Anatomy Act 1930

The Act builds on a handful of defined concepts and recurring structural devices. Definitions in s 2 and the statutory language control meaning through the Act.

• Authorised school of anatomy (s 2): an establishment specified in a Gazette notice under s 4. The Minister controls what places may lawfully carry on the practice of anatomy by issuing, varying or revoking notices (s 4(1), (3)). Authorisation is thus place‑based and contingent on Gazette publication and any conditions specified (s 4(2)).

• Practice licence (s 2): a licence granted or renewed under s 5 to a person in charge of an authorised school. A practice licence authorises the licence holder to practise anatomy at the authorised school and to authorise other persons in writing to practise anatomy there (s 5(2)). Licences have specified durations and conditions (s 5(3), (4)), and a licence holder must ensure practice is carried out according to the Act (s 5(4)).

• Chief Health Officer, Minister, inspector (s 2): the CHO administers the Act subject to Ministerial control, and may nominate inspectors (s 3). Inspectors and the CHO have powers to visit, inspect and report on authorised schools and may require production of books kept by the school (s 7, s 14).

• Senior next of kin (s 2): a statutorily ordered hierarchy for decision‑making in relation to a deceased person, listed in order: spouse/de facto partner living with the deceased, spouse, adult son or daughter, parent, adult brother or sister, executor or other personal representative. Several operational provisions refer to the senior next of kin as the person whose wishes can prevent an anatomical examination even where others have permitted it (ss 8-11).

• Consent and direction mechanisms (ss 8-11): the Act identifies who may permit removal (s 8 delegates certain public institution officers by licence), who may permit under private arrangements (s 9: executor or person with lawful possession), and how a person may direct that their body be examined after death (s 10). The Act requires that attention of the senior next of kin or person with possession be drawn to the relevant sections and that consent be obtained in writing before a body is removed under ss 8-10 (s 11).

• Procedural prerequisites and records (ss 12, 14, 16, 17): removal cannot occur until 12 hours after death and until six hours’ notice has been given to the CHO of intended removal, and a certificate of cause of death (Births, Deaths and Marriages Registration Act 1998 s 44) or coroner findings must be delivered with the body (s 12). The receiving school must demand the certificate, enter particulars in a book and transmit the certificate/record and a return to the CHO within 24 hours (s 14). After examination the body must be decently interred or cremated in accordance with senior next of kin wishes, and a certificate of interment/cremation must be transmitted to the CHO within six weeks (s 16), subject to variation by Order in Council (s 17).

• Prohibitions and conditional exceptions (ss 15, 18, 20): the Act makes it unlawful to carry on or teach anatomy or receive/examine bodies except at authorised schools under a practice licence (s 15). Removal or possession of body parts is generally unlawful unless by practice licence holders or persons they authorise, and approved in writing by the CHO, for educational, scientific or research purposes (s 18). Section 20 states that the Act does not prevent or extend to post mortem examinations required by competent legal authority, post mortems by medical practitioners to ascertain cause/extent of disease, or removal of tissue under the Human Tissue and Transplant Act 1982.

• Enforcement and sanctions (s 22): the Act classifies unlawful practice and unlawful removal/receiving of bodies as crimes with imprisonment and fines, and sets regulatory offences with monetary penalties for obstructing inspectors, breaching licence conditions, or failing to transmit required certificates/returns (s 22(3)).

• Regulatory scope (s 23): the Governor may make regulations on conduct, equipment, inspection and control of authorised schools, on discipline, forms and fees, and generally on matters required or permitted.

These concepts produce a network of authorisations, conditional permissions, record and reporting duties, and criminal prohibitions. Authority is concentrated mechanically in the Minister and the Chief Health Officer, with statutory powers to authorise places (Minister) and to licence and inspect persons (CHO and inspectors). Consent and evidentiary gates (cause of death certificates, coroner findings, written consent from next of kin) are integral to permitted transfers of bodies. The regime makes both entry (authorisation/licence) and ongoing operation (compliance, recordkeeping, inspections) contingent on administrative approvals and continuing compliance with statutory conditions.

The Act allocates rights, duties and burdens across a defined group of public actors and private parties. Who pays, who decides, and what behaviour changes flow from the text.

Primary decision-makers and administrators

• The Minister for Health decides which places may be authorised schools of anatomy by Gazette notice and may specify conditions, and the Minister may vary or revoke authorisations (s 4). The Minister also issues licences to certain public institution officers under s 8 (by licence under his hand).
• The Chief Health Officer administers the Act subject to the Minister’s control, grants and renews practice licences on application by the person in charge of an authorised school (s 3, s 5), nominates inspectors, and must make quarterly returns to the Government statistician of bodies removed for anatomical examination (s 6). The CHO also approves in writing persons who may take or possess body parts for approved purposes (s 18, s 5(1)) and is the contracting party for interstate despatch agreements (s 10A).

