109A Inducement to publish advertisement (a) the person makes a statement to another person; and (b) the person knows the statement is misleading; and (c) in making the statement, the person intends to induce the other person to publish or display an advertisement; and (d) the advertisement would contain prohibited conduct or an intention to engage in prohibited conduct. misleading, in relation to a statement, means a statement that is misleading in a material particular or because of the omission of a material particular.
