Airworthiness Directives 2004 - Revocation and Remaking - Allison Turbine Engines - 250 Series

The instrument is built around a few tight administrative concepts, expressly stated in the text provided.

Legal authorisation and delegation: The instrument is made by a CASA delegate, David Alan Villiers, under subregulation 39.001(1) of the Civil Aviation Safety Regulations 1998. That citation is the only provision in the text that shows the statutory power claimed for the act. The presence of a named delegate and an enabling subregulation identifies the instrument as an exercise of a delegated statutory power rather than primary legislation.

Revocation and remaking: The two core legal operations are revocation and remaking. Paragraph (a) expressly revokes the Airworthiness Directives specified in Schedule 1. Paragraph (b) then makes, as separate instruments, each Airworthiness Directive mentioned in Schedule 1 and attached. The dual mechanics mean the previous instrument form of the ADs is being withdrawn and new, separately identified instruments will take their place.

Attachment and fidelity: The instrument relies on attachments. The note states that each attached AD is "being re-made in exactly the same form as appears in the latest published edition of the Directive." That is an express commitment that the content of the re-made instruments will match the most recent published text of each Directive. The replication is thus presented as administratively faithful rather than substantive revision.

Inventorying by Schedule: Schedule 1 performs the role of a manifest. It lists AD names (for example "Life Limited Components", "Compressor Front Bearing Thrust Washer and Spring", "Sixth Stage Compressor Blades") together with AD numbers (for example AD/AL 250/1, AD/AL 250/2). Some entries bear amendment annotations ("Amdt 12", "Amdt 1", "Amdt 3", etc.) and many entries are annotated "CANCELLED." The combined listing signals which directives are to be revoked and correspondingly remade or otherwise reflected in the attached instruments.

Document status and continuity: The instrument is dated 20 December 2004 and signed by the delegate. The stated intent to re-make the ADs in exactly the same form as the latest published edition implies continuity of substantive obligations where the ADs remain active, and administrative continuity of text where the instrument re-creates the AD as a separate instrument. The Schedule’s mix of active, amended and cancelled entries suggests differential status outcomes across the set , some ADs are re-made with amendments noted; others are recorded as cancelled.

Limits of the text: The instrument does not set out the full content of the attached ADs in the body text, nor does it include explanatory material about reasons, costs, compliance steps, or enforcement. It contains no penalties or sanctions language and no timetable for transition other than the date of signing. The enabling regulation is named but not reproduced; thus any procedural or substantive requirements in subregulation 39.001(1) are not visible in the six lines of text beyond citation.

The instrument targets the universe of persons and entities subject to Airworthiness Directives for Allison Turbine Engines, 250 Series. While the text does not list affected individuals by name, the Schedule identifies the technical subjects of the ADs, which allows a grounded mapping to categories of stakeholders.

Aircraft operators and owners who have aircraft powered by Allison 250 Series turbine engines are the primary practical audience for the ADs listed. The AD names in Schedule 1 include component-specific directives such as "Compressor Front Bearing Thrust Washer and Spring - Replacement" (AD/AL 250/2), "Fuel Pump Drive Shaft - Inspection" (AD/AL 250/20 Amdt 1), "Third Stage Turbine Wheel - Inspection and RPM Operational Restrictions" (AD/AL 250/41 Amdt 5), and "Engine Fuel and Control - Bendix Fuel Control Assemblies and Power Turbine" (AD/AL 250/52 Amdt 1). Each of these ADs, by subject matter, attaches to a subset of operators who use or maintain the particular components or systems identified.

Maintenance organisations, approved maintenance engineers and overhaul facilities that inspect, repair, modify or replace Allison 250 engine components are materially affected. The ADs listed cover inspections, replacements, modifications, installations, part retirement and operational restrictions; those are actions typically carried out by certificated maintenance organisations, so those organisations will need to incorporate the re-made instruments into their maintenance planning and compliance records.

Parts suppliers, component manufacturers and overhaul vendors engaged in supplying or certifying replacement parts for the Allison 250 series are affected to the extent that ADs in the Schedule require parts replacement, specific part numbers, or installation of modifications (for example ADs concerning "Fourth Stage Compressor Wheel - Retirement" AD/AL 250/33 or "Internal Energy Absorbing Ring" AD/AL 250/64 Amdt 3). If an AD imposes retirement limits or mandates specific part P/Ns, suppliers must ensure availability and traceability consistent with the re-made ADs.