Licensed operators and authorised schools

• Persons in charge of authorised schools who hold a practice licence pay compliance costs: applying for and maintaining a licence (s 5), meeting licence conditions, allowing inspections and producing the books required by s 14, demanding and keeping cause of death certificates and making prompt returns to the CHO (s 14), ensuring bodies are decently interred or cremated and that certificates of interment/cremation are transmitted (s 16). The authorised school itself is a regulated place; only schools specified in a Gazette notice may carry on anatomy (s 4, s 15).

Medical and institutional actors

• Medical practitioners have roles under the Act: one (not involved in the post-removal examination) must provide a certificate of cause of death under the Births, Deaths and Marriages Registration Act 1998 s 44 before removal (s 12). Public institutions (penal establishments, hospitals and other public institutions) are affected by s 8 which allows the Minister to authorise certain officers to permit removal of bodies, and the Act requires a printed copy of s 8 be posted in a conspicuous place in each such institution, except an “authorised hospital” as defined in the Mental Health Act 2014 s 4 (s 8).

Family, executors and senior next of kin

• Members of a deceased person’s family, and executors or other persons having lawful possession of a body, are directly affected on the consent and notification side. The Act requires that before removal under ss 8-10 the attention of the senior next of kin or person having the body must be directed to the relevant provisions and that consent be obtained in writing (s 11). The Act sets out a statutory order of priority for the senior next of kin (s 2), and in several places the senior next of kin can require interment or cremation without examination even where another person has authorised examination (ss 8, 9, 10). That creates a power for family or personal representatives to prevent anatomical examination in particular circumstances.

Persons handling body parts and researchers

• Section 18 restricts removal, possession or transportation of body parts. Only practice licence holders, persons they authorise, and persons who have CHO written approval may take or possess portions for educational, scientific or research purposes. Researchers and institutions seeking to obtain or retain anatomical specimens must therefore be licenced and approved by the CHO.

Other affected actors

• Undertakers and persons entrusted with bodies only for interment/cremation are excluded from the class of persons who may permit anatomical examination (s 9). Persons obstructing the CHO or inspectors or failing to comply with licence conditions face statutory penalties (s 22(3)).

Who pays

• The direct monetary costs likely fall on those operating authorised schools and on parties needing to obtain licences and approvals: fees for licences and prescribed matters may be set by regulations (s 23). Time and administrative costs are borne by authorised schools in complying with inspections, recordkeeping and returns (ss 6, 7, 14). Families and executors may incur transaction costs in providing timely direction and documentary evidence required by the Act. The State (CHO/Minister) bears administrative costs of making returns, nominating inspectors, entering interstate agreements, and processing licence applications.

Who decides

• The Minister decides which places may be authorised and sets conditions (s 4). The CHO decides on practice licences, inspections, returning and approving persons to take parts (ss 3, 5, 7, 18), and negotiates interstate arrangements (s 10A). Senior next of kin have a decision right to require interment/cremation instead of anatomical examination even where a person during life directed examination (ss 8-11). Executors and persons with possession of the body have the immediate operational power to permit or direct removal, subject to the senior next of kin’s contrary instruction (s 9).

Behavioural effects

• The Act centralises authority, creating administrative gates for entry and operation. Individuals expressing an intention for post‑mortem anatomical examination are placed in a regime where that intention may be overridden by senior next of kin, which affects individuals’ ability to give absolute post‑mortem directions (s 10). The requirement that only authorised schools may lawfully receive bodies and that licensed persons must supervise practical anatomy (s 15) channels academic and research demand into regulated institutions, affecting where anatomy teaching and research can be undertaken and by whom.

The Act allocates a mix of affirmative duties, procedural requirements and statutory rights. Below are the key operational obligations and entitlements, cited to the relevant sections.

Duties and procedural requirements

• Ministerial authorisation and conditions: The Minister must publish Gazette notices to authorise schools of anatomy, and any authorisation is subject to any conditions specified by the Minister (s 4(1)-(2)). The Minister may vary or revoke authorisations (s 4(3)). Duty: administrators must ensure statutory publication and observance of conditions.

• Practice licences: The person in charge of an authorised school must apply in the form approved by the CHO; the CHO may grant or renew a practice licence (s 5(1)). Licence holders must ensure practice is carried out according to the Act (s 5(4)). Licences specify duration and conditions (s 5(3)). Duty: maintain valid licence and comply with its conditions.

• Inspections and reporting: The CHO and inspectors may visit and inspect any place where anatomy is practised at any time and must report as prescribed (s 7). Persons must not obstruct inspectors (s 22(3)(a)). Duty: permit inspection and produce books when required (s 14).

• Recordkeeping and returns: On receiving a body, the person in charge must demand and receive the cause of death certificate or coroner record and within 24 hours transmit it to the CHO, together with a return stating date/time/from whom the body was received, date/place of death, sex, full name and age and last place of abode, and enter these particulars in a book to be kept and produced on demand (s 14). Additionally, the CHO must make quarterly returns to the Government statistician of every body removed for anatomical examination (s 6). Duty: strict and prompt record transmission and book maintenance.

