Airworthiness Directives 2004 - Revocation and Remaking - Sikorsky S-76 Series Helicopters

The instrument rests on a small set of administrative legal concepts evident in the text. First, the legal authority: the delegate is exercising a statutory power under subregulation 39.001(1) of the Civil Aviation Safety Regulations 1998. The instrument records the delegate's act in two parts, revocation and re-making, which are discrete legal acts in administrative practice: revocation removes an instrument from force; re-making creates a fresh instrument with the content specified (opening paragraph; Schedule 1; Note). Second, the "separate instruments" concept: rather than leaving the ADs embedded within a consolidated instrument, each AD in Schedule 1 is to be a separate instrument attached to this decision. That is explicit: the delegate will "make, as separate instruments, each Airworthiness Directive mentioned in Schedule 1 and attached" (opening paragraph).

Third, the preservation-of-substance principle: the Note states that each attached AD is being "re-made in exactly the same form as appears in the latest published edition of the Directive." That phrase anchors the whole exercise to replication of published text, rather than amendment. It means the instrument is not introducing new technical content; instead it is reproducing the latest published AD words into the new separate-instrument format. Fourth, the Schedule itself is a formal list of the ADs affected. The Schedule contains AD names and AD numbers; where entries include "Amdt" notation, the schedule records amendment levels for particular ADs (for example AD/S-76/8 Amdt 11). Several AD entries are qualified with the word "CANCELLED," and at least one entry is labelled "Not Issued". Those annotations are included in the Schedule listing and therefore form part of the administrative record of what is being revoked and re-made.

Finally, the instrument reflects a distinction between legal form and substantive obligation. The text instructs an administrative change in how obligations are presented (as separate attached instruments) while signalling that the latest substantive text of each AD is to be preserved. Practically, that concept affects citation, record-keeping and the formal instrument that operators and maintainers will reference going forward, even though the substantive requirements of the ADs are unchanged, according to the Note.

The instrument affects stakeholders in a defined operational slice of civil aviation: holders and operators of Sikorsky S-76 series helicopters, maintenance organisations, certifying engineers, and any person or entity that relies on or enforces the listed ADs will be the parties materially affected. That follows from the Schedule: it enumerates Airworthiness Directives specifically with the AD series identifier "S-76", and by naming systems and parts (for example "Fuselage Tail Cone Inspections", "Main Rotor Blade - Tip Plate Assembly Retention Bolts", "Main Gear Box Assembly - Shaft and Spur Pinion Inspection and Retirement"). The instrument does not itself create new substantive compliance obligations; it reproduces existing ADs in the "latest published edition" form. Therefore, anyone who was subject to those ADs prior to this instrument remains subject to their requirements once the ADs are re-made, because the Note preserves the latest published form.

Beyond operators and maintainers, the instrument affects compliance officers and legal advisers who must update references and documentation. The mechanical revocation and re-making means that the primary legal instruments to be cited for compliance purposes will be the newly attached separate instruments, not the prior formats. Where entities maintain regulatory compliance registers, maintenance programmes, continuing airworthiness records, certificates of release to service, or audit trails that reference the earlier instrument identifiers or consolidated AD lists, they will need to verify that the references remain correct after the re-making. The Schedule shows multiple entries with amendment numbers (Amdt) and some entries annotated "CANCELLED" or "Not Issued"; those annotations may create particular points of attention for operators confirming whether a given AD is active, has been cancelled prior to re-making, or requires different handling in records.

Regulators and enforcement bodies within CASA are also affected administratively: the delegate has altered the instrument structure, and CASA's internal registers, gazettes or online AD repositories will need to reflect the new separate instruments. Finally, suppliers, inspectors and third-party auditors whose work relies on reading the applicable AD will need to confirm they are applying the attached, re-made instruments, in the exact form stated in the Note.

The instrument itself states no new technical duties or rights beyond the structural revocation and re-making of the listed ADs. The operative declaration is administrative: the delegate revokes listed ADs and makes them as separate attached instruments (opening paragraph; Schedule 1). The Note specifying that each attached AD is "re-made in exactly the same form as appears in the latest published edition of the Directive" is the central protection for rights and duties: it preserves the substantive wording of the latest published ADs. Therefore the primary substantive duties and rights remain those contained in the re-made AD texts; this instrument preserves them rather than altering them.