Regulators and compliance officers within operators must track the administrative change: the instrument revokes listed ADs and re-issues them as separate attached instruments. That administrative act affects how compliance is documented, how ADs are cited in manuals, and which instrument identifiers are current. The Schedule includes entries marked "CANCELLED"; that will affect those stakeholders by removing an AD from force (as listed) or by reflecting that earlier ADs have been cancelled , the instrument itself implements the revocation noted in Schedule 1.

Finally, the instrument affects legal counsel, auditors, and accident investigators who rely on the status of ADs for determining regulatory compliance and maintenance histories. Because the instrument re-makes ADs "in exactly the same form as appears in the latest published edition", the substantive obligations for those ADs that remain active should be unchanged in wording; however, the administrative re-issue may require reviewers to check the attached instruments to confirm citation and version control.

The instrument does not create new categories of affected persons beyond those identifiable from the AD topics; it does not name operators, does not list registrants, and does not specify territorial reach beyond the legal authority of CASA exercised under subregulation 39.001(1).

The text of this instrument itself sets out no new technical duties, performance standards, or rights; rather, it effects an administrative change in the identity and form of a series of Airworthiness Directives. The key operational duty created by the instrument is procedural: those who were subject to the ADs listed in Schedule 1 must now look to the re-made, separate instruments attached to this revocation/remaking instrument for the operative text and for continuing compliance obligations.

Duties preserved by remaking: The note states each attached AD is being re-made "in exactly the same form as appears in the latest published edition of the Directive." That indicates the substantive content of the ADs remains as in the latest published edition. Therefore, any compliance duties that were imposed by the latest published versions of those ADs continue to apply, but under newly re-made instruments. The legal obligation to comply with an AD derives from the AD itself; this instrument simply changes the instrument identity and formal publication status while leaving the AD text unchanged.

Administrative duties for record-keeping and citation: Because the instrument revokes the ADs previously in force and creates new separate instruments for each AD in Schedule 1, affected parties have a duty to update their compliance records, aircraft maintenance records, maintenance control manuals and operations manuals to reference the new instrument identifiers and the attached ADs. The Schedule includes AD numbers and amendment notations (for example Amdt 1, Amdt 3, Amdt 12); matching these to the attached instruments is necessary for accurate compliance citation.

Right to rely on the re-made text: The instrument’s note makes an express promise about fidelity of the re-made instruments to the latest published edition. A person may therefore reasonably expect that the text of the attached ADs corresponds to the last published versions. If a party needs to establish what an AD required at the date of this instrument, the attached re-made ADs are the relevant texts according to the instrument’s own statement.

No express appeals or review rights in this instrument: The document does not include any procedural text about rights of review, objections, or appeals to the revocation or remaking. It does not specify a transitional timetable nor does it provide exemptions, variations, or alternative means of compliance. Any rights to seek review or to challenge the instrument would need to be found in the enabling legislation (subregulation 39.001(1) of the Civil Aviation Safety Regulations 1998) or in other general administrative law processes; those are not set out in the instrument.

Ambiguities for cancelled entries: Several entries in Schedule 1 are marked "CANCELLED". The instrument’s text revokes the ADs in Schedule 1 and remakes each AD "mentioned in Schedule 1 and attached." For entries listed as "CANCELLED", operators will need to verify whether the attached instrument is a cancellation record or a re-made AD that itself records cancellation. The instrument does not clarify this distinction in the body text; therefore a duty to confirm the status of any "CANCELLED" entry arises from the need to determine whether a continuing compliance obligation exists.

The instrument itself does not set out penalties, monetary sanctions or enforcement procedures. Its operative content is limited to revocation of specified Airworthiness Directives and the re-creation of those directives as separate instruments attached to the decision. The only statutory provision cited in the instrument is subregulation 39.001(1) of the Civil Aviation Safety Regulations 1998, which the delegate identifies as the source of authority for the action taken. The instrument does not reproduce or summarise any enforcement powers, nor does it state what penalties, if any, attach to non-compliance with the re-made ADs.

Consequently, there are two discrete observations grounded in the text:

• This instrument is administrative, not punitive in form. It reorganises how the ADs are issued (revoking and remaking them as separate instruments). The substantive mandatory content of each AD, insofar as it is in the latest published edition and re-made unchanged, will carry whatever enforcement consequences that AD text (and the enabling regulations) already provide. Those consequences are not recorded in this instrument.

