ALICE SPRINGS (WASTE MANAGEMENT FACILITY) BY-LAWS 2013

The by-laws define several key terms. Facility means the Alice Springs Waste Management Facility on Lot 7902 Commonage Road and any other public waste management facility, landfill or garbage dump however described that the Council may establish from time to time. This is a deliberately broad definition: it gives the Council power to apply the same by-laws to future waste sites without fresh subordinate legislation. Council means the Alice Springs Town Council. Employee means a Facility employee irrespective of whether the Facility is operated by Council or a contractor, and includes the manager. This definition ensures that the by-laws apply equally to Council staff and private contractor staff, so that directions given by either are enforceable. Manager means the manager of the Facility from time to time, again regardless of whether they work for Council or a contractor. Tip shop means the shop on or attached to the Facility where goods are sold. This is relevant to the scavenging prohibition: material acquired through the tip shop is exempt from the permit requirement for removing waste material. The concept of conditions of entry is central. By-law 5(1) requires entry through the public entrance, during opening times and on payment of any applicable fee. By-laws 6(1) and 7(1) deem a person entering the Facility to have agreed to load inspections and to stating their name, address and date of birth if requested. This deemed consent is a legal fiction: the person cannot opt out by refusing to agree; the agreement is automatically imposed as a condition of entering. Failure to comply with a request under either by-law then becomes an offence, not a breach of contract. The by-laws also create the concept of a regulatory offence (by-law 16), which may trigger special procedural or evidentiary rules under other legislation. The infringement notice system allows the Council to offer a fixed penalty for specified offences as an alternative to prosecution. The fixed penalties in the Schedule are expressed in penalty units, not dollar amounts, so the actual fine amount will vary with the value of a penalty unit set under the Penalty Units Act. The infringement notice must include statements about the right to elect to have the matter dealt with by a court under section 21 of the Fines and Penalties (Recovery) Act 2001, about the consequences of non-payment including potential enforcement actions, and must include a statement of election.

The by-laws directly affect any person who enters or seeks to enter the Alice Springs Waste Management Facility. This includes private individuals disposing of household waste, businesses and tradespeople disposing of commercial or construction waste, farmers and rural residents, tip shop customers, and potentially visitors who have no waste to deposit. It also affects employees of the Council and of any contractor engaged to operate the Facility. The manager is given specific powers to grant permissions for tampering with fences, gates, plant, structures, vehicles or waste material (by-law 11) and for causing a fire (by-law 12). The by-laws apply to the Facility alone, but the Facility definition extends to any future waste facility the Council establishes, so persons using any future Council-operated landfill or dump will also be bound. The by-laws particularly affect persons who might wish to scavenge or remove waste material: they must obtain a permit from the Council (though the tip shop is exempt). This may affect small-scale recyclers, scrap metal collectors, community groups or individuals seeking reusable items. The ban on animals applies irrespective of whether the animal is contained in a vehicle, which means that a person with a dog in a ute or a cat in a carrier may not enter the facility. This affects tradies who keep dogs in work vehicles, persons with assistance animals (no exemption is provided for assistance animals), and families who travel with pets. The load inspection condition may affect tradespeople carrying mixed loads who may be concerned about privacy or about being required to unload for inspection. The identity disclosure requirement may affect persons who are concerned about providing personal information to facility employees. The by-laws also affect the Council itself: it must administer the infringement notice scheme, issue infringement notices, serve courtesy letters under the Fines and Penalties (Recovery) Act, and potentially pursue enforcement. The Council must ensure that all signage is clear and enforceable. Contractors operating the Facility must train employees to give lawful directions that relate to activities on the Facility and that are necessary or convenient for management, and must ensure employees do not abuse their powers.

