and parliamentary oversight. Exemptions made by the Governor in Council under s 5D must be published in the Government Gazette and laid before each House of Parliament (s 5D(1)-(2)), engaging procedures from the Subordinate Legislation Act and parliamentary tabling requirements.

Relationship with Crimes Act accessorial provisions. Section 5E(6) states that the section does not affect the operation of Subdivision (1) of Division 1 of Part II of the Crimes Act 1958. That means the Act’s accessorial liability provisions are additional to, and do not displace, existing accessorial liability in the Crimes Act; prosecutors may proceed under both statutory regimes where relevant.

Regulatory instruments permitted. Section 6 allows the Governor in Council to make regulations for forms and “any other matter or thing…necessary to be prescribed to give effect to this Act.” This creates a pathway for subordinate instruments to define procedural details, fees and forms, and interact administratively with other statutes.

Transitional and amendment interactions. Section 7 deems the ANZAC Day Proceeds Fund to be the same as the Fund prior to the 2003 amendments, which is an internal continuity device. Section 8 clarifies the temporal application of s 5E in light of the Statute Law Amendment (Directors’ Liability) Act 2013, aligning the Act with changes in directors’ liability law.

In sum, the Act is both self-contained and interdependent: its prohibitions displace inconsistent subordinate or other Acts for certain regulated activities, it borrows definitions and operational infrastructure from other statutes (Corporations Act; Liquor Control Reform Act), and it channels funds from other Acts into a dedicated Treasury fund subject to specific distribution rules. Practitioners must therefore read the ANZAC Day Act in tandem with the Corporations Act, Liquor Control frameworks, the Racing Act where funding overlaps, and subordinate legislation/regulations which may implement procedural detail.

The Act has a long amendment history; the endnotes to the consolidated text list the principal amending Acts and where they changed the statute. Key changes and their mechanical effects are as follows; specific section citations are provided to where the current text reflects those amendments.

Original Act and commencement. The Anzac Day Act 1958 (assented 30 September 1958) came into operation 1 April 1959 (Endnotes, 1). The 1958 Act was the consolidating statute replacing the Anzac Day Act 1928 (Schedule 1).

1960-1987 early amendments. The Anzac Day Act 1960 (No. 6607/1960) and subsequent amending Acts through the 1970s and 1980s adjusted provisions. The Youth, Sport and Recreation Act 1972 (No. 8344/1972) and the Anzac Day (Amendment) Act 1987 (No. 2/1987) made changes captured in the consolidated text to s 4 and related sections (see Table of Amendments).

1993 Public Holidays Act interactions. The Public Holidays Act 1993 (No. 119/1993) is listed as containing references to ANZAC Day and represents an important contextual amendment to public holiday law affecting how ANZAC Day functions in workplace and trading law (Endnotes).

2002-2003 modernisation and renaming. The Theatres (Repeal) Act 2002 and the ANZAC Day (Amendment) Act 2003 (No. 96/2003) modernised and reorganised the Act. The 2003 amendments changed the Act’s name to the stylised ANZAC Day Act 1958 and inserted or amended headings and several operative subsections (see text notes adjacent to ss 1, 3, 4, 5, 5A and others). The 2003 reforms also introduced the ANZAC Day Proceeds Fund wording continuity (s 7).

2004-2006 financing and distribution change. The Racing and Gaming Acts (Amendment) Act 2004 and the Veterans Act 2005 (No. 98/2005) materially altered the ANZAC Day Proceeds Fund mechanics. Section 4A(2) now requires payment into the Fund of moneys required by this Act, the Racing Act 1958 or any other Act; s 4A(3)-(4) (inserted by No. 98/2005 s 87) prescribes the annual distribution of the Fund’s balance on 31 August to welfare organisations and requires distributions to be made in accordance with recommendations of the Victorian Veterans Council.

2008 labour and industry reforms. The Labour and Industry (Repeal) Act 2008 (No. 62/2008) restructured Part 3, inserting ss 5B-5D and Schedule 2 which define “factory”, “manufacturing process”, “warehouse”, and list classes of exempt factories and warehouses. Those insertions are the current statutory basis for workplace closure and exemption mechanics (ss 5B-5D; Sch 2).

