ANIMAL PROTECTION REGULATIONS 2022

The Regulations operationalise several statutory concepts from the Act by prescription, specification and procedure. Several core concepts recur and determine duties, rights and enforcement outcomes.

Codes of practice: Regulation 4 adopts specific external documents as codes of practice “relating to animal welfare” for the purposes of section 20 of the Act. Schedule 1 is divided into Part A (documents adopted as in force on 1 November 2022) and Part B (documents adopted as in force on the day section 19 of the Animal Protection and Related Legislation Amendment Act 2025 commences). The effect is to make specific, enumerated standards statutory referents for welfare obligations and compliance action. The adoption is by reference to particular editions and versions for Part A and to the in-force versions of Part B on a specified commencement day; the Regulations therefore fix which textual versions govern.

Cruelty by device use: Regulation 5 prescribes conduct that constitutes cruelty for section 24(5)(b) of the Act. It does three things. First, for electrical devices that are not “excluded electrical devices” (see regulation 9 and Schedule 2), it expressly prescribes as cruelty the use of the device against the face, udders, anus or genitals of an animal (regulation 5(a)). Second, it prescribes the use of an electrical device (other than an excluded device) on an animal under 3 months of age as cruelty (regulation 5(ab)). Third, it makes use of an excluded electrical device contrary to the restrictions in Schedule 2 criminally culpable as cruelty (regulation 5(b)). Those provisions turn two types of conduct into prescribed cruelty: improper use of non-excluded electrical devices, and improper use of excluded devices outside their permitted scope.

Excluded electrical devices and conditional legality: Regulation 9 delegates to Schedule 2 a closed list of electrical devices that are “excluded” from the generic prohibition if they are made or adapted and used for the specified purpose, used on the specified animals, and used in accordance with specified conditions. Schedule 2 lists devices such as electric stock prods, electric stunning devices for abattoirs, certain electric training collars (specifically excluding collars operated by remote control devices), electro-ejaculators, electro-immobilisers, electro-stunners for crocodiles, electronic fencing systems using collars and transmitters for containment, and virtual fencing systems using collars and GPS for livestock. Each item specifies permitted species and purposes and lists express prohibitions (for example not against face, udders, anus or genitals; not on animals under 3 months; not as an alternative to analgesia where the latter is preferred). The Schedule repeatedly conditions lawful use on adherence to manufacturer’s instructions.

Prohibitions and limited exceptions: The Regulations mark specific practices as prohibited or restricted. Regulation 8 prescribes a prohibited trap: an adhesive glue layer on a base material intended to capture live rodents. Regulation 7 excludes certain poisoning conduct from the offences in section 28(1)-(4) of the Act, where the laying of poison is by a person authorised under particular Acts (Agricultural and Veterinary Chemicals (Control of Use) Act 2004; Medicines, Poisons and Therapeutic Goods Act 2012; or another Territory or Commonwealth law) or where a residential occupier lays rat poison inside an enclosed residence meeting defined conditions (regulation 7(b)).

Administrative structures and reporting: The Regulations set out the Advisory Committee membership by appointing entities to make specified appointments (regulation 10). The Committee must hold at least two meetings each financial year and prepare an annual report by 30 September for the financial year ending the previous 30 June (regulations 15 and 17). For scientific use of animals, registration application and renewal fees are prescribed as 83 revenue units (regulation 18). Registered persons and accredited animal ethics committees must prepare annual reports containing prescribed information such as project names, purposes, durations, descriptions, places, number and class of animals, sources, housing locations, and particulars of complaints, inspections and breaches (regulations 19-20).

Enforcement architecture: The Regulations identify which Act provisions can be enforced by infringement notices and set infringement amounts in Schedule 3 as penalty units (regulation 21 and Schedule 3). Authorised officers may issue an infringement notice where they reasonably believe an offence occurred (regulation 22). Notices must contain specified information and a statement of rights (regulation 23); payment within 28 days expiates the offence (regulation 25). There is provision to withdraw notices (regulation 26) and explicit preservation of court prosecution powers and higher penalties (regulation 27). Improvement notices must contain specified particulars and advise of the right of review to NTCAT (regulation 28).

Interplay with prior law and transition: Part 5 prescribes transitional arrangements to convert pending licence and permit applications under the repealed Act into registration and project approval applications under the current Act (regulations 31-32). It continues existing advisory committee members and chairpersons into the new Advisory Committee framework (regulation 33) and revokes adoptions of codes under the repealed Act while temporarily leaving licences subject to revoked codes until the earlier of licence amendment or one year (regulation 34).