Duties of persons entering or using the Facility:

• Enter only through the public entrance, at times the facility is open to the public, and on payment of any applicable fee (by-law 5). There is no duty to pay a fee if none is set, but if a fee is set it must be paid.
• Submit to inspection of any load carried or towed by a vehicle, if requested by an employee (by-law 6). The person must comply with the request; failure is an offence.
• On request by an employee, state their name, address and date of birth (by-law 7). This must be done while in the Facility. There is a reasonable excuse defence for non-compliance (by-law 7(3)), but the by-law does not specify what constitutes reasonable excuse.
• Comply with any direction given by an employee that is necessary or convenient for management of the Facility (by-law 8). Directions may relate to movement, speed, parking or placement of vehicles or machinery; location for depositing particular waste types; manner of depositing waste; or a direction to leave the site. Failure without reasonable excuse is an offence.
• Comply with all signs, notices and printed directions situated within and upon the Facility, to the extent they require the person to do or refrain from doing any act (by-law 9). Reasonable excuse defence available.
• Not remove waste material of any kind from the Facility without a permit (by-law 10). Material acquired through the tip shop is exempt.
• Not tamper with a fence, gate, plant, structure, vehicle or waste material without permission of the manager (by-law 11). Reasonable excuse defence available for contravention.
• Not cause a fire without the permission of the manager (by-law 12). No reasonable excuse defence is provided, so this appears to be a strict liability offence.
• Not bring any animal onto the Facility, whether or not contained in a vehicle (by-law 13). Reasonable excuse defence available. No exemption for assistance animals stated.
• Not threaten, intimidate or use abusive language against an employee carrying out duties in the course of employment (by-law 14). No reasonable excuse defence provided.
• Not hinder or obstruct an employee carrying out duties in the course of employment (by-law 15). No reasonable excuse defence provided.

Rights of persons:

• The right to enter the Facility subject to compliance with the by-laws.
• The right to apply for a permit to remove waste material (though the by-laws do not specify criteria for granting or refusing permits; that is at Council’s discretion).
• The right to request permission from the manager to tamper with fences, gates, plant, structures, vehicles or waste, or to cause a fire.
• The right to elect to have an alleged offence dealt with by a court instead of paying an infringement notice (by-law 18(3)(c) and the Fines and Penalties (Recovery) Act).
• The right to use the tip shop and acquire material there without needing a permit for removal.

Rights of employees and managers:

• The right to inspect any load carried or towed by a vehicle entering or on the Facility (by-law 6).
• The right to request a person’s name, address and date of birth (by-law 7).
• The right to give directions necessary or convenient for management, including directions to leave (by-law 8).
• The manager’s right to grant permission for tampering (by-law 11) and fire (by-law 12). The by-laws do not specify any criteria for granting or withholding permission; this creates unfettered discretion.

The by-laws create a two-tier penalty system: maximum court-imposed penalties and fixed penalties under infringement notices.

Maximum penalties (by-law 17): A person guilty of an offence is liable to a penalty not exceeding 100 penalty units for an individual or 500 penalty units for a body corporate. In addition, the court may impose a daily penalty not exceeding 5 penalty units for an individual or 25 penalty units for a body corporate for each day the offence continues. This continuing penalty applies only to offences that can be ongoing, such as failing to comply with a direction (e.g. a direction to leave the site) or failing to comply with signage. The value of a penalty unit is set under the Penalty Units Act (Northern Territory) and is currently $157 for an individual (as of 2024-25), so the maximum individual fine is $15,700 for a single offence plus up to $785 per day thereafter. For a body corporate, the maximum is $78,500 plus $3,925 per day. These are substantial penalties for conduct at a waste facility.

Infringement notices (by-law 18 and Schedule): For the specific by-laws listed in the Schedule, the Council may serve an infringement notice offering a fixed penalty as an alternative to prosecution. The fixed penalties are expressed in penalty units. The Schedule sets: entering improperly - 10 units; failing to comply with load inspection request - 3 units; failing to state identity - 3 units; failing to comply with direction - 3 units; failing to comply with sign - 3 units; removing waste without permit - 1 unit; tampering with equipment or waste material - 10 units; causing a fire - 100 units; bringing animal - 1 unit; abusing employee - 3 units; hindering or obstructing staff - 3 units. Note that causing a fire has a fixed penalty equal to the maximum court penalty (100 units), indicating a policy decision to treat this as a serious offence with no discount for an infringement notice. The fixed penalty for removing waste without permit and for bringing an animal is only 1 unit (about $157), which is low.

