123 Application of amendments (1) The amendments made by the amending Act do not apply to prohibited conduct or systemic discrimination that took place before the commencement. (2) Subsection (1) does not prevent evidence of conduct that took place or practices that were used before the commencement being taken into account in determining whether prohibited conduct or systemic discrimination occurs after the commencement. (2) For subsection (1), if any of the conduct constituting an offence occurred before the commencement, the offence is taken to have been committed before the commencement.