The Regulations create obligations and affect a range of actors in the Territory’s animal-related economy, research sector and regulatory architecture. The immediate categories of affected persons and entities, with the primary instrument provisions that create the impact, are:

• Livestock producers, transporters and mustering operations: Schedule 2 item 1 permits electric stock prods to be used on cattle, crocodiles, buffalo, camels, swine, goats or sheep for driving, herding, mustering or control, but prohibits use on specified body parts, animals under three months, or diseased/injured animals, and requires manufacturer’s-instruction compliance. The adoption of land transport and livestock codes in Schedule 1 (e.g. Australian Animal Welfare Standards and Guidelines - Land Transport of Livestock; Australian Animal Welfare Standards and Guidelines for Cattle) means producers must align practices with these codes where they are applied under the Act (regulation 4, Schedule 1).

• Abattoir operators and slaughterhouses: Schedule 2 item 2 permits electric stunning devices for specified livestock in abattoirs provided the prohibited body parts and age limits are respected and manufacturer’s instructions followed. Operators must therefore ensure devices comply with Schedule 2 conditions and relevant codes (regulation 9 and Schedule 2).

• Veterinarians, research institutions and registered persons: The Regulations prescribe registration fees (regulation 18) and detailed annual-reporting obligations for registered persons using animals for scientific purposes (regulation 19). Charles Darwin University and other research stakeholders have explicit representation on the Advisory Committee (regulation 10(g)). Electro-ejaculators and specified devices have listed permitted uses (Schedule 2 items 4), which affects semen-collection practices.

• Animal ethics committees and accredited committees: The Regulations require accredited animal ethics committees to prepare annual reports containing committee membership, qualifications under the scientific use code, application and approval statistics, inspection findings, compliance actions and breaches of adopted codes (regulation 20). This increases administrative obligations for ethics committees.

• Dog trainers, pet owners and pet industry operators: Schedule 2 item 3 allows “electric training collars (excluding collar operated by remote control device)” for training dogs subject to constraints. Electronic fencing systems using collars and transmitters are permitted for containment of dogs or cats (Schedule 2 item 7) with prohibitions and manufacturer-instruction conditions. Notably, collars operated by remote control are explicitly excluded from the permitted “electric training collar” category, which affects trainers using remote-operated e-collars. The pet industry is also affected by codes in Schedule 1 (e.g. Guidelines for the Care and Welfare of Animals in Retail Pet Shops; Standards and Guidelines for Boarding and Doggy Day Care centres).

• Pest control operators and householders: Regulation 8 prescribes that adhesive glue-layer traps intended to capture live rodents are prohibited traps. Regulation 7 provides narrow exemptions for laying poison (authorised users under certain Acts and occupiers laying rat poison in enclosed residences), which affects pest-control practice and domestic pest management.

• Industry representative bodies and regulators: The Advisory Committee composition requires appointments by the RSPCA NT, Australian Veterinary Association, Local Government Association, Agency responsible for the Act, primary industry agency (if different), Northern Territory Cattlemen’s Association, Charles Darwin University, Parks and Wildlife Commission, Animal Management in Rural and Remote Indigenous Communities Ltd (AMRRIC), and allows Ministerial appointment of others (regulation 10). These appointments institutionalise representation of certain interests, creating both formal consultative roles and responsibilities to supply members and to accommodate Committee processes (regulations 10-16).

• Ministers and public agencies: The Minister retains appointment and termination powers (including detailed grounds for termination in regulation 14), and the Agency is both a member appointer and a subject of reports and activities. The Regulations preserve agency discretion in enforcement, including authorised officers issuing infringement notices (regulations 22-23) and issuing improvement notices (regulation 28).

• Holders of existing licences and applicants under the repealed Act: Transitional provisions (regulations 31-33) convert pending licence/permit applications into applications under the new Act and carry over existing advisory committee members and chairpersons. Licences under the repealed Act that were subject to codes adopted under that Act are revoked but remain subject to the revoked code for up to a year or until the licence is amended (regulation 34).

Collective effects and intersectional impacts: The Regulations concentrate compliance and procedural burdens on organisations that use animals in science or commercial endeavours (research institutions, abattoirs, livestock enterprises, breeders), on bodies that appoint Advisory Committee members, and on ethics committees and registered persons who must prepare prescribed annual reports. The Regulations create both permissions (for specified electrical devices where used per Schedule 2) and new criminalised conduct (prescribed categories of cruelty and a specified prohibited trap), shifting risk and enforcement exposure among operators in agriculture, research, pest control and pet services.

The Regulations specify discrete duties, conditional permissions and express rights of review or election. Below are the principal duties and the rights they create.

Duties to follow adopted codes of practice: By regulation 4 the Minister adopts the documents listed in Schedule 1 as codes of practice relating to animal welfare. Persons whose conduct falls within the scope of those codes will be expected to comply with them as statutory codes of practice under the Act. The Regulations do not itself list sanctions tied directly to breach of a code, but regulation 20(5)(e) requires animal ethics committees to report any breaches of adopted codes they are aware of, and breaches can be the basis for enforcement action under the Act.

