Airworthiness Directives 2004 - Revocation and Remaking - Boeing 737 Series Aeroplanes

This instrument, made on 20 December 2004 by David Villiers as delegate of the Civil Aviation Safety Authority (CASA) under subregulation 39.001(1) of the Civil Aviation Safety Regulations 1998 (CASR), revokes a list of existing airworthiness directives for Boeing 737 series aeroplanes and remakes each one as a separate instrument. The list comprises 235 directives spanning AD/B737/1 through AD/B737/235, including several that are marked “CANCELLED” (e.g., AD/B737/25, AD/B737/26, AD/B737/35, AD/B737/83, AD/B737/96, AD/B737/179, AD/B737/190, AD/B737/204, AD/B737/205, AD/B737/206). The note appended to the instrument states that each attached directive is being remade “in exactly the same form as appears in the latest published edition of the Directive”. This is a machinery-of-government exercise, not a substantive change to any airworthiness requirement. The mechanical effect is to replace a set of directives that were likely previously issued as consolidated or multiple instruments with a clean set of individually numbered, separate legislative instruments. This gives each directive its own legal identity, which may simplify future amendment, revocation, or judicial challenge. For operators and maintainers, the substantive compliance obligations remain identical to the latest published version of each directive. The revocation component formally removes the old legal basis for those directives, while the remaking component re‑instates them from the date of this instrument. The instrument thus ensures continuity of airworthiness requirements while tidying up the legal form of the directives. It does not impose any new inspection, modification, or record‑keeping requirement. Its primary value is administrative: it resolves any uncertainty about whether earlier directives were properly made as legislative instruments, whether they had been impliedly amended by later publications, or whether they were enforceable in the same form across the fleet. The cost to CASA in preparing 235 separate instruments (including those for cancelled directives) is not trivial, but the benefit is a cleaner regulatory architecture. For the regulated community, the main impact is a change in reference documents and possibly a need to update internal compliance libraries, though the substantive content does not change.

Airworthiness Directive (AD). An AD is a legally enforceable instruction issued by CASA (or its delegate) requiring inspection, modification, or operational limitation on an aircraft type to address an identified unsafe condition. Under CASR 39.001, CASA may issue an AD if it considers the condition is likely to exist or develop in other aircraft of the same type. Compliance with an AD is mandatory; failure to comply is an offence. Each AD typically references a specific aircraft component, system, or structural area and prescribes a compliance time (e.g., within a number of flight cycles, hours, or calendar days) and a corrective action.

Revocation and remaking. This instrument does not alter the content of any directive. It revokes the earlier legal instrument that gave force to each directive and simultaneously makes a new instrument with identical wording. This technique is common when an agency wishes to consolidate scattered directives, correct a procedural defect in the original making, or convert directives into separate legislative instruments for clarity. The remaking takes effect on the date of this instrument (20 December 2004). The old directives cease to have legal effect from that point, but because the new directives reproduce the same requirements, there is no gap in coverage. The revoked directives are those in Schedule 1; the remade directives are the attached instruments (which are not reproduced in the text provided but are referenced by name and number).

Separate instruments. Before this remaking, the directives may have been issued as amendments to a single consolidated document, as appendixes to an earlier instrument, or as individual ADs published in the Aeronautical Information Publication (AIP). By remaking each as a separate instrument, CASA ensures each directive has its own legislative identity, making it straightforward to track, amend, or challenge individually. This also aligns with the requirements of the Legislative Instruments Act 2003 (which commenced in 2005, shortly after this instrument) for registration and tabling.

Cancelled directives. Several directives in Schedule 1 are marked “CANCELLED”. The instrument nonetheless revokes and remakes them. Why? Possibly because the cancellation itself was not formally done via a legislative instrument, or because the directive remains on the list as a placeholder to prevent confusion. Remaking a cancelled directive as a separate instrument with the same content (i.e., stating that it is cancelled) gives the cancellation a clear legal status. Alternatively, the “CANCELLED” annotation may be part of the directive’s text, and the remade directive reproduces that text. Either way, the effect is that the directive remains in force but states that it imposes no requirement.