• Responsibility for enforcement likely remains with CASA under its statutory framework, but the instrument does not state enforcement processes, compliance monitoring, or penalty scales. The instrument’s silence on enforcement means that anyone seeking to identify specific sanctions for contravening the requirements of the re-made ADs will need to consult the enabling regulatory framework (subregulation 39.001(1) and related provisions) and the text of the re-made ADs themselves. Those sources are not reproduced in the instrument.

Practical compliance inference: Because the note promises exact re-creation of the latest published AD texts, the substantive obligations, time limits, inspection intervals, part retirement policies, operational restrictions and other prescriptive elements that commonly appear in ADs are expected to be present in the attached instruments where they applied in the latest published editions. Any breach of those substantive AD requirements would therefore be enforceable under the regulatory scheme that gives effect to ADs, but the instrument does not recast or restate those enforcement provisions.

Transparency and evidentiary implications: The act of revoking and re-making ADs can affect evidentiary records of compliance and enforcement. Where an entity needs to show historical compliance with a particular AD, it should ensure that records cite the specific re-made instrument attached to this instrument (and the relevant amendment number in Schedule 1, if applicable), since the original instrument identifiers have been revoked by this instrument. The instrument does not itself explain transitional evidentiary arrangements; that is left implicit.

The instrument explicitly states its interaction with the Civil Aviation Safety Regulations 1998 by identifying subregulation 39.001(1) as its enabling authority. This is the only statutory cross-reference contained in the text. The instrument therefore sits within the regulatory architecture created by the Civil Aviation Safety Regulations 1998, but no other statutes, regulations or legal instruments are cited or reproduced in the text provided.

Delegation and regulatory hierarchy: The instrument’s signature line shows the action is taken by a delegated official ("Delegate of the Civil Aviation Safety Authority"). That both places the instrument within the administrative hierarchy of CASA and signals that the power exercised is one capable of being delegated under the Civil Aviation Safety Regulations. The instrument does not reproduce the content of subregulation 39.001(1), so any procedural or substantive limits in that subregulation that affect revocation or remaking of ADs are not visible in this text.

Relationship with previously published ADs: The instrument purports to re-make each AD "in exactly the same form as appears in the latest published edition of the Directive." That signals an intended continuity between the latest published ADs and the new separate instruments attached. Practically, this means that the re-made AD instruments should be read and applied in the same way as the previously published ADs; their content is not being altered by this instrument, at least according to the instrument’s own statement.

Effect on prior instruments: Because the instrument revokes the Airworthiness Directives mentioned in Schedule 1, it changes the legal identity of those instruments. Prior references to the old AD instruments (for example in manuals, compliance certificates, maintenance logs, or other statutory instruments) may need updating to reflect the new instrument identifiers and the attached AD texts. The interaction here is administrative: the instrument replaces older instrument citations with newly issued separate instruments.

No express interaction with civil law, contract law, or administrative appeal processes: The instrument does not mention how the revocation and remaking interact with contractual obligations between operators and maintenance providers, nor does it state whether the revocation/remaking affects rights or remedies under contract or tort. Similarly, it does not state how the action interacts with administrative appeal or judicial review rights under general administrative law. Those interactions therefore must be located in the broader statutory and common law framework, which the instrument does not reproduce.

Attachment reliance: Since the ADs are to be attached as separate instruments, the practical interaction with other laws will depend on the content of those attachments and any cross-references they contain to other regulations, standards, or material incorporated by reference. The instrument does not reproduce those attachments in the body text provided, so readers must consult the attached re-made ADs to map further legal cross-links.

The instrument itself is dated 20 December 2004 and signed by the CASA delegate. It does not contain an internal amendment history of its own beyond the date and the Schedule listing. However, Schedule 1 furnishes traces of prior amendment activity through annotation of individual AD entries with amendment numbers and cancellation markers.

Amendment annotations in Schedule 1: Numerous AD entries in the Schedule include amendment notations such as "Amdt 12", "Amdt 1", "Amdt 3", "Amdt 5", "Amdt 7", "Amdt 2", "Amdt 9", etc. These annotations indicate that those ADs have been previously amended, and the annotation records the current amendment iteration that is being reflected at the point of revocation and remaking. For example, "Life Limited Components - CANCELLED AD/AL 250/1 Amdt 12" shows an amendment number 12 recorded for AD/AL 250/1 prior to cancellation in this Schedule, indicating a history of amendments before this instrument’s action.

