37 Exemption – irrelevant criminal record (1) A person may discriminate against another person on the grounds of irrelevant criminal record in the area of work if: (a) the work principally involves the care, instruction or supervision of vulnerable persons; and (b) the discrimination is reasonably necessary to protect the physical, psychological or emotional well-being of those vulnerable persons, having regard to all of the relevant circumstances of the case including the person's actions. Anti-Discrimination Act 1992 31 (2) In subsection (1): vulnerable persons includes children, aged persons and persons with a physical or intellectual disability or mental illness.
