Plain English Summary

2/10 complexity

This instrument updates how 'effects of lightning' are defined for veterans' compensation claims.

Under the Veterans' Entitlements Act, the Repatriation Medical Authority creates 'Statements of Principles' that determine which medical conditions are recognised as service-related for former defence personnel.

This amendment clarifies that external burns caused by lightning are not included in this definition. Only death or other bodily harm (excluding burns) from lightning strikes are covered under this instrument.

This exclusion exists because lightning-related burns are already covered under separate Statements of Principles dealing with external burns. The change ensures veterans' claims are assessed under the correct legal category without overlap.

The amendment applies to all existing matters under the relevant Statement of Principles.

Veterans’ Entitlements Act 1986
subsection 196B(2)

The Repatriation Medical Authority amends, under subsection 196B(2) of the Veterans’ Entitlements Act 1986 (the Act), Instrument No.151 of 1995 (Statement of Principles concerning effects of lightning) by:

omitting the definition of “effects of lightning” in paragraph 4, and inserting in its place the following definition:

“'effects of lightning' means the death or bodily harm sustained by a person when struck by lightning, excluding external burn due to lightning, attracting ICD code 994.0;”