• Notification, consent and waiting periods: Bodies cannot be removed until 12 hours after death, and removal requires six hours’ notice to the CHO of intended removal (s 12). Before removal under ss 8-10, the attention of the senior next of kin or person having the body must be directed to the provisions and consent obtained in writing (s 11). Duty: do not remove until statutory waiting/notice periods and consent steps completed.

• Handling and disposal obligations: Before removal, the body must be placed in a decent coffin or shell (s 16). After examination the recipient must ensure the body is decently interred in consecrated ground if so desired by the senior next of kin, or in a public burying ground appropriate to the deceased’s religion, or cremated, and must transmit a certificate of interment or cremation to the CHO within six weeks (s 16). The Governor may vary that period (s 17). Duty: ensure and document respectful disposal within statutory timeframes.

• Restrictions on removal of body parts: It is unlawful to take or remove parts of a body before the body is received into an authorised school, or to take or remove any portion from an authorised school except for burial or cremation, or to possess parts taken in contravention of the section. Exception: practice licence holders or persons authorised by them who are approved in writing by the CHO may take or possess parts for educational, scientific or research purposes (s 18). Duty: obtain CHO approval and operate under a practice licence to lawfully handle specimens.

Rights and entitlements

• Right to authorise and to be authorised: The Minister’s Gazette notice creates the facility for an authorised school; the CHO’s grant of a practice licence creates the legal right to practise and to authorise others to practise at that school (ss 4, 5(2)).

• Right of licensed persons to immunity: A practice licence holder and persons authorised by them are immune from prosecution, penalty, forfeiture or punishment for receiving or having bodies for anatomical examination or for examining bodies in accordance with the Act (s 19). This provides a statutory shield for lawful activity under the Act.

• Right of persons to direct anatomical examination: Any person may direct, in writing during life or verbally in presence of two witnesses during the terminal illness, that their body be anatomically examined or nominate a person authorised to make such an examination; if that direction is made known before interment or cremation to the person having lawful possession of the dead body, that person must direct the examination (s 10). Conditional right: this direction is expressly subject to the senior next of kin’s power to require interment or cremation without examination (s 10).

• Right of senior next of kin to require no examination: The senior next of kin may require that the body be interred or cremated without examination, which can override permissions otherwise given by an executor or by the deceased’s direction (ss 8-10). The Act therefore gives the senior next of kin a decisive veto right in these situations.

• Right to certain procedural protections for public institutions: Section 8 provides a statutory procedure authorising principal medical officers, prison chief executives, or resident or honorary medical officers connected with public institutions to permit removal of bodies, but includes an exception where the deceased had expressed a desire against examination or the senior next of kin requires burial/cremation (s 8).

• Regulatory right to make interstate arrangements: The CHO, with Ministerial approval, may enter agreements to send bodies to out‑of‑state schools for examination, subject to conditions including provision for interment/cremation and return of certificates (s 10A).

Practical legal interactions among duties and rights

• The licence regime creates an entitlement to practise within the authorised school but conditions that entitlement on compliance with recordkeeping, reporting and consent processes (ss 5, 14, 11). The immunity in s 19 protects lawful conduct but only where the Act’s procedural requirements have been satisfied. The senior next of kin’s veto power creates a conditional check on otherwise binding personal directions (s 10), and the CHO’s administrative discretion (licences, approvals, inspectors, interstate agreements) creates ongoing regulatory dependencies for operators.

The Act combines criminal penalties, monetary fines, and administrative enforcement tools. Enforcement is concentrated in two institutional vectors: administrative oversight by the Chief Health Officer and inspectors (ss 3, 7), and criminal sanctions in s 22.

Criminal offences and penalties

• Unlawful practice and receipt/examination (s 22(1)): “Every person who practises anatomy or receives or has in his possession for anatomical examination or examines anatomically any dead human body otherwise than in accordance with the provisions of this Act shall be guilty of a crime, and, on conviction, shall be liable to imprisonment for 2 years.” This provision establishes a category of indictable criminal conduct, with a custodial maximum sentence of two years for unlicenced or otherwise non‑compliant practice or possession/examination.

• Unlawful permitting of removal by persons or authorities (s 22(2)): “Every person or authority who contrary to the provisions of this Act permits or causes any dead human body to be removed out of his possession for the purposes of anatomical examination shall be guilty of a crime, and, on conviction, shall be liable to a fine of $1 000.” This targets persons/authorities who permit removal in breach of the Act’s rules.

• Regulatory offences (s 22(3)): A range of failures attract monetary penalties (prescribed as $1 000 per offence in the current text): obstructing or attempting to obstruct the CHO or an inspector in execution of powers/duties; failing to comply with conditions of a licence; failing to transmit required certificates/returns; failing to produce a book on demand; and other failures to comply with the Act. These are summary/regulatory offences, but the Act sets specific prescribed penalties.