Infringement notice procedure: The notice must be in a determined form and include the alleged offender’s name, nature of the offence, date/time/place, amount of fixed penalty, and the period (14 days from service) and place to pay. The notice must contain statements explaining: (a) the person may expiate the offence by paying within 14 days, (b) if paid Council will take no further action, (c) the person may elect to have the matter dealt with by a court under section 21 of the Fines and Penalties (Recovery) Act by completing a statement of election and serving it on Council before the due date or before a courtesy letter is served, (d) if not paid and no election, enforcement may follow including licence suspension, property seizure, wage deduction, statutory charge on land, community work order or imprisonment. The notice must also include a statement of election containing the information required by regulation 7(1) of the Fines and Penalties (Recovery) Regulations. A fixed penalty may be expressed as a fraction of a penalty unit.

Enforcement options: The Council may choose to prosecute rather than issue an infringement notice. For infringement notices that are not paid and no election made, the Fines and Penalties (Recovery) Act 2001 applies. That Act provides for a courtesy letter, then enforcement action. The by-laws list potential enforcement outcomes in the required notice statements: licence suspension, property seizure, deduction from wages or salary, statutory charge on land, community work order, or imprisonment if a community work order is breached. These consequences apply to unpaid fines generally; they are not specific to waste facility offences.

The by-laws are made under Part 13.1 of the Local Government Act 2008. That Act sets the general power of a council to make by-laws for its municipality. The by-laws are subordinate legislation and must be consistent with the parent Act. The definition of Act in by-law 3 refers to the Local Government Act 2008, even though the header of the by-laws as at 28 May 2014 says “By-laws under the Local Government Act 2019”. This discrepancy likely arises from a reprint which updates the header to the current Act but does not change the by-law text; the operative definition remains the 2008 Act. The by-laws repeal the earlier 1984 by-laws, so they are the exclusive regulatory code for the Facility.

The by-laws interact with the Fines and Penalties (Recovery) Act 2001 and the Fines and Penalties (Recovery) Regulations 2001 through the infringement notice procedure. The by-laws expressly incorporate the Act and Regulations by reference for the election process and enforcement. A person served with an infringement notice may elect under section 21 of that Act to have the matter dealt with by a court. Failure to pay or elect results in that Act’s enforcement machinery applying.

The by-laws classify any offence as a regulatory offence (by-law 16). This classification may have implications under other Northern Territory laws. For example, the Criminal Code (or the Criminal Procedure Act) may treat regulatory offences differently from indictable offences or simple offences in relation to burden of proof, summary jurisdiction, or limitation periods. The by-laws themselves do not specify the meaning of “regulatory offence”, so one must look to the broader NT legislative framework.

The by-laws may interact with environmental protection legislation, such as the Waste Management and Pollution Control Act 1998 (NT). That Act regulates waste management more broadly and may impose licensing or approval requirements on the Facility itself. The by-laws do not duplicate those requirements; they focus on site conduct. However, conduct that contravenes a by-law may also contravene the environmental Act, and both could be enforced separately.

The by-laws may also interact with work health and safety laws. For example, a direction from an employee under by-law 8 must relate to management of the Facility and could include safety-related directions. However, if a direction conflicts with a person’s obligations under work health and safety legislation, the person may have a reasonable excuse for non-compliance. The by-laws do not provide a direct exemption, but the reasonable excuse defence available for most offences (except fire, abuse, hindering) might allow a person to argue that compliance would have exposed them to safety risks.

The Anti-Discrimination Act 1992 (NT) may be relevant to the animal ban in by-law 13. There is no express exemption for assistance animals (guide dogs, hearing dogs). If a person with a disability is refused entry because of an assistance animal, they could potentially argue discrimination. The by-laws do not override anti-discrimination legislation, so a court or tribunal would need to resolve any conflict. However, the by-law’s ban is absolute and without a disability exemption, creating a real risk of inconsistency.

The by-laws also interact with the Local Government Act’s general provisions about by-law making, such as the requirement for a special resolution (which was obtained on 25 November 2013), and the requirement that by-laws be consistent with the Act and not repugnant to the general law.