Cancelled entries: Several entries in the Schedule are expressly labelled "CANCELLED" (for example AD/AL 250/1, AD/AL 250/7, AD/AL 250/10, AD/AL 250/15, and others). The presence of these cancellation notes in the Schedule suggests earlier instruments were already marked as cancelled in prior publication cycles and are included here within the revocation and remaking administrative action. The instrument does not explain whether those cancellations occurred before this instrument or are being implemented by this instrument; it simply includes them in the Schedule that is subject to revocation and remaking.

Remaking in same form as latest published edition: The note attached to the instrument declares that each attached AD is being re-made "in exactly the same form as appears in the latest published edition of the Directive." That language indicates the remaking exercise does not amend substantive content compared with whatever the most recently published form of each AD was. From an amendment-history perspective, this instrument functions as a reissuance that preserves the latest textual amendments rather than introducing a new amendment cycle.

No internal chronology or explanation: The instrument does not supply an internal record of when each AD was first issued or when each amendment took place. The only historical trace within the instrument is the amendment numbers attached to certain AD entries and the use of the word "CANCELLED" on others. Anything more granular about the amendment history must be read off those annotations or must be sought in the prior published editions to which this instrument refers, which are not reproduced here.

Administrative housekeeping function: In effect, the instrument appears to be consolidating, revoking and re-issuing a body of ADs for the Allison 250 series in separate instrument form, preserving the latest amendment content. It therefore functions as an administrative milestone in the lifecycle of these ADs rather than as a substantive amending instrument.

The instrument contains no references to litigation, legal challenges, court orders, or decisions. It does not record any judicial or quasi-judicial history relating to the ADs in Schedule 1 or to the revocation and remaking process. There are no case names, citations, or summaries provided within the text.

Implication of silence: Because this instrument is an administrative revocation/remaking instrument and because it contains no litigation references, there is no recorded litigation history in the document itself. Any litigation that may have concerned these ADs, their content, enforcement or legal effects is not reflected in this text. Researchers seeking litigation history therefore must look beyond this instrument to court records, tribunal records, or other government publications; that material is not reproduced or summarised here.

Evidentiary or procedural challenge avenues not stated: The instrument does not set out avenues for appeal, judicial review, or internal administrative reconsideration in relation to the revocation or remaking. If affected parties have sought or sought to seek judicial review of decisions about AD content or administrative form, such matters would not be recorded in the instrument text and must be located elsewhere.

Attachable ADs may contain references: Any contentious factual, technical or legal material that has been or could be litigated may be found in the attached re-made ADs or in the "latest published edition" to which the note refers. Those attachments might include narrative material, technical findings, or references to incidents that gave rise to ADs. However, no such attachments or litigation records appear in the body of this instrument as provided.

The instrument presents a number of practical pitfalls and interpretive wrinkles for operators, maintenance organisations, legal advisers and record-keepers. The following issues are grounded in the text as presented.

1. Administrative identity versus substantive content: The instrument revokes listed ADs and remakes them as separate instruments attached. The note says the re-made ADs are "in exactly the same form as appears in the latest published edition of the Directive." Users must not conflate revocation of an instrument identifier with elimination of substantive obligations. If an AD remains substantively active in the attached re-made instrument, compliance obligations continue even though the prior instrument identifier has been revoked. Failure to update documentation to cite the new instrument may create evidential gaps.

2. Ambiguity around entries marked "CANCELLED": The Schedule contains many entries annotated "CANCELLED" (for example AD/AL 250/1, 250/7, 250/10, 250/15, and others). The instrument both revokes and remakes "each Airworthiness Directive mentioned in Schedule 1 and attached." It is not explicit whether a "CANCELLED" entry will have a corresponding attached instrument (for example, an attachment that itself records cancellation), or whether the cancelled entries are only being revoked. Operators must check the actual attachments to determine whether a particular AD is in force or has been cancelled, and whether any successor obligations exist.

3. Amendment number tracking: Schedule 1 lists many ADs with amendment numbers (Amdt 1, Amdt 3, Amdt 5, Amdt 12, etc.). These amendment numbers will matter for cross-references in maintenance manuals, supplier part numbering and in compliance records. If organisations rely on amendment numbers to track obligations, they must ensure the attached re-made ADs reproduce the same amendment iteration as referenced in the Schedule. Failure to match amendment iterations could lead to mismatched obligations.

4. No enforcement or transition text in the instrument: The instrument contains no timing provisions, transitional arrangements, or explicit direction about how to treat works in progress conducted under the former instrument citations. This omission requires operators and maintainers to seek clarification where ongoing maintenance programmes straddle the revocation date, or to conservatively treat the re-made ADs as the operative texts from the signature date forward.

