What it does
These regulations establish a permissions-and-prohibitions regime for access to, handling of, and use of the Allport Library and Museum of Fine Arts Collection and the areas in which the Collection is kept. They commence 12 December 2022 (reg 2) and are cited as the Allport Library and Museum of Fine Arts Regulations 2022 (reg 1). The instrument defines key terms, notably “Collection”, “item”, “reserved areas” and “employee” (reg 3), and then imposes a framework with these mechanical elements.
First, the Secretary controls research access: a person seeking to use, handle, copy, reproduce, remove an item, or to enter a part of reserved areas while closed, must apply for permission in a form approved by the Secretary (reg 4(1)-(2)). The Secretary may approve only if they consider the activity “appropriate for research purposes” and may refuse (reg 4(3)). When permission is granted, the Secretary may impose terms and conditions, limit their application, and cancel or amend them at any time by written notice (reg 4(4)(a)-(d)).
Second, the regulations set prohibitions backed by monetary penalties: borrowing or removing items except as provided in the underlying “agreement” or authorised by a permission (reg 5); using, handling, copying or reproducing an item except as authorised (reg 6); photographing or making electronic representations of a reserved area or of items or parts of items except as authorised (reg 7); entering or remaining in reserved areas while closed under the Secretary’s power (reg 9); activating security alarms without lawful excuse (reg 11). Each of those contraventions carries the same stated penalty: a fine not exceeding 0.5 penalty units (regs 5, 6, 7, 9, 10(2), 11).
Third, an operational enforcement mechanism is conferred on employees: employees may direct a person to leave or exclude a person from the reserved areas for contravening the regulations or the Libraries Regulations 2022, or for entering without authorisation; persons must comply with those directions (reg 10). Finally, the regulations require acknowledgement of the Collection as a source when a person publishes or intends to publish work that uses an item as a source (reg 8).