Immunity and defences

• Statutory protection for licensed activity (s 19): “A person who holds a practice licence, and any person authorised by a person who holds a practice licence, shall not be liable to any prosecution, penalty, forfeiture, or punishment for receiving or having in his possession for anatomical examination or for examining anatomically any dead human body according to the provisions of this Act.” The immunity operates as an express statutory shield for licensed and compliant activity. It does not extend to unlawful conduct outside the Act’s provisions.

Enforcement mechanisms

• Administrative inspection and reporting (ss 3, 7): The CHO administers the Act and may nominate inspectors. The CHO and inspectors may visit and inspect any place where anatomy is practised at any time (s 7). Inspections must be reported to the Minister as prescribed. These inspection powers support compliance monitoring and enforcement.

• Record and reporting obligations as compliance triggers (s 14; s 6): The requirement that schools transmit cause of death certificates and returns within 24 hours and that the CHO make quarterly returns to the Government statistician creates traceability of transfers and provides data points for enforcement action if breaches appear (ss 14, 6).

• Licence conditions and discipline (s 5; s 23): Licence conditions (s 5(3)-(4)) and regulation‑making power (s 23) permit discipline and operational standards that the CHO or Governor can enforce. Regulation may prescribe forms and fees, and matters of discipline for authorised schools.

Linked legal constraints and exceptions

• The Act expressly does not apply to certain post mortem examinations or tissue removal under the Human Tissue and Transplant Act 1982 (s 20). Parties performing such activities are out of scope of the criminal provisions of the Anatomy Act in so far as those activities fall under the exceptions, reducing enforcement friction where other statutory regimes apply.

Practical enforcement considerations and evidentiary traces

• The Act’s enforcement rests heavily on documentary proofs: cause of death certificates, coroner findings, written consents, entries in the authorised school’s book, and certificates of interment/cremation. Failure to produce these documents may constitute regulatory offences (s 22(3)(c)), and their timely transmission is a specified duty (s 14). The CHO’s quarterly returns (s 6) are also designed to create an auditable trail.

• The penalties mix custodial and monetary sanctions. Unlawful practice and possession/examination attract two years’ imprisonment (s 22(1)), signalling a relatively serious criminalisation of non‑compliance. Lesser procedural breaches attract fines of $1,000 (s 22(3)), though regulatory amendment power under s 23 could change administrative fees.

The Anatomy Act 1930 operates alongside and references a number of other Western Australian statutes. The text itself both imports definitions and excludes certain activities in favour of parallel regimes. The Act’s text and compilation table identify explicit interactions.

Statutes and provisions cited in the Act

• Public Health Act 2016 s 4(1) (definition of Chief Health Officer): The Anatomy Act defines “Chief Health Officer” by reference to that definition (s 2). That links CHO functions, status and potentially conditions of appointment to the Public Health Act.

• Births, Deaths and Marriages Registration Act 1998 s 44: Section 12 requires that before removal of the body for anatomical examination a certificate of cause of death must be provided under s 44 of the Births, Deaths and Marriages Registration Act 1998 by a medical practitioner other than one concerned in examining the body after removal, unless a coroner has made findings. This creates an explicit evidentiary linkage: compliance with the Births, Deaths and Marriages regime is a prerequisite for lawful transfer under the Anatomy Act.

• Prisons Act 1981 s 3: Section 8 authorises the Minister to authorise by licence the “chief executive officer within the meaning of that expression as defined in section 3 of the Prisons Act 1981” to permit removal of bodies from penal establishments. The Anatomy Act therefore relies on the Prisons Act definition to identify who in prisons can lawfully permit removal.

• Mental Health Act 2014 s 4: Section 8 requires a printed copy of that section to be posted in institutions, “except an authorised hospital as defined in the Mental Health Act 2014 section 4,” creating a carve‑out for mental health authorised hospitals with respect to the posting requirement.

• Human Tissue and Transplant Act 1982: Section 20(c) expressly preserves activities authorised under the Human Tissue and Transplant Act 1982, noting that the Anatomy Act does not prohibit removal of tissue for purposes authorised under that Act. The Anatomy Act was also subsequently amended by the Human Tissue and Transplant Amendment Act 2022 (compilation table), reflecting legislative coordination between these regimes.

Operational and regulatory overlaps

• Parallel regimes for post mortems: Section 20(a)-(b) clarifies that the Anatomy Act does not extend to or prohibit post mortem examinations required by competent legal authorities or post mortems by medical practitioners for clinical purposes. Where a post mortem is under a coroner’s direction or required by another legal authority, the Anatomy Act’s licensing and consent rules do not displace those duties. This creates a non‑duplication principle: coroner‑mandated work and clinical post mortems proceed under their own statutory umbrellas.

• Regulatory harmonisation via regulations and definitions: The Governor's regulation power in s 23 enables the Anatomy Act to be co‑ordinated with forms, fees and disciplinary processes that may mirror or overlap with other health and coronial regimes. Because the CHO is defined by reference to the Public Health Act 2016, the administrative locus for implementation is integrated with broader public health governance frameworks.

