What it does
This legislative instrument, signed by Dane Roberts as Delegate of the Minister for the Environment and dated 10 January 2020, amends the list of exempt native specimens established under the Environment Protection and Biodiversity Conservation Act 1999 (EPBC Act). The instrument is made pursuant to subsection 303DC(1)(a) of the EPBC Act and operates by deleting a particular entry from the existing list of exempt native specimens (set out in Schedule 1 of the instrument) and inserting a replacement entry with revised scope and conditions (set out in Schedule 2). The instrument is expressed to be a legislative instrument for the purposes of the Legislation Act 2003 and commences the day after it is registered.
Mechanically, the amendment does three concrete things:
- It removes an earlier exemption entry that applied to specimens "that are or are derived from fish or invertebrates, other than specimens that belong to species listed under Part 13 of the Act, taken in the Western Australian West Coast Purse Seine Managed Fishery" (deleted by Schedule 1).
- It inserts a replacement exemption entry that applies to specimens "that are or are derived from fish or invertebrates taken in the Western Australian West Coast Purse Seine Managed Fishery and Development Zones, as defined in the management regime in force under the Fish Resources Management Act 1994", but explicitly excludes several categories of taxa (added by Schedule 2).
- It incorporates, as at commencement, any state and territory legislation that is referred to in Schedule 2 (the instrument states that "All state and territory legislation referred to in Schedule 2 to the instrument is incorporated as in force at the time this instrument commences").
The inserted notation in Schedule 2 conditions reliance on the exemption on two factual predicates: first, that "the specimen, or the fish or invertebrate from which it is derived, was taken lawfully", and second, that "the specimens are covered by the declaration of an approved wildlife trade operation under section 303FN of the EPBC Act in relation to the fishery". The replacement entry also enumerates four explicit exclusions, referencing specified provisions of the EPBC Act: taxa listed under section 209 (Australia’s List of Migratory Species), section 248 (Australia’s List of Marine Species), eligible listed threatened species as defined under section 303BC, and taxa listed under section 303CA (Australia’s CITES List).