The Alice Springs (Waste Management Facility) By-laws 2013 (Subordinate Legislation No. 49, 2013) were made by special resolution of the Alice Springs Town Council at its Ordinary meeting on 25 November 2013. They were notified in the Gazette on 28 May 2014 and commenced on 28 May 2014. They repealed the Alice Springs (Garbage Dumps) By-laws 1984 (Subordinate Legislation No. 31 of 1984). The by-laws were made under the Local Government Act 2008. The endnotes indicate that general amendments of a formal nature were made by the Interpretation Legislation Amendment Act 2018 (Act No. 22 of 2018) to by-laws 1, 2, 3, 18, 59 and 82. Note that the by-laws as enacted only have 18 clauses; the reference to by-laws 59 and 82 likely refers to a numbering scheme in the reprint or is an error in the endnotes, but we report as stated. These amendments were likely for updating references to Acts or correcting formatting. The endnotes also state that the Interpretation Legislation Amendment Act 2018 made general amendments of a formal nature to “bl 1, 2, 3, 18, 59 and 82”. Since this set of by-laws only contains 18 clauses, the references to 59 and 82 are puzzling; they may relate to a consolidated reprint that includes other by-laws, or the endnote may be incorrectly copied from another instrument. We note this without speculation. No other amendments are recorded. The by-laws remain in force as at the stated reprint date (28 May 2014). The Act under which they were made (Local Government Act 2008) has since been repealed and replaced by the Local Government Act 2019, but the by-laws continue in force under transitional provisions of the 2019 Act unless they have been repealed or amended. The source does not indicate any later amendments.

The source text does not refer to any cases or court decisions interpreting or challenging the by-laws. There is no mention of any prosecution, appeal, or judicial review in the text. This does not mean no litigation has ever occurred; it simply means the source does not provide that information. The by-laws, being subordinate legislation of a local council, are unlikely to generate high-profile litigation unless a significant rights issue arises. The most likely areas for potential challenge include: the scope of the deemed consent to load inspections and identity disclosure (whether this amounts to an unlawful search or self-incrimination), the animal ban in relation to assistance animals, the breadth of the manager’s discretion to grant or withhold permissions, and the strict liability offences for fire, abuse and hindering (particularly if a person is convicted without proof of fault). The infringement notice process would be tested if a person elected to go to court and argued that the by-law under which the notice was issued was invalid or that the notice was defective. The lack of litigation history may suggest that the by-laws are either accepted by the community or enforced through infringement notices without contest. Persons receiving infringement notices have the option to elect court, but few may do so given the low fixed penalties. The environment of Alice Springs and the practical nature of waste facility management probably mean that most users simply comply or pay the fine. We cannot invent case names or outcomes.

Several provisions in these by-laws create traps for the unwary, particularly for those accustomed to more liberal waste facility access.

Deemed consent traps. By-laws 6(1) and 7(1) state that entry is conditional on a person being deemed to have agreed to load inspections and identity disclosure. This means the person cannot refuse on the basis of privacy or commercial sensitivity. Even if the person has not actually agreed, the law treats them as having agreed by virtue of entering. Refusal to cooperate then becomes an offence, not a breach of a contractual condition. The reasonable excuse defence for identity (by-law 7(3)) and load inspection (by-law 6(3) does not include a reasonable excuse defence; it simply says a person who does not comply is guilty - so load inspection refusal is strict liability? By-law 6(3) says “A person who does not comply with a request given under clause (2) is guilty of an offence.” There is no “without reasonable excuse” qualifier, unlike by-law 7(3). So refusing a load inspection is a strict liability offence with no defence. This is a harsh provision that could catch someone who legitimately cannot safely unload or who has a mechanical issue.

No reasonable excuse for fire, abuse, hindering. By-laws 12(2), 14(2) and 15(2) omit the words “without reasonable excuse”. This means they are likely strict liability offences. A person could be convicted even if they had a good reason for causing a fire (e.g. an emergency), unless they can rely on a general defence such as necessity or sudden emergency under the Criminal Code. But those common law defences may not be available or may be limited. Similarly, a person who uses abusive language in response to provocation may still be guilty, as there is no defence of reasonable excuse. The hindering offence could catch someone who accidentally blocks an employee while manoeuvring a vehicle.

Broad definition of Facility. The definition includes “such other public waste management facility landfill or garbage dump however described which may be established by Council from time to time”. This means the by-laws can apply to any future facility without notice to the public. A person who uses a new facility might not know which by-laws apply.