2013 directors’ liability reform. The Statute Law Amendment (Directors’ Liability) Act 2013 (No. 13/2013) inserted s 5E, creating explicit accessorial liability for officers in relation to specified offences (s 5E). Section 8 of the Act contains a transitional provision confirming temporal application (s 8).

2015 clarification. The Justice Legislation Amendment Act 2015 (No. 20/2015) amended s 5E(6) to clarify that s 5E does not affect certain provisions of the Crimes Act (endnotes identify commencement date).

2019 auction and taxation amendments. The Sale of Land Amendment Act 2019 (No. 14/2019) inserted s 5AB (public auctions), prohibiting public auctions of land or business before 1 p.m. on ANZAC Day and providing an express carve-out for online auctions that started earlier (s 5AB(1)-(3)). The State Taxation Acts Further Amendment Act 2019 (No. 46/2019) amended s 4A(2) (commencement 1.1.20) to include moneys which are required to be paid into the Fund by “this Act, the Racing Act 1958 or any other Act” (s 4A(2)).

2024 sporting legislation amendment. The State Sporting Legislation Amendment Act 2024 (No. 28/2024) made amendments to the sports provisions (ss 3, 4 of that amending Act commenced 21 August 2024) and the consolidated text shows updated subsection numbering and content in s 4(3)-(6) and s 5 changes. The 2024 amendments are reflected in the current s 4 provisions governing time of commencement, profit payments, reporting, and penalties.

Cumulative effect. The amendment history shows evolution from an older regime focused largely on curfew-style prohibitions to a modern statutory architecture incorporating funding flows (ANZAC Day Proceeds Fund), clearer workplace definitions and exemptions (s 5B; Sch 2), administrative authorisations and conditions (Ministerial permit regime) and explicit personal liability for officers (s 5E). The table of amendments in the endnotes provides dates and amending instruments that are the source for these textual changes.

For practitioners, key milestones to note are the insertion of the detailed factory/warehouse definitions and Schedule 2 in 2008, the creation of s 5E in 2013, the auction prohibition in 2019, and the 2024 sporting amendments. Each of those amendments changed who is regulated, the administrative mechanics and the enforcement exposure.

The consolidated Act and its endnotes do not cite any judicial decisions or a body of case law applying the ANZAC Day Act 1958. The statutory text and endnotes provide no named litigation history. That absence of cases in the text means analyses of potential judicial development must be framed as areas where litigation is plausible rather than as summaries of decided authorities.

Plausible areas for dispute under the Act. The Act’s text creates a number of interpretive issues that are candidates for future litigation or administrative review:

• Definition scope litigation: The statutory definitions in s 5B (e.g., “factory”, “manufacturing process”, “special manufacturing process”, “warehouse”) are detailed but broad. Disputes are possible over whether a particular premises or activity falls within the definition, especially for hybrid businesses (e.g., premises combining retail and wholesale functions, or activities with intermittent manufacturing). Schedule 2 lists exemptions that could be the subject of disputes about whether a particular operation falls within a listed class.
• “Genuine commemoration” standard: Section 5A(3)(b)(i) allows the Minister to grant a permit if the provision of entertainment “is a genuine commemoration of ANZAC Day.” That standard is inherently evaluative and discretionary, and could give rise to administrative-law challenges on procedural fairness, reasonableness or jurisdictional error grounds if applicants allege the Minister misapplied the statutory test.
• “Would not detract from, or adversely affect, the commemorative nature” test: Section 5A(3)(b)(ii) allows the Minister to authorise non‑commemorative entertainment that would not detract from commemoration. Disputes may arise over what constitutes “detract from” or “adversely affect”, particularly in edge cases involving commercialised memorial events.
• Officer liability and proof standards: Section 5E makes officers criminally liable if they authorised or permitted the offence or were “knowingly concerned” in it. Litigation could test the evidential thresholds for “knowingly concerned” and for the defence where the officer relies on a defence the corporate body could raise.
• Interaction with other statutory regimes: The express “despite anything in any other Act” wording (s 5(1); s 5A(1)) could be litigated where a statutory right from another Act appears to conflict, especially in contexts where a licence or permit under another Act authorises activity that this Act prohibits.
• Timing and financial compliance: Section 4(3)-(4) requires payment and financial reporting within two months; disputes could arise where organisers disagree on the Minister’s direction about the portion of net profit to be paid or the calculation of “net profit”.