Device-use duties and prohibitions: Regulation 5 prescribes that certain uses of electrical devices constitute cruelty. The duty is framed as negative obligations: do not use electrical devices (other than excluded devices) against an animal’s face, udders, anus or genitals, and do not use electrical devices (other than excluded devices) on animals under 3 months (regulation 5(a) and 5(ab)). Schedule 2 sets out permitted devices and conditions; using an excluded device contrary to those restrictions is also prescribed as cruelty (regulation 5(b)). Schedule 2 repeatedly attaches duties of adherence to the manufacturer’s instructions and specific prohibitions (for example items 1-8 of Schedule 2).

Duty to avoid certain traps and to respect poison exceptions: Regulation 8 prescribes that an adhesive glue-layer trap intended to capture and hold live rodents is a prohibited trap. Regulation 7 excludes specified poison-laying activities from offences under section 28 of the Act where the person is authorised under specified Territory or Commonwealth legislation, or where rat poison is laid by an occupier inside an enclosed, inaccessible-to-outside residential premises. Practically, lay pest-control and household treatments must either comply with these qualifications or risk contravening section 28 offences.

Reporting and fee duties for scientific use: Registered persons must include specified information in annual reports: project name, purpose, duration, activities, locations, number and description of animals (class and species), source and housing locations, and particulars and outcomes of complaints (regulation 19). Accredited animal ethics committees must report committee membership, member qualifications under the scientific use code, application and approval statistics, brief descriptions of research areas approved or refused, complaints particulars and responses, inspection activity, problems identified and rectified, outcomes and the number of breaches of adopted codes the committee is aware of (regulation 20). The registration application and renewal fee is prescribed at 83 revenue units each (regulation 18).

Enforcement and contravention consequences: Authorised officers may issue infringement notices under regulation 22 where they reasonably believe on grounds that an infringement offence has been committed. Notices must contain required particulars (regulation 23). Payment of the infringement amount within 28 days expiates the alleged offence and prevents further proceedings (regulation 25); the person may instead elect to have the matter dealt with by a court by completing a statement of election and not paying (regulation 23(2)(b)). An authorised officer may withdraw a notice before payment within 28 days (regulation 26). The Regulations preserve the regulator’s ability to instead prosecute in court (regulation 27).

Improvement notices and review rights: An improvement notice must name the person, identify the specific provision believed contravened and grounds, specify the required remedial action or restraint, set dates or times, and state the person’s right to apply to NTCAT for review (regulation 28). That creates a procedural right to review in NTCAT for persons affected by improvement notices.

Advisory Committee duties and election/appointment rules: The Committee must have members appointed by the specified entities in regulation 10, must elect its own chairperson from its members (regulation 11), hold at least two meetings each financial year (regulation 15(1)), and submit an annual report by 30 September each year for the preceding financial year (regulation 17). Members are eligible for reappointment (regulation 10(4)). The Minister may determine terms and conditions and may terminate appointments for specified grounds (regulation 14). A member may resign by written notice to the Minister and the appointor (regulation 13).

Who decides and who pays: Decision-makers include the Minister (appointment and termination powers, and power to adopt codes under the Act as effected by regulation 4), specified bodies who appoint Advisory Committee members (regulation 10), and authorised officers who decide to issue infringement or improvement notices (regulations 22, 28). Those who pay include registered persons (registration fee, regulation 18) and persons who choose to expiate an infringement notice by payment (regulation 25). The Regulations require certain persons and committees to prepare and deliver reports (regulations 17-20), which allocate administrative costs to those bodies.

Procedural protections and bounded discretion: The Regulations set documentary requirements for notices and reports, limit termination grounds for Committee members to specified reasons (regulation 14), require written appointments/terminations/resignations (regulations 10(2), 13(3)), and preserve rights to elect court proceedings (regulation 23) and to review improvement notices at NTCAT (regulation 28(e)). At the same time, the Regulations preserve prosecutorial discretion: infringement notices need not be given for every offence and court penalties may exceed infringement amounts (regulation 27).

The Regulations implement a two-tier enforcement architecture: infringement notices for specified Act contraventions, and the continuation of court-based prosecution and tribunal review mechanisms. The key enforcement and penalty features are as follows.

Infringement notice framework and amounts: Regulation 21(2) identifies that an “infringement notice offence” means an offence against a provision of the Act specified in Schedule 3. Regulation 21(1) sets the infringement amount as the monetary value of the penalty units specified in Schedule 3 for the relevant offence. Schedule 3 enumerates specific Act provisions and attaches penalty units to each (for example, section 29(1) is listed at 4 penalty units; section 74(3) is listed at 5 penalty units). The Regulations do not convert penalty units to monetary amounts themselves; instead the infringement amount is the monetary value of the named penalty unit quantity. Practitioners need to convert penalty units into monetary sums using the Territory’s current penalty unit value and the treatment of “revenue units” where applicable.