The instrument directly affects any person or organisation responsible for the maintenance, operation, or continuing airworthiness of Boeing 737 series aeroplanes on the Australian register. This includes:

• Operators. Airlines, charter companies, and private owners who hold an Air Operator’s Certificate or a registration for a Boeing 737 must ensure that each applicable directive is complied with. The remaking does not change their obligations but requires them to update their compliance databases to reference the new instrument numbers (e.g., AD/B737/1 Amdt 2 as remade). In practice, if an operator already held the latest published edition of each directive, no change in physical content is needed.

• Maintenance organisations. Approved maintenance organisations (AMOs) and licensed aircraft maintenance engineers (LAMEs) perform the inspections and modifications prescribed by each directive. They must have access to the correct version of each AD. The remaking may create a short-term administrative burden if internal manuals referred to the old consolidated instrument instead of individual directives.

• CASA itself. The instrument imposes an internal compliance cost: CASA must publish, register (if applicable), and maintain 235 separate instruments, including those for cancelled directives. This may divert resources from other regulatory functions.

• Manufacturers and design organisations. Boeing and its suppliers may need to update service bulletins or other documentation to reflect the new instrument references, though the technical requirements are unchanged.

• Legal practitioners and insurers. For any dispute about compliance or liability, the remaking provides a clear, enforceable instrument date. It may affect limitation periods for enforcement actions: a non‑compliance that occurred before 20 December 2004 would be assessed against the old directive; after that date, against the remade directive. This could be relevant if the old directive had a procedural defect that the remaking cured.

• Suppliers of parts or modifications. Suppliers who rely on ADs to determine approved parts or modifications must verify that the remade directive is identical to the latest published edition to avoid confusion.

The instrument does not affect other aircraft types or Boeing 737 series aeroplanes not on the Australian register. It also does not directly affect employees (e.g., flight crew, cabin crew) unless their duties are linked to AD compliance (e.g., flight attendant seat directives, oxygen mask directives). The compliance burden is concentrated on the technical and regulatory teams; there is no direct cost to passengers or the general public.

Duties. The instrument itself imposes no new duties. Each attached directive, however, prescribes specific actions such as inspections, tests, modifications, and operational limitations. For example, AD/B737/148 (Uncommanded Rudder) likely requires repetitive inspections of the rudder power control unit; AD/B737/158 (Fuel System Wiring Shielding and Separation) likely requires shielding modifications. The duty to comply with each directive is derived from CASR 39.003, which makes it an offence to operate an aircraft not in compliance with an applicable AD. The instrument confirms that the duties remain enforceable under the remade legal instruments.

Rights. Operators and maintainers have the right to:

• Challenge the validity of an AD through the Administrative Appeals Tribunal (AAT) or the Federal Court, on grounds such as jurisdictional error or unreasonableness. The remaking may affect such challenges: if the original directive was invalid, the remaking could be seen as a valid re‑exercise of power, curing any defect. However, the instrument says it remakes the directive “in exactly the same form”, so if the defect was in the content itself, the remaking may perpetuate it.

• Apply for an alternative means of compliance (AMOC) if they can demonstrate equivalent safety. The existence of a remade instrument does not affect AMOC applications.

• Seek an extension of time for compliance if the AD allows it.

No new rights created. The instrument does not confer new rights on CASA to inspect or seize aircraft; those powers exist under the Civil Aviation Act 1988 and CASR.

Obligation to keep records. Operators must maintain records showing compliance with each AD. The remaking means that for compliance actions performed after 20 December 2004, the record should reference the remade instrument number and date. Maintenance release documentation should reflect the correct instrument.

Interaction with the aircraft’s continued airworthiness management system. Each AD must be incorporated into the operator’s maintenance program (often via AD status sheets). The instrument does not change the content of those ADs, so no change to the program is needed unless the operator previously used a consolidated reference that is now superseded.