5. Reliance on attachments: The instrument’s effectiveness for compliance depends on the attached re-made ADs. The body text does not contain the AD content; therefore, relying on this instrument alone without the attachments is insufficient. Organisations that store local copies of ADs must ensure they update their internal repositories with the attached instruments.

6. Potential inconsistency between "latest published edition" and local copies: The note promises fidelity to the "latest published edition of the Directive," but local in-house copies may be older. Users must verify that their local copies correspond to the “latest published edition” that this instrument purports to re-make. Otherwise, there is a risk of following an outdated inspection interval, part number, or operational restriction.

7. Paper-trail and audit risk: Because the instrument revokes and re-issues ADs, historical records that cite the old AD identifiers may require cross-walking to the new instrument identifiers during audits, accident investigations or sale of aircraft. The absence of a mapping table in the instrument text increases administrative work and the risk of mis-citation.

8. Granularity of affected components: The Schedule lists many component-specific ADs (throttle shafts, compressor blades, bleed valves, magnetic drain plugs, etc.). Those with narrow technical readerships (specialist maintainers versus general operators) must ensure the correct technical staff are notified. Failure to target the correct technical maintainers may lead to overlooked inspections or mandatory part retirements.

The instrument’s own text prescribes no new technical compliance steps beyond its administrative action, but it creates an unequivocal administrative obligation for affected parties to consult and adopt the re-made ADs attached and to bring their records and procedures into alignment. The following steps are grounded in the instrument text and in the practical implications that flow from revocation and remaking.

1. Obtain the attached re-made ADs immediately: The instrument relies on attachments for the operative text. The note confirms each attached AD is "in exactly the same form as appears in the latest published edition of the Directive." Compliance begins by acquiring the attached instruments and verifying their content against local copies or the latest published editions previously relied upon.

2. Confirm status of entries marked "CANCELLED": For any AD in Schedule 1 annotated "CANCELLED", confirm whether the attached instrument reflects continuation as a cancellation notice or whether the cancellation pre-dates this instrument. Establish whether there are any residual obligations or whether the AD is no longer in force.

3. Update maintenance control documentation and manuals: Replace references to the revoked instrument identifiers with the new separate instrument references as reflected in the attachments. This includes maintenance control manuals, continuing airworthiness records, maintenance release forms and operator maintenance schedules. Matching amendment numbers from Schedule 1 to the attached ADs will help ensure correct version control.

4. Reconcile amendment iterations against in-house records: Where Schedule 1 lists amendments (Amdt 1, Amdt 3, Amdt 12, etc.), ensure the attached re-made AD matches the amendment iteration relied upon in your maintenance planning. If there is any discrepancy, seek clarification from CASA or the issuing authority.

5. Audit in-progress maintenance tasks: If inspections, replacements or modifications were underway under the prior AD identifiers at or near the signature date (20 December 2004), document whether those actions were completed under the old instrument citation and, if necessary, re-certify or re-reference the work against the re-made attached AD to avoid evidentiary gaps.

6. Notify relevant maintenance staff and suppliers: Distribute copies of the attached ADs to the specific technicians, maintenance organisations and parts suppliers affected by component-specific directives listed in Schedule 1 (for example directives concerning third-stage turbine wheels, fuel systems, bleed valves, governors and gearbox components). Ensure suppliers understand any part-number or retirement mandates in the attachments.

7. Preserve audit trail of the transition: Keep a clear log showing when the revoked instruments were superseded by the re-made attached ADs, including certificate logs, amendment numbers and a cross-reference table. This will assist during audits, resale due diligence, or investigations.

8. Seek legal or regulatory clarification where necessary: Because the instrument does not set out enforcement, transitional procedures or appeals, where an operator’s obligations or exposure are unclear (for example regarding cancelled ADs or records spanning the revocation date), consider seeking clarification from CASA or legal advice based on the attachments and the enabling regulation cited (subregulation 39.001(1) of the Civil Aviation Safety Regulations 1998).

9. Maintain a copy of the instrument itself: Retain the revocation/remaking instrument (signed and dated 20 December 2004 by the CASA delegate) with the attached re-made ADs in the operator’s regulatory compliance file. That record will be necessary to demonstrate an understanding of the administrative change and to show reliance on the re-made ADs.

10. Monitor for subsequent amendments or cancellations: Although this instrument re-makes the ADs "in exactly the same form as" the latest published editions, future amendment rounds or cancellation notices may follow. Set up an ongoing monitoring process for CASA AD publications to capture later changes, amendments, or cancellations.