From an administrative-compliance perspective, the key duty created by this instrument is procedural: affected parties must read and rely on the newly attached separate instruments as the operative AD instruments going forward. That is not explicitly phrased as a duty in the text, but it follows from the fact that the previously existing instruments listed in Schedule 1 are revoked and the re-made versions are the attached instruments. Consequently, rights that depend on the content or timing of ADs (for example rights to challenge or seek exemptions, or the right to demonstrate compliance to an inspector) will now attach to the newly made instruments rather than the revoked originals. The instrument does not set out timelines, compliance windows, or transitional provisions; those will be found, if present, in the attached re-made ADs which the Note says are identical in substance to the latest published editions.

The instrument does not itself create appeal or review procedures. It is silent on remedies, exemptions, or enforcement mechanisms; these matters are left to the substantive AD instruments and to the underlying regulatory framework (the instrument merely records that the delegate is acting under subregulation 39.001(1) of the Civil Aviation Safety Regulations 1998). Practically, therefore, an affected party's rights to contest, seek clarification or obtain relief are those available under the general CASA/regulatory regime and under the content of each re-made AD. The absence of express transitional directions in this instrument means that if an affected party needs to know how to treat actions taken under the revoked instrument for record-keeping or certification purposes, they must consult the attached re-made AD and CASA guidance or contact CASA for administrative clarity.

The instrument contains no express penalty provisions, financial sanctions or enforcement procedures within its own text. Its operation is administrative: to revoke and re-make the listed ADs while preserving their published content (opening paragraph; Note). The Schedule lists the ADs being revoked and re-made, but the instrument does not itself set out compliance timelines, penalty amounts or enforcement mechanisms. Those elements, if they exist, will be part of the substantive text of each re-made AD (which the Note says is identical to the latest published edition) or in the broader regulatory framework under which ADs are issued and enforced.

Because the delegate acts under subregulation 39.001(1) of the Civil Aviation Safety Regulations 1998, enforcement and penalty matters are governed by the statutory and regulatory regime that confers authority to CASA and its delegates; however this instrument does not reproduce those enforcement provisions. From a practical standpoint, stakeholders must look to the attached re-made AD texts for any express compliance obligations, and to the CASR and related enforcement instruments for information about penalties, certification consequences and legal sanctions for non-compliance.

The administrative revocation and re-making may have enforcement implications that are practical rather than substantive. For example, inspectors, auditors and enforcement officers need to ensure they are referencing the current (re-made) instruments when assessing compliance, and operators need to ensure their maintenance records and compliance evidence cite the correct document. The instrument does not specify whether the re-made instruments carry the same instrument identifiers or whether CASA will re-number or re-issue unique instrument identifiers; those practicalities will determine how enforcement references should be made in practice. Because the Note commits to re-making "in exactly the same form," it is reasonable on the face of the instrument to expect that substantive compliance obligations and any penalties attached to them are preserved, but the instrument itself does not set out enforcement detail.

This instrument is explicitly located within the Civil Aviation Safety regulatory architecture: it is made by "a delegate of the Civil Aviation Safety Authority" acting under subregulation 39.001(1) of the Civil Aviation Safety Regulations 1998 (opening paragraph). That citation identifies the statutory provenance of the delegate's power. Within the limited text of the instrument, the primary interaction is therefore with the CASR 1998 regime that provides the authority to issue, amend or revoke Airworthiness Directives. The instrument does not recapitulate the CASR provisions in full, nor does it itself purport to amend the CASR; it is an exercise of the administrative powers that those Regulations confer.

The instrument also interacts with the body of Airworthiness Directives as a distinct regulatory corpus. By revoking and re-making the ADs listed in Schedule 1, it changes the formal legal instruments that constitute the operative ADs for the Sikorsky S-76 series. For users of the regulatory corpus, that interaction affects citation, registry records, and any cross-references in other regulatory materials, manuals or maintenance programmes that previously referenced the revoked instruments. The Note's assurance that re-made ADs are identical in substance to the latest published editions limits substantive legal change, but it does mean that the formal reference point for legal obligations shifts to the newly created separate instruments.