Potential remedies and adjudicators. Challenges to the Minister’s permits or decisions would be brought as administrative law proceedings in the Victorian Supreme Court or by internal administrative review depending on the availability of merits review and the statutory regime in place at the time (not specified in the Act). Criminal prosecutions for offences under the Act would proceed through the criminal courts; offences involving officers under s 5E would likely be prosecuted in the relevant criminal jurisdiction. Where Orders under s 5D are made by Governor in Council, parliamentary scrutiny provides a political check; legal challenges might focus on the validity of Orders if they exceed statutory power.

Absence of recorded case law in the Act may reflect that disputes have been resolved administratively, litigated but not cited in consolidation, or not yet tested in reported decisions. Practitioners should therefore treat many aspects of the Act as having potentially unsettled interpretive questions and plan for risk mitigation rather than relying on settled judicial doctrine. Administrative decision-making transparency (reasons for permits, documentation of consultation) will be relevant if any challenge occurs.

This section highlights practical pitfalls that arise directly from the statutory text and structure. Each item is grounded in the Act’s current provisions.

Timing and two-month deadlines. For approved sports, organisers must pay any Minister‑directed portion of net profits into the ANZAC Day Proceeds Fund “within 2 months after the holding of the sports” and must supply a detailed statement of receipts and expenditure within 2 months, verified by statutory declaration (s 4(3)-(4)). In practice organisers need to allow for accounting close‑off timelines, audit or verification delays, banking transfer times and statutory declaration execution. Missing the two‑month window exposes organisers and committee members to penalty under s 4(6).

Different penalty regimes in the Act. The sports provisions use a specific dollar maximum (“not more than $1000” , s 4(5)-(6)), whereas the film, entertainment, factory closure and auction offences use penalty units (notably 100 penalty units cited at footnotes to ss 5(1), 5A(5), 5C(1) and s 5AB(1)). Practitioners must check the current value of a penalty unit when calculating exposure, because the monetary consequence of “100 penalty units” can be materially different at different points in time.

Ministerial discretion and evidential record. The Minister’s power to approve sports and to issue entertainment/film permits is discretionary and may be conditioned (ss 4(1), 5(2), 5A(4)). For events requiring the Minister’s satisfaction that the entertainment is a “genuine commemoration” or would “not detract from” commemoration (s 5A(3)(b)), organisers should prepare a factual and documentary record demonstrating commemorative intent and content. A weak application record increases the risk of refusal and of subsequent allegations of non‑compliance.

Scope of “sports” depends on admission/payment/donation. The statutory definition of “sports” (s 4(7)) captures events “held on any ground or in any building to which persons are admitted on payment of an admission fee or charge or after any donation has been sought from them for the purpose of witnessing the same.” Free events with voluntary donations might still be captured if donations are “sought.” Likewise, commercial sponsorship or venue fee arrangements could trigger coverage. Organisers running non‑ticketed community events should scrutinise whether they fall within the definition.

Licensed-premises carve-out narrowness. Section 5A(2) excludes entertainment provided at licensed premises at a time when alcohol may be consumed in accordance with the particular licence (s 5A(2)). That exemption is limited to the consumption window authorised by the licence; events at a licensed venue outside those permitted drinking times are not exempt and would therefore require a permit if before 1 p.m.

Online auctions exception is narrowly drawn. Section 5AB(2) allows online public auctions that have commenced but not completed before 1 p.m. to continue. This does not authorise starting an online auction before 1 p.m. that had not already commenced; it only protects auctions that are already in progress. Sellers and platforms should ensure bidding start times and catalogue listings comply.