Issuing infringement notices: Authorised officers may issue an infringement notice to a person whom the officer believes on reasonable grounds committed an infringement offence (regulation 22). The belief standard is expressed as “believes on reasonable grounds,” establishing an evidential threshold for issuance. The notice must include specified particulars (regulation 23(1)): name, address (if known), date the notice is given, date/time/place of the alleged offence, a description of the offence, the infringement amount, and the enforcement agency to which payment is payable. The notice must inform the person of the right to expiate the offence by paying within 28 days, the right to elect to have the matter dealt with by a court by completing a statement of election and not paying, and that enforcement action may be taken under the Fines and Penalties (Recovery) Act 2001 if the person does nothing (regulation 23(2)).

Expiation and effect of payment: Payment of the infringement amount in accordance with the notice expiates the alleged offence and bars further proceedings in relation to that offence (regulation 25). Regulation 24 clarifies when payment takes effect: electronic payments take effect when credited to the payee’s bank account, and cheques take effect when cleared on first presentation. Payment thus provides a statutory, time-limited method to avoid prosecution.

Withdrawal of notices and time limits: An authorised officer may withdraw an infringement notice by written notice given to the person, but only within 28 days after the infringement notice is given and before payment of the infringement amount (regulation 26). This constrains the practical window for withdrawal.

Non-exclusivity of infringement pathway: Regulation 27(1) is explicit that the Division does not preclude court proceedings or higher penalties: it does not prejudice the start or continuation of a proceeding for an infringement offence unless expiated; it does not limit the penalty that may be imposed by a court; it does not require an infringement notice to be given; and it does not prevent more than one infringement notice for the same offence being given. If more than one notice is given, a person may expiate by paying any one of them (regulation 27(2)). These clauses preserve prosecutorial discretion and a dual-track enforcement regime.

Improvement notices and tribunal review: Regulation 28 prescribes the minimum content for an improvement notice under section 75(4) of the Act: the name of the person, the specific provision believed contravened and grounds, action required to remedy and to comply, associated dates and times, and the person’s right to apply to NTCAT for review. This creates a statutory pathway for administrative enforcement where an authorised officer requires remedial action and concurrently ensures a right of merits review to NTCAT.

Interaction with other enforcement statutes: Regulation 23(2)(c) warns that failure to respond to an infringement notice can result in enforcement action under the Fines and Penalties (Recovery) Act 2001. Regulation 7 provides that certain poison-laying carried out under other statutory regimes (for example the Agricultural and Veterinary Chemicals (Control of Use) Act 2004 or the Medicines, Poisons and Therapeutic Goods Act 2012) is excluded from the Act’s poisoning offences, limiting enforcement exposure for those authorised under other laws.

Administrative and criminal overlap: The Regulations assign some contraventions to infringement-notice treatment (Schedule 3), while preserving the ability to prosecute criminally. The presence of penalty units in Schedule 3 means the financial penalty for expiation is scaled by the number of penalty units. However, the Regulations do not convert all offences to infringement-only; the regulator maintains discretion to choose the enforcement pathway, and courts may impose penalties above expiation levels.

Enforcement risks and practical effects: Operators face both administrative enforcement (improvement notices, reporting obligations) and the possibility of monetary penalties via infringement notices or higher court penalties. The authorisation for officers to issue multiple infringement notices for the same offence and to withdraw notices within a 28-day window creates operational uncertainty for recipients. The statutory right to elect court prosecution preserves procedural fairness but also means contested matters can escalate to litigation with potentially higher penalties or injunctions.

The Regulations are written to interact explicitly with the Act and with other Territory and Commonwealth statutes. The text names cross-references and establishes where the Regulations defer to or exclude other regimes.

Connection to the Animal Protection Act 2018: The Regulations operate under the Animal Protection Act 2018 and repeatedly invoke specific Act sections in their regulatory hooks. For example, regulation 4 is “For section 20 of the Act” and adopts codes of practice; regulations 5 and 6 are “For section 24(5)(b) of the Act” prescribing cruelty; regulation 7 is “For section 28(7) of the Act” excluding certain laying of poison from offences; regulation 8 is “For section 29(6) of the Act” prescribing a prohibited trap; regulation 9 is “For section 30(6) of the Act” specifying excluded electrical devices; regulations 10-17 are “For section 19(2) of the Act” setting out Advisory Committee matters; regulation 18 is “For section 41(2)(f) of the Act” and section 45(3)(c) for renewal fees; regulations 19-20 reference sections 72 and 73 in prescribing annual report contents; regulations 21-27 implement the Act’s infringement notice mechanics; regulation 28 is “For section 75(4) of the Act” describing improvement notice contents; and Part 5 relies on section 129 for transitional authority. The Regulations therefore sit as subordinate instruments implementing Act mechanisms and defining many operative details.