The instrument may also affect administrative interactions with non-regulatory documents that reference ADs, such as maintenance programmes, type certificates, continuing airworthiness management documents and contractual maintenance obligations. Those documents often cite specific AD numbers or editions; the revocation and re-making exercise could create a need to update documentary references to ensure they point to the attached instruments. Where other laws or instruments incorporate AD requirements by reference (for example, certification standards or contractual clauses that refer to "the relevant AD"), the relevant obligations will now be satisfied by compliance with the re-made ADs so long as the substance remains unchanged, as the Note states.

Finally, the instrument is silent about interaction with judicial review rights, administrative appeals, or other statutory remedies. Any such interactions will be governed by general administrative law and the CASR framework, not by this instrument itself. The instrument alters the formal instrument landscape but, by its own Note, preserves the latest substantive AD texts, thereby aiming to minimise disruptive legal interaction while altering record-keeping and citation paths.

The text of the instrument itself records a single administrative event dated 20 December 2004, signed by David Alan Villiers as delegate of CASA (signature line). It does not record any earlier iterations of this same instrument, nor does it contain a schedule of prior amendments to this revocation/remaking instrument. The Schedule 1 entries, however, contain their own amendment annotations for the individual ADs. For example, several AD entries are annotated with amendment numbers, such as AD/S-76/8 Amdt 11, AD/S-76/21 Amdt 1, AD/S-76/27 (no amendment specified in the text provided), AD/S-76/65 Amdt 4, AD/S-76/29 Amdt 4. Those Amdt notations in the Schedule reflect the amendment histories of the individual ADs as recorded at the time the Schedule was compiled; they are not amendments to this revocation/remaking instrument itself.

The instrument's Note states that each attached AD is being re-made "in exactly the same form as appears in the latest published edition of the Directive." That phrase indicates that for each AD the delegate has used the "latest published edition" as the source text for the re-made instrument. Consequently, any amendments that were already in the latest published edition of an AD are carried into the re-made separate instrument. The instrument therefore functions as a republishing event that consolidates the latest amendment status of each listed AD into separately-made instruments attached to the revocation/remaking notice.

There is no further amendment footnote, expiry clause, sunset, or serial amendment history recorded in the instrument provided. The list of ADs in Schedule 1, with their amendment numbers, is the only explicit record of amendment status visible in the text. Any subsequent amendments to the re-made ADs would have to be made by later separate instruments; this instrument neither anticipates nor precludes such subsequent amendment, it merely sets out the act of revocation of the prior instruments and re-making of the latest-published editions as attached instruments on the date specified.

The instrument contains no reference to litigation, court proceedings, challenges, or decisions in relation to the revocation and re-making exercise. The text is a short administrative act: a delegate revokes a set of ADs and re-makes them as separate instruments (opening paragraph; Schedule 1; Note). There is no mention of judicial review, appeals, or any past or pending legal contestation in the material provided. Accordingly, within the four corners of the instrument, there is no litigation history to report.

Because the instrument does not purport to change substantive technical requirements , the Note promises the re-made ADs are identical to the latest published editions , it is likely intended as an administrative housekeeping exercise. That administrative nature is consistent with the absence of litigation references. Any litigation that might concern the substantive content of individual ADs would be directed at the ADs themselves or at the broader regulatory framework, but such litigation is not documented in this instrument. For practitioners needing to know whether one of these ADs has been the subject of legal challenge, the instrument does not provide that information and the appropriate step is to consult case law databases, CASA records or the attached AD texts for any references to legal proceedings , none of which are included in the text provided.

The instrument is short and administrative, but it contains a few points that can cause practical confusion if not noticed. First, the instrument revokes and re-makes the listed ADs "as separate instruments" and provides a Note that the re-made ADs are "in exactly the same form as appears in the latest published edition of the Directive." That apparent sameness can lull practitioners into assuming nothing has changed; however the formal act of revocation and re-making alters the legal form and possibly the instrument citation or registry entry for each AD. If a maintenance programme, continuing airworthiness record or contractual clause cites a specific previously-issued AD instrument by its prior citation or registry entry, that reference may need updating to the newly attached instrument even if the substantive text is unchanged. The instrument does not state how CASA will publish, number or reference the newly created separate instruments in its registers; that practical gap is a point of attention.