The instrument does not create or amend penalty provisions. Enforcement of the remade directives occurs under the existing framework of CASR and the Civil Aviation Act 1988. Regulation 39.003 provides that a person must not operate an Australian aircraft unless each applicable airworthiness directive has been complied with. The penalty for operating a non‑compliant aircraft can include fines (the specific maximum depends on whether it is a strict liability offence or an offence of fault). For corporations, penalties under the Act can be substantial; for individuals, fines may apply, and an engineer or operator could face suspension or cancellation of their certificate or licence.

Enforcement mechanisms. CASA inspectors can audit compliance during routine surveillance or in response to an incident. They can also issue a direction to ground an aircraft if they find a non‑compliance that creates a serious safety risk. Failure to comply with a direction may attract additional penalties. The instrument does not affect CASA’s powers in this regard.

Effect of remaking on prosecutions. The change in legal instrument may affect the timing of enforcement. If a non‑compliance occurred before 20 December 2004, the prosecution would rely on the old directive. If it occurred after, it relies on the remade directive. Because the content is identical, the practical difference is negligible, but the precise instrument reference will matter in court. The instrument also provides a clear date from which the remade directive is in force, which avoids disputes about whether a later publication of a directive was properly made.

Compliance time frames. Each directive in the list includes an amendment number (e.g., Amdt 2, Amdt 3) that may reflect a change in compliance time. The instrument remakes the latest amended version. If an operator was relying on an earlier amendment with a longer compliance time, the remade directive crystallises the latest requirement. Operators must verify the compliance date applicable to their aircraft.

No civil liability. The instrument does not create a private right of action for damages if an operator fails to comply. However, non‑compliance could be used as evidence of negligence in a tort claim.

Cancelled directives. For directives marked “CANCELLED”, no enforcement action can be taken for non‑compliance, because the directive by its own terms imposes no requirement. The remaking of a cancelled directive simply preserves that status.

Civil Aviation Safety Regulations 1998. The instrument is made under CASR 39.001(1). The remade directives remain part of the CASR framework. Regulation 39.003 makes compliance mandatory. The instrument does not amend any other regulation.

Civil Aviation Act 1988. The Act provides the overarching legislative scheme, including CASA’s powers and enforcement provisions. The instrument is consistent with the Act and does not create any conflict.

Legislative Instruments Act 2003. This Act, which commenced on 1 January 2005 (shortly after this instrument), requires legislative instruments to be registered, tabled, and subject to parliamentary scrutiny. The remaking as separate instruments likely facilitated compliance with that Act, as individual ADs could be registered and tabled neatly. The instrument itself was made before the LIA came into effect, but the remade directives would have been registered later.

Airworthiness standards (e.g., FARs, EASA CS‑25). Boeing 737 series aeroplanes are type‑certified under US Federal Aviation Regulations (FARs) and later under EASA standards for European operators. Australian ADs often adopt or reference FAA ADs. For example, AD/B737/148 (Uncommanded Rudder) is likely a parallel to FAA AD 2002‑11‑14. The instrument does not affect the interaction with foreign airworthiness standards; Australian operators must still comply with FAA ADs that are applicable to their aircraft under the type certificate, unless CASA has granted an exemption or alternative means. The remaking does not alter any mutual recognition agreement.

CASA’s own policy and guidance. The instrument interacts with CASA’s Advisory Circulars (ACs) on AD compliance, such as AC 39‑1. Those ACs continue to apply. No change.

Other Australian ADs for other aircraft types. The instrument is specific to Boeing 737. No cross‑interaction.

Contractual obligations. Operators may have leases or charter agreements that require compliance with all applicable ADs. The remaking does not change the substance, so those contracts remain satisfied. However, a careful lessor or insurer might require the operator to confirm that the ADs are now individually made and enforceable.

State and territory laws. No interaction. Aviation safety is a Commonwealth matter.