Exclusions and intersections with chemical and poisons law: Regulation 7 expressly excludes conduct from section 28 offences where laying of poison is by a person authorised under the Agricultural and Veterinary Chemicals (Control of Use) Act 2004, the Medicines, Poisons and Therapeutic Goods Act 2012, or any other Territory or Commonwealth law. That creates an explicit interaction and coordination with those regimes: authorised pesticide or veterinary substance use under those Acts will not be prosecuted under the Animal Protection Act’s poisoning offences in the prescribed circumstances. Practitioners must therefore check parallel authorisations under those Acts before assuming exposure to section 28 offences.

Fines enforcement and recovery: Regulation 23(2)(c) references the Fines and Penalties (Recovery) Act 2001 for enforcement action if a person does nothing in response to an infringement notice. This situates monetary enforcement mechanisms outside the Animal Protection Act apparatus, utilising the Territory’s broader fines recovery framework.

Administrative tribunal review: Regulation 28(e) explicitly provides that an improvement notice must state the person’s right to apply to the Northern Territory Civil and Administrative Tribunal (NTCAT) for review of the notice. This imports the Tribunal’s review processes and remedies into the enforcement chain for improvement notices.

Transition from the repealed Act: Part 5 is expressly made under section 129 of the Act. Transitional rules convert pending licence and permit applications under the repealed Act into registration and project approval applications under the current Act and preserve incumbent advisory committee membership and a chairperson (regulations 31-33). Regulation 34 revokes prior adoptions of codes under the repealed Act but preserves the application of those revoked codes to existing licences until the earlier of licence amendment or one year after commencement. These transitional clauses ensure continuity and define the interaction between the new Regulations and the prior legislative regime.

Adopted external codes and version anchoring: Regulation 4 adopts external documents as codes of practice and anchors Part A documents to the versions “in force on 1 November 2022” while Part B documents are adopted as in force on the day a specified Amendment Act section commences. That approach means that only the versions specified are adopted; future updates to these external documents after the adopted date will not automatically become the statutory code unless the Regulations are amended. Practitioners should therefore treat the Regulations as fixing a textual point-in-time of external standards.

Penalty unit and revenue unit regimes: Schedule 3 lists infringement amounts as penalty units rather than a monetary figure. Regulation 18 prescribes registration fees in revenue units (83 revenue units). The monetary value of penalty units and revenue units is determined elsewhere in Territory law and may change over time, so conversion is required to determine actual dollar amounts. That interaction matters for budgeting and cost assessment.

Collective effect on regulated parties: Collectively, interaction clauses channel some conduct away from liability under the Animal Protection Act to other regulatory regimes (notably chemicals and poisons legislation), but they also elevate external standards into the Act’s enforcement domain via codes and reporting requirements. Enforcement actions (infringement notices, improvement notices) interact with the Fines and Penalties (Recovery) Act and NTCAT review procedures, meaning that compliance action can move through administrative, civil recovery and tribunal processes.

The Regulations were originally made on 13 October 2022 and commenced on 1 November 2022 as Regulation SL No. 14, 2022 (per Endnotes). The Endnotes record a series of amendments under the Animal Protection and Related Legislation Amendment Act 2025 (Act No. 22, 2025), which received assent on 12 September 2025 and commenced 3 November 2025 (Endnotes, List of Legislation).

The regulatory text itself identifies the following amendment entries (Endnotes 3, List of Amendments):

• regulation 4 was amended by Act No. 22, 2025, section 20;
• regulation 5 was amended by Act No. 22, 2025, section 21;
• regulation 6 was amended by Act No. 22, 2025, section 22;
• regulation 9 was substituted by Act No. 22, 2025, section 23 (the substitution created the Schedule 2 structure for excluded electrical devices now in place);
• regulation 10 was amended by Act No. 22, 2025, section 24 (changes to Advisory Committee membership provisions, including the insertion of AMRRIC as an appointing body under regulation 10(1)(ha));
• regulation 14 was amended by Act No. 22, 2025, section 25 (amendments to Ministerial termination grounds and obligations, including mandatory termination for certain absences and insolvency-related actions);
• Schedule 1 was amended by Act No. 22, 2025, section 26 (updating adopted codes or adding Part B items with specific effective dates);
• Schedule 2 was substituted by Act No. 22, 2025, section 27 (comprehensively listing excluded electrical devices and their conditions);
• Schedule 3 was amended by Act No. 22, 2025, section 28 (modifying the list of infringement notice offences and their penalty unit amounts).

The text of the Regulations incorporates these changes; in particular the substitution of Schedule 2 and amendments to regulations 4-6 and 10 and 14 reflect a legislative policy update in 2025 that refined device-specific permissions, the Advisory Committee membership and the cruelty definitions. The Endnotes therefore establish an observable legislative trajectory: initial instrument in 2022, followed by a suite of targeted amendments in 2025 that materially altered technological and governance elements. The Amendment Act’s commencement date for some changes (for example the dates used in regulation 4 for Part B adoption) drives the effective timing for certain code adoptions.