Factory/warehouse definitions catch‑alls. The Act’s definitions in s 5B are broad: for example, “factory” includes premises where “any manufacturing process is carried on and 2 or more persons are directly employed,” and “special manufacturing process” includes baking bread or pastry “for trade or sale” (s 5B). Many small businesses that routinely operate on ANZAC Day may fall into these definitions unless a Schedule 2 exemption applies. Employers must check these definitions carefully rather than assuming the premises fall outside the Act.

Bread factory exception technicalities. Schedule 2 provides narrow exemptions for bread factories “while dough only is being prepared” or “after 8 p.m. when ANZAC Day falls on a Friday.” This creates operational timing nuances: an operation that completes baking before 1 p.m. but also prepares dough or bakes earlier may still be caught outside those narrow windows unless the activity matches an exemption precisely.

Officer liability even where corporation not prosecuted. Section 5E(4) allows officers to be prosecuted whether or not the corporate has been prosecuted or found guilty. That means corporate risk management and insurance assumptions that rely on proceeding only against corporates are inadequate; officers should be aware of direct criminal exposure for managerial decisions that authorise or permit contraventions.

Parliamentary tabling for exemptions but no guarantee of effective scrutiny. The Governor in Council may exempt classes of factories or warehouses (s 5D(1)), but the sole parliamentary control is a requirement that Orders be laid before each House as soon as practicable (s 5D(2)). There is no express requirement for affirmative parliamentary approval, creating a potential gotcha where stakeholders assume stronger parliamentary oversight than the Act requires.

Interaction with other statutes not eliminated for all provisions. Although s 5(1) and s 5A(1) operate “despite anything in any other Act or a statutory rule,” s 4 has its own “notwithstanding anything in any Act regulation or by‑law” clause limited to Sunday law (s 4(8)). Practitioners must not assume blanket displacement of other laws in every context; cross-check the precise non‑derogation language in each provision.

Reporting verification formality. The requirement that statements be “verified by statutory declaration” (s 4(4)) is a formal legal step; incorrect execution can invalidate compliance with the reporting duty and invite liability. Organisers should ensure statutory declarations are executed to statutory formalities.

These “gotchas” underscore the need for planners, employers and corporate officers to map practical activity timelines to the Act’s precise language, to document Ministerial communications and permits, and to treat officer liability as a live exposure rather than a theoretical risk.

This section sets out concrete steps and a compliance checklist for the principal regulated actors: event organisers (sports and entertainment), cinema and venue operators, auctioneers, occupiers of factories/warehouses, and officers of corporations. Each action is tied to the statutory provision it addresses.

For sports organisers (s 4)

• Determine whether the event falls within the statutory definition of “sports” (s 4(7)): does admission require payment or is a donation actively sought? If yes, apply for written Ministerial approval before holding the event (s 4(1)).
• Plan event start times to ensure no race, match, game, exercise or other event commences before 1 p.m. (s 4(2)).
• Budget for potential Fund payments: be prepared to pay any portion of net profit as directed by the Minister into the ANZAC Day Proceeds Fund within two months after the sports (s 4(3)).
• Prepare accounting systems to produce a detailed statement of receipts and expenditure and ensure the statement can be verified by statutory declaration by authorised signatories (chairman/president and secretary/treasurer, or equivalent) within two months of the event (s 4(4)).
• Keep contemporaneous records and communications with the Minister regarding any direction on profit payments, and, where events occur more than 50 kilometres from the Melbourne CBD, be ready to document consultation with the president of the Victorian branch of the RSL if the Minister authorises local disbursement (s 4(3)).

For cinema and film exhibitors (s 5)

• Do not show films before 1 p.m. on ANZAC Day to places admitting persons on payment or following solicitation of donations unless you hold a written permit from the Minister (s 5(1)).
• If applying, pay any prescribed fee, obtain the permit in writing and ensure all permit conditions are documented. Comply with conditions; non‑compliance is an offence (s 5(2)-(3)).
• Retain permits and supporting documentation on premises for inspection.