• Inter‑statutory delegation and interstate transfer (s 10A): Section 10A enables the CHO, with Ministerial approval, to make agreements with persons in charge of schools in other Australian states to send WA bodies to them for anatomical examination. Contracts under s 10A must include provisions for interment or cremation and the return of certificates to the CHO. This interacts practically with interstate law and procedural infrastructures for transporting bodies and may require cross‑jurisdictional compliance (transport, certificates, burial law at destination).

Potential points of regulatory friction

• Conflicts in directions: The Act creates overlapping decision rights among an executor or person with possession (s 9) and the senior next of kin (s 2; ss 8-10), and these intersect with coronial obligations and the requirement for cause of death certificates (s 12). Where a coroner’s investigation is ongoing, coronial direction controls; where it is not, the interplay between executor directions, person’s prior wishes and senior next of kin’s veto rights may raise legal questions about which statutory grant prevails in practice.

• Interaction with human tissue and transplantation regimes: Section 20(c) preserves activities under the Human Tissue and Transplant Act 1982; the 2022 amendment (compilation table) shows legislative attention to aligning these regimes. Practitioners must ensure the correct statutory basis for removal of tissue , Anatomy Act authorisations and CHO approvals or Human Tissue and Transplant Act authorisations.

• Administrative cross‑over: The CHO’s reporting duties to the Government statistician (s 6) and possible regulation by the Governor (s 23) create points where administrative obligations under other public health statutes may be coordinated or duplicated. The CHO’s powers and duties as defined under the Public Health Act 2016 will govern how these functions are operationalised.

In short, the Anatomy Act is not standalone; it prescribes a specialised licensing and consent architecture that operates in concert with coronial, birth/death registration, prison, mental health and human tissue legislation. Practitioners and institutions must therefore map compliance across these regimes and ensure documentary proofs and approvals align with the applicable statutory source for the activity in question.

The Act has a long amendment record; the compilation table in the source lists the principal legislative changes and reprints. Below is a synthesis of the mechanical amendment history as recorded in the compilation table and section notes.

Founding and early amendments

• The Anatomy Act 1930 (23 of 1930) received assent and commenced on 19 December 1930. It established the original licensing and regulatory scheme.

• An early amendment created by the Anatomy Act Amendment Act 1946 (20 of 1946) inserted section 10A and other changes (s 10A inserted by No. 20 of 1946 s 3, per notes). This amendment enabled interstate agreements for despatch of bodies to schools of anatomy in other states (s 10A).

Subsequent reprints and consolidations

• The Act was reprinted and consolidated multiple times, with reprints authorised in 1963, 1970 and 2002 and a Reprint 4 as at 7 September 2012, incorporating a series of amendments up to that date.

Notable legislative amendments over the decades

• Decimal Currency Act 1965 (113 of 1965): A consequential amendment appears in the compilation table; this commonly updated monetary penalties to decimal currency.

• Anatomy Act Amendment Act 1971 (7 of 1971): Added material later reflected in the text such as s 20 relating to post mortem examinations.

• Health Legislation Amendment Act 1984 (28 of 1984): Multiple technical and administrative amendments, reflected in the notes next to various sections.

• Criminal and sentencing consequential amendments: Criminal Law Amendment Act (No. 2) 1992 (51 of 1992) and Sentencing (Consequential Provisions) Act 1995 (78 of 1995) amended penalty provisions, reflected in s 22 amendments.

• Acts Repeal and Amendment (Births, Deaths and Marriages Registration) Act 1998 (40 of 1998): Amended s 12 to reference the Births, Deaths and Marriages Registration Act 1998 s 44, and s 13 and s 14 were updated in 1998 to account for the registration scheme.

• Acts Amendment (Equality of Status) Act 2003 (28 of 2003): Technical updates, including changes to consent and next of kin references in ss 8-11, were made as part of this enactment.

• Medical and health regulatory updates: The Medical Practitioners Act 2008 and the Health Practitioner Regulation National Law (WA) Act 2010 are reflected in definition and registration cross‑references (s 2 definitions updated in 2008 and 2010 amendments).

• Mental Health Legislation Amendment Act 2014 (25 of 2014): Affected the posting requirement in s 8 by excluding “authorised hospitals” as defined in the Mental Health Act 2014 s 4.

• Public Health (Consequential Provisions) Act 2016 (19 of 2016): Amended administrative references and integrated the CHO’s role as defined under the Public Health Act 2016, with multiple sections amended as noted in the text.

• Human Tissue and Transplant Amendment Act 2022 (41 of 2022): Section 20 was amended on 22 November 2022 to clarify interactions with the Human Tissue and Transplant Act 1982.

Recurrent types of amendments

• Administrative modernisation: Many amendments updated definitions, administrative responsibility (linking to CHO defined in Public Health Act 2016), and inspection/admin powers to reflect changes in health governance.