What the Regulations do not record in the instrument: The text provides no conversion table for penalty units to dollar amounts and does not specify the current monetary value of a revenue unit. It does not record any delegated instruments or subordinate determinations made under provisions such as the Minister’s determination of terms and conditions for Advisory Committee appointments (note in regulation 10). Practitioners must therefore consult the relevant Territory instruments determining penalty unit values and any Ministerial determinations to understand precise monetary and administrative impacts.

The Regulations themselves do not record or summarise any judicial decisions or tribunal rulings. The instrument provides procedural pathways that create the potential for litigation or tribunal review, but it does not document case law.

Forums and processes available under the Regulations that may give rise to litigation or review are explicitly set out in the text and should be understood as the primary dispute-resolution avenues:

• Election to have an infringement notice dealt with by a court: Regulation 23(2)(b) requires that an infringement notice include a statement informing the recipient that they may elect to have the matter dealt with by a court by completing a statement of election and not paying the infringement amount. That creates the direct route for matters to be litigated before territorial courts instead of settled by expiation.

• Improvement notice review at NTCAT: Regulation 28(e) requires improvement notices to advise recipients that they have a right to apply to the Northern Territory Civil and Administrative Tribunal for review. The Tribunal’s jurisdiction to review administrative action of this type is thus the statutory review route for improvement notices.

• Enforcement under the Fines and Penalties (Recovery) Act 2001: Regulation 23(2)(c) states that if the person does nothing in response to an infringement notice, enforcement action may be taken under the Fines and Penalties (Recovery) Act 2001. That Act contains debt-recovery mechanisms that can be litigated or challenged procedurally.

• Criminal prosecution: Regulation 27(1)(b) preserves the ability of courts to impose penalties beyond the infringement amount; the Division does not limit the penalty that may be imposed by a court. Where the regulator elects prosecution rather than infringement expiation, matters will proceed through criminal prosecution channels where procedural and evidential issues can be litigated.

Because the Regulations do not cite cases, the following observations are limited to procedural and jurisdictional implications rather than precedent analysis. Areas likely to generate litigation or appellate attention include:

• Interpretation of “reasonable grounds” for authorised officers issuing infringement notices (regulation 22), which determines whether issuance could be judicially reviewable or whether suppression of evidence or admissibility issues arise in contested hearings.

• The scope and meaning of “used in accordance with the manufacturer's instructions” as applied to electrical devices in Schedule 2. Disputes could arise about what constitutes reasonable or manufacturer-compliant use, particularly where manufacturers’ instructions are deficient or ambiguous.

• The interpretation of the cruelty prescriptions in regulation 5, particularly how the distinction between “excluded” and “non-excluded” electrical devices operates in practice and whether particular devices (for example remote-controlled collars, which are excluded from the permitted “electric training collar” entry in Schedule 2) fall within the statutory protection or the cruelty prescription.

• Compliance with reporting obligations in regulations 19 and 20, such as sufficiency of project descriptions or animal counts, and whether administrative penalties or licence consequences can follow from incomplete reports.

• The boundaries of the poison-laying exclusions in regulation 7, particularly whether a person is “authorised” within the meaning of the listed Acts or whether a private operator’s activity falls within the exemption.

Absent judicial decisions in the text, practitioners should monitor NTCAT and local court lists for matters arising under these Regulations, and check territory legal databases for decisions addressing the interpretation of the Animal Protection Act 2018 and its Regulations. For now the Regulations provide the procedural scaffolding that determines where disputes are litigated or reviewed, but they do not themselves supply litigation history.

The Regulations contain several drafting choices and cross-references that create practical friction points, interpretative ambiguities and compliance risks. These items are not evaluative but highlight matters for careful attention.

Remote-controlled collars and the exclusion carve-out: Schedule 2 item 3 permits an “electric training collar (excluding a collar operated by remote control device)” for dogs. The explicit exclusion of remote-controlled collars means they are not within the listed “excluded electrical devices”. Because regulation 5 prescribes the use of electrical devices that are not excluded on certain body parts or on animals under 3 months as cruelty, the practical legal status of remote-controlled collars could expose users to enforcement risk unless their use is clearly outside the cruelty descriptions. The Regulations do not otherwise expressly ban remote-controlled collars, but their exclusion from the Schedule creates regulatory uncertainty for dog trainers and owners who use such collars. Practitioners should note the precise phrasing and plan accordingly.

Reliance on manufacturer’s instructions: Schedule 2 repeatedly conditions lawful use of excluded devices on use “in accordance with the manufacturer's instructions.” The Regulations do not define what level of specificity or contemporaneity is required from manufacturer instructions. Where instructions are silent on a particular practice, an authorised officer could challenge use as contrary to the Schedule and regulation 5(b) by treating the device as improperly used. Entities reliant on devices should retain manufacturer documentation and ensure versions are accessible and reasonable.