For other entertainment and venue operators (s 5A)

• Determine whether your activity is “entertainment” within the statutory meaning (s 5A(8)), and whether the place meets the admission/payment/donation or commercial business criteria in s 5A(1).
• If the activity falls within s 5A(1), obtain a written permit from the Minister. The Minister may only grant a permit if any prescribed fee is paid and the event is a genuine commemoration or would not detract from commemoration (s 5A(3)). Prepare an application that documents commemorative content, program, and audience nature.
• Note the licensed-premises exception: if you operate licensed premises and alcohol may be consumed under the licence at the time in question, s 5A(2) applies; nevertheless verify licence conditions carefully.

For auctioneers and sellers of land/businesses (s 5AB)

• Do not conduct a publicly advertised auction of land or a business before 1 p.m. on ANZAC Day (s 5AB(1)).
• If using online auction platforms, ensure that the auction has legitimately commenced before 1 p.m. if you intend to continue past 1 p.m.; otherwise schedule start times accordingly (s 5AB(2)).

For occupiers/employers of factories and warehouses (ss 5B-5C; Sch 2)

• Map your premises and operations against the definitions in s 5B to determine if they qualify as a “factory” or “warehouse.” Key attention points: if two or more persons are directly employed in a manufacturing process, or if activities include special manufacturing processes (baking bread/pastry for trade, confectionery, cereal food manufacture, fish/poultry processing for wholesale), you will likely be covered (s 5B).
• Check Schedule 2 for statutory exemptions (newspapers, gas/electric supply, necessarily continuous processes, milk supply, pastry cook trade, specific bread factory exceptions). If you claim a Schedule 2 exemption, document how your operations match the schedule criteria (Sch 2).
• If you seek a Governor in Council exemption under s 5D, prepare materials for the Order application and be prepared for tabling in Parliament (s 5D(1)-(2)). Note that the Order-making power is discretionary and administrative.
• If covered by s 5C, ensure the premises are closed and each employee is given a whole holiday on ANZAC Day; employees solely employed for safeguarding the premises are excluded from the holiday requirement (s 5C(1)-(3)). Update payroll and rostering systems to reflect the required holiday and any public‑holiday pay entitlements determined under industrial instruments or other statutes.

For corporate officers (s 5E)

• Implement governance controls and compliance checklists to prevent the corporation committing offences under s 5(1), s 5A(1) or s 5C(1). Officers should ensure they do not “authorise or permit” prohibited conduct and must avoid being “knowingly concerned” in contraventions (s 5E(1)).
• Maintain records of decisions, permit applications, approvals and legal advice to demonstrate that officers exercised due diligence. In prosecutions, an officer may rely on any defence available to the corporate but bears the same burden (s 5E(3)).
• Review directors’ and officers’ insurance and indemnity arrangements in light of potential criminal exposure.

Administrative and documentation checklist

• Permits and approvals: apply for Ministerial written approval/permits early; ensure payment of any prescribed fees; retain permit letters and condition lists.
• Financial controls: for sports, ensure accounting systems can deliver the verified statement within two months and process Fund payments promptly.
• Records: retain statutory declarations, minutes, correspondence with the Minister, and evidence of consultations (e.g., with the Victorian branch of the RSL when applicable).
• Legal review: seek legal advice when an activity’s status is uncertain under s 5B definitions or Sch 2. Document the legal basis for any exemption reliance.
• Communication and scheduling: plan event start times and operational shifts to avoid inadvertent pre‑1 p.m. activity. For online auctions and digital sales processes, confirm platform start times and terms to avoid running afoul of s 5AB.

Regulatory monitoring and regulatory instruments (s 6)

• Monitor the Government Gazette and Departmental guidance for regulations, forms, prescribed fees and Orders under s 5D. Regulations may set out procedural detail necessary for compliance.

By aligning operations with the statutory deadlines and definitions, securing permits where required, and documenting decision-making and financial flows, event organisers, venue operators, factory employers and corporate officers can materially reduce legal exposure under the Act.