Second, the Schedule includes numerous entries annotated "CANCELLED" and one entry annotated "Not Issued." Since the instrument revokes and re-makes the listed ADs, those annotations may be ambiguous in practice. The instrument does not explain whether ADs labelled "CANCELLED" are being re-made in their cancelled form, or whether the inclusion of a cancelled AD in the Schedule is simply a record-keeping step. The Note's wording suggests the re-made AD will match the latest published edition, which could itself be a cancelled edition; practitioners must therefore check the attached instruments to determine whether a particular AD is active, cancelled, or otherwise different in status.

Third, the Schedule shows multiple ADs with amendment numbers (Amdt). The instrument does not restate the amendment content. If a practitioner needs to know the effective date of a particular amendment or the precise text of an amendment, they must consult the attached re-made AD or the latest published edition referenced in the Note. The instrument gives no transitional directions about how to treat maintenance, inspections or life-limited parts actions that were performed under the revoked instruments prior to re-making; whether those actions are recognised for compliance purposes depends on the substance of the re-made ADs and on CASA practice, which is not described here.

Fourth, the instrument does not include express enforcement, penalty or appeal provisions, leaving a gap for readers who want to know immediate consequences of non-compliance with the re-made ADs. Because the Note assures substantive identity with the latest published editions, any enforcement consequences will be those attached to the ADs themselves, but the instrument does not guide the reader to those specifics.

Finally, practical users should be alert to documentation and audit trail issues. Re-making instruments can create mismatches between older records and newly issued instrument citations. For those conducting post-event audits, maintenance certifying, or preparing for an inspection, failure to cross-check that the correct version and instrument citation is being relied on is a common operational gotcha.

The instrument itself does not set out step-by-step technical compliance actions; compliance depends on the content of the re-made ADs that are attached in the "exactly the same form" as the latest published editions. Therefore the immediate compliance steps for responsible parties are administrative and documentary rather than technical, and they are as follows.

1. Obtain the re-made AD texts attached to this instrument. The Note binds the re-made instruments to the latest published edition of each AD; compliance requires consulting the attached re-made instruments to determine the exact obligations, compliance times, affected serial numbers, and any work-scope instructions.

2. Confirm status for any AD annotated "CANCELLED" or "Not Issued" in the Schedule. Do not assume such annotations mean the AD places no obligations; check the attached re-made text to determine whether the AD is a cancelled edition recorded for completeness, or whether the cancellation status is operative.

3. Update internal documentation and registers. Replace references to the revoked AD instruments with citations to the newly attached instruments as the operative ADs. For maintenance programmes, continuing airworthiness management exposition (CAME) entries, and contractual maintenance obligations that reference specific AD numbers or editions, ensure the edition cited corresponds to the attached re-made instrument.

4. Verify any ongoing compliance windows and retirement lives. Some AD entries in the Schedule indicate "Retirement Lives" or other life-limit topics (for example AD/S-76/8 "Retirement Lives" Amdt 11). Confirm whether the re-made instrument preserves the previously published retirement schedules and whether any parts previously retired are appropriately recorded in maintenance logs.

5. Ensure certifying staff reference the correct instrument when issuing certificates of release to service. Since the revocation and re-making changes the formal instrument landscape, certifying engineers and release authorities must cite the re-made AD when declaring compliance with AD-mandated work.

6. If there is uncertainty about whether compliance already carried out under the revoked instrument remains valid for the re-made instrument, seek administrative clarification from CASA or consult the re-made AD's text for any transitional provisions. The revocation/re-making instrument contains no explicit transitional rules; therefore reliance on prior compliance is safest when it can be shown to meet the substantive text of the re-made AD.

7. Keep a copy of both the revoked instrument (if previously in organisational records) and the re-made attached instrument for audit trail continuity. This will assist inspectors and auditors in reconciling historical compliance actions with the current formal instrument.

8. Monitor CASA registries for any subsequent amendments. The Note indicates these are re-made in the form of the latest published editions as at the date of re-making; subsequent amendments may follow in later separate instruments and will need to be incorporated into maintenance planning.

These steps are the practical compliance pathway implicit in the instrument's administrative action: read the attached re-made ADs (which are identical to the latest published editions), treat those attached instruments as the operative legal instruments, update records and citations accordingly, and ensure maintenance and certification actions reference the re-made texts. The instrument itself does not change substantive obligations; it changes only the formal vehicle by which those obligations are documented and must therefore be treated principally as an administrative record-keeping and citation update event.