• Procedural harmonisation: Amendments in 1998 and 2016 harmonised cause of death and coronial requirements with the contemporaneous Births, Deaths and Marriages Registration Act and public health administration.

• Penalty adjustments and currency updates: Amendments across the 1960s to 1990s adjusted monetary penalties and sentencing references to modern equivalents and consolidated penalties across statutes.

Interpretive note on the amendment history

• The compilation table documents which Acts amended the Anatomy Act and when they commenced. Amendments include both substantive policy changes (for example, enabling interstate despatch s 10A) and technical edits aligning the Anatomy Act with newer statutory frameworks (e.g., CHO definition, birth/death registration). The recurrent theme is administrative integration into wider public health, coronial and medical regulation systems. For practitioner purposes, the compilation table is the authoritative ledger of textual changes; any historical research into legislative intent should consult the original amending Acts and the published explanatory materials for those amendments.

The source document is a statutory compilation and does not report judicial decisions or any litigation history. No cases are cited or described in the text. Accordingly, the Act as presented contains no recorded litigation history in the compilation material.

Nevertheless, the statute’s language points to a number of areas likely to be fertile for legal dispute if litigation were to arise. The Act itself does not record judicial interpretation, so the following observations are framed as statutory fault lines indicated by the text rather than summaries of judicial holdings.

Potential areas for dispute grounded in the statutory text

• Priority and effect of a deceased person’s direction versus the senior next of kin’s veto (ss 2, 9-11): The Act permits an individual to direct anatomical examination in writing during life or verbally before death (s 10), and obliges the person having lawful possession to effect that direction if made known before interment or cremation. However, the same subsection explicitly allows the senior next of kin to require interment or cremation without examination. A court confronted with a factual dispute about whether a direction was properly made known, or about the rights of an executor versus senior next of kin, would be asked to interpret these competing statutory rights and the sufficiency of notice or evidence (e.g., whether verbal directions in presence of two witnesses meet s 10, and whether senior next of kin’s demand is effective).

• Who has lawful possession and authority to permit removal (s 9): Section 9 allows an executor or “other person having lawful possession of the body” to permit anatomical examination unless the senior next of kin objects. Litigation could arise over the legal characterisation of “lawful possession” in particular circumstances , for example, where multiple persons claim control, or where undertakers are involved who are excepted from the class of persons entitled to permit examination.

• Compliance with certificate/coroner prerequisites (s 12) and coroner involvement: Section 12 requires a certificate of cause of death by another medical practitioner or coroner findings before removal. Disputes could occur over whether the certificate satisfies the statutory requirement, whether a coroner’s investigation precludes removal for anatomy, or whether notice requirements to the CHO were complied with.

• Removal and possession of body parts (s 18): The Act’s strict prohibition on taking parts except in narrow circumstances, coupled with the CHO approval route, could lead to litigation over whether a particular taking was authorised in writing, whether consent or approval was adequate, or whether possession of a specimen was in contravention of s 18.

• Administrative discretion, natural justice and CHO decisions: The CHO has broad discretion to grant licences, approve persons to take parts, and enter interstate arrangements. Courts may be asked to review CHO decisions for procedural fairness, reasonableness, or compliance with statutory conditions if an affected party seeks judicial review. The Act’s text gives no prescriptive process for decision‑making, so administrative law principles would be applied by reference to the Public Health Act 2016 and general administrative law.

• Interactions with coronial and human tissue regimes (s 20): Disputes may arise over whether particular action is caught by the Anatomy Act or is governed by the Human Tissue and Transplant Act 1982, or whether a post mortem required by a competent legal authority precludes reliance on the Anatomy Act’s authorisation. Ambiguity about the applicable statutory source could produce litigation.

Because the source contains no case law, practitioners and researchers with litigation‑oriented interests should search reported decisions, coronial records and administrative review filings to see whether courts have addressed these questions. The Act’s text plainly flags the above areas as likely loci for contestation, but the compilation itself contains no judicial treatment to cite.

Practitioners should note a number of non‑obvious operational traps in the statutory language. These are factual and procedural points where failure to observe a specific textual requirement can transform lawful conduct into a criminal offence under s 22.

1. Individual directives can be overridden by senior next of kin (ss 10, 2)

• A person’s written or witnessed verbal direction to have their body examined is not absolute. The Act requires the nominated person to comply with such a direction unless “the senior next of kin of the deceased person requires the body to be interred or cremated without such examination” (s 10). Practically, an individual’s clear testamentary instruction may be displaced by a surviving senior next of kin. Do not assume personal direction is determinative without checking the senior next of kin hierarchy (s 2).

2. Strict hierarchy and adult age thresholds in senior next of kin (s 2)

• The senior next of kin is the first available person in a statutorily ordered list; that list includes age thresholds for some categories (e.g., de facto partner and children must be 18 or over). Where family structures are complex, determining who is the senior next of kin requires application of the statute, not informal family assumptions.