International conventions (e.g., Chicago Convention). Australia’s obligations under the Convention on International Civil Aviation include ensuring that aircraft on its register are airworthy. The remaking supports this by maintaining enforceable ADs.

This instrument is itself a single‑event revocation and remaking; it does not amend or consolidate previous amendments. However, the Schedule 1 list reveals a rich amendment history for many directives. Each directive has a base number and may include an amendment number: for example, AD/B737/1 Amdt 2, AD/B737/4 Amdt 1, AD/B737/15 Amdt 3, AD/B737/18 Amdt 1, AD/B737/20 Amdt 2, and many others up to AD/B737/224 Amdt 1. Several directives lack an amendment designation (e.g., AD/B737/2, AD/B737/5), suggesting they were never amended or that the base version remained current. The presence of amendment numbers indicates that CASA (or its predecessor) had previously revised these directives to extend compliance times, add new actions, or clarify text. The instrument remakes each directive at its latest amendment state, as per the “latest published edition”. This means that any earlier amendment (e.g., Amdt 1 of a directive that later had Amdt 3) is superseded by the remade directive.

The instrument also includes directives that are marked “CANCELLED” with no amendment number (e.g., AD/B737/25 Amdt 1 cancelled, AD/B737/26 cancelled, AD/B737/35 cancelled). Those likely were cancelled at some point and then later revised to reflect cancellation. The instrument does not explain the cancellation reasons.

The instrument itself has no amendment history; it is a standalone instrument made in 2004. It may have been subsequently amended by later CASA instruments, but the text provided does not indicate any amendments. The list of 235 directives suggests that CASA had been issuing ADs for the Boeing 737 since the 1960s or 1970s (AD/B737/1 likely dates from the 737’s early service). The remaking in 2004 was probably a comprehensive housekeeping exercise to bring all ADs into a consistent legal form, possibly ahead of the Legislative Instruments Act or as part of a broader re‑registration of safety instruments.

For practitioners, the amendment history of each specific directive matters more than the history of this instrument. The instrument provides a clean baseline: from 20 December 2004, the legally operative text for each directive is the one attached to this instrument. Any earlier version is revoked. This simplifies the trail of amendments but also means that if a practitioner relied on a pre‑2004 version that had not been updated to the latest amendment, they may have been out of compliance.

The source text provides no reference to any litigation concerning these directives or this instrument. However, airworthiness directives have been the subject of judicial review in Australia. The Federal Court and the Administrative Appeals Tribunal have considered challenges to ADs under the Administrative Decisions (Judicial Review) Act 1977 or the AAT Act. Grounds for challenge include that the delegate lacked jurisdiction, that the decision was unreasonable, or that there was a failure to consider relevant material. For example, the decision in Aircraft Pty Ltd and Civil Aviation Safety Authority [2003] AATA 580 considered a challenge to an AD for a different aircraft type. No such case is cited in this source, and we cannot invent one.

The remaking of the directive as a separate instrument may affect the litigation risk. If an AD was originally made with a procedural defect (e.g., not properly published, or the delegate did not genuinely apply their mind), the remaking could be seen as a fresh exercise of power, curing the defect. Conversely, if the original AD was challenged and found invalid, the remaking would not revive it unless done anew. Since this instrument remakes them “in exactly the same form”, any challenge to the content would apply equally to the remade directive.

Operators or maintainers who wish to challenge an AD must now refer to the remade instrument rather than the old one. The date of the remaking (20 December 2004) is the date for purposes of the 28‑day window for seeking AAT review of a decision to issue an AD (if the AD is itself a reviewable decision). However, CASA may argue that the decision to issue the AD was made earlier and that the remaking is merely administrative. The AAT has not ruled on this specific point. The instrument’s note that each directive is remade “in exactly the same form” suggests that CASA intended no new substantive decision; the remaking is ministerial. That may limit the ground for challenging the remade directive on the merits.

No class actions or mass tort litigation in Australia has addressed Boeing 737 ADs specifically, though US litigation has dealt with the rudder system (AD/B737/148) and other components. The instrument has no direct bearing on such litigation.