Age cut-off at 3 months: Regulation 5(ab) and Schedule 2 items impose a broad prohibition on use of electrical devices on animals less than 3 months of age. That is a hard threshold and may affect standard husbandry and training practices where younger animals are involved. Operators must track ages carefully to comply.

“Face, udders, anus or genitals” prohibition scope: Regulation 5(a) and Schedule 2 prohibit use of electrical devices against specific body parts. The precise anatomical language does not mention other body areas (for example flanks or limbs), which suggests the Regulations deliberately target sensitive body areas; nonetheless the language may raise questions in borderline cases (e.g. near-the-face application). Enforcement discretion in ascertaining whether a device was used “against” a prohibited part may create enforcement risk.

Adhesive glue traps: Regulation 8 prescribes an adhesive glue-layer trap intended to capture and hold live rodents as a “prohibited trap.” That wording suggests both design and intended purpose matter; a trap using adhesive glue for other specified purposes or designed in a different manner may fall outside the prohibition. However, ambiguity remains for marginally different products.

Poison-laying exemptions are narrow: Regulation 7 excludes laying poison by persons authorised under certain Acts and occupiers within sealed residential premises. The exemption is limited , it does not exempt commercial pest-control operators acting outside those authorisations, or householders laying poison in non-enclosed premises. Practitioners should not assume a broad poisoning exemption.

Codes and version anchoring: Regulation 4 adopts particular versions of external codes for Part A (as in force 1 November 2022) and Part B (as in force on the day section 19 of the Amendment Act 2025 commences). This anchoring technique means that later updates to those external codes will not automatically be the statutory code. Where an industry relies on an updated external standard, the regulatory compliance position will depend on whether the Regulations (or the Minister) adopt the later version.

Penalty unit and revenue unit conversion: Schedules list infringement amounts as penalty units and registration fees as revenue units (regulation 18). The Regulations do not convert these units to dollar amounts. Practitioners must compute dollar costs by reference to the Territory’s penalty unit and revenue unit valuations established elsewhere. This is a budgetary “gotcha” for applicants or registered persons.

Advisory Committee appointment complexity: Regulation 10 prescribes appointments by a number of named bodies. If an appointing body delays filling a vacancy, regulation 13(2) requires a successor be appointed within a “reasonable period,” but the Regulations leave “reasonable period” undefined. The Minister also has wide termination powers (regulation 14) for inability, ineffectiveness or misbehaviour, and must terminate for specified occurrences (absences or insolvency law applications). Parties should be aware of these appointment and termination contingencies.

Infringement notice multiplicity and withdrawal window: Regulation 27 allows more than one infringement notice for the same offence to be given; regulation 26 permits withdrawal only within 28 days and before payment. This combination can create practical difficulty for recipients who receive multiple notices or whose notices are withdrawn after the 28-day window. Legal advice should be sought promptly on multiplicity or withdrawal scenarios.

Evidence and “reasonable grounds” standard: Regulation 22 permits authorised officers to issue notices where they “believe on reasonable grounds” an offence occurred. The Regulations do not specify evidentiary thresholds for reasons. In contested matters, the standard of reasonable grounds and officer decision-making will be a central issue.

Transitional carryover of revoked codes for licences: Regulation 34 revokes adoption of codes under the repealed Act but keeps revoked codes attached to existing licences until licence amendment or one year after commencement. Licence holders should check whether their licence remains subject to a revoked code for up to a year and plan for compliance with whatever code remains attached until formally changed.

Compliance requires attention to device-specific rules, reporting obligations, adopted codes, administrative processes and enforcement pathways. Below are practical, source-grounded steps for different stakeholder types and for general risk management, grounded in the Regulations.

For livestock producers and mustering operations

• Inventory electrical devices and check whether each device is listed in Schedule 2 as an “excluded electrical device” (regulation 9 and Schedule 2). If listed, ensure the usage purpose and species match the Schedule entry (Schedule 2 item clauses (1)). If not listed (for example remote-controlled collars), understand that use may be subject to the cruelty prescriptions in regulation 5.
• Ensure all permitted devices are used in accordance with the manufacturer’s instructions as mandated repeatedly in Schedule 2.
• Do not apply electrical devices to the face, udders, anus or genitals of animals, and do not use electrical devices on animals under 3 months of age (regulation 5 and Schedule 2 prohibitions).
• Maintain records of device purchase, model, manufacturer’s instructions and training provided to staff showing compliance with manufacturer guidance.
• Where animals are diseased, injured or suffering, avoid use of permitted devices where Schedule 2 expressly prohibits use (e.g. stock prods on diseased/injured animals, Schedule 2 item 1(2)(c)).

For abattoir operators

• Ensure stunning devices used in abattoirs are the electric stunning devices listed in Schedule 2 item 2 and that they are used only on permitted species (cattle, buffalo, sheep, goats, swine) and in accordance with the manufacturer’s instructions and the Schedule’s age and body-part prohibitions.
• Keep calibrations, maintenance logs and training records to evidence compliance with the device conditions.