3. Written consent requirement and the “authority” definition (s 11)

• Section 11 requires that consent be obtained in writing and that the attention of senior next of kin or person having the body be directed to the relevant sections before removal under ss 8-10. The section treats “authority” as including any medical officer, nurse or other person who has attended the deceased. Failure to obtain written consent or to suitably notify can convert a permitted transfer into an offence under s 22.

4. Time and notice windows for removal (s 12)

• Do not remove a body until 12 hours after death and until six hours’ notice to the CHO has been given. Furthermore, a certificate of cause of death (under the Births, Deaths and Marriages Registration Act 1998 s 44) or coroner findings must accompany the body. Omission of any of these steps risks exposure to the criminal sanction in s 22(1).

5. Requirement to place body in a coffin or shell before removal (s 16)

• The Act prescribes the physical requirement that every body removed for examination be placed in a “decent coffin or shell” before removal. This is a specific procedural obligation that could be overlooked in logistics, and non‑compliance is an offence under s 22.

6. Immediate documentary obligations for authorised schools (s 14)

• The person in charge of an authorised school must demand and receive the cause of death certificate and within 24 hours transmit it and a return to the CHO and enter the details in a book to be produced on demand. The 24‑hour window is short; administrative delays may result in criminal liability under s 22(3)(c).

7. Limits on removal/possession of body parts and the need for CHO approval (s 18)

• Taking or possessing parts is broadly unlawful unless the taker both holds or is authorised by a practice licence and is approved in writing by the CHO. Approval must be explicit. Researchers and lecturers should not presume that possession of specimens used for teaching is lawful without both licence‑based authority and written CHO approval.

8. Posting requirement in public institutions (s 8)

• A printed copy of s 8 must be posted in a conspicuous place in penal establishments, hospitals or public institutions, except authorised hospitals under the Mental Health Act 2014. Failure to post may not itself be a criminal offence but could form part of compliance failures that attract sanction under s 22(3) for failing to comply with the Act.

9. Differing timeframes for disposal certificates if bodies are sent interstate (s 10A and s 16)

• Bodies despatched under s 10A must be accompanied by a certificate or record as in s 12 and the interstate agreement must require the receiving school to transmit certification of interment/cremation to the CHO within 12 weeks. This is longer than the six weeks required under s 16 for bodies examined within WA. Ensure contractual and logistic arrangements reflect these differing timeframes.

10. Immunity is conditional on compliance (s 19)

• The immunity against prosecution for licence holders (s 19) protects only those acting “according to the provisions of this Act.” Immunity does not shield licence holders who fail to comply with consents, records, notices, or other statutory duties. Immunity is not a blanket protection.

11. Fees and regulation may add hidden costs (s 23)

• The Governor may prescribe fees on the grant of licences and regulations for conduct, equipment, inspection and control of authorised schools. These may create additional compliance costs and operational standards beyond the Act’s primary text.

12. Terminology and cross‑references require checking

• Several key terms and obligations are defined by reference to other Acts (e.g., CHO in Public Health Act 2016; cause of death certificate in Births, Deaths and Marriages Registration Act 1998). Practitioners must read those cross‑references to confirm administrative details and procedural content.

13. Criminal penalties remain significant and include imprisonment (s 22(1))

• Unlawful practice exposing a person to two years’ imprisonment is a severe outcome. Do not assume offences are restricted to fines.

In sum, compliance requires careful procedural sequencing: ascertain who has the lawful right to permit removal; obtain/verify written consents; wait statutory time periods; give notice to the CHO; secure the required death certificate or coroner findings; transport in a coffin or shell; demand, lodge and record documents within the short statutory windows; obtain CHO written approvals to handle specimens; and retain documentary evidence of each step.

Below is a practical, source‑grounded compliance checklist for institutions and persons likely to operate under the Anatomy Act. Each step cites the controlling clause in the statute and focuses on predictable operational actions.

1. Confirm authorised status of the physical place (s 4, s 15)

• Only receive, possess or examine bodies at an “authorised school of anatomy” published in the Gazette (s 4(1); s 15). Before any anatomical activity begins, confirm the school’s authorisation notice in the Gazette, confirm any conditions attached to that authorisation (s 4(2)), and ensure those conditions are observable. Do not accept bodies at non‑authorised sites.

2. Apply for and maintain a practice licence (s 5)

• The person in charge of an authorised school must apply in the form approved by the CHO to obtain a practice licence (s 5(1)). Ensure licences are current and that the person in charge understands licence conditions. The licence must be displayed and compliance with all conditions is required; it also enables the licence holder to authorise other persons in writing to practise anatomy at the school (s 5(2)).

3. Ensure staff authorisations and CHO written approvals for specimens (ss 5, 18)

• Any person who will take, remove or have possession of body parts for teaching, research, or scientific purposes must be authorised in writing by the licence holder and must have written approval by the CHO (s 18). Keep written evidence of both the licence holder’s authorisation and CHO approval on file.