Animal ban even in vehicles. By-law 13(2) confirms that the ban applies irrespective of whether the animal is contained in a vehicle. This means a tradie with a ute carrying a dog in a cage cannot enter, even if the dog never leaves the vehicle. No exemption for assistance animals. This could breach the Disability Discrimination Act 1992 (Cth) or the NT Anti-Discrimination Act. A person with a guide dog would have to leave the dog outside the facility, which may be impractical or unsafe.

No permit criteria for scavenging or tampering. By-laws 10 and 11 allow the manager to grant permits or permissions, but no criteria are stated. The manager has unfettered discretion. A person could be refused a permit for scavenging for no stated reason, and there is no review mechanism in the by-laws. This creates a risk of arbitrary or discriminatory treatment.

Fixed penalty for causing fire equals maximum court penalty. The Schedule sets 100 penalty units for a fire offence, which is the same as the maximum court-imposed penalty. This means there is no incentive to accept the infringement notice; the only benefit is avoiding the time and cost of court proceedings. For a serious fire, the Council may well choose to prosecute rather than issue an infringement notice.

Short payment period. The infringement notice must be paid within 14 days of service. Failure to pay or elect within that period triggers the Fines and Penalties (Recovery) Act process, which can lead to enforcement including licence suspension. This is a short window.

Body corporate liability. The penalties for bodies corporate are five times higher than for individuals. A company whose employee contravenes a by-law may be liable, and the daily penalty continues. Companies sending multiple vehicles to the facility need strict procedures.

Tip shop exemption. The scavenging prohibition does not apply to material acquired through the tip shop. However, a person who buys an item at the tip shop and also takes other waste without a permit commits an offence. The boundary between tip shop goods and other waste may be unclear.

For individuals, the most straightforward approach is to treat the Facility as a controlled site with strict rules. Before entering, check the opening hours and any applicable fee. Ensure the vehicle does not contain any animal of any kind, including dogs, cats, or livestock in trailers. Leave pets at home or with someone outside the facility. If you have an assistance animal, seek legal advice or contact the Council in advance to request an exemption; the by-laws have no exemption, but the Council may be able to provide an alternative arrangement or issue a permit. Do not bring any fire-making equipment or light any fire on site; if you need a fire for works (e.g. to burn off), obtain written permission from the manager before visiting.

When arriving, drive through the public entrance. If an employee asks to inspect the load in or on your vehicle, allow the inspection; do not refuse, even if you believe the request is unreasonable. The only defence is reasonable excuse, but the by-law does not specify what constitutes excuse, so compliance is safest. If you are asked for your name, address and date of birth by an employee, provide that information. You may ask why it is needed, but you must provide it or risk an offence (only identity refusal has a reasonable excuse defence; but reasonable excuse is not defined and may be limited). Carrying identification documents is advisable, especially for drivers of commercial vehicles.

While on the Facility, obey any direction given by an employee. This includes directions about where to drive, how fast, where to park, where to deposit specific types of waste, and how to deposit waste (e.g. sorting requirements). If you are directed to leave the site, do so promptly; remaining after a direction to leave is an independent offence. Pay attention to all signs, including speed limits, no entry signs, directional signs, and warning signs. If a sign says “no dumping” or “tip shop only”, comply.

If you wish to remove waste material (such as scrap metal, timber, or discarded items), you must obtain a permit from the Council. Do not assume that abandoned materials are free for the taking. The only exception is material purchased from the tip shop; keep a receipt as proof. Do not tamper with any fence, gate, structure, plant, vehicle or waste material unless you have the manager’s permission. This includes not climbing on waste piles, not moving barriers, and not adjusting equipment.

For body corporates, the compliance burden is higher. Ensure that all employees and contractors who will drive to the Facility are trained on these by-laws. Implement a pre-trip checklist: no animals in vehicles; loads should be covered and accessible for inspection; driver must carry identification. If the company uses tip shop purchases, ensure a separate account is kept of what was bought versus what might be considered scavenging. Consider seeking a standing permit from the Council for the removal of recyclable waste materials if that is part of the business model. Regularly review the Council’s website for changes to hours, fees, or signage that may impose new requirements. The daily penalty for bodies corporate continues until the company complies; if a vehicle is refused entry and directed to leave, the driver must comply immediately, or the company faces escalating fines.