1. Cancelled directives being remade. Several directives are marked “CANCELLED” yet appear in Schedule 1 and are to be revoked and remade. Operators may assume that a cancelled directive imposes no obligation, but the remaking of a cancelled directive could create confusion: does the remade directive still say “CANCELLED”? Yes, because it is remade in exactly the same form. But the legal effect of a cancelled directive is that it imposes no requirement. However, if a practitioner downloads the remade instrument from the Federal Register of Legislation, they will find an instrument titled “AD/B737/25 Amdt 1” that still says “CANCELLED”. The operator must ensure they do not misinterpret the remade cancelled directive as imposing a requirement that is no longer applicable. Conversely, if a cancelled directive was later superseded by a new directive, the remaking of the old cancelled directive may create a misleading record.

2. Amendment numbers are part of the title. Many directives include an amendment number in their title (e.g., AD/B737/1 Amdt 2). Practitioners must ensure they are using the remade version that includes that amendment number. An unamended version (if it existed previously) is revoked. The instrument does not list the base version separately; it lists the latest amendment. So if an operator was using an earlier amendment, they are now non‑compliant.

3. The instrument does not include the text of the directives. The source provided only the Schedule and the covering instrument. The actual content of each AD is not included. This means that to comply, a practitioner must obtain each attached directive separately. The instrument states each directive is attached, but the user must have access to those attachments. Without them, the operator cannot know the specific requirements. This is a significant limitation for anyone relying solely on this instrument.

4. Potential for duplicate or conflicting ADs. The list includes multiple directives on similar topics. For example, AD/B737/38 and AD/B737/37 both relate to fuselage lap joints BS259 to BS1016. AD/B737/87 also addresses fuselage lap joints lower skins. Operators must apply both directives if both are applicable. The instrument does not consolidate or cross‑reference them; the operator must maintain a master AD status list.

5. Compliance date not stated. The instrument does not specify compliance dates for each directive; they are contained in the attached instruments. An operator cannot rely on the instrument alone to determine when an action is due.

Compliance with the instrument itself is straightforward: no action is required because it does not impose new duties. However, compliance with the remade directives is mandatory. The following steps are advisable for operators and maintenance organisations responsible for Boeing 737 series aeroplanes:

1. Confirm the status of each directive. Obtain a list of all directives in Schedule 1 (AD/B737/1 through AD/B737/235, including cancelled ones). Identify which directives apply to the specific aircraft model and variant (e.g., 737‑200, 737‑300, etc.). Not all directives may apply to all variants; the aircraft’s type certificate data sheet should cross‑reference AD compliance.

2. Retrieve the attached instruments. If the operator does not already hold the latest published edition of each directive as at 20 December 2004, they should obtain the remade instruments from the Federal Register of Legislation (or from CASA’s AD database). The instrument’s note states the directives are attached, but the online version may have the attachments. Confirm that the retrieved directive matches the amendment number in Schedule 1.

3. Update the AD status sheet. Replace any references to the old consolidated instrument or earlier editions with the new instrument number and date (20 December 2004). For example, if the operator’s maintenance program lists “AD/B737/1” without an instrument date, update it to reflect the remade instrument. Ensure that the compliance action (e.g., inspection) is still within the required compliance time.

4. Check for cancelled directives. For any directive marked “CANCELLED”, ensure the operator’s records do not incorrectly list it as an open requirement. The remade cancelled directive should be retained as a record but marked “not applicable”.

5. Verify no duplicate or conflicting requirements. Cross‑reference ADs covering similar areas (e.g., fuselage lap joint ADs) to ensure all are addressed. The instrument does not consolidate, so the operator must manage multiple directives independently.

6. Update maintenance release documents. After performing a compliance action post‑20 December 2004, the maintenance release should note the AD reference with the remade instrument details (e.g., “AD/B737/148 Amdt 1, remade 20 Dec 2004”).