4. Establish and document consent procedures for families and executors (ss 9-11)

• Train staff to ensure that before removal under ss 8-10 the senior next of kin or person having possession of the body is directed to the relevant statutory provisions and that written consent is obtained (s 11). Keep robust records of who was notified, how, and the written consent. Understand the senior next of kin hierarchy in s 2 and document steps taken to identify the senior next of kin.

5. Verify cause of death certificate or coroner findings (s 12)

• Before removal, secure a cause of death certificate under the Births, Deaths and Marriages Registration Act 1998 s 44 provided by a medical practitioner not concerned in the post‑removal examination, or obtain official coroner findings (s 12). Ensure these documents accompany the body when transferred; the receiving school must demand and receive them (s 14).

6. Observe timing and notification obligations (s 12)

• Do not remove a body until at least 12 hours after death and until at least six hours’ notice has been given to the CHO of the intended removal (s 12). Record the time of death and the time notice was sent, and archive confirmation of CHO notification.

7. Physical handling standards (s 16)

• Place the body in a decent coffin or shell before removal and maintain appropriate dignity and security during transport (s 16). Ensure transportation meets any conditions specified by the Minister or CHO.

8. Immediate post‑receipt documentation and returns (s 14)

• On receipt of a body, demand and retain the cause of death certificate/coroner record, enter the required particulars (date/hour/from whom received, date/place of death, sex, proper full name, age, last place of abode) in the authorised school’s book, and within 24 hours transmit the certificate/record and the return to the CHO (s 14). Keep the book available to produce on demand by the CHO or an inspector.

9. Disposal and post‑examination certificates (s 16, s 17)

• After examination, arrange for decency, interment or cremation in line with the senior next of kin’s wishes (or religious burial practices where applicable) and transmit a certificate of interment or cremation to the CHO within six weeks of receipt of the body (s 16). Note the Governor may vary this period by Order in Council (s 17), and for interstate despatch under s 10A a 12‑week period applies.

10. Comply with public institution posting and procedural rules (s 8)

• If operating within or interacting with penal establishments, hospital or other public institutions, ensure that the printed copy of s 8 is posted in the institution’s entrance hall or other conspicuous place, unless the institution is an “authorised hospital” under the Mental Health Act 2014 s 4 (s 8). Ensure institutional staff understand their limited licence to permit removal where applicable.

11. Prepare for inspections and CHO reporting (ss 3, 6, 7, 14)

• Be ready for inspection at any time by the CHO or inspectors and keep required records up to date. The CHO will make quarterly returns to the Government statistician of bodies removed for anatomical examination (s 6). Ensure internal audit processes monitor compliance with the 24‑hour return window and the six‑week disposal certificate window.

12. Avoid unauthorised taking or possession of specimens (s 18)

• Do not remove portions or specimen parts from a body before the body is received into an authorised school, and do not remove portions from an authorised school except for burial or cremation unless the taker is both authorised under a practice licence and approved in writing by the CHO (s 18). Ensure chain‑of‑custody processes and documentary approvals for all specimens.

13. Ensure staff training on criminal exposure (s 22)

• Staff must be aware that unlicensed practice or receipt/examination otherwise than in accordance with the Act constitutes a crime liable to two years’ imprisonment (s 22(1)), and that other breaches carry fines. Maintain compliance checklists and regular training.

14. Check and comply with regulations and fees (s 23)

• Review relevant regulations made by the Governor under s 23 for detailed standards on conduct, equipment, inspection, discipline, prescribed forms and fees. Ensure that administrative procedures align with those regulations and that fees on licence grants are paid where prescribed.

15. Interstate despatch process (s 10A)

• If despatching bodies interstate under an agreement made by the CHO with Ministerial approval, ensure delivery includes the required certificate/record and follow CHO direction on manner and conditions of delivery (s 10A(2)-(3)). Verify that the interstate agreement includes a commitment by the receiving school to inter the body or cremate and to transmit a certificate to the CHO within the time specified (s 10A(1)).

16. Keep documentary evidence of all steps

• Given the criminal and monetary penalties, and the Act’s reliance on documentary compliance, keep duplicates and secure records of all consents, notices to the CHO, cause of death certificates, coroner findings, licence documents, CHO approvals, returns made to CHO, interment/cremation certificates, and any correspondence regarding interstate despatch.

17. When in doubt, consult CHO or legal counsel

• The CHO administers the Act and has discretion to grant approvals and make determinations. For borderline situations , e.g., questions about who is the senior next of kin, conflict between an executor and next of kin, or urgency surrounding coronial inquiries , seek CHO guidance and legal advice to reduce the risk of criminal exposure.

This compliance checklist is source‑grounded in the Anatomy Act 1930 provisions cited. It is operationally practical: the Act’s core compliance levers are documentary (consents, certificates, CHO approvals, and book entries); operational timing gates (12 hours/6 hours/24 hours/6 weeks); and licence/authorisation status. Designing workflows that reflect those levers will materially reduce exposure to the Act’s criminal and monetary penalties.