For dog trainers and pet services

• Note that Schedule 2 permits certain electric training collars but expressly excludes collars operated by remote control (Schedule 2 item 3). If you use remote-operated collars, treat their legal status as outside the Schedule and therefore subject to the cruelty conditions in regulation 5. Consider alternative training tools or legal advice.
• For electronic fencing and virtual fencing systems (Schedule 2 items 7-8), follow manufacturer instructions and ensure systems are not used against prohibited body parts or on animals under 3 months.
• Adopt the relevant Part A/B codes in Schedule 1 where they apply to retail pet shops, boarding facilities, day care centres and exhibited animals and ensure staff training and premises practices track those codes.

For registered persons and research institutions

• Budget for the prescribed registration application and renewal fee of 83 revenue units (regulation 18) and verify the current monetary value of a revenue unit in Territory law.
• Prepare and lodge the statutory annual report containing the items listed in regulation 19: project name, purpose, duration, description of activities, locations, number and class/species of animals, source, housing locations, and particulars and outcomes of complaints. Ensure recordkeeping systems collect these data contemporaneously.
• Ensure accredited animal ethics committees prepare annual reports per regulation 20 with membership details, qualifications under the scientific use code, numbers of applications approved/refused, descriptions of research areas, complaints particulars and outcomes, inspections conducted and any breaches of adopted codes. Ensure committees have written minutes, inspection records and documentation sufficient to populate the annual report.

For pest-control operators and householders

• Do not deploy adhesive glue-layer traps intended to capture live rodents, as these are prescribed prohibited traps (regulation 8).
• For poison-laying, confirm statutory authorisation: if acting under the Agricultural and Veterinary Chemicals (Control of Use) Act 2004, the Medicines, Poisons and Therapeutic Goods Act 2012, or another Commonwealth or Territory law that authorises the laying of the poison, the exemption in regulation 7 may apply; otherwise, exercise caution. Keep authorisation documents and permits to hand when laying poison.

For all operators exposed to enforcement risk

• If served with an infringement notice, note the 28-day window for payment to expiate the offence (regulation 23(2)(a) and regulation 25). Decide promptly whether to pay to avoid prosecution or to elect court proceedings (regulation 23(2)(b)).
• If issued with an improvement notice, consider a timely application to NTCAT, as the notice must advise of the right to apply (regulation 28(e)). Seek legal advice on grounds and evidence to contest or to propose remedial actions.
• Maintain contemporaneous documentation (device manuals, training records, animal age records, treatment logs, inspection records, complaint files) to rebut allegations and to demonstrate compliance with manufacturer instructions and adopted codes of practice (regulation 4 and Schedule 1).
• If an authorised officer issues an infringement notice, note that it may be withdrawn within 28 days and before payment (regulation 26); maintain communication channels and seek clarification rapidly.

Governance, Advisory Committee and appointment compliance

• Entities that appoint Advisory Committee members (RSPCA NT, AVA, Local Government Association, Agency, primary industry Agency if different, NT Cattlemen’s Association, Charles Darwin University, Parks and Wildlife Commission, AMRRIC) should ensure they make appointments in writing and supply the Minister with copies of appointments as required (regulation 10(2)-(3)).
• Appointees should be prepared to attend meetings (quorum of 4, at least two meetings per financial year - regulation 15) and to submit an annual report by 30 September (regulation 17). Keep records of meeting minutes and proxies (regulation 15(4)).

Practical administrative checklists

• Confirm which codes in Schedule 1 apply to your activities and obtain the adopted version designated by the Regulations (regulation 4; Schedule 1, Part A/B). Do not rely on later external updates without checking the regulatory adoption date.
• Audit device inventories against Schedule 2 and withdraw or replace any devices that cannot be used consistent with Schedule 2 conditions. Where devices are not listed, document safe-use protocols and manufacturer instructions.
• Implement an incident-reporting and complaints-handling system to satisfy the reporting items in regulation 19(4) and regulation 20(4).
• Update employment and contractor training regimes to reflect restrictions on device use, age thresholds, and body-part prohibitions.
• For new or pending licence/permit applications under the repealed Act, treat them as taken to be applications under the current Act per the transitional provisions (regulations 31-32) and ensure submissions meet the Act’s considerations (sections 42, 46, 59, 61, 64 as referenced).

Recordkeeping and legal review

• Retain device manuals, maintenance logs, inspection records, complaint responses, project data and animal records for at least the period covered by annual reporting cycles and any statutory retention periods under the Act or associated codes.
• Consult legal counsel for interpretation of edge cases such as remote-controlled collar use, manufacturer instruction sufficiency, the status of poisoning authorisations, and for strategic decisions about whether to expiate an infringement notice or contest it in court.

Adherence to these steps will not eliminate enforcement risk but will position regulated entities to meet the Regulations’ documentary and operational standards and to defend compliance in the event of administrative or judicial challenge.
